HomeMy WebLinkAbout11/03/2015 ARCADIA CITY COUNCIL REGULAR MEETING MINUTES TUESDAY, NOVEMBER 3, 2015 CALL TO ORDER — Mayor Kovacic called the meeting to order at 7:05 p.m. INVOCATION - Pastor George Hooper, Church of the Good Shepard PLEDGE OF ALLEGIANCE —Tammy Tang, Arcadia High School Marching Band Drum Major ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Council Member Beck, Segal, Tay, Chandler, and Kovacic ABSENT: None REPORT FROM CITY ATTORNEY REGARDING STUDY SESSION ITEMS City Attorney Deitsch announced that a Special Meeting was conducted prior to the regular meeting to hear a report from staff concerning a possible moratorium on single family home development, and reported that the City Council considered the matter but took no action to place the item on a future City Council agenda; he also announced that the City Council heard a report from staff concerning the undergrounding of utilities on Morlan Place associated with the development of the Rusnak Mercedes-Benz expansion project, and reported that a motion was made by Council Member Segal, seconded by Mayor Pro Tem Chandler to authorize and direct staff to prepare an agreement for City Council approval that Rusnak Mercedes-Benz would pay $250,000 (1/4), and that the City would advance $750,000 (3/4) of the cost of undergrounding utilities on Morlan place with the City's (3/4) share being reimbursed to the City over time through sales tax receipts over and above the threshold amount $800,000 per annum of sales tax generated by the Rusnak Mercedes-Benz project in future years, and that the item passed (4-1) with Council Member Beck voting no. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto announced there was no supplemental agenda information; and introduced Carrie Gallagher, the City's new Deputy City Clerk. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Tay, seconded by Mayor Pro Tem Chandler to read all ordinances and resolutions by title only and waive the reading in full. PRESENTATIONS a. Presentation of Mayor's Certificate of Commendation to the Arcadia Historical Society in appreciation for their efforts in renovating a new office space at Prince Erik Hall. View full version of this City Council meeting 1 11/03/2015 b. Presentation of Proclamation to Vince and Dolores Foley for their years of service — to the community. c. Presentation of Proclamation to Arcadia Music Club in celebration of the 62nd Annual Arcadia Festival of Bands. d. Administer the Oath of Office to newly appointed Arcadia Beautiful Commission Member. PUBLIC COMMENTS Stuart Reeves, an Arcadia resident, appeared and spoke in support of maintaining the City's Utility Users Tax; he noted the many services currently enjoyed in the City, and noted that this is a small price to pay for the services the residents enjoy. Domenico Tallerico, an Arcadia resident, appeared and referenced earlier comments that he misspoke; he cited an article that he had previously referenced referring to facts he had shared; and agreed to a debate as previously suggested by Council Member Segal, but requested such debate be held closer to the election. Carolyn Papp, an Arcadia resident, appeared and shared her appreciation regarding the motion made for a moratorium on single family home development until the Zoning Code Update is completed; she commented on the budget for the Zoning Code Update; and noted an article in a local publication regarding the individuals that were selected to participate on the zone change committee. Roy McMeen, an Arcadia resident, appeared and spoke about the vote taken to stop the Zoning Code Update, and believes the fees involved and the cost to restart and complete the study should not be paid for by the taxpayers. Lawrence C. Papp, an Arcadia resident, appeared and thanked Council Member Segal in his efforts to resolve the Highlands lawsuit; he complimented Police Chief Guthrie for diffusing a situation in the City that could have been worse, and mentioned an incident when the Arcadia Fire Department saved his life; he requested clarification of the cost paid by residents for services received through utility taxes; and requested the City look at reducing costs other ways instead of reducing or eliminating services. John S. MacDonnell, an Arcadia resident, appeared and indicated that Council Member Segal did the job he was appointed to do; he referenced an incident that occurred in the Council Chambers at the last City Council meeting where a cell phone was shoved in his face making him feel very uncomfortable; he urged citizens to vote and, indicated that citizens should not complain if they don't vote. April Verlato, an Arcadia resident, appeared and thanked City Council Member Segal for his efforts to try to bring the community together; she indicated that 3,000 signatures are needed to have the initiative placed on the ballot, and noted the benefits to the City if it passed. 2 11/03/2015 REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense CAB 123411 Council Member Beck congratulated those who were recognized earlier during presentations; he announced the Veteran's Day Recognition on November 6 at the Community Center, the new Arcadia Street Fair on November 7, the opening of a time capsule on November 12 at the Chamber of Commerce; and announced Mayor Kovacic's Birthday on November 16; he referenced a special meeting held earlier regarding a possible moratorium on building and indicated that it did not pass; and again asked for City Council support in placing on a future agenda for discussion, an item regarding a ban on single use plastic bags, Mayor Kovacic and Council Member Segal concurred. Council Member Tay clarified his vote on the Zoning Code study because of the Save the Arcadia Highlands lawsuit; he noted that the appreciation of property values has no direct impact on him personally; and indicated that residents should talk to their insurance agents if they have a legal non-conforming property. Mayor Pro Tem Chandler indicated that honoring the Foleys should make us all realize that when we move out of Arcadia, new people replace us, and that life goes on. Council Member Segal also commented on Vince and Dolores Foley moving out of Arcadia, and mentioned that Mr. Foley helped with his past election campaigns and would not have not been elected without the Foleys; and challenged Mr. Tallerico if he can find a city in the San Gabriel Valley who reduced their revenue 12.5% and never cut any services to their residents, because that is what the UUT initiative will do, and to return to the next City Council meeting and bring back his findings. City Manager Lazzaretto noted a 30% water reduction in the City for the month of October and provided suggestions to residents on how to help with additional water saving measures; he noted fines that were handed out by the State last month to cities who had not met their reduction goals; and mentioned that the City will be providing information and taking input from residents at the community meetings on the Zoning Code Update scheduled for November 4 and November 12. City Clerk Glasco announced that the Daughters of the American Revolution are celebrating 125 years nationally, and 65 years in Arcadia, and indicated that this past Saturday he presented the Mayor's proclamation at their event; he presented a brief PowerPoint presentation on the Vietnam War Monument fundraising efforts; he announced the Recreation Department's Veterans Day luncheon; he provided information on which local restaurants are offering free meals to veterans with proper identification; and thanked all servicemen and women. Mayor Kovacic noted that City Clerk Glasco also served in Vietnam, and thanked him for his service; he announced additional Veteran's Day events around the City; he thanked the Foleys for their work in the City, and also noted that Vince Foley helped him and Mr. Chandler with their election campaigns, and they will be missed; he announced a letter that he received from former Mayor Dr. Chang regarding the Police Department's efforts in recovering his stolen vehicle; he announced that Foothill Unity Center needs turkeys and donations can be made to any local Foothill Unity Center; he commented that the Zoning Code Update should not have been stopped because of the lawsuit and noted that one had nothing to do with the other, and it is time to move on. 3 11/03/2015 I. CONSENT CALENDAR a. Special and Regular Meeting Minutes of October 6, 2015. Recommended Action: Approve b. Agreement with the County of Los Angeles to document the roles and responsibilities of the City and County with respect to the County's Traffic Signal Synchronization Program ("TSSP") along arterial routes in the City. Recommended Action: Approve c. Final Map No. 72322 for an eight-unit residential condominium subdivision at 610- 612 S. Second Avenue. Recommended Action: Approve d. Extension to the contract with Sheldon Mechanical Corporation for HVAC preventative maintenance services at various City facilities in the amount of $138,984. Recommended Action: Approve e. Street closures for Festival of Bands Parade. Recommended Action: Approve f. Purchase of IBM i2 Coplink Data Source Integration Services from IBM for the Police Department in the amount of$39,535. Recommended Action: Approve g. Ordinance No. 2330 amending Division 4, Chapter 5, Part 5 of Article VII of the Municipal Code regarding Water Efficient Landscaping requirements. Recommended Action: Adopt h. Request for Budget Appropriation of Inmate Program Trust Account for Fiscal Year 2015-16. Recommended Action: Appropriate and Approve Letter of support for the Los Angeles 2024 Olympic Bid Committee's efforts to bring the games to Los Angeles. Recommended Action: Authorize the Mayor to sign and submit a letter of support on behalf of the City of Arcadia It was moved by Council Member Segal, seconded by Mayor Pro Tern Chandler, and carried on roll call vote to approve Consent Calendar Items 1.a through 1.i. Ordinance No. 2329 amending Section 4280 of Part 8, Chapter 2 of Article IV of the Arcadia Municipal Code regarding Library Rules and Enforcement. Recommended Action: Introduce 4 11/03/2015 Director of Library & Museum Services Hayes provided the staff report. It was moved by Mayor Pro Tern Chandler, seconded by Council Member Beck, and carried on roll call vote to introduce Ordinance No. 2329 amending Section 4280 of Part 8, Chapter 2 of Article IV of the Arcadia Municipal Code regarding Library Rules and Enforcement. AYES: Council Member Chandler, Beck, Segal, Tay, and Kovacic NOES: None b. Arcadia Transit Service Needs Assessment and Restructuring Plan Final Report. Recommended Action: Approve the Report's Policy Recommendations; and authorize staff to proceed with the implementation of the recommended service improvements Assistant City Manager/Development Services Director Kruckeberg and Transportation Services Manager Hui provided the staff report. In response to Mayor Kovacic's inquiry whether there was a system currently in place in another city, Mr. Kruckeberg invited Steve Wilks, of IBI Group to provide additional information to the City Council. It was moved by Mayor Pro Tern Chandler, seconded by Council Member Tay, and carried on roll call vote to accept and approve the Arcadia Transit Service Needs Assessment and Restructuring Plan Final Report and authorize staff to proceed with the implementation of the recommended service improvements.
