Wray, Deputy Director of Development Services NJ By: Kevin Merrill, Senior Engineering Assistant SUBJECT: RESOLUTION 6751 DEDICATING CERTAIN CITY -OWNED PROPERTY ON MAGNOLIA COURT (ONE -FOOT CONTROL STRIP ON TRACT MAP 60096) FOR PUBLIC RIGHT -OF -WAY PURPOSES Recommendation: Adopt SUMMARY The City of Arcadia accepted a one -foot wide control strip in 2004, in Fee Ownership, along the south side of Magnolia Court as part of Tract Map 60096, a five -lot single - family residential subdivision at 1120 -1126 South Mayflower Avenue. The one -foot wide control strip was dedicated to legally deny access from 1202 South Mayflower Avenue to Magnolia Court. Recently a developer proposed a four -lot single - family residential subdivision comprising the properties at 1202 and 1206 South Mayflower Avenue and requested access to Magnolia Court. The developer of 1202 and 1206 South Mayflower Avenue has agreed to make the required improvements as per the conditions of approval for Parcel Map 71312 and has requested the City to dedicate the one -foot wide control strip for public right -of -way purposes. In consideration of the developer's proposed subdivision (Parcel Map 71312), staff recommends that the City Council dedicate a one -foot wide control strip as shown on Tract Map 60096 for public right -of -way purposes necessary to give the developer access to Magnolia Court. BACKGROUND Magnolia Court runs east and west between Mayflower Avenue and the City of Arcadia /Los Angeles County Boundary Line. It is located north of Camino Real Avenue Staff Report December 7, 2010 Page 2 on the east side of Mayflower Avenue. More specifically, Magnolia Court is approximately 300 -feet long and currently provides access to five (5) single - family residential lots to the north. Due to separate property ownership, the two adjacent parcels of 1202 and 1206 Mayflower Avenue, were not included as part of the subdivision in 2004, which created Tract Map 60096. At that time, the developer was required to grant the City of Arcadia a one -foot wide strip of land in "Fee Ownership" across the south side of Magnolia Court, which in essence denied access to Magnolia Court from the landowner at 1202 Mayflower Avenue. DISCUSSION It has been past practice of the City of Arcadia to use one -foot wide control strips to restrict access to City streets from certain adjacent properties and require developers to make necessary improvements through the City's development approval process prior to allowing access to any City street. At its June 8, 2010 meeting, the City Planning Commission approved Tentative Parcel Map 71312 a four -lot, single - family residential subdivision at 1202 and 1206 Mayflower Avenue. The new subdivision completes an existing one -sided cul -de -sac and all four Tots are consistent with the City's subdivision requirements and General Plan. An Agreement for the Completion of Public Improvements accompanied by Faithful Performance and Payment Bonds was entered into on November 10, 2010 between the City of Arcadia and Dexter Mayflower, LLC (the developer) which insures the public improvements will be completed to the satisfaction of the City Engineer. Currently, the City has fee ownership of the one -foot wide control strip across the south side of Magnolia Court that legally blocks access of 1202 Mayflower Avenue to Magnolia Court. To facilitate the development of Parcel Map 71312, the City must dedicate said control strip for public right -of -way purposes. Enclosed with this report is Resolution 6751 that dedicates one -foot control strip on Tract Map 60096 for public right -of -way purposes upon the acceptance of all the public street improvements completed by the developer. FISCAL IMPACT There will be no fiscal impact incurred by the City. The subdivider has agreed to reimburse the City for administrative costs to process this dedication. ENGINEERING DIVISION RESOLUTION NO. 6751 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DEDICATIING CERTAIN CITY - OWNED PROPERTY ON MAGNOLIA COURT (ONE -FOOT CONTROL STRIP ON TRACT MAP 60096) FOR PUBLIC RIGHT -OF -WAY PURPOSES WHEREAS, a one -foot control strip on Tract Map 60096 was conveyed in fee to the City of Arcadia, at the time said map was recorded for the purpose of preventing access from property adjacent to said strip of land onto Magnolia Court until such time as the proper right -of -way improvements on Magnolia Court are made; and WHEREAS, Parcel Map 71312 is now ready for approval and the developer of Parcel Map 71312 has agreed to make improvements to the right -of -way adjacent to Lots 1 to 4 on said map in order to allow access from Lots 1 to 4 onto Magnolia Court. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That certain property located in the City of Arcadia, County of Los Angeles, State of California, which constitutes a one -foot control strip as described on the attached Exhibit "A" and shown on Exhibit "B ", is hereby dedicated for public right -of -way purposes, effective upon the acceptance by the City of Arcadia of all of the public right -of- way improvements completed on the southerly side of Magnolia Court. SECTION 2. The City Clerk shall certify to the adoption of this Resolution. Passed, approved, and adopted this day of 2010.
