Wray, Deputy Director of Development Services /City Engineer N; Prepared by: Tim Kelleher, Assistant Engineer SUBJECT: ACCEPTANCE — 21 MORLAN PLACE PARKING LOT Recommendation: Accept all work performed by Panorama General Engineering Inc. for the paving of the lot at 21 Morlan Place as complete and authorize the final payment to be made in accordance with the contract documents In September of 2008, the Redevelopment Agency purchased the property at 21 Morlan Place from the Church in Arcadia to facilitate the expansion of the Rusnak /Arcadia Mercedes -Benz dealership. In February 2009, the Church in Arcadia moved out of the building into temporary facilities while they pursue the construction of their new building at 630 East Live Oak Avenue. In September 2009, the City demolished the Church in Arcadia building making way for the construction of a new parking lot. On December 1, 2009, the Redevelopment Agency Board awarded a contract for the paving of the lot at 21 Morlan Place to Panorama General Engineering, Inc. in the amount of $191,000, which included a 10% contingency for the contract as well as additional contract management and inspection funding. There were two (2) change orders in the amount of $6,347.03 which increased the contract amount to $161,817.03. The terms and conditions of this project have been completed and the required work has been performed to staff's satisfaction for a final cost of $161,817.03. Staff recommends that the City Council accept the project as complete and authorize the final payment in accordance with the approved contract documents. The Redevelopment Agency has been working with Rusnak/Arcadia to assemble parcels to facilitate the expansion of its Mercedes -Benz Automobile dealership. The Chairman and Redevelopment Agency Board February 16, 2010 Page 2 property at 21 Morlan Place was owned by the Church in Arcadia and is directly east of the Rusnak property. In September of 2008, the Redevelopment Agency purchased the property from the Church in Arcadia and as part of the sale, included a site at 630 East Live Oak Avenue for the Church to relocate. In February of 2009, the Church moved out of the building at 21 Morlan Place into temporary facilities while their new building is being developed. On June 16, 2009, the Redevelopment Agency Board awarded a contract to demolish the Church in Arcadia building in preparation for construction of a parking lot. The building was removed in September 2009 which resulted in a dirt lot with a large hole from the former building's basement. As part of the fiscal year 2009/2010 Capital Improvement Program, the City Council appropriated $150,000 and an additional $41,000 on December 1, 2009 for the construction of the parking lot with the intent to make the lot available for Rusnak use. Staff drafted plans and specifications for the parking lot and advertised for bidders. On November 14, 2009 the City received 14 bids with Panorama General Engineering, Inc. being the low bid at $155,470. On December 1, 2009, the Agency Board awarded the contract to Panorama General Engineering in the amount of $155,470 with a 10% contingency to cover extra or unforeseen work and an additional $41,000 not covered by the original CIP budget. DISCUSSION Work began on January 4, 2010 and was completed by January 29, 2010. The project included substantial import backfill to fill in the hole left by the church basement. Also, there was an underground retaining wall along the easterly property line that required removal. Once the wall was removed and the hole filled, the contractor graded the lot to drain to an environmental bio -swale constructed along Morlan Place. Finally, the contractor paved the lot and re- constructed the chain link fence along the easterly property line. Overall, staff was very pleased with the contractor's performance relative to delivery and quality of work. There were two (2) change orders in the amount of $6,347.03 which increased the contract amount to $161,817.03. The first change order increased the quantity of asphalt concrete by $5,576.03. During the paving operation, it was decided to increase the length of a ramp connecting Rusnak's lot to this lot making the transition smoother. The second change order was for $771 to remove and replace additional sidewalk that was deteriorated. Chairman and Redevelopment Agency Board February 16, 2010 Page 3 FISCAL IMPACT The Redevelopment Agency Board approved a total project budget appropriation of $191,000 from available Redevelopment Agency reserves. There is adequate funds budgeted to cover engineering, construction, inspection, and materials testing. RECOMMENDATION That the Agency Board accept all work performed by Panorama General Engineering, Inc. for the paving of the lot at 21 Morlan Place as complete and authorize the final payment to be made in accordance with the contract documents.
