REGULAR MEETING MINUTES
TUESDAY, OCTOBER 20, 2015
CALL TO ORDER — Mayor Kovacic called the meeting to order at 7:00 p.m.

PRESENT: Council Member Beck, Chandler, Tay, and Kovacic

REPORT FROM CITY ATTORNEY REGARDING CLOSED SESSION ITEMS
City Attorney Deitsch reported that the City Council met in Special Closed Session meeting to
consider the two items listed on the posted agenda under Closed Session, no reportable action
was taken.
SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS
City Manager Lazzaretto stated there was no supplemental agenda information.
MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE
THE READING IN FULL
A motion was made by Council Member Tay, seconded by Mayor Pro Tern Chandler to read all
ordinances and resolutions by title only and waive the reading in full.
1. APPOINTMENTS
a. Appointment to the City Council.
Recommended Action: Make Appointment; and as applicable swear in new
member
City Manager Lazzaretto presented the staff report and announced that this afternoon a letter
was received by Dr. Sheng Chang requesting he be considered for appointment to the City
Council.
It was moved by Mayor Pro Tern Chandler, seconded by Council Member Beck, and carried on
roll call vote to appoint Mickey Segal to fill the unexpired term until April 2016; and that he be
sworn into office at this time.

At 7:08 a.m. Mayor Kovacic called a brief recess to reorganize the seating of the City Council.

Due to the resignation of Mr. Wuo, Mayor Kovacic announced changes to the Council Member
Liaison List as follows:
Mayor Pro Tern Chandler- Library Board of Trustees Liaison
Council Member Sho Tay - Independent Cities Association Delegate
Council Member Beck — Southern California Association of Governments Delegate
Mayor Kovacic also announced that there will be no alternates to the L.A. County Division of the
League or the San Gabriel Valley Council of Governments.
b. Appointment to the Arcadia Beautiful Commission.
Recommended Action: Make Appointment
Mayor Kovacic opened nominations to fill a vacancy on the Arcadia Beautiful Commission which
expires June 30, 2017.

Seeing no other nominations, City Council Members voted as follows:

By a vote of the City Council, Donald Fandry was appointed to the Arcadia Beautiful
Commission to fill an unexpired term which expires June 30, 2017.
2. PUBLIC HEARING
a. Ordinance No. 2330 amending Division 4, Chapter 5, Part 5 of Article VII of the
Municipal Code regarding Water Efficient Landscaping requirements.
Recommended Action: Introduce
Community Development Administrator Kasama provided the staff report.
Mayor Kovacic opened the public hearing.
Arthur Lane, an Arcadia resident, appeared and spoke about large homes where no one is there
and the sprinklers go on every day; and asked about penalties for those individuals who violate
watering regulations.
A motion to close the public hearing was made by Mayor Pro Tem Chandler, seconded by
Council Member Segal, and seeing no further objection, Mayor Kovacic declared the public
hearing closed.
It was moved by Mayor Pro Tem Chandler, seconded by Council Member Tay, and carried on
roll call vote to introduce Ordinance No. 2330 amending Division 4, Chapter 5, Part 5 of Article
VII of the Municipal Code regarding Water Efficient Landscaping requirements.

City Manager Lazzaretto announced that Public Works Services Director Tait advised him that
notices and citations have been issued to over 350 properties, and flow restrictors have been
installed at a number of properties.
PUBLIC COMMENTS
Michael Vercillo, a member of the Arcadia Police Civilian Employees Association and resident of
Arcadia, appeared and expressed his opposition to the Utility Users Tax measure; he spoke
about the impacts to the City and Arcadians if it is passed; and encouraged residents to find out
all the facts before voting.
Charles Greene, an Arcadia resident, appeared and commented on statements made by Mayor
Pro Tern Chandler at the September 15, City Council meeting regarding the Zoning Code
initiative saying that the proposed ballot initiative was not clearly written and creating any code
or law changes is best left up to the City Council.
Richard Midgley, President of the Santa Anita Oaks Homeowners Association, appeared and
commended the City Council for filling the City Council seat; he noted that the Zoning Code
initiative will be closely watched, and that they are in favor of the Zoning Code initiative, and
congratulated Council Member Segal on his appointment.
Joe Sira appeared and indicated that misleading and false information is being given out to
residents so they will sign the Zoning Code petition and that he did his own research; he
encouraged residents to contact a local relator to get correct information regarding property
values; and announced that if anyone wants their name removed from the petition because they
were given false information, they should contact the City Attorney's office.
Britt Cole, representing the Arcadia Fire Fighters Association, appeared and spoke in opposition
of the Utility Users Tax initiative and the impacts to the City and citizens if it is passed.
Brian Ortiz, a member of the Arcadia Police Officers Association, appeared and spoke in
opposition of the Utility Users Tax initiative and the impacts to the City and the citizens if it is
passed; he encouraged potential candidates to let the citizens know where they stand on the
UUT initiative.
Kristi Ortiz, representing the Arcadia Police Civilian Employees Association, appeared and
spoke in opposition of the Utility Users Tax; she described some of the impacts to the City and
City services and employees it would cause if it was passed and urged voters to vote no on the
Utility Users Tax measure.
Carolyn Papp, a resident of the Highland Oaks, appeared and spoke about masionization in the
Highlands and the loss of trees and landscaping as a result of the big homes being built.
Roy McMeen, an Arcadia resident, thanked the City Council for appointing Mickey Segal and
congratulated him for mediating the Save the Arcadia Highlands litigation; and asked who set
the 5 minute time limit for speakers.
John MacDonnell, an Arcadia resident, appeared and spoke in opposition of the Utility Users
Tax initiative; he challenged the City Council to get the dispute of development resolved quickly;

he complained about the tactics Save the Arcadia Highlands people are using to get signatures
for their petition; he complained about a haunted house on Highland Oaks Drive which he feels
is a nuisance and believes that they charge to enter and would like the City Council to look into
this matter; and congratulated Council Member Segal on his appointment to the City Council.
Erica Bradley, an Arcadia resident and freshman at Arcadia High School, appeared and
complained about the Arcadia Police Department calling the Department of Social Services on
her mother with false accusations of child abuse.
Ya-May Christie, an Arcadia resident and mother of Erica Bradley, appeared and complained
about the Arcadia Police Department falsely accusing her as an abusive parent and calling the
Department of Child Services on her;she wanted to know why the Arcadia Police Department
will not return her call; and asked the Mayor and City Council to look into the matter.
Domenico Tallerico, an Arcadia resident, appeared and congratulated Mr. Segal on his
appointment to the City Council; he spoke about the burden of taxes to the taxpayers, and asked
the City Council to revisit their position on the Utility Users Tax repeal measure; and indicated
that he is in favor of the repeal of the Utility Users Tax measure; and cited his source as
Investors Business Daily.
Brett Matulski, an Arcadia resident, appeared and discussed the Zoning Code initiative and the
formulas and calculations used by other cities.
Burton Brink, an Arcadia resident, appeared and congratulated Mr. Segal on his appointment to
the City Council; he indicated that he understands that money is needed to run the City; he
indicated that he was "duped" into signing the Utility Users Tax petition, and apologized to Mr.
Ortiz for signing the petition; and indicated that he will be voting no on the Utility User Tax repeal —
measure, and urged Arcadia residents to also vote no.
April Verlato, an Arcadia resident, appeared and congratulated Mr. Segal on his appointment to
the City Council; she indicated that she appreciated Mr. Segal's comments and commitment to a
Zoning Code update; she indicated that she would like to see a moratorium on demolition
permits being issued; she asked how a historical survey of properties can be done when up to
200 demolition permits were issued in 2014, and that she would like to see those homes still
standing when the historical survey is done; she spoke about the number of signatures needed
to get the Zoning Code initiative on the ballot, and encouraged people to get involved and get
educated.
REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the
City Council related to meetings attended at City expense[AB 12341)
Council Member Segal clarified on the number of signatures required to place the Zoning Code
initiative on the ballot made by Ms. Verlato; he responded to misstatements made by Mr.
Tallerico regarding taxes and the Utility Users Tax repeal initiative, and indicated that the City
does not receive income taxes.
Mayor Pro Tem Chandler thanked the Arcadia Elks Lodge for hosting the Annual Fire and Law
Enforcement Appreciation Luncheon.
Council Member Tay announced that on October 10, he attended the Methodist Hospital Crystal
Ball along with City Manager Lazzaretto and City Clerk Glasco; he commented on the Zoning —
Code update and explained why it was stopped; and commented on the different setbacks in
surrounding cities that were listed in the City's newsletter.

Council Member Beck announced that the Arcadia Welfare and Thrift closed after 82 years, and
listed the different organizations that benefitted from the proceeds of the sale of the building; he
thanked the board members of the Arcadia Welfare and Thrift for their services to the community
and countless hours of volunteering and dedication; he noted that with the addition of Council
Member Segal to the City Council that things will take a turn for the better; he spoke about the
City Newsletter that Council Member Tay was referencing about residential development; he
announced Community outreach meetings on November 4 at Foothills Middle School and
November 12 at Holly Avenue School; and acknowledged that there is a problem with
development in the City and indicated that he is committed to solving it before the next election.
City Clerk Glasco announced various upcoming events in and around the City; and spoke about
a marriage ceremony he performed on the previous Saturday.
City Manager Lazzaretto announced that a special edition of the City's Newsletter will be mailed
out to all residents regarding codes in the City and frequently asked questions including
comparisons to other cities of the codes, and announced that this is the first of a public
education campaign supported by Mayor Pro Tem Chandler; he announced the community
meetings on November 4 at Foothills Middle School and November 12 at Holly Avenue School,
and described some of the different information the newsletter provides to the residents; and
welcomed Mr. Segal back to the City Council.
Mayor Kovacic thanked the staff for the special edition Newsletter; he thanked Arcadia Welfare
and Thrift for their contributions to Foothill Unity; he announced the 2015-16 Performing Arts
Center season programs; he asked City Manager Lazzaretto to look into the Haunted House in
the Highlands that Mr. MacDonnell mentioned during the public comment period.
Council Member Segal requested a study session regarding placing a moratorium on demolition
permits, and asked two City Council Members for support. Mayor Kovacic and Council Member
Beck supported Council Member Segal's request.
Mayor Kovacic continued and indicated that on Thursday an announcement will be made when
the Gold Line will be running and operational; he announced that the Arcadia Police Department
will be conducting a workshop at the Library on October 21 regarding how to stay safe; and he
congratulated Council Member Segal on his first grandchild.
1. CONSENT CALENDAR
a. Resolution No. 7090 granting an easement to the County of Los Angeles for
landscaping purposes in the Peck Road Water Conservation Park.
Recommended Action: Adopt
b. Resolution No. 7091 initiating an application requesting that the Los Angeles
County Local Agency Formation Commission (LAFCO) initiate proceedings for
reorganization of territorial boundaries between the County of Los Angeles and
City of Arcadia at the intersection of Duarte Road and Oak Avenue, and near the
intersection of Mayflower Avenue and Standish Street.
Recommended Action: Adopt
c. Contract with General Pump Company for inspection and rehabilitation of
Longden Well 1 in the amount of $107,600.

d. Contract with Vincor Construction, Inc. for the removal of underground unleaded
and diesel fuel tanks at Fire Station 106 in the amount of $91,424.97.
Recommended Action: Approve
It was moved by Council Member Tay, seconded by Council Member Segal, and carried on roll
call vote to approve Consent Calendar Items 1.a through 1.d.

2. CITY MANAGER
a. Amendment to the Professional Services Agreement with MIG, Inc., for the
restart of all portions of the Zoning Code Update Project and instruct
Architectural Resources Group, Inc. to proceed with the Historic Resources
Survey for all areas of the City.
Recommended Action: Approve
Assistant City Manager/Development Services Director Kruckeberg provided the staff report.
It was moved by Council Member Segal, seconded by Mayor Pro Tem Chandler, and carried on
roll call vote to approve an amendment to the Professional Services Agreement with MIG, Inc.,
in the amount of $54,970, and allocate an additional $20,000 for community information and
outreach efforts; and to instruct Architectural Resources Group, Inc. to proceed with the Historic
Resources Survey for all areas of the City.

b. Accept the Water and Sewer Rate Cost of Service Study and direct the Public
Works Services Department to follow Proposition 218 balloting procedures to
establish water and sewer rates, and conduct a Public Hearing at the December
15, 2015 City Council meeting. (Continued from October 6 meeting).

It was moved by Mayor Pro Tem Chandler, seconded by Council Member Tay, and carried on
roll call vote to accept the Water and Sewer Rate Cost of Service Study and direct the Public

meeting.
