Pursuant to Government Code Section 54956.9(a) to confer with legal counsel regarding the Workers' Compensation case of Gary Voss. b. Pursuant to Government Code Section 54956.9(a) to confer with legal counsel regarding the case of April Verlato, et al. v. City of Arcadia, et al. (Los Angeles Superior Court Case No. GC042729). RECONVENE CITY COUNCIL /REDEVELOPMENT AGENCY MEETING TO OPEN SESSION Mayor Wuo called the regular meeting to order in the Council Chamber at 7:00 p.m. INVOCATION Reverend Darwin Ng, First Church of the Nazarene of Pasadena PLEDGE OF ALLEGIANCE Carolyn Garner - Reagan, Director of Library and Museum Services ROLL CALL OF CITY COUNCIL /REDEVELOPMENT AGENCY MEMBERS: PRESENT: Council /Agency Member Amundson, Chandler, Harbicht, Kovacic and Wuo ABSENT: None REPORT FROM CITY ATTORNEY /AGENCY COUNSEL ON STUDY SESSION ITEMS City Attorney Jeffrey Ballinger reported that the City Council met in Closed Session to discuss the two (2) items listed on the posted agenda, no reportable action was taken. SUPPLEMENTAL INFORMATION FROM CITY MANAGER/EXECUTIVE DIRECTOR REGARDING AGENDA ITEMS The City Manager announced that there were no supplemental reports regarding agenda items. 01 -05 -10 MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Mayor Pro Tem /Agency Vice Chair Amundson, seconded by Council /Agency Member Chandler and carried on roll call vote to read all ordinances and resolutions by title only and waive the reading in full. PRESENTATION a. Presentation of Certificates to the Rose Queen and Court. PUBLIC COMMENTS - No one appeared. REPORTS FROM THE MAYOR, CITY COUNCIL AND CITY CLERK Council Member Kovacic commented on the Rose Parade and football game; he congratulated the Tournament of Roses and the Queen and Court and wished everyone a Happy New Year. Mayor Pro Tem Amundson announced the Santa Anita Japanese Assembly Center exhibit currently being displayed at the Historical Museum; he commented on the bear issue in Monrovia and on Monrovia Council Member Adams comments in the newspaper; he commented on the Santa Squad and the awards given and encouraged everyone to participate next year (a slide show of photographs were shown); he thanked Jim Barrows for playing Santa Claus; Vince Foley for driving the Arcadia Beautiful Commission and thanked everyone who participated. Council Member Chandler had no comments. 52:0002 Council Member Harbicht noted that in his opinion everyone has adjusted to the once a week trash pick up; and further noted that many residents leave their trash containers out after trash pick and suggested using volunteers to place notes on trash containers reminding residents of the code requirements. Council Member Kovacic suggested that the hangers should be in different languages and also include information regarding trash containers taken in by the trash services after pick up and should include the free service for disabled customers and seniors receive a 10% discount. City Clerk Barrows wished everyone a happy 2010 and thanked City staff for a job well done on the Santa Squad. Mayor Wuo wished everyone a happy new year and thanked the City staff for a great 2009 and a better 2010. The Mayor invited the Chief of Police Sanderson to provide a brief report regarding the early release of prisoners. Police Chief Sanderson noted that beginning January 25 the California Department of Corrections will begin an early release program of approximately 18,000 prisoners on summary parole through 2011; that 33% of those prisoners will be paroled to the Los Angeles County; he explained that the prisoners will have no parole supervision and no access to state funded mental health or substance abuse treatment; that 56% of state prisoners also report mental health problems and drug abuse history; he provided a brief summary of the overcrowding in the prison system including the federal court panel that ordered the release of the prisoners. He discussed medical and mental health treatment for prisoners already incarcerated and the change in the acceptance policy of new prisoners from municipal police 01 -05 -10 1. CONSENT CALENDAR REDEVELOPMENT AGENCY ITEMS: a. Approve the Meeting Minutes of December 15, 2009. Recommended Action: Approve CITY COUNCIL ITEMS: c. Approve the Meeting Minutes of December 15, 2009. Recommended Action: Approve 52:0003 agencies who require hospitalization; and explained the City's responsibility if a prisoner in custody at the Arcadia jail is taken to a local hospital for medical attention. In response to a question by Council Member Kovacic regarding the City paying the prisoners medical expenses, Chief Sanderson explained that the City is responsible and liable for that prisoner's health and welfare through the physical booking process and court appearance. b. Approve a plan to Expend Excess Surplus Funds in the Agency's Low and Moderate Income Housing Fund. Recommended Action: Approve d. Adopt Resolution No. 6708 accepting the dedication of non - vehicular access restrictions for the easterly lot line of Lot 2 of Parcel Map 71099 (Santa Anita Avenue Project). Recommended Action: Adopt e. Adopt Ordinance No. 2266 amending Article IX of the Arcadia Municipal Code to address assembly uses, schools, tutoring centers and the requirements for Conditional Use Permits for such uses, and to add a provision for reasonable accommodations of issues related to the Federal Religious Land Use and Institutionalized Persons Act. Recommended Action: Adopt f. Accept all work performed by Silvia Construction Inc. for the road rehabilitation of Santa Anita Avenue from Longden Avenue to Live Oak Avenue as complete and authorize the final payment to be made in accordance with the contract documents. Authorize the City Manager to execute a one (1) year Professional Services Agreement extension with John L. Hunter and Associates, Inc. for the Administration and Monitoring of the Municipal Stormwater (NPDES) and Industrial Waste Programs in the amount of $85,041. Recommended Action: Approve Tom Tait, Public Works Services Director explained the Clean Water Act and regulations relating to NPDES requirements for storm water discharge; he noted that all public agencies are required to implement programs and activities that reduce the discharge of pollutants found in storm water from entering U.S. Waters; he noted that the City's NPDES and Industrial Waste Program includes site inspections, plans checks and a public outreach program; and 61% of the programs cost are recovered through plan check and permit fees. Mr. Tait discussed a recent ruling by the Regional Water Quality Control Board to amend cities NPDES permits to include the Trash TMDL; that cities will now be responsible for installing and maintaining catch basin inserts into county owned catch basins. He reported that the City has approximately 250 catch basins and inserts have been installed into about 185 of them; that the County has about 700 catch basins in the City of Arcadia; and explained that putting the Trash TMDL into the NPDES permit would set a precedence that includes numeric limits which also means that the City would be out of compliance with the Trash TMDL. He noted that staff is working with the City Attorney to be added to the petition to the State Water Board against the recent ruling. Carmen Trujillo, Management Aide further explained the Clean Water Act in greater detail; that due to the complexity of the mandated program elements an environmental consultant with the expertise and experience to support the City with the implementation of an effective stormwater program. She noted that in 2008, John L. Hunter and Associates (JLH) was retained as a consultant to assist the City with the administration of the monitoring of the City's stormwater and industrial waste program; that JLH is reaching the end of their contract and has submitted a written offer to extend their services for an additional year with no increase in rates. She further noted that JLH continued to provide the City with expertise in the implementation of the City's stormwater and industrial waste program, provided information regarding water quality standards and new mandates, prepared the City's annual stormwater reports and conducted an annual review of the City's stormwater quality management program. She also noted that as part of last year's budget reductions, JLH did agree to a 7% reduction ($6,400) with no change in services and recommends a one year contract extension for the administration and monitoring of the Municipal Stormwater (NPDES) and Industrial Waste Programs in the amount of $85,041. It was moved by Council Member Harbicht, seconded by Council Member Chandler and carried on roll call vote to authorize the City Manager to execute a one (1) year Professional Services Agreement extension with John L. Hunter and Associates, Inc. for the Administration and Monitoring of the Municipal Stormwater (NPDES) and Industrial Waste Programs in the amount of $85,041. 01 -05 -10 ADJOURNMENT The City Council /Redevelopment Agency adjourned 7:55 p.m. to Tuesday, January 19, 2010, 5:30 p.m. in the City Council Chamber Conference Room located at 240 W.
