SUBJECT: ACCEPT ALL WORK PERFORMED BY SILVIA CONSTRUCTION, INC.
FOR THE ROAD REHABILITATION OF SANTA ANITA AVENUE FROM
LONGDEN AVENUE TO LIVE OAK AVENUE AS COMPLETE AND
AUTHORIZE THE FINAL PAYMENT TO BE MADE IN ACCORDANCE
WITH THE CONTRACT DOCUMENTS
Recommendation: Approve
On May 5, 2009, the City Council awarded a contract to Silvia Construction, Inc. in the
amount of $514,861.10, plus a 10% contingency, for the construction of the Road
Rehabilitation of Santa Anita Avenue from Longden Avenue to Live Oak Avenue. The
terms and conditions of this project have been complied with and the work has been
performed to staffs satisfaction for a total project cost of $529,890.34. This amount
reflects the original contract amount of $514,861.10 plus changes totaling $15,029.24 or
3% above the original contract amount.
Staff recommends that the City Council accept all work performed by Silvia
Construction, Inc. as complete and authorize the final payment to be made in
accordance with the contract documents.
On February 17, 2009, the President signed into law the American Recovery and
Reinvestment Act of 2009 (ARRA). ARRA provides $27.5 billion supplemental funding
to Federal Highway Administration (FHWA) projects to be apportioned to the states and
cities. City personnel submitted applications for three road improvement projects to the
California Department of Transportation (CALTRANS) and received approval for the use
of ARRA funds.

On May 5, 2009, the City Council awarded a contract to Silvia Construction, Inc. in the
amount of $514,861.10, plus a 10% contingency, for the construction of the Road
Rehabilitation of Santa Anita Avenue from Longden Avenue to Live Oak Avenue, the
first of the three ARRA funded projects. The terms and conditions of this contract have
been complied with and the work has been performed to staff's satisfaction. Therefore,
staff recommends that the City Council accept all work performed by Silvia
Construction, Inc. as complete and authorize the final payment to be made in
accordance with the contract documents, subject to a retention of $52,989.
In addition to the work originally covered by the contract, there were three (3) contract
change orders (CCO). The following reflects the change orders associated with the
project:

2 Additional contract work at contract unit prices $ 8,245.23
3 Additional piping and concrete encasement of surface drain $ 2,794.73
The final contract amount has been determined to be $529,890.34. This amount
reflects the original contract amount of $514,861.10, plus changes totaling $15,029.24
or 3% above the original contract amount.
FISCAL IMPACT
This project is funded 100% by Federal ARRA monies. State approval of the Program
Supplemental Agreement No. 009 -N allows reimbursement to the City of up to $600,000
for this approved project.
