SFADR 15-12 FOR A PROPOSED 3,890 SQUARE-FOOT, TWO-STORY, SINGLE-FAMILY RESIDENCE WITH AN ATTACHED 415 SQUARE-FOOT TWO-CAR GARAGE AT 228 W. PAMELA ROAD Recommendation: Conditionally Approve the Appeal SUMMARY On November 10, 2015, the Planning Commission opened a public hearing to consider the appeal by the property owner, Bob Cheou, to request that the Planning Commission review the Development Services Department’s denial of the architectural design review for a proposed 3,890 square foot, two-story, Traditional-style, single-family residence with an attached 415 square foot two car garage at 228 W. Pamela Road. The November 10, 2015 staff report is attached. The Planning Commission continued the public hearing to the November 24, 2015, Regular Meeting to allow the property owner, designer, and Development Services Department staff to meet and discuss the changes that would be necessary in order for the proposed design to be deemed compatible with the neighborhood and consistent with the City’s Single-Family Residential Design Guidelines. The proposal has been revised as recommended by staff, and the property owner is satisfied with the revisions. It is recommended that the Planning Commission conditionally approve the appeal based on the revised design submitted November 18, 2015. BACKGROUND On November 10, 2015, the Planning Commission opened a public hearing to consider the appeal by the property owner of the subject property, Bob Cheou, to request that the Planning Commission review the Development Services Department’s denial of the Appeal SFADR 15-12 228 W. Pamela Road November 24, 2015 – Page 2 of 5 architectural design review for a proposed 3,890 square-foot, two-story, Traditional- style, single-family residence with an attached 415 square-foot two-car garage at 228 W. Pamela Road – refer to Attachment No. 1 for the November 10, 2015, staff report. Testimony was received from residents that were in support and opposed to the proposal. Staff provided suggestions, as listed below, as to how the proposal could be revised to be more consistent with the City’s Single Family Residential Design Guidelines. • Lower the first floor plate height to 9’-0” or less • Provide a greater front yard setback on the second story • Revise the roof pitch to lower the overall height of the home Based on the public comments and staff’s recommendations the Planning Commission voted 4-0 with one absent to continue this item to the November 24, 2015, Regular Meeting to allow the property owner, designer, and Development Services Department staff to meet and discuss the changes that would be necessary in order for the proposed design to be deemed compatible with the neighborhood and consistent with the City’s Single-Family Residential Design Guidelines. PROPOSAL The designer and property owner met with staff and have revised the proposal as recommended, and submitted revised plans on November 18, 2015. The revised plans more completely address concerns regarding the mass and visual appearance of the home, particularly the second-story – refer to Attachment No. 2 for the Revised Architectural Plans, and images shown below. The changes to the plans, when compared to the plans presented at the November 10, 2015, Planning Commission meeting, are as follows: • To further minimize the massing on the second floor, the front of the second floor has been stepped further back by approximately 2’-0” from the first floor and the number of breaks in the wall plane has been reduced from four to three to soften the appearance. The revisions result in a 13’-0” to 14’-6” front yard setback compared to the previous 10’-6” to 12”-0”. • The windows on the second floor along the front elevation are smaller by six inches, from 3’-0” x 4’-0” to 3’-0” x 3’-6”. • The roof pitch has been lowered from 4:12 to 3.5:12, and the first floor plate height has been lowered from 9’-6” to 9’-0”. These changes reduce the overall height of the home by 14 inches, from 25’-8” to 24’-6” to blend better with the older, established one-story residences. Appeal SFADR 15-12 228 W. Pamela Road November 24, 2015 – Page 3 of 5 • The additional front setback reduces the bulk of the second floor by 62 square feet; from 1,308 square-feet to 1,246 square-feet. The overall square footage of the home has been reduced from 3,890 square-feet to 3,828 square-feet. • A 1’-0” wall and roof articulation has been added on the second floor along the easterly side of the home. The appellants are in agreement with the proposed changes. The Development Services staff finds that the revised architectural design for the proposed residence is in conformance with the City’s R-1 Zoning Regulations and Single-Family Residential Design Guidelines. ENVIRONMENTAL DOCUMENT The proposed project qualifies as a Class 3 Exemption from the requirements of the California Environmental Quality Act (CEQA) as New Construction of One, Single- Family Residence under Section 15303 of the CEQA Guidelines. Refer to the attachment to the November 10, 2015 staff report. Before After Appeal SFADR 15-12 228 W. Pamela Road November 24, 2015 – Page 4 of 5 PUBLIC HEARING NOTIFICATION No further public hearing notices were required for this item since the public hearing was continued to a specific date. Staff received two additional letters of support from neighboring property owners – refer to Attachment No. 3 for Letters of Support. RECOMMENDATION It is recommended that the Planning Commission find that this project qualifies as a Class 3 Categorical Exemption from CEQA, and approve the appeal based on the revised design submitted November 18, 2015, subject to the following conditions of approval: 1. All City requirements regarding disabled access and facilities, occupancy limits, building safety, health code compliance, emergency equipment, environmental regulation compliance, and parking and site design shall be complied with by the property owner/applicant to the satisfaction of the Building Official, City Engineer, Community Development Administrator, Fire Marshal, and Public Works Services Director, or their respective designees. 2. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officials, officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officials, officers, employees or agents to attack, set aside, void, or annul any approval or conditional approval of the City of Arcadia concerning this project and/or land use decision, including but not limited to any approval or conditional approval of the City Council, Planning Commission, or City Staff, which action is brought within the time period provided for in Government Code Section 66499.37 or other provision of law applicable to this project or decision. The City shall promptly notify the applicant of any claim, action, or proceeding concerning the project and/or land use decision and the City shall cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose its own attorney to represent the City, its officials, officers, employees, and agents in the defense of the matter. 3. Approval of Single-Family Architectural Design Review Application No. SFADR 15-12 shall not be of effect unless on or before 30 calendar days after approval of this project, the property owner/applicant has executed and filed with the Community Development Administrator or designee an Acceptance Form available from the Development Services Department to indicate awareness and acceptance of these conditions of approval. PLANNING COMMISSION ACTION Approval of the Appeal and Revised Design If the Planning Commission intends to approve of the proposed revised design, the Commission should state that the project is consistent with the City’s design guidelines, Appeal SFADR 15-12 228 W. Pamela Road November 24, 2015 – Page 5 of 5 and approve a motion to approve the appeal based on the revised design for SFADR 15-12, subject to the aforementioned conditions of approval, or as modified by the Commission. Denial of the Appeal and Revised Design If the Planning Commission intends to deny the appeal and the revised design, the Commission should approve a motion to deny the appeal and the revised design for SFADR 15-12, and state that the project is not consistent with the City’s design guidelines. SFADR 15-12 FOR A PROPOSED 3,890 SQUARE-FOOT, TWO-STORY, SINGLE FAMILY RESIDENCE WITH AN ATTACHED 415 SQUARE-FOOT TWO-CAR GARAGE AT 228 W. PAMELA ROAD Recommendation: Deny Appeal SUMMARY The property owner, Mr. Bob Cheou, is appealing the Development Services Department’s denial of the architectural design review for a proposed 3,890 square-foot, two-story, Traditional-style, single family residence with an attached 415 square-foot two-car garage at 228 W. Pamela Road – see Attachment No. 2 for the Current Submittal of Architectural Plans. It is recommended that the Planning Commission deny the appeal. BACKGROUND The subject property is 8,744 square-feet in area, zoned R-1-7,500, and is currently developed with a 1,982 square-foot, one-story residence with an attached two-car garage constructed in 1949. The property is located on W. Pamela Road, which is a cul- de-sac in the southern part of the city accessed from El Monte Avenue. Including two corner lots, there are 20 properties on the street – see Attachment No. 1 for an Aerial Photo with Zoning Information & Photos of the Subject Property and Vicinity. The properties are currently improved as follows: • Nineteen one-story homes originally constructed in the 1950’s, ranging from 1,192 square-feet to 2,643 square-feet in size; and • One, two-story home consisting of 5,232 square feet at 200 W. Pamela Road (on the southwest corner) that was approved in November 2014 and is currently under construction. Appeal SFADR 15-12 228 W. Pamela Road November 10, 2015 – Page 2 of 6 The properties immediately around the subject property consist of the following: • North: A 1,192 square-foot, one-story residence constructed in 1949. • East: A 2,037 square-foot, one story residence constructed in 1950. • South: A 2,458 square-foot, one-story residence constructed in 1939. • West: A 1,939 square foot, one-story residence constructed in 1950. The applicant, Mr. Philip Chan of PDS Studio, Inc., on behalf of the property owner, Mr. Bob Cheou, submitted Single-Family Architectural Design Review No. SFADR 15-12 on February 19, 2015. The original application submittal was for a 3,953 square-foot, two- story residence with an attached 415 square-foot, two-car garage – see Attachment No. 3 showing the First Submittal of Architectural Plans. Planning Services found that this proposal did not meet the City’s Single-Family Residential Design Guidelines (SFRDG), and issued an incompletion letter on April 9, 2015. Among the items identified as incompatible with the surrounding neighborhood and inconsistent with the SFRDG were the architectural style and massing of the proposed residence – see Attachment No. 4 for the Incompletion & Denial Letters. Two additional design submittals followed on April 22, 2015, and June 15, 2015, in which both showed relatively minor changes to the design of the proposed home. Staff’s responses to both submittals were that further revisions were needed to improve the architectural style and to reduce the mass and bulk of the structure – see Attachment No. 4. A Notice of Pending Decision was mailed on July 31, 2015, to the property owners and residents in the design review notification area – see map on page 4. In response to this notice, staff received four letters/emails from residents in the surrounding neighborhood; three letters in opposition, and one in support of the proposed design. Staff also received a petition in opposition to the project signed by the residents of six of the properties within the immediate vicinity - see Attachment No. 5 for the Public Comments of Opposition and Petition. The letters/emails of opposition question the compatibility of the proposed two-story home with the surrounding single-story neighborhood, the potential change in character to the neighborhood, obstruction of views, and the overall size of the proposed home in relation to other homes in the neighborhood. Because staff was still not supportive of the proposed plans, and in response to the comments that were received from neighboring property owners, revised plans were submitted on September 2, 2015, and September 22, 2015 to address the various concerns. Over the course of the four revised submittals, the design has been altered as follows: • Revised the architectural style from Cape Cod to Traditional; • Reduced the total livable area from 3,953 square-feet to 3,890 square-feet; • Increased the second-story setback from the side property lines (adjacent to one- story residences) from the minimum 16’-0” required by the Zoning Code to 18’-0”; Appeal SFADR 15-12 228 W. Pamela Road November 10, 2015 – Page 3 of 6 • Lowered the top-plate heights from 10’-0” to 9’-6” for the first floor and from 9’-0” to 8’-0” on the second floor; • Reduced the overall height of the house from 28’-5” to 25’-8” (maximum 30’-0” allowed by the Zoning Code); • Provided additional articulation on the second story along the front elevation; • Removed the rear balcony from the master bedroom; • Increased the planting sizes of the proposed trees; and • Reduced the size, and changed the placement of the second story windows on the sides of the home. The applicant states that attempts were made to meet with the residents and property owners in the neighborhood that oppose the project to discuss what changes could be made to address their concerns; however, no meeting ever took place. On October 8, 2015, the Development Services Department issued a denial letter (see Attachment No. 4) for the project, based on a determination that further reductions in the size, mass, and volume of the proposed residence are needed for the design to be deemed compatible with the surrounding neighborhood and consistent with the City’s Single-Family Residential Design Guidelines. On October 15, 2015, the applicant filed an appeal of the Development Services Department’s decision – see Attachment No. 6 for the Appeal Letter. Appeals of Single-Family Architectural Design Review decisions by staff are heard before the Planning Commission. The Planning Commission may approve, conditionally approve, or deny the appeal/proposed design. The Commission’s decision may be appealed to the City Council. PROPOSAL The fifth submittal of architectural plans (Attachment No. 2) proposes a 3,890 square- foot residence comprised of a 2,582 square-foot first floor and a 1,308 square-foot second floor. The first floor is comprised of a foyer, a great room, library, family room, kitchen, wok-kitchen, laundry room, one bedroom, and 1½ bathrooms. An open ceiling to the second floor is proposed for the foyer. The second floor consists of three bedrooms and three bathrooms. An attached 415 square-foot, two-car garage is proposed at the front of the residence. The architecture of the proposed design is Traditional in style, and features colors, materials, and design elements typical of this style of architecture. The proposed setbacks for the first-story are at or slightly greater than the minimum 8-foot requirement for the portion of the home along the easterly side property line. The proposed second story side yard setbacks are 2-feet greater than the 16-foot requirement. The second story is setback an additional 10’-6” from the required front yard setback. The conceptual landscape plan for this project indicates that additional new trees are proposed in the front, rear, and side yards, including new privacy hedge trees along the rear and side property lines. Pamela Road November 10, 2015 – Page 4 of 6 ANALYSIS Staff is satisfied with the overall architectural style of the proposed residence, including the proposed materials, colors, and architectural detailing. The primary reason for the staff denial is that the majority of homes on this block are still single-story, post-war homes, including the homes immediately surrounding the subject property. It is staff’s determination that further reductions and changes in the mass and visual appearance of the second-story are needed for the design to be deemed compatible with the neighborhood and consistent with the City’s Single-Family Residential Design Guidelines. Staff finds that the proposed project is inconsistent with the following subsections of the design guidelines: Site Planning (p.6): • The location, configuration, size, and design of new buildings should be visually harmonious with their sites and compatible with the character and quality of the surroundings. • The height and bulk of proposed dwellings should be in scale and in proportion with the height and bulk of dwellings on surrounding sites. Alternatively, projects should incorporate design measures to adequately mitigate scale differences. Massing (p.9): • New dwellings should be compatible in mass and scale to surrounding buildings in the neighborhood and with the natural site features. PUBLIC COMMENTS In addition to the Notice of Pending Decision process, public hearing notices for this appeal were mailed on October 27, 2015 to the property owners and tenants of those properties within the design review notification area. As of November 6, 2015, staff has not received any additional public comments on this project. Appeal SFADR 15-12 228 W. Pamela Road November 10, 2015 – Page 5 of 6 RECOMMENDATION It is recommended that the Planning Commission deny the Appeal, and uphold the decision of the Development Services Department to deny Single-Family Architectural Design Review No. SFADR 15-12, and find that the project is not consistent with the Single-Family Residential Design Guidelines. If the Planning Commission intends to approve the Appeal, and approve the project, it is recommended that the project be approved subject to the following conditions: 1. All City requirements regarding disabled access and facilities, occupancy limits, building safety, health code compliance, emergency equipment, environmental regulation compliance, and parking and site design shall be complied with by the property owner/applicant to the satisfaction of the Building Official, City Engineer, Community Development Administrator, Fire Marshal, and Public Works Services Director, or their respective designees. 2.
