Grant of Easement for Subsurface Public Utilities and Subsurface General
Utility as well as Public Sidewalk and Pedestrian Purposes
FOR GOOD AND VALUABLE CONSIDERATION, the receipt and sufficiency of
which is hereby acknowledged by METRO GOLD LINE FOOTHILL EXTENSION
CONSTRUCTION AUTHORITY, a public agency existing under the authority of the laws of
the State of California, TRUSTEE OF THE LOS ANGELES - PASADENA METRO BLUE
LINE GOVERNMENTAL PROPERTY TRUST U /T /D DATED AUGUST 19, 1999
( "Grantor "), Grantor does hereby GRANT and CONVEY to the CITY OF ARCADIA, a
California municipal corporation ( "Grantee "), and its successors and assigns, a non - exclusive
easement for (i) subsurface public utilities and subsurface general utility purposes for any and all
subsurface public and general utility facilities, together with any and all appurtenances pertaining
thereto, as well as (ii) public sidewalk, walkway, path and pedestrian use, access, ingress and
egress purposes, and appurtenances and uses associated therewith, including without limitation
the installation and maintenance of a public sidewalk, together with any and all appurtenances
pertaining thereto, (i) as to the subsurface utility portion of the easement, in, on, along, through,
below, under and across the subsurface portion, and (ii) as to the sidewalk and pedestrian access
portion of the easement, over, above, on, across, along and through that certain portion, of
Grantor's real property located in the City of Arcadia, County of Los Angeles, State of
California, more particularly described in the legal description attached hereto as Exhibit "A"
and depicted or illustrated on the plat or map attached hereto as Exhibit "B "; both of such
attachments / exhibits are incorporated herein by this reference. Grantee shall have the
obligation to maintain the easement, including without limitation the appurtenances to such
easement.
