REGULAR MEETING MINUTES
TUESDAY, JULY 7, 2015
Mayor Kovacic called the Closed Session meeting to order at 6:40 p.m.

regarding the initiation of litigation — one (1) potential case.
No reportable action was taken on the Closed Session item.

CITY COUNCIL REGULAR MEETING
CALL TO ORDER — Mayor Kovacic called the regular meeting to order at 7:05 p.m.

REPORT FROM CITY ATTORNEY ON CLOSED SESSION ITEM
City Attorney Deitsch reported that the City Council met in Closed Session prior to the regular
meeting to consider the one item listed on the posted agenda under Closed Session; no
reportable action was taken.
SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS
City Manager Lazzaretto stated there was no supplemental agenda information.

A motion was made by Council Member Tay, seconded by Mayor Pro Tern Chandler to read all

PUBLIC HEARING
a. Resolution No. 7059 authorizinq the Arcadia Police Department to use funds allocated
from the Cit izens' Option for Public Safety- Supplemental Law Enforcement
Services Fund (COPS - SLESF) for the purpose of front line police services
Recommended Action: Adopt
Chief of Police Guthrie presented the staff report.
Mayor Kovacic opened public hearing. No one appeared.
A motion to close the public hearing was made by Mayor Pro Tern Chandler, seconded by
Council Member Tay, and seeing no further objection, Mayor Kovacic declared the public
hearing closed.
It was moved by Mayor Pro Tem Chandler, seconded by Council Member Tay, and carried on
roll call vote to adopt Resolution No. 7059 authorizing the Arcadia Police Department to use
funds allocated from the Citizens' Option for Public Safety - Supplemental Law Enforcement
Fund (COPS - SLESF) for the purpose of front line police services during Fiscal Year 2015 -16.

PUBLIC COMMENTS
Mickey Segal, former Mayor, appeared and indicated that before he left the City Council, other
cities wanted to be like Arcadia, he commended the City Manager and staff for all their hard
work; he shared his experience serving on the City Council; he expressed his disappointment of
the 3 to 2 votes he has observed since he left the City Council, and discussed the City Council's
role; he asked where that City Council was that supported and accommodated the community;
he commented on the Save the Arcadia Highlands lawsuit against the City, and stated that it is
the City Council's obligation to sit down and fix it the problem, that litigation is not the answer,
and for the record indicated that the City Council has 120 days to fix the problem and unrestrict
zoning changes, or he will take his 6,000 name mailing list and begin a recall process.
Charles Greene, a resident in the Highlands, appeared and expressed his concerns regarding
an editorial he read in the Pasadena Star News regarding the zoning code update and
mansionization in the City; he urged the City Council not to suspend the zoning code update
and historical preservation survey project that will include the Highlands are while the lawsuit is

pending; and noted that the City Council is punishing the residents of Arcadia and expressed
that he is not OK with it.
Travis Chen, a student at Arcadia High School and representative of the Arcadia Youth Council
Commission, appeared and thanked the City Council for serving Arcadia; he provided a brief
summary of the Youth Council's missions, visions and activities; he indicated that he hopes to
build a relationship among the students in the City and the City Council; and urged the City
Council to reach out to the youth in the community; and invited the City Council to attend the
July 19 Arcadia Youth Bonding event they are sponsoring.
Mayor Kovacic asked Travis Chen to set up an appointment to meet with him.
David Arvizu, representative of the Save the Arcadia Highlands, appeared and spoke about an
article he read in the Arcadia Weekly and Sierra Madre Tattler website regarding Council
Member Wuo's ties and relationship with Gem Coin; he indicated that he believes Council
Member Wuo owns an overseas account and has something to do with the City officials'
cancelled trip to China; and questioned where the $30,000 donation went, and indicated that he
seconds Mr. Segal's comments.
Lawrence C. Papp, an Arcadia resident, appeared and spoke about the utility users tax repeal
and expressed his disappointment about the exclusion of the Highlands from the historical
preservation study.
Matt McSweeny, representing the Downtown Arcadia Improvement Association, appeared and
*► thanked former and present City Council Members and City staff for supporting the patriotic and
street fair events; and provided an overview of the events.
Burton Brink, an Arcadia resident, appeared and expressed his concerns and disappointments
that the City Council is not listening to the residents of Arcadia, and commented on the lawsuit
by the Highlands against the City of Arcadia, and the development in the Highlands; he believes
that the City should continue with the zoning code update project despite the lawsuit; and
announced that he is running for the City Council in April 2016.
William Kyi, representing the Arcadia Youth Council Commission, appeared and spoke about
the youth of Arcadia not being represented; and provided an overview of the Arcadia Youth
Council Commission, and each member introduced themselves.
Tim Burch, an Arcadia resident, appeared and commented on development based on his
experience growing up in the City; he expressed his disappointment with mansionization and
the City's developments that are fueled by speculators, investors, and ignorant City Council
Members who should resign. Mr. Burch suggested the City Council authorize the Planning
Department to write a report regarding the zoning code updates from the surrounding cities and
publish the result.
Laura Lynn Rogers, an Arcadia resident, appeared and spoke about mansionization in the
Highlands; and expressed her disappointment regarding the zoning code update decision and
exclusion of the Highlands from the historical preservation survey.

REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the
City Council related to meetings attended at City expense [AB 1234])
Council Member Beck congratulated and thanked all incoming and outgoing board and
commission members, the Arcadia Chinese Association for supporting Law Day, and the 2015
Leadership Academy graduates; he noted that there is a possibility that the lawsuit against the
City may go on for years and expressed his frustration.
Council Member Beck asked for City Council support to reconsider excluding commercial
districts from the zoning code update. It was the consensus of the City Council to bring back for
discussion and reconsideration at the next regular City Council agenda to go forward with the
commercial and industrial district portions of the zoning code update.
Council Member Beck also requested the City Council to reconsider excluding R -2 and R -3
zoning (multi - family), and bring it back to the next City Council agenda for discussion and
reconsideration. Mayor Kovacic concurred and expressed his disappointment that there was not
another vote to put this on a future agenda.
Council Member Beck also asked if the City Council would reconsider moving forward with the
Neighborhood Impact Community meetings. Only Mayor Kovacic concurred. Council Member
Beck expressed his disappointment and frustration regarding the postponement of the zoning
code update due to the lawsuit.
Council Member Wuo congratulated and thanked all incoming and outgoing board and
commission members, the Arcadia Chinese Association for supporting Law Day for 17 years,
and the Leadership Academy graduates, and thanked City Manager Lazzaretto for bringing this
program to the City; and encouraged the Petitioner to drop the lawsuit so that things can get
done; he called the lawsuit frivolous and feels that a lawsuit is the wrong way to handle the
situation, and questioned why they are doing this to the City; and mentioned that their demands
is what has the City's hands tied.
Council Member Tay commented on the Save Arcadia Highlands lawsuit and added that the City
Council did not hide anything from the public; he responded to comments made by former Mayor
Segal and Mr. Brink; and commented on Council Member Beck's suggestion at the last City
Council meeting for the Petitioner of the Highlands lawsuit to publicly state their settlement
demands to the City.
Due to an interruption of the meeting by a member of the public, Mayor Kovacic called for a
recess.
The City Council recessed at 8:47 p.m.; and reconvened at 8:54 p.m. Mayor Kovacic read the
decorum statement of meetings on the back of each City Council agenda.
In response to a request by Mayor Kovacic, City Attorney Deitsch discussed whether it would be
appropriate for either party to disclose confidential information from a settlement conference in
the pending Save the Arcadia Highlands litigation; he stated that to his knowledge, no one from
the City has violated the agreement by challenging the other party to release settlement
demands.

Mayor Kovacic indicated that he understood the challenge part of the issue, but does not agree
with someone disclosing the terms of a settlement agreement after being challenged, and urged
the City Council to stop challenging what was said at the settlement conference and move on
with the substantive nature of what is before them; and requested that City Attorney Deitsch
research the issue further.
Mayor Pro Tem Chandler announced that he attended the Elks Club ribbon cutting ceremony
and shared information about the Elks, and congratulated them on their continued brotherhood;
he announced that on June 27, he and City Manager Lazzaretto attended the Santa Anita Race
Track with a Mayor's Proclamation that it was for American Pharaoh Day; and commented on
the postponement of the zoning code update study, and commented and discussed the floor
area ratio, and property values and property rights.
City Manager Lazzaretto reported that water conservation numbers for June were 28 %, and
indicated that is a very impressive number and encouraged everyone to keep reducing; he
announced that the free mulch program is underway and reminded residents to sign up; and
announced that regarding Consent item 2.e, that he has a potential conflict of interest, as
referenced in the staff report, and will be removing himself from the room during that item if the
City Council discusses the matter.
City Clerk Glasco announced that he participated in the Sierra Madre July 4 Parade; and
announced movies at the Museum beginning July 18.
Mayor Kovacic respectfully corrected Council Member Wuo, and indicated that he does not
•+ recall anyone referring to the Save the Arcadia Highlands lawsuit as "frivolous "; he reminded
Mayor Pro Tern Chandler that the City's zoning code update has come to a halt, but the FAR
has not; and he expressed his disappointment that the zoning code update is being
piecemealed.
Mayor Kovacic asked for City Council support for a future study session regarding residential turf
regulations. Mayor Kovacic, Mayor Pro Tern Chandler and Council Member Wuo concurred.
In response to Mayor Kovacic's request to add Santa Anita Park to the zoning code update, City
Manager Lazzaretto and Assistant City Manager Kruckeberg confirmed that Santa Anita Park
would already be included in the previous motion to re -start the commercial and industrial
portion of the zoning code update.
Mayor Kovacic asked for City Council support to include vacant lots and homes in the zoning
code update. This request failed for lack of support.
Mayor Kovacic congratulated the Elks Club on their ribbon cutting ceremony; he thanked
everyone who attended the patriotic events, congratulated everyone for all their hard work in
putting these events together; he announced that summer concerts begin Thursday, July 9
where there will also be an environmental fair, and on Friday, July 10 is the start of movies in the
park; he thanked the City of Sierra Madre for inviting the City to their 4th of July Parade; and he
shared his dog's condition who was attacked by another dog, and urged dog owners to take
care of their dogs.

2. CONSENT CALENDAR
a. Set a public hearing date of August 4 2015 for an appeal of the Planning Commission
denial of Modification Application No MC 14 -18 and Single- Family Architectural Design
Review No. SFADR 14 -112 for a new, two -story, modern -style residence at 1217
Mayflower Avenue.
Recommended Action: Set hearing date for August 4, 2015
b. Accept all work performed by Garland /DBS Inc for the City Hall Roofing Restoration
ro'ect.

C. Accept all work performed by X -Act Technology Solutions Inc for the Category 6 Cable
Installation at various City facilities project

d. Agreement with Beacon Media Inc for Legal Advertising Services in an amount not to
exceed $8,000.

e. Professional Services Agreement with Architectural Resources Group Inc to complete a
historic resources survey.

f. Professional Services Agreement with L S Lichty & Associates to provide technical
hardware specifications for the final phases of acquisition and implementation of a voice
over internet protocol telecommunication system in an amount not to exceed $11,935.

g. Professional Services Agreement with KOA Corporation for traffic engineering services
for the Duarte Road traffic siqnal and crosswalk evaluations in an amount not to exceed
$29,349.

h. Purchase Order with National Auto Fleet Group for five 2016 Ford Explorer black and
white police patrol vehicles and one 2016 Ford Explorer administration vehicle in an
amount not to exceed $211,311.20.

i. Purchase Order with Sunaard Pentamation for financial system software maintenance in
an amount not to exceed $35,199.

j. Extension to the Purchase Order with Black and White Emergency Vehicles Inc for the
Purchase and installation of emergency equipment and lighting for City vehicles in an
amount not to exceed $84,794.

k. Extension to the Professional Services Agreement with Baker & Taylor Inc for library
material vendor services in an amount not to exceed $215,000. _

various City facilities in an amount not to exceed $305,547.

3. CITY MANAGER
a. Resolutions approving amendments to Memoranda of Understanding and Management
Fringe Benefits Resolution in accordance with California's New Paid Sick Leave Law and
Recommendations from the CalPERS Office of Audit Services.
Recommended Action: Adopt
Administrative Services Director Quach and Human Resources Manager Jeanette Flores
provided the staff report.
It was moved by Mayor Pro Tern Chandler, seconded by Council Member Tay, and carried on
roll call vote to adopt:
(a) Resolution No. 7075 approving amendments to the Memorandum of Understanding for
employees represented by the Arcadia Civilian Employees Association (ACEA); and
(b) Resolution No. 7076 approving amendments to the Memorandum of Understanding for
employees represented by the Arcadia Firefighters' Association (AFFA); and
(c) Resolution No. 7077 approving amendments to the Memorandum of Understanding
for employees represented by the Arcadia Police Civilian Employees Association
(APCEA); and
(d) Resolution No. 7078 approving amendments to the Memorandum of Understanding for
employees represented by the Arcadia Public Works Employees Association (APWEA);
and
(e) Resolution No. 7079 approving amendments to the Memorandum of Understanding for
employees represented by the Arcadia Police Officers Association (APOA); and
(f) Resolution No. 7080 approving amendments for fringe benefits and related
compensation for City Council, Executive Management, Management and
unrepresented employees of the City of Arcadia.

ADJOURNMENT
Mayor Kovacic adjourned this meeting at 9:39 p.m. in memory of Arcadia Police Department
VIPS member Gianny Lucarelli and Los Angeles County Superior Court Judge Jan Plium to
Tuesday, July 21, 2015, at 5:00 p.m. in the Council Chamber Conference Room.
