HomeMy WebLinkAbout7103 RESOLUTION NO. 7103 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ESTABLISHING MORLAN PLACE UNDERGROUND UTILITY DISTRICT WHEREAS, the City Council of the City of Arcadia, at its regular meeting of December 15, 2015, held a public hearing at the hour of 7:00 o'clock p.m., in the City Council Chambers at the City Hall, Arcadia, California, to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electric, communication or similar or associated service, within that certain area of the City shown on the map attached hereto as Exhibit "A" and described as follows: Morlan Place bounded as follows: The entire segment of Morlan Place as shown on Tract map No. 13768, recorded in book 273, page 37, of maps in the office of the County Recorder for the County of Los Angeles, California, bounded on the south by the prolongation of Morlan Place, 60-feet wide, southerly, 60-feet to the southerly line of Huntington Drive, as shown on said map; and on the east by the easterly prolongation of Morlan Place 60-feet wide, easterly, 100- feet to the easterly line of Santa Anita Avenue. WHEREAS, notice of such hearing was given to all affected property owners as such are shown on the last equalized assessment roll and to all utilities concerned in the manner and within the time required by law; and WHEREAS, such hearing was duly and regularly held, and all persons interested have been given an opportunity to be heard. -1- NOW, THEREFORE, THE COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That pursuant to Ordinance No. 1375 of the City of Arcadia, the above-described area is hereby declared an underground utility district and is designated as Morlan Place Underground Utility District in the City of Arcadia. SECTION 2. That the City Council of the City of Arcadia hereby finds and determines that the public necessity, health, safety, and welfare require the removal of poles, overhead wires and associated structures, and the underground installation of wires and associated structures, including without limitation wires and facilities for supplying electric, communication of similar or associated service in said area. SECTION 3. That the City Council does hereby fix June 30, 2016 as the date on which affected property owners must be ready to receive underground service, and does hereby order the removal of all poles, overhead wires, and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication of similar or associated service within Morlan Place Underground Utility District on or before December 31, 2019. SECTION 4. That the City Council finds and determines: a. That the undergrounding to be accomplished pursuant to this resolution will avoid or eliminate an unusually heavy concentration of overhead distribution facilities. b. That the street rights-of-way in said area are extensively used by the general public and carry a moderate volume of pedestrian and vehicular traffic. SECTION 5. That the following exceptions in said Morlan Place Underground Utility District are permissible and are hereby authorized: -2- a. Equipment appurtenant to underground facilities, such as surface mounted transformers, pedestals, mounted terminal boxes and meter cabinets, and concealed ducts. b. Temporary poles, overhead wires and associated overhead structures used or to be used in conjunction with construction projects. c. Poles and cables designated by the City of Arcadia for the purpose of hanging banners. SECTION 6. That the Southern California Edison Company has agreed to administer this project under the provisions of the California Public Utilities Commission Rule 20 B program and will subsidize the cost in an amount equal to the cost equivalent to overhead system, and the removal of the existing system. All remaining costs are the responsibility of the City of Arcadia. SECTION 7. That the City Clerk, within ten (10) days after the adoption of this Resolution, shall mail a copy hereof and a copy of Ordinance No. 1375 to affected property owners as such are shown on the last equalized assessment role and to the affected utilities. The City Clerk shall further notify such affected property owners of the necessity that the serving utility companies will provide all necessary facility changes on their premises so as to receive such service from the lines of the supplying utility or utilities at a new location. SECTION 8. That the City Clerk shall certify the adoption of this Resolution.
