HomeMy WebLinkAboutBoyle Enginerring Corporation - 1995AGREEMENT FOR CONSULTING SERVICES THIS AGREEMENT FOR PROFESSIONAL SERVICES (hereinafter referred to as "Agreement ") is made and entered into this L0' day of J-V 1995, by and between the CITY OF ARCADIA, a municipal corporation, (hereinafter referred to as "Arcadia ") and Boyle Engineering Corporation (hereinafter referred to as "Consultant "). RECITALS WHEREAS, Arcadia has selected Boyle Engineering Corporation to undertake the professional services as fully described in Exhibit "A" (copy attached) for the preparation of the Sewer and Drainage Master Plans; and WHEREAS, Consultant represents that it has experience and technical competence to act as Consultant to Arcadia's Staff for the services required by this contract. NOW THEREFORE, the parties agree as follows: 1. REPRESENTATIVE OF THE PARTIES AND SERVICE OF NOTICE The representatives of the parties who are primarily responsible for the administration of this Agreement and to whom formal notices, demands and communications shall be given, are as follows: All notices and written communications sent to Arcadia under the Agreement shall be sent to the following address, unless authorized to be sent elsewhere by Arcadia: CITY OF ARCADIA Attn: William R. Kelly, City Manager 240 W. Huntington Drive Arcadia, CA 91007 All communications sent to Consultant shall be sent to: BOYLE ENGINEERING CORPORATION Attn: Harvey Gobas, Managing Engineer 660 S. Figueroa Street, Suite 1000 Los Angeles, CA 90017 -3452 Any such notices and written communications by mail shall be conclusively deemed to have been received by the addressee five (5) days after the deposit thereof in the U.S. Mail, first - class postage and properly addressed as noted above, or upon actual receipt thereof if delivered by personal service. DESCRIPTION OF WORK Arcadia hereby engages Consultant, and Consultant accepts such engagement, to perform the services set forth in the attached Exhibit "A" incorporated as part of this agreement; Arcadia's principal representative or the representative's designee, shall have the right to review and inspect the work during the course of its performance at such times as may be specified by the representative. 3. COMMENCEMENT AND COMPLETION OF WORK A. The execution of this Agreement by the parties constitutes an authorization to proceed, unless otherwise provided by the terms of this Agreement. B. The work described in Exhibit "A" shall be completed in accordance with the schedule set forth in Exhibit "C" or as otherwise agreed upon in writing by amendment to this Agreement. 4. DATA PROVIDED TO CONSULTANT Arcadia shall provide to Consultant to the extent feasible all data, including reports, records, and other information, as requested by Consultant to perform this agreement: Consultant shall be expected to rely upon the accuracy-of the data provided without independent review or evaluation. 5. OWNERSHIP OF DOCUMENTS All files, records, reports, studies, and other - documents prepared or obtained by this Agreement shall be the property of Arcadia. Basic notes, computations, computer diskettes and similar data prepared or obtained by Consultant under this Agreement shall, upon request, be made available to Arcadia without restriction or limitation on their use. Consultant shall deliver such materials to Arcadia according to the terms of this Agreement. Consultant shall have -the right to make duplicate copies of such materials and documents for his /her files as may be authorized in writing by Arcadia. 6. RELEASE OF INFORMiATION All information gained by Consultant in performance of this Agreement shall not be released by Consultant without Arcadia's prior written authorization. Confidentiality and disclosure shall be subject to the California Public Records Act (Government Code Section 6250, et. seq). 2 7. CONFLICTS OF INTEREST Consultant covenants that neither they nor any officer or principal of their firm have any interest in, nor shall they acquire any interest, directly or indirectly which will conflict in any manner or degree with the performance of their services hereunder. Consultant further covenants that in the performance of this Agreement, no person having such interest shall be employed by them as an officer, employee, agent, or subconsultants (see warranty - Section 15). 8. COMPENSATION A. Consultant agrees to provide the services set forth in the attached Exhibit "A" hereto, for a fee based on time and materials not -to- exceed ONE HUNDRED SIXTEEN THOUSAND EIGHT HUNDRED AND TWENTY DOLLARS ($116,820). Should Arcadia request, in writing, that Consultant to perform additional work and services beyond those required under this Agreement, compensation for such services shall be on a time and material basis as outlined in Exhibit "B" attached hereto and made a part hereof. B. On or before the tenth (1.0th) day of each calendar month following the commencement of the work, Consultant shall cause to be made and submitted to Arcadia a written value of the time for all work completed and materials incorporated into the project up to the first day of that month. If Arcadia requests, the consultant shall provide Arcadia along with the invoice, copies or verification of all work performed for which Arcadia is being invoiced. In reviewing and approving such invoice, Arcadia may consider, in addition to other facts and circumstances, the relationship of the work completed to the work remaining to be done. Arcadia shall have the right to retain ten percent (10 %) of the estimated cost of the work as partial security for Consultant's performance of this Agreement. Within thirty (30) days after approval of Consultant's invoice, Arcadia shall pay to Consultant that balance of such invoice after deducting therefrom all prior payments and all sums to be retained as partial security under the terms- of this Agreement. C. Upon satisfactory completion of all work and services described in Exhibit "A ", and Arcadia's approval thereof, Arcadia shall pay Consultant for the total amount remaining due for each increment or phase of the work, including all funds retained as partial security. Final payment shall be made by Arcadia to Consultant within thirty (30) days after Arcadia's written acceptance of the work. D. EXTRA SERVICES. If after work commences pursuant to this Agreement, it becomes apparent that additional work not originally contemplated as within the scope of this Agreement may be necessary such as that shown on Exhibit "A ", or otherwise, if such services are performed, Consultant shall be compensated at Consultant's prevailing time and materials rate schedule as outlined in Exhibit "B ". The Consultant shall inform Arcadia in writing of the need for such additional work. No additional work shall be done without the prior written approval of Arcadia. 3 9. MANAGEMENT The City Manager or his designee the Deputy City Manager/Development Services Director shall represent Arcadia in all matters pertaining to the administration of this Agreement, including without limitation, coordination of all necessary meetings and conferences, and review and approval of all products submitted by the Consultant. Authority to enlarge the scope of services or change the compensation due to Consultant is subject to the approval of the City Council. 10. INDEPENDENT CONTRACTOR Consultant is and shall at all times be deemed to be an independent contractor and shall be solely responsible for the manner in which it performs the services required by the terms of this Agreement. Nothing herein contained shall be construed as creating the relationship of employer an employee, or principal and agent, between Arcadia and Consultant or any of the Consultant's employees or any subconsultants. Consultant assumes responsibility for the performance of services by its employees and any subconsultants as related to the services to be provided during the course and scope of their employment. 11. CONSULTANT'S PERSONNEL A. Consultant's personnel engaged in performing services requested under this Agreement shall be as designated in Consultant's proposal dated April 21, 1995. Any substitution of personnel requires Arcadia's written pre- approval, except in an emergency. Arcadia shall not act unreasonably. B. All services required under this Agreement shall be performed by Consultant, or under Consultant's direct supervision, and all personnel shall possess the qualifications, permits and licenses required by State and local law to perform such services. C. Consultant shall be solely responsible for the satisfactory work performance of all personnel engaged in performing services required by this Agreement, and compliance with all reasonable performance standards of the water /wastewater industry. D. Consultant shall comply with all federal and state statutes and regulations relating to the employer /employee relationship, including but not limited to, minimum wage, non- discrimination, equal opportunity, workers' compensation, hazardous /unsanitary or dangerous surroundings, the Fair Labor Standards Act, 29 U.S.C., 201, et. se g., and the Immigration Reform and Control Act of 1986 8 U.S.C. 245 (a). in 12.. SUBCONTRACTING, DELEGATION AND ASSIGNMENT This Agreement covers professional services of a specific and unique nature. Consultant shall not delegate, subcontract or assign its duties or rights hereunder, either in whole or in part; without the prior written consent of Arcadia. Any proposed delegation, assignment or subcontract shall provide a description of the services to be covered, identification and qualifications of the proposed assignee, delegee or subcontractor and an explanation of why and how the selection was made. 13. NON - DISCRIMINATION AND EQUAL EMPLOYMENT OPPORTUNITY A. In the performance of this Agreement, Consultant shall not discriminate against any employee, subcontractor, or applicant for employment because of race, color, religion, ancestry, sex, national origin, disabilities or age. Affirmative action relating to employment shall include, but not be limited to the following: employment, upgrading, demotion or transfer; recruitment; layoff or termination; rates of pay or other forms of compensation; and selection for training including apprenticeship. B. The provision of subsection A above shall be included in all solicitations or advertisements placed by or on behalf of Consultant for personnel to perform any services under this Agreement. Arcadia shall have access to all documents, data and records of Consultant and its subcontractors for purposes of determining compliance with the equal employment opportunity and non- discrimination provisions of this Section, and all applicable provisions of Executive Order No. 11246 which is incorporated herein by this reference. A copy of Executive Order 11246 is available for inspection and on file with Arcadia. 14. INDEMNITY AND INSURANCE A. HOLD HARMLESS INDEMNITY Consultant agrees to indemnify and hold harmless Arcadia, their officers, and employees from any claims, suits and liabilities for damage to person or property arising out of Consultant's errors, omissions or negligent acts. B. INSURANCE Consultant shall carry comprehensive liability insurance with combined single limits of at least $2,000,000.00 naming City of Arcadia as additional insured. Proof of such insurance in a form and content approved by Arcadia's City Attorney is a condition precedent to execution of this Agreement by Arcadia. Insurance shall be maintained with insurers listed "A" or better in the Best's Insurance Guide and be authorized to do business in the State of California. Consultant shall also maintain a professional liability insurance covering errors and omissions providing protection of at least $1,000,000 for errors and omissions with respect to losses, claims, and liability arising from negligent action of consultants in performing pursuant to this Agreement. 5 C. WORKERS' COMPENSATION AND EMPLOYER'S LIABILITY A program of Workers' Compensation insurance or state - approved self - insurance program in an amount, form and as broad as to meet all applicable requirements of the Labor Code of the State of California, including Employer's Liability with limits of at least $100,000 per occurrence. Should the Consultant be self - employed, he /she must certify under Section 3800 of the California Labor Code, the performance of the work for which this contract is issued is without employing any person in any manner so as to become subject to the Workers' Compensation Laws of California. 15. CONSULTANT'S REPRESENTATIONS Consultant represents to Arcadia as follows: A. Consultant has no knowledge that any officer or employee of Arcadia has any interest whether contractual, noncontractual, financial, proprietary or otherwise, in this transaction or in the business of the Consultant, and that if any such interest comes to the knowledge of Consultant at any time, a complete written disclosure of such interest will be made to Arcadia, even if such interest would not be deemed a prohibited "conflict of interest" under applicable laws. B. Upon the execution of this Agreement, Consultant has no interest, direct or indirect, in any transaction or business entity which would conflict with or in any manner hinder the performance of services and work required by this Agreement, nor shall any such interest be acquired during the term of this Agreement. 16. RESOLUTION OF DISPUTES (ATTORNEY FEES) A. Disputes regarding the interpretation or application of any provisions of this Agreement shall, to the extent reasonably feasible, be resolved through good faith negotiations between the parties. B. If any action at law or in equity is brought to enforce or interpret any provisions of this Agreement, the prevailing party in such action shall be entitled to reasonable attorney's fees, costs and necessary disbursements, in addition to such other relief as may be sought and awarded-. 17. MODIFICATION OF AGREEMENT The terms are subject to modification by mutual agreement between Arcadia and Consultant which such changes shall be incorporated by authorized written amendments to this Agreement. The parties agree that the requirements for prior written changes, amendments, or modifications to this Agreement may not be waived and any attempted waiver shall be void. C 18. TERMINATION A. Arcadia may terminate this Agreement without cause upon five (5) days written notice to Consultant to the address specified in this Agreement. Notice may include telephonic communication to Consultant to cease work. Should City terminate this Agreement, Consultant agrees to immediately discontinue performance and deliver to City the work which he has completed, including all maps, data, reports and like materials. Consultant shall receive a fee equal to an amount which bears the same relationship to the total fee payable pursuant to Section 8 that the amount of work performed by Consultant prior to such termination bears to the total work to be performed by Consultant to this Agreement. B. Arcadia may terminate this Agreement with cause effective immediately upon written notice of such termination to Consultant, based upon the occurrence of any of the following events: (1) Material breach of this Agreement by Consultant; (2)' Cessation of Consultant to be licensed, as required; (3) Failure of Consultant to substantially comply with any applicable federal, state, or local law or regulation; (4) Filing by or against. Consultant of any petition under any law for the relief of debtors; and (5) Filing of a criminal complaint against Consultant for any crime, other than minor traffic offenses. C. Work Product. In the event of termination, Consultant shall, at Arcadia's request, promptly surrender to City all completed work and work in progress and all materials, records, computerized information and notes developed, procured, or produced pursuant to this Agreement. Consultant may retain copies of such work product as a part of its record of professional activity. 19. ENTIRE AGREEMENT AND AMENDMENTS A. This Agreement supersedes all prior proposals, agreements and understandings between the parties and may not be modified or terminated orally. B. No attempted waiver of any of the provisions hereof, not any modification in the nature, extent or duration of the work to be performed by Consultant hereunder, shall be binding unless in writing and signed by the party against whom the same is sought to be enforced. 7 20. GOVERNING LAW This Agreement shall be governed by the laws of the State of California. 21. EFFECTIVE DATE This Agreement shall become effective as of the date set forth below in which the last of the l parties, whether Arcadia or Consultant, executes said Agreement. 22. COMPLETION DATE All work under this Agreement shall be completed within five (5) months of the City's written Notice to Proceed. Work shall progress in general compliance with the project schedule, attached hereto as Exhibit "C ". Upon satisfactory completion of all work under this Agreement, a written acknowledgement of said completion shall be provided to Consultant by City. 23. KEY PERSON It is acknowledged and agreed that the key person and contact for the performance of this Agreement is Gary H. Eikermann. No other person shall be substituted in this capacity, and said key person shall communicate directly with the City's Program Manager C. Stephen Bucknam Jr. He shall be available for contact by Arcadia and shall attend all meetings as requested by Arcadia, unless excused. 0 IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be executed and attested by their respective officers thereunto duly authorized. Hydraulic Analysis The sewer model will include all of the backbone system as in the previous Master Plan model as well as known deficiency areas as described below. For the hydraulic analysis, we do not anticipate the necessity to model every manhole, nor most of the existing CSD trunk facilities. However, we have presented as an optional task, the inclusion of all City sewers in the system modeling. Sewer loadings will be developed based on land use loading coefficients based on CSDLA criteria, and the sewer area tributary to a manhole. This information will be developed utilizing the polygon processing features of ArcCAD. Structures or activities which do not conform to standard land/area flow generations will be handled on a case by case basis using parameters like square footage, beds, plumbing fixtures, or dwelling units. After an initial run of the existing system is finished, we envision the desirability of flow monitoring sites to confirm deficiencies, establish a benchmark for prioritizing improvements and confirm peaking factors and major point source flows. At least one flow monitoring site would be required for each service area (approximately 15). If determined by City to be beneficial, monitoring will continue at each site for a period of one week to acquire data. This scope includes identification of monitoring sites and review of the data. Equipment and actual monitoring is assumed to be contracted for separately by the City and performed by others. Flow monitoring could impact the project schedule. Deficiency Analysis The purpose of the Deficiency Analysis is to evaluate known system deficiencies. The analysis will include a maintenance and repair planning program that will provide input in establishing an ultimate system scenario for modeling the impact of future improvements. According to the City, the sewer system has few hydraulic capacity problems. The Deficiency Analysis will summarize the recommendations from an operational standpoint, with input solicited from the operators of the system to obtain their perspective. Deficiencies will be analyzed using current criteria and standards. The Deficiency Analysis will be fast - tracked and conducted in conjunction with the hydraulic analysis and preparation of the Capital Facilities Plan. The effort will feature close coordination with City staff to identify and assess known problems, current O &M programs, and estimated costs. Included will be the following areas which have been identified by City staff for further evaluation: • Three freeway crossings, at Vaquero Road, Old Ranch Road, and Rancho Road. Microtunneling to be considered if replacement of 8" sewers is necessary. • Sewer alternatives at the Arboretum • "Downtown 2000" redevelopment. • All siphons. Backyard sewers at several locations north of I -210 Freeway and in Highland Oaks area. City unable to locate some manholes. The impact of SART facilities if they are not connected directly to CSD facilities. The hospital remodeling. Alternatives to the crossing at Rancho Road include providing a parallel crossing, and diverting flows to CSD facilities to the east. These and other problem areas will be evaluated considering: long term reliability, maintenance burden, and availability of access manholes. The hydraulic model will be helpful in developing recommendations for improvements to reduce problems in these areas. Solutions will be included in the Capital Facilities Plan. The hydraulic model will also identify deficiencies and determine replacement and parallel pipes to provide adequate conveyance capacity, to include a future development capacity scenario. Where opportunities for prospective system improvements are identified, recommendations will also consider relief projects, such as new connections to CSD facilities, or use of underutilized capacity in other local portions of the trunk system. ARC- EXTA.DOC 13OWLE Exhibit A (cost) Surcharging sewers identified by flow monitoring and/or City experience will be identified as top priority improvements. Other deficiencies will be determined and prioritized by comparing the ultimate and current depth to diameter ratios, the percent of ultimate flow being experienced, and known physical deficiencies. Specific deficiencies - identification work tasks include: • Conduct field trips with City operational staff to the three freeway crossings, the backyard sewers north of the freeway and in the Highland Oaks, and the Arboretum sewer. • Review the video tapes of the sewers for the freeway crossings, the backyard sewers, and the Arboretum sewer. • Investigate the possibility of rehabilitating the existing sewers at the three freeway crossings. • Conduct an analysis to determine alternatives to either relocate the sewer from the Arboretum or to rehabilitate (Insituform line or otherwise strengthen) the existing sewer. The City has already conducted a concept level study. • Examine increased maintenance opportunities to alleviate backyard sewer problems. It is recommended that the City negotiate right -of -entry with property owners for maintenance access. • Prepare preliminary cost estimates for each alternative. Capital Facilities Plan /Conceptual Cost Estimates The Capital Facilities Plan will include the proposed facilities developed through the deficiency analysis and hydraulic model including: relief systems, replacement sewers, parallel sewers, and upgrades to replace deteriorated system components. Cost estimates will be developed for proposed parallel and replacement sewers as revealed by the model. The estimates will be generated from the cost information and proposed improvements stored in the project database. Project concepts will be developed to the level required to estimate conceptual costs. Financing Strategy Reiter -Lowry Consultants (RLC) will perform an evaluation to determine workable options for developing a cash flow to fund needed sewer system improvements identified in the Capital F ?cilities Plan. A cursory evaluation of the nexus between fees and benefits is anticipated, but as directed, this scope does not include a detailed cost -of- service study resulting in a formal Financial Plan. Sewer System Mapping As a result of producing the Sewer Master Plan, the City will be provided with an AutoCAD file and associated database that contain numerous items of data for mapping such as: pipe number, node numbers, pipe size, record pipe slope, pipe roughness, sanitary loading, double line streets, street names, land use, future land use, sewer service areas, owner information, location with respect to centerline, City manhole numbering, year of installation, pipe material, as -built plan reference, rim elevation, invert elevations, direction of flow, calculated depth of cover, and encasement locations. Of these items, only those shown in italics are included for the hydraulic model. The remainder would be input as information becomes available for map information in anticipation of a future GIS system. Mapping is included for the backbone system as part of our basic services. Boyle has the capability of providing mapping in many useful computerized formats including: • Self contained viewing programs that fit on a single diskette and contain graphics and database information • Sophisticated GIS coverages designed for products like ArcView which allow graphical display of information based on the user's input. At the appropriate time an in -depth discussion of the City's needs coupled with a frank discussion of the different mapping costs would be beneficial. Boyle will provide the City with a product that meets current needs, and will be usable in the City's future GIS plans. ARC- EXTA.0032 Page 2 MOWLE - Exhibit A (coat) For a basis of comparison, we included a separate cost estimate for mapping in our basic services. This mapping effort would be done on a 400 scale base map with streets shown as double lines, as generated in the Water Master Plan. Information included on the map would be: pipe size, direction of flow, inverts at manhole centers and rim elevations, encasement locations, ownership, and a cross reference to "as- built" construction drawings. Our scope envisions the need for depth measurements at certain manhole locations but does not include detailed field survey to determine invert elevations. Because the base map does not contain street centerline, such data if shown would need to be called out by description. Our basic services scope includes mapping for the modeled facilities shown "in the streets." This mapping will be produced on approximately four (4) "D" size black and white mylar sheets. Optionally, the City may wish to have all of the facilities mapped. Also, this system would have the ability to produce field -book maps at any scale for ready reference by maintenance staff. Final Summary Report and Software Delivery Five copies of a final draft Sewer Master Plan will be submitted to the City for review. The Final Summary Report, which incorporates City comments, will then be submitted (30 copies). Sewer program software (BSWAN) will also be provided. Training. Basic services include 20 hours of training time to explain to the City staff the sewer program (BSWAN). Should the City opt to acquire the database application software (SEWPLAN), our training will encompass that feature. These two programs are very user - friendly and all that are necessary to run the model after it is established by Boyle. Optionally we can provide training on the use of ArcCAD or AutoCAD. :. General Inventory Field Review and Data Collection. Boyle staff will inspect the catchment of the City-owned facilities to observe the existing system. A photo -log will be prepared. Boyle will receive from the City the following: • Available sewer and drainage system operational records and mapping • Copies of previous Master Plans and related studies of the systems • Copies of pertinent ordinances and resolutions • Access to and prints of available as -built sewer and drainage system elements • Other information mutually agreed to be beneficial to the -work effort Boyle will coordinate with the staff of the City of Arcadia and the County of Los Angeles to obtain available information regarding deficiencies and aid the City in acquiring the County's available mapping of their facilities within the City. Deficiency Identification The majority of the storm drains in the City are owned and operated by the County of Los Angeles. However, approximately 4.1 miles of storm drains belong to the City. The storm drain system has performed well. In fact, in the recent heavy storms early this year, there were no reports of major flooding, except at the intersections of El Monte Avenue /Live Oak Avenue, Columbia Road/Drake Road, and 8`f' Avenue/Norman Avenue. The operations staff attribute these floodings to the surface drains not being at the proper grade. Specific work tasks include: ✓ Meet with the County to obtain information on the County's drainage system and deficiencies within the City of Arcadia. ✓ Conduct a field trip with City operational staff to review the drainage facilities. ✓ Conduct an inventory of the drainage system, including the County facilities. ARC- EXTA.0032 Page 3 SOWLE - , Exhibit A► (cont) ✓ Determine the deficiencies in the City storm drain system due to change in design criteria. ✓ Prepare a preliminary cost estimate of the deficiencies for the City system only. ✓ Prepare a letter report summarizing the findings, conclusions, and recommendations. Hydrological Analyses Create Existing Storm Drain System Layers. Four AutoCAD -based format graphic layers of system information will be created to delineate the storm drain system and sizes, land use, soil groups, and rainfall. Create a Hydrologic Model Subarea Nodal Point and Flowpath Segment Layers. Using the existing Drainage Master Plan as a guide, modeling subareas will be developed for City approval. Each subarea will have approximately three to five nodal points for TC (time of concentration) estimation purposes. Nodes will be placed at all storm drain system confluences. The computer model will use nodal points with flowpath links. These nodes will be automatically linked to subareas. The nodes will be placed at major storm drain system catch basin lateral confluences with collector lines. Catch basins and laterals will not be modeled or evaluated. Nodal point numbering will be developed that could be linked to other GIS software in the future. Develop a Hydrologic Network Model. For each link used in a street section, a coupled street flow model and pipe flow model will be developed. It is understood that a single planning criteria will be used. For example: 10- year peak flow to top -of -curb (or other); 25 -year flow with one lane open in arterial streets. Compute Streetflow and Pipeflow Capacities, Hydrologic Estimates, and Annual Pollutant Loadings. Using the single streetflow criteria developed above, streetflow capacities, will be developed for each street link used in the model. For each existing storm drain link, a surcharged (flow in both the street and pipe) flow capacity will be computed. This data will be stored in a database. For the single design storm event, peak flow rates will be computed at all nodal points. This data will be stored in the database. As an option, NPDES annual pollutant loadings will be computed using the State of California Best Management Practices (BMP) Handbook. Estimate System Deficiencies and Develop Deficiency Mitigation. For each link used in the model, flow deficiency will be computed by comparing coupled streetflow plus pipeflow with the hydrologic estimates of peak flow rates. For each link, deficiency mitigation pipe systems will be determined as new, replacement, or parallel pipe elements. NPDES Compliance Review of Compliance with Existing NPDES Permit. The County of Los Angeles, in conjunction with the cities of Los Angeles County, were jointly issued a municipal NPDES stormwater permit (permit) by the Los Angeles Regional Water Quality Control Board (RWQCB) on June 18, 1990. This permit established requirements for the permittees to develop and implement baseline compliance programs. The City has identified Early Action and Additional Best Management Practices (BMPs) and is in the process of implementation. A review of the City's program to evaluate compliance with the permit will be conducted. A brief summary report summarizing findings of evaluation of the City's permit compliance program will be prepared. This report will include identification of compliance program needs and recommendations for future action including cost estimates for system upgrading. Specific compliance activities which will be evaluated will include: ✓ Compliance procedures and reporting methods (internal and external); ✓ Implementation schedules; ✓ Legal authorities (ordinances and regulations); and ✓ Other programs and materials as needed. Boyle team will provide field guidance and coordination for a City- contracted T.V. inspection which will identify maintenance problems as well as potential illegal connections or pollutant inflow points. This task will include review of videos produced from the survey. Capital Facilities Plan and Conceptual Cost Estimates and Financing Strategies Drainage deficiency mitigation improvements and costs, to include City's costs of meeting its NPDES responsibilities, will be developed. Preliminary design will be performed to the level necessary to identify conceptual -level costs. Alternative financing strategies will be discussed and presented in a brief report. This effort will draw upon the financing strategies developed in Boyle's experience from 33 other Master Plans as well as numerous Reiter -Lowry financial evaluations. Included will be consideration of setting up a stormwater drainage utility, and review of the applicable experience of such agencies as San Clemente; County of San Diego; Bellevue, Washington; and others. Updated Drainage System Maps Using the AutoCAD layers, a set of maps depicting the updated drainage system will be prepared. This will include at a minimum, size of pipe, catch basin data, direction of flow, ownership of facility, easement information, ties to centerline, and reference to as -built construction drawings. Again, field -book maps at any scale could be produced for utilization by maintenance staff. Final Summary Report, Software Delivery, Training Five copies of a final draft Master Plan of Drainage report will be submitted to the City for review. Upon incorporation of City comments, thirty copies of a Final Summary Report will be submitted to the City.
