HomeMy WebLinkAboutItem 1a - Regular Meeting and Special Meeting Minutes of April 7, 2015ARCADIA CITY COUNCIL REGULAR MEETING MINUTES TUESDAY, APRIL 7, 2015 Pursuant to the adjournment of the March 17, 2015, Regular Meeting of the City Council, the Chief Deputy City Clerk appeared at the time and place of adjournment at 6:00 p.m. and announced that no quorum was present until 7:00 p.m. CALL TO ORDER — Mayor Wuo called the meeting to order at 7:10 p.m. INVOCATION — Reverend Thomas Shriver of Church of Emmanuel Assembly of God PLEDGE OF ALLEGIANCE — Kurt Norwood, Fire Chief ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Council Members Beck, Chandler, Kovacic, Tay, and Wuo ABSENT: None REPORT FROM CITY ATTORNEY ON CLOSED SESSION ITEM City Attorney Deitsch reported that prior to the regular meeting, the City Council met in a Closed Session to consider the one item listed on the posted agenda regarding existing litigation, no reportable action was taken; he further reported that the Special Closed Session Meeting was continued to Tuesday, May 5, 2016, at 5:30 p.m. in the Council Chamber Conference Room. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto announced that Ordinance No. 2327 was revised as a result of public concern and will be discussed further during the public hearing on that item; and that a copy has been provided to the City Council. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Tay, seconded by Council Member Chandler, to read all ordinances and resolutions by title only and waive the reading in full. PRESENTATIONS a. Proclamation designating April 12 -18, 2015, as "National Library Week" and encouraging the community to take advantage of the resources available to them at the Arcadia Public Librarv. PUBLIC HEARING a. Ordinance No. 2324 amending portions of Article IX, Chapter 2, Part 5 of the Arcadia Municipal Code in order to update the City's Single - Family Residential Real Estate Sign and Developer- Contractor Sign Regulations. Recommended Action: Introduce 04 -07 -15 Assistant City Manager /Development Services Director Kruckeberg and Associate Planner Schwehr presented the staff report. Mayor Wuo opened the public hearing. Andrew Cooper, CEO of the Arcadia Board of Realtors, appeared on behalf of the Board of Realtors in support of the proposed sign ordinance; he indicated that they agree with the height of signs, confiscation of the signs, and penalizing realtors who do not comply with the sign regulations as proposed in the ordinance. A motion to close the public hearing was made by Mayor Pro Tern Kovacic, seconded by Council Member Tay, and seeing no further objection, Mayor Wuo declared the public hearing closed. After discussion by the City Council, it was the consensus that the following be added to the Ordinance: (1) the sixteen square foot sign needs approval stamp from Planning Services; (2) rendering required on the sign for all new development; (3) signs should be no more than three feet in height with a six month grace period for transitioning to such signs; (4) only one "for sale" sign will be allowed on a site even on a corner lot; (5) keep confiscated signs for 30 days before destroying; (5) four open house signs allowed and hours should be from 1 p.m. to 6 p.m. on weekends except caravan days, where they will be allowed from 10 a.m. to 1 p.m. Council Member Chandler made a motion to reopen public hearing in order to allow Mr. Cooper to speak. The City Council concurred. Mr. Cooper commented on the 3 foot height restriction, stating that it would be a concern to his membership, indicating that there was not a problem with the current signs. It was moved by Mayor Pro Tern Kovacic, seconded by Council Member Tay, and carried on roll call vote to continue the public hearing to May 5, 2015, at 7:00 p.m. in order to bring back a revised ordinance for introduction as directed by the City Council. AYES: Council Member Kovacic, Tay, Chandler, Beck, and Wuo NOES: None b. Ordinance No. 2326 amending portions of Division 1, Part 1, Chapter 2 of Article VI; portions of Division 8, Part 1, Chapter 4 of Article VI; and portions of Part 2, 6 and 7, Chapter 2 of Article IX of the Arcadia Municipal Code in order to update the City's Massage Therapist and Business Regulations. Recommended Action: Introduce Assistant City Manager /Development Services Director Kruckeberg and Associate Planner Li provided the staff report. In response to a question raised by Mayor Pro Tern regarding the proposed removal of the language relating to discrimination, which he would like to see left in, City Attorney Deitsch indicated that he does not recall why the discrimination wording was being proposed to be removed, does not see any issues with leaving it in, and will look into the matter. 04 -07 -15 City Attorney Deitsch indicated that the City Council can introduce the sign ordinance tonight with the recommended change as requested by Mayor Pro Tern Kovacic and bring back to the next regular City Council meeting for adoption. The City Council concurred. Mayor Wuo opened the public hearing. No one appeared. A motion to close the public hearing was made by Council Member Chandler, seconded by Council Member Tay, and seeing no further objection, Mayor Wuo declared the public hearing closed. It was moved by Mayor Pro Tern Kovacic, seconded by Council Member Beck, and carried on roll call vote to introduce Ordinance No. 2326 amending portions of Division 1, Part 1, Chapter 2 of Article VI; portions of Division 8, Part 1, Chapter 4 of Article VI; and portions of Part 2, 6 and 7, Chapter 2 of Article IX of the Arcadia Municipal Code in order to update the City's Massage Therapist and Business Regulations; and add Section 6418.20(H) back in the Ordinance for introduction at the meeting of April 21, 2015. AYES: Council Member Kovacic, Beck, Chandler, Tay, and Wuo NOES: None Ordinance No. 2327 amending Section 7553.7.1 of Chapter 5, of Article VII of the Arcadia Municipal Code concerning Outdoor Irrigation and Prohibited Water Uses. Recommended Action: Introduce City Manager Lazzaretto and Public Works Department Director Tait provided the staff report. Mayor Wuo opened the public hearing. Craig Kessler, Director of Governmental Affair, Southern California Golf Association, appeared and commented on the 2014 State water regulations as they relate to the two golf courses in Arcadia; and expressed his concerns with the language in the ordinance and asked for flexibility since the golf courses are in the City. In response to Mr. Kessler's comments, City Manager Lazzaretto responded that the amended language in the Ordinance allows large users of water to get an exemption from the City which must be approved by the Public Works Services Director. Gary Kossick, representative of the County of Los Angeles, Santa Anita Golf Course, appeared and expressed their support of the ordinance and indicated that they will be doing what they have to do to conserve water. Scott Bourgeouis, American Golf Course Corporation, Arcadia Par 3 Golf Course, appeared and spoke about the efforts they are doing to conserve water at the golf course. April Verlato, an Arcadia resident, appeared and spoke about water conservation; she indicated that she has a "smart" irrigation system and asked that the City Council to consider exemptions for those residents who have saved water, because she has reduced her personal water use by at least 20 %. 04 -07 -15 A motion to close the public hearing was made by Mayor Pro Tern Kovacic, seconded by Council Member Tay, and seeing no further objection, Mayor Wuo declared the public hearing closed. In response to Council Member Chandler's proposal to establish a free mulch program to help residents conserve water, Mayor Wuo and Council Member Tay agreed to have staff study this matter and schedule discussion at a future study session. In response to Mr. Kessler's comments, City Attorney Deitsch suggested language to the proposed Ordinance that would address Mr. Kessler's point; he indicated that on Page 3 at the end of subsection (i) add "or by such other measurement of reduction adopted by resolution of the City Council from time to time" would be an alternate to the 2013 baseline; and that a resolution as early as upon adoption of the Ordinance or even before the Ordinance becomes effective can be prepared for City Council consideration if necessary. It was moved by Mayor Pro Tern Kovacic, seconded by Council Member Chandler, and carried on roll call vote to introduce Ordinance No. 2327 amending Section 7553.7.1 of Chapter 5, of Article VII of the Arcadia Municipal Code concerning Outdoor Irrigation and Prohibited Water Uses, as amended by the City Attorney. AYES: Council Member Kovacic, Chandler, Beck, Tay, and Wuo NOES: None PUBLIC COMMENTS — No one appeared REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense CAB 1234]) Council Member Chandler announced the Police Department Town Hall meeting on April 14; he indicated that the topic of discussion is residential burglaries and how to stay safe, and urged everyone to attend. Council Member Beck announced that he attended the Citizen of Year Dinner in honor of Jim and Terry Leahy. Council Member Tay announced that in one year, the Chamber of Commerce increased their membership by 133. Mayor Pro Tern Kovacic announced that his law firm is now a member of the Chamber of Commerce; he noted that the Derby Day 5K run event was a great success; he announced the Fire Department Annual Pancake Breakfast and Law Day on May 9; and congratulated Diane Lucas, a long time Arcadia resident, on her recent Woman of Distinction honor awarded by Representative Judy Chu. Mayor Wuo commented on the Derby Day 5K run and thanked all the employees and everyone who participated. City Clerk Glasco announced that on April 16 at 7:30 a.m. at the Santa Anita Golf Course, the Chamber will be having their monthly breakfast meeting and Attorney Jim Helms will be honored. 04 -07 -15 2. CONSENT CALENDAR a. Special Meetina Minutes of March 4. 2015. and Reaular Meetina Minutes of March 17, 2015. Recommended Action: Approve b. Resolution No. 7060 accepting a dedication of certain property at 316 -324 South Third Avenue (corner cutback at the intersection of Third Avenue and Diamond Street as part of parcel map 72502) for public use. Recommended Action: Adopt Ordinance No. 2325 amending Chapter 8 of Article VII of the Arcadia Municipal Code relating to Stormwater Management and Discharge Control. Recommended Action: Adopt Contract with Vasili Inc. for the Miscellaneous Sewer Main Repair project in the amount of $44,860. Recommended Action: Approve e. Contract with X -Act Technology Solutions, Inc. to furnish, deliver, and install Category 6 Cable at Various City facilities in an amount not to exceed $74,000. Recommended Action: Approve Purchase order with Emeraencv Vehicle Group. Inc. to remount and refurbish three rescue ambulances for the Arcadia Fire Department in an amount of $304,200, and appropriate an additional $35,000 from the Equipment Replacement Fund. Recommended Action: Approve Professional Services Agreement with G4S Secure Solutions, Inc. for temporary Media Communication Services. Recommended Action: Approve Purchase order with National Auto Fleet Group for the purchase of one heavy duty pickup truck with utility body in the amount of $43,317.15. Recommended Action: Approve Purchase of 3.000 acre -feet of Imported Replacement Water from the main Gabriel Basin Watermaster for a total cost of $2,019,000. Recommended Action: Approve Purchase order with Haaker Equipment Company for the purchase of a 2015 Elgin CNG Crosswind Street Sweeper in the amount of $315,010. Recommended Action: Approve Contract with ICG, Inc. for the Recreation and Parks Master Plan Project and approval of a supplemental appropriation from the Parks and Recreation Facility Fund in the amount of $49,650. It was moved by Mayor Pro Tern Kovacic, seconded by Council Member Tay, and carried on roll call vote to approve Consent Calendar Item 2.i. Lis ussenden Chi Deputy City Clerk 04 -07 -15 ARCADIA CITY COUNCIL SPECIAL MEETING MINUTES TUESDAY, APRIL 7, 2015 CALL TO ORDER - Mayor Wuo called the Special Meeting to order at 5:30 p.m. in the Council Chamber Conference Room. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Council Member Beck, Chandler, Kovacic, Tay and Wuo ABSENT: None PUBLIC COMMENTS Tim Burch, an Arcadia resident, appeared and spoke about oversized development in Arcadia, especially in the Highlands area; and discussed how the Architectural Review Board process is broken and requested the City's assistance. April Verlato, a resident in the Highland Oaks area, appeared and spoke about the de novo process and Berkeley case. David Arvizu, representing Save the Arcadia Highlands, appeared and indicated that he is the force behind the Save the Arcadia Highlands litigation; he indicated that a separate lawsuit is being filed regarding the interpretation of Resolution No. 6770, which he feels is not being interpreted correctly by the City Attorney's office; and read several emails from residents regarding the process. Richard Fricke of the Lower Rancho Architectural Review Board spoke about the process in his Architectural Review Board. Arthur Layne appeared and commented on the expansion of homes in Arcadia and traffic and questioned Arcadia's intent. At 5:50 p.m. the City Council went into Closed Session CLOSED SESSION a. Pursuant to Government Code Section 54956.9(d)(1) to confer with legal counsel regarding the matter of Save the Arcadia Highlands v. City of Arcadia, City Council of the City of Arcadia, and Does 1 through 10; and Robert Tong, Bowden Development, Inc., 29 East Orange Grove Avenue, LLC, and Does 11 through 25; Los Angeles Superior Court (Central District — Stanley Mosk Courthouse); Court Case No. BS154327. No reportable action was taken on the Closed Session item.
