HomeMy WebLinkAboutItem 3 - 3-10-15 Planning Commission Minutes 3-10-15 ARCADIA PLANNING COMMISSION REGULAR MEETING MINUTES Tuesday, March 10, 2015 CALL TO ORDER – Chairman Falzone called the meeting to order at 7:00 p.m. in the Arcadia City Council Chambers. PLEDGE OF ALLEGIANCE ROLL CALL PRESENT: Commissioners Baerg, Chan, Chiao, Lin and Falzone ABSENT: None SUPPLEMENTAL INFORMATION FROM STAFF REGARDING AGENDA ITEMS Mr. Kasama introduced Attorney Jim Priest from Best Best & Krieger who was at the meeting to provide legal advice regarding Item 2, Text Amendment No. TA 15-01, to amend the City’s massage and personal service business regulations. PUBLIC COMMENTS None PUBLIC HEARINGS 1. Resolution No. 1935 - Approving Tentative Tract Map No. TTM 73324, Modification No. MP 14-22, and Multiple-Family Architectural Design Review No. MFADR 14-21 with a Categorical Exemption under the California Environmental Quality Act (CEQA) for a 13-unit residential condominium development at 907-915 Arcadia Avenue Applicant: Meilinium Investments, LLC Recommendation: Adopt Resolution No. 1935 Mr. Kasama introduced the item. Associate Planner, Tim Schwehr, presented the staff report. Chairman Falzone opened the public hearing and asked if the applicant would like to speak. Mr. Javier Gonzalez, the project architect, responded. Chairman Falzone asked if anyone would like to speak in favor of this item. There were none. Chairman Falzone asked if anyone would like to speak in opposition to this item. The following responded: Mr. Fabio Bachman, a resident of the existing building Mr. Alex Flores, a resident of the existing building 3-10-15 Chairman Falzone asked if the applicant would like to speak in rebuttal. Mr. Gonzalez responded. MOTION It was moved by Commissioner Chan, seconded by Commissioner Lin, to close the public hearing. Without objection, the motion was approved. MOTION It was moved by Commissioner Baerg, seconded by Commissioner Lin, to adopt Resolution No. 1935 and approve Tentative Tract Map No. TTM 73324, Modification No. MP 14-22, and Multiple-Family Architectural Design Review No. MFADR 14-21 and the Categorical Exemption, subject to the findings and conditions in the staff report. Approval of Text Amendment No. TA 15-01 with an Exemption under the California Environmental Quality Act (CEQA) to amend Chapters 2 and 4 of Article VI, and Chapter 2 of Article IX of the Arcadia Municipal Code to amend the City’s massage and personal service business regulations. Recommendation: Recommend approval to the City Council Mr. Kasama introduced the item. Associate Planner, Tom Li, presented the staff report. Chairman Falzone asked if anyone would like to speak in favor of this item. There were none. Chairman Falzone asked if anyone would like to speak in opposition to this item. A representative of Orient Retreat Spa and Mr. John Zhao responded. MOTION It was moved by Commissioner Baerg, seconded by Commissioner Chiao, to close the public hearing. Without objection, the motion was approved. MOTION It was moved by Commissioner Lin, seconded by Commissioner Chiao, to recommend approval of Text Amendment No. TA 15-01 to the City Council with clarification on Section 6418.20, subsection P, regarding full height doors and windows for treatment rooms and with a suggestion to Council to consider retaining City certification as well as State certification of massage therapists. 3-10-15 ROLL CALL AYES: Commissioners Baerg, Chan, Chiao, Lin and Falzone NOES: None 3. Approval of Text Amendment No. TA 15-02 with an Exemption under the California Environmental Quality Act (CEQA) to amend Chapter 2, Part 5 of Article IX of the Arcadia Municipal Code to amend the City’s real estate and developer-contractor sign regulations. Recommendation: Recommend approval to the City Council Mr. Kasama introduced the item. Associate Planner, Tim Schwehr, presented the staff report. Chairman Falzone asked if anyone would like to speak in favor of this item. There were none. Chairman Falzone asked if anyone would like to speak in opposition to this item. There were none. MOTION It was moved by Commissioner Chan, seconded by Commissioner Chiao, to close the public hearing. Without objection, the motion was approved. MOTION It was moved by Commissioner Lin, seconded by Commissioner Chiao, to recommend approval of Text Amendment No. TA 15-02 to the City Council with comments from the Planning Commission to be included in the Staff Report. ROLL CALL AYES: Commissioners Chan, Chiao, Lin and Falzone NOES: Commissioner Baerg CONSENT CALENDAR 4. Minutes of the February 24, 2015, Regular Meeting of the Planning Commission. MOTION It was moved by Commissioner Baerg, seconded by Commissioner Lin, to approve the minutes as presented. ROLL CALL AYES: Commissioners Baerg, Chan, Chiao, Lin and Falzone NOES: None 3-10-15 MATTERS FROM COUNCIL LIAISON Councilman Tay reported on the Residential Zoning Code Update Community Meeting on February 26. He said the meeting was well attended and the residents had many comments and concerns. In response to their concerns a Neighborhood Impacts Committee consisting of local residents, Homeowners Association representatives, and developers, will be formed to address these issues. FROM PLANNING COMMISSIONERS Commissioners Chan and Lin reported on the League of California Cities Planning Commissioners Academy which they attended last week. Commissioner Lin provided a copy of one of the Power Point Presentation on electronic communication. Commissioner Chan noted that AB 1147 regarding massage regulations was another issue they covered. Commissioner Baerg asked if affordable housing requirements were still in force. Mr. Kasama replied that density bonuses are in place and requirements are in force. Commissioner Baerg mentioned that when he first joined the Commission, staff arranged a city tour citing examples of different types of architecture; i.e., desirable versus undesirable features, and that in light of the recent controversy perhaps an updated tour would be in order. Mr. Kruckeberg agreed that a tour would be beneficial and said that he would set it up. Commissioner Chan asked if the City has considered having a Design Review Board. Mr. Kruckeberg replied that the City Council has considered establishing a Design Review Board but, to date, has decided against it. Commissioner Chan asked if the City has any funds set aside for housing. Mr. Kruckeberg said that no funding source has replaced redevelopment. MATTERS FROM MODIFICATION COMMITTEE Commissioner Lin reported that two applications were approved for modifications to setbacks. MATTERS FROM STAFF INCLUDING UPCOMING AGENDA ITEMS Mr. Kasama said that the Text Amendments reviewed tonight will be presented to the City Council at their April 7 meeting. He also said that so far, there are no items scheduled for the March 24 meeting so the meeting will probably be canceled. However, there are a few items scheduled for the Modification Committee meeting. 3-10-15 ADJOURNMENT Chairman Falzone adjourned this meeting at 8:41 p.m. to Tuesday, March 24, 2015, at 7:00 p.m. in the City Council Chambers located at 240 W.
