HomeMy WebLinkAbout12/15/2015 ARCADIA CITY COUNCIL REGULAR MEETING MINUTES TUESDAY, DECEMBER 15, 2015 CALL TO ORDER— Mayor Kovacic called the meeting to order at 7:00 p.m. INVOCATION - Reverend Darwin Ng, First Church of the Nazarene of Pasadena PLEDGE OF ALLEGIANCE — Brian Ursettiei, Arcadia Fire Department Firefighter ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Council Member Beck, Segal, Tay, Chandler, and Kovacic ABSENT: None REPORT FROM CITY ATTORNEY REGARDING STUDY SESSION ITEMS City Attorney Deitsch announced that a Special Meeting was conducted prior to the regular meeting to hear a report from staff concerning (a) scope and cost estimates for the Baldwin Avenue streetscape project from Huntington Drive to Camino Real Avenue, and reported that the City Council directed staff to prepare and bring back for City Council consideration budget optional items including lighting and funding sources to pay for the project; and (b) that the City Council discussed and heard a report from staff concerning a potential city-sponsored ballot initiative, and reported that the City Council took no action to place any potential city-sponsored ballot initiative on the April 12, 1016 ballot. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto announced that supplemental information distributed to the City Council prior to the meeting was regarding Public Hearing Item 1.b (56 West Duarte Road): two letters of objection were received from the Villa Christina Homeowners Association; and revised language to the first Condition of Approval, which allows the developer more flexibility in leasing for the project. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Tay, seconded by Mayor Pro Tern Chandler to read all ordinances and resolutions by title only and waive the reading in full. PRESENTATIONS a. Presentation by Museum Foundation President Floretta Lauber regarding the Gilb Museum and Museum Foundation. Floretta Lauber, Museum Foundation President appeared and reported on Foundation activities; and advised that a life like figure of Lucky Baldwin will be made to go with the life like figure of Anita Baldwin, which was previously completed; and she also provided information for anyone interested in making a donation to the Foundation. Resolution No. 7103 establishing Morlan Place underground utility district; and an agreement with Santa Anita LLC (Rusnak Arcadia Mercedes-Benz dealership) for cost sharing of the undergroundinq of overhead utilities on Morlan Place. Recommended Action: Adopt and Approve Deputy Director of Development Services/City Engineer Wray presented the staff report. Mayor Kovacic opened the public hearing. No one appeared. A motion to close the public hearing was made by Mayor Pro Tern Chandler, seconded by Council Member Segal, and seeing no further objection, Mayor Kovacic declared the public hearing closed. It was moved by Mayor Pro Tern Chandler, seconded by Council Member Tay, and carried on roll call vote to adopt Resolution No. 7103 establishing Morlan Place Underground Utility District; and approve an agreement with Santa Anita LLC (Rusnak Arcadia Mercedes-Benz dealership) for cost sharing of the undergrounding of overhead utilities on Morlan Place, and approve an appropriation of $750,000 (75%.of the $1 Million estimate) with an increase of up to $200,000 (20% of total cost)for updated estimates. General Plan Amendment, zone change, and other entitlements related to a three-story Mixed-Use Commercial and Residential Development with 19,360 square feet of ground floor restaurant/retail space and 37 residential condominium units at 56 East Duarte Road, and adoption of a Mitigated Negative Declaration to comply with the California Environmental Quality Act. Ordinance No. 2331 amending the Zoning designation of certain property within the City From C-2, General Commercial, To MU, Mixed-Use at 56 E. Duarte Road. Recommended Action: Introduce Resolution No. 7100 amending the General Plan Designation of certain property within the City from commercial to Mixed-Use at 56 E. Duarte Road. Recommended Action: Adopt Resolution No. 7101 approving Conditional Use Permit No. 15-02, Architectural Design Review No. ADR 14-23, and Tentative Tract Map No. TTM 73453 and a Mitigated Negative Declaration under the California Environmental Quality Act ("CEQA")for a three-story, Mixed-Use Development at 56 E. Duarte Road. Recommended Action: Adopt Assistant City Manager/Development Services Director Kruckeberg and Economic Development Analyst Tim Schwehr provided the staff report. Mayor Kovacic opened the public hearing. 2 12/15/2015 Michael Hastings, Direct Point Advisors, representing the applicant, appeared and addressed the size and square footage of the project, and alley setbacks and privacy issues, and the telephone pole situation; he discussed the live-work environment; he also indicated that he met with the church regarding security and parking issues; and also addressed shopping carts, and the Villa Christina Homeowners Association objections. Doug Meyer, an Arcadia resident, appeared and expressed his support of the project; he indicated that the project would be a great addition to the neighborhood; and strongly encouraged the City Council to approve the project. . Brian Abernathy, representing Abernathy Insurance, a neighbor, appeared and expressed his support of the project. Leah Newsom, representing the Villa Christina Homeowners Association, appeared and expressed her concerns that the project is too big for the space. David Leong, an Arcadia resident, appeared and shared various concerns of the neighboring church about the project, and proposed conditions regarding a shared parking agreement with the developer. Jane Hu, an Arcadia resident, appeared and expressed her objections and concerns regarding privacy, and the proposed business hours of the project. Mr. Hastings, representing the applicant, appeared and addressed comments and concerns made by the speakers. A motion to close the public hearing was made by Mayor Pro Tem Chandler, seconded by Council Member Tay, and seeing no further objection, Mayor Kovacic declared the public hearing closed. Assistant City Manager/Development Services Director Kruckeberg discussed the revised Conditions of Approval. Mayor Kovacic re-opened the public hearing in order to allow Mr. Hastings to respond to the additional Conditions of Approval as proposed by the City Council. A motion to close the public hearing was made by Mayor Kovacic, seconded by Council Member Beck, and seeing no further objection, Mayor Kovacic declared the public hearing closed. It was moved by Mayor Pro Tem Chandler, seconded by Council Member Tay, and carried on roll call vote to introduce Ordinance No. 2331 amending the Zoning designation of certain property within the City from C-2, General Commercial, to MU, Mixed-Use at 56 E. Duarte Road. AYES: Council Member Chandler, Tay, Beck, Segal, and Kovacic NOES: None It was moved by Mayor Pro Tem Chandler, seconded by Council Member Tay, and carried on roll call vote to adopt Resolution No. 7100 amending the General Plan Designation of certain property within the City from commercial to mixed-use at 56 E. Duarte Road. 3 12/15/2015 AYES: Council Member Chandler, Tay, Beck, Segal, and Kovacic NOES: None Assistant City Manager/Development Services Director Kruckeberg went over the suggested changes to the Conditions of Approval as directed by the City Council. It was moved by Mayor Pro Tem Chandler, seconded by Council Member Tay, and carried on roll call vote to adopt Resolution No. 7101 approving Conditional Use Permit No. 15-02, Architectural Design Review No. ADR 14-23, and Tentative Tract Map No. TTM 73453 and a Mitigated Negative Declaration under the California Environmental Quality Act ("CEQA") for a three-story, mixed-use development at 56 E. Papp, an Arcadia resident, appeared and spoke about how the businesses in Arcadia benefit from the Utility Users Tax measure; and cited an inscription on a monument at West Point. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense CAB 1234)) Council Member Tay referred to an article in the Arcadia Weekly by Jim Helms regarding "Arcadia's Yesteryear and Today", and read a short bio on him; and wished everyone happy holidays. Council Member Beck wished everyone Happy Holidays and a safe New Year. 4 12/15/2015 Mayor Pro Tern Chandler commented on the employee holiday party; and recognized Public Works Services Department employee Dave McVey for his 35 years of service to the City; and wished everyone Happy Holidays. Council Member Segal wished everyone Happy Holidays and a Happy New Year. City Manager Lazzaretto wished everyone Happy Holidays and a Happy New Year; he announced a Special City Council meeting on January 5, 2016 at 8:00 a.m. regarding medical marijuana dispensaries; and reminded residents that during the holiday season residents should remember to get packages off the front porch and in the house as quickly as possible. City Clerk Glasco announced the all mail ballot election on Tuesday, April 12, 2016, and noted that the nomination period for City Council and City Clerk begins on Monday, December 21 and closes on Friday, January 15, 2016; and wished everyone Happy Holidays and Happy New Year. Mayor Kovacic recalled the tree lighting and dedication ceremony; he thanked Kristen Olafson, Connie Schacatano and Mary Buttice in the City Manager's office for organizing the event; and announced that on March 5, 2016, the Gold Line train is coming; and wished everyone Happy Holidays and a Happy New Year. 2. CONSENT CALENDAR a. Regular Meeting Minutes of November 17, 2015. Recommended Action: Approve b. Contract with Pacific Coast Elevator Company dba Amtech Elevator Services for the library elevator upgrade project in the amount of $57,500. Recommended Action: Approve c. Donation of $10,000 from the Arcadia Museum Foundation for artifacts, supplies, and programming at the Gilb Museum of Arcadia Heritage. Recommended Action: Accept d. Purchase of hardware and licensing from Siqmanet for the Police Department's PS.NET/CAD upgrade project in an amount not to exceed $70,000. Resolution No. 7099 establishing wage adjustments for unrepresented, non- benefited, part-time employees in accordance with California's minimum wage increase effective January 1, 2016. Recommended Action: Adopt City Manager Lazzaretto and Administrative Services Director Quach provided the staff report. 5 12/15/2015 It was moved by Council Member Segal, seconded by Council Member Tay, and carried on roll call vote to approve Resolution No. 7099 establishing wage adjustments for unrepresented, non-benefited, part-time employees in accordance with California's minimum wage increase effective January 1, 2016. AYES: Council Member Segal, Tay, Beck, Chandler, and Kovacic NOES: None b. Special Use Permit No. Sup 15-26 to allow an Asian American Lunar New Year Festival in downtown Arcadia on January 24, 2016. Recommended Action: Conditional Approval Assistant City Manager/Development Services Director Kruckeberg provided the staff report. Matt McSweeney, Treasurer of the Arcadia Improvement Association, appeared and indicated that they have been working with EDI Media to put the Lunar Festival together and feels that it will be a good event. Albert, Marketing Director for EDI Media, appeared and provided background information regarding EDI Media. It was moved by Council Member Segal, seconded by Mayor Pro Tern Chandler, and carried on roll call vote to approve Special Use Permit No. SUP 15-26 to allow the Asian American Lunar New Year Festival in Downtown Arcadia on January 24, 2016, subject to the Conditionals of Approval.
