The obligations, burdens and benefits contained in this Grant of Easement shall run with the land and shall be binding upon the Grantor and Grantee and their respective successors and assigns. 03 3573388 This Easement shall continue in force and effect in perpetuity until (i) affirmatively terminated by the parties, or (ii) this Easement is abandoned by the City. For purposes of this Easement, it shall be presumed by the Parties that the Easement is "abandoned" when the City fails to use the property described above for a period of one (1) continuous year.
