HomeMy WebLinkAboutMaterials Distributed at Meeting 1119 cadv4-1 POTENTIAL MORATORIUM ON SINGLE-FAMILY RESIDENTIAL DEVELOPMENT DISCUSSION POINTS CITY COUNCIL STUDY SESSION—NOVEMBER 3, 2015 Process An Interim Urgency Ordinance can be adopted by the City Council on single-family residential development per the authority granted to cities in the California Constitution, California Health &Safety Code, and California Government Code. An Interim Urgency Ordinance could be adopted pursuant to a 4/5 vote of the City Council for a period of 45 days. The Ordinance would need to be based on findings that the action was necessary to protect the public health, safety, and welfare and that the City was going to be working toward changes to residential development standards during the interim period. If the Moratorium was found to be necessary for a longer period of time, the City Council could vote to extend the Moratorium up to an additional 10 months and 15 days through an extension of the Urgency Ordinance. How would a Moratorium be implemented? There are many different ways that a Moratorium could be implemented.A Moratorium could be placed on the issuance of new demolition permits, new building permits, new design review approvals,or other thresholds.There are several stages to the approval of a home and issuance of permits.They are: • Approval of Design Review—A home goes through the process of Design Review with either staff or a Homeowners'Association.This typically takes a number of months and many iterations • Issuance of a Certificate of Demolition—If an existing home on a lot is to be demolished and it is 50 years old or older,the applicant must have the home reviewed by an architectural historian or historian to determine the historical significance of the home. If the home is deemed to have historic value, additional processes and review are required. • Plan Check—If a home is in Plan Check,this means that the home has been approved through design review and the applicant has completed engineering and construction drawings and is having the final home plan reviewed by the City. • Building Permit Issuance—A Building Permit is issued when the home has been approved and is ready for construction to begin. • Demolition Permit Issuance—A demolition permit is required to ensure that all existing utilities are safely capped, any environmental hazards have been abated (such as lead and asbestos), and the home is ready for demolition.This can occur at several different stages in the process. • • • . l � • What is in the Pipeline that would be impacted by a Moratorium? Based on records as of October 29, 2015, the following single-family homes are in the "pipeline" in various stages of review. These numbers do not include additions to single-family homes or multi-family projects. • There are 23 homes that have been issued Building Permits but have not yet been issued Demolition Permits. • There are 91 homes currently in Plan Check that have not yet been issued a Building Permit. Of these,there are 8 homes that have been issued Demolition Permits. • There are approximately 30 homes that have been approved through Design Review but are not yet in Plan Check. • There are 82 homes currently in the City's Design Review process that have not yet been approved. Huntington Drive Arcadia, CA 91006 ` BO: MORATORIUM ON DEMOLITION PERMITS Mayor Kovacic and City Councilman, The Oaks, Village and Highlands ARB Chairs support a temporary moratorium on demolition permits while the City concludes it's zoning code update and historical survey. A moratorium on demolition permits would help to preserve those homes that are identified in the historical resources survey before the survey results are published. In addition, a moratorium would hold in abeyance further construction of homes that are out of scale to the neighborhood but comply with the current codes . We are all in agreement that we will work together to reach a consensus as to zoning code updates that will meet the needs of all residents of Arcadia.
