Wray, Deputy Director of Development Services By: Coleman Olinger, Assistant Engineer SUBJECT: RESOLUTION NO. 7060 ACCEPTING A DEDICATION OF CERTAIN PROPERTY AT 316 -324 SOUTH THIRD AVENUE (CORNER CUTBACK AT THE INTERSECTION OF THIRD AVENUE AND DIAMOND STREET AS PART OF PARCEL MAP 72502) FOR PUBLIC USE Recommendation: Adopt SUMMARY On October 22, 2014, the Arcadia Planning Commission tentatively approved Parcel Map 72502, subject to conditions of approval. The parcel map is for a proposed four - unit residential condominium development at 316 -324 South Third Avenue. In order to construct a new accessible ramp and sidewalk at the northeast corner of Third Avenue and Diamond Street, the developer was required to dedicate additional right -of -way, sufficient to construct the new accessible ramp. The Parcel Map is now ready for approval and the dedication is offered on the Map. In consideration of the developer's offer of dedication, it is recommended that the City Council adopt Resolution No. 7060 accepting this dedication as set forth in Parcel Map 72502. DISCUSSION The Arcadia Planning Commission tentatively approved Parcel Map No. 72502 with a condition for the developer to replace the existing sidewalk and construct new sidewalk along the property frontage on Third Avenue and Diamond Street. This sidewalk replacement includes the construction of a new accessible curb ramp at the northeast corner of the intersection of Third Avenue and Diamond Street. In order for the developer to construct the new accessible curb ramp, a dedication is required to provide sufficient right -of -way at the northeast corner of Third Avenue and Diamond Street. Resolution No. 7060 (Third Avenue and Diamond Street) April 7, 2015 Page 2 of 2 The developer has submitted the final parcel map to the City for approval, including the offering of dedication; and has entered into an agreement with the City to construct the public improvements which were conditions of approval for the tentative map. The extent of the dedication is more accurately shown on Exhibit "A" of Resolution No. 7060. Parcel Maps do not require City Council approval; however, since this Parcel Map includes an offer of dedication, the City Council must either accept or reject the offer before the map can be approved. FISCAL IMPACT There will be no fiscal impact incurred by the City. RECOMMENDATION It is recommended that the City Council adopt Resolution No. 7060 accepting a dedication of certain property at 316 -324 South Third Avenue (corner cutback at the intersection of Third Avenue and Diamond Street as part of Parcel Map 72502) for public use. Approved Dominic Lazzar d City Manager Attachment: Resolution No. 7060 RESOLUTION NO. 7060 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ACCEPTING A DEDICATION OF CERTAIN PROPERTY AT 316 -324 SOUTH THIRD AVENUE (CORNER CUTBACK AT THE INTERSECTION OF THIRD AVENUE AND DIAMOND STREET AS PART OF PARCEL MAP 72502) FOR PUBLIC USE WHEREAS, Tentative Parcel Map No. 72502 was approved by the Planning Commission of the City of Arcadia on October 22, 2014, with a condition to dedicate a portion of land at the northeast corner of Third Avenue and Diamond Street intersection for the construction of an accessible ramp; and WHEREAS, Parcel Map No. 72502 is now ready for approval and the property owner has offered to dedicate a corner cutback dedication at the northeast corner of Third Avenue and Diamond Street as shown on attached Exhibit "A" (Parcel Map 72502). NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION I. That certain property located in the City of Arcadia, County of Los Angeles, State of California, which constitutes a corner cutback dedication offered for public use as shown on attached Exhibit A (Parcel Map 72502), is hereby accepted by the City of Arcadia.
