SUBJECT: RESOLUTION NO. 6732 AUTHORIZING THE SUBMITTAL OF THE
USED OIL PAYMENT PROGRAM (OPP) APPLICATION TO
CALRECYCLE
Recommendation: Adopt
The Department of Resources Recycling and Recover (CalRecycle), formerly the
California Integrated Waste Management Board (CIWMB), is responsible for
administering the Used Oil Payment Program (OPP). The City received notice from
CalRecycle to apply for a new Used Oil Payment Program (OPP) authorized by Senate
Bill (SB) 546 (Lowenthal) to continue with the City's Used Oil Recycling Program. The
Used Oil Payment Program (OPP) replaces the Used Oil Block Grant Program (UBG)
that the City has received for the past several years. With the change, the intent
remains the same, which is to assist local governments in developing and maintaining a
used oil recycling program for their communities.
Since the Used Oil Payment Program (OPP) is non - competitive and funding is based on
a per capita basis, the City of Arcadia only needs to submit an on -line application with
an adopted resolution that authorizes submittal of the application and the City Manager
or his /her designee to execute any agreement, contracts, and requests for payment
regarding this matter on behalf of the City.
The California Oil Recycling Enhancement Act (Act) mandates the Department of
Resources Recycling and Recovery or CalRecycle (formerly California Integrated Waste
Management Board) to allocate annual funding to assist local governments in
developing and maintaining an ongoing used oil and used oil filter collection /recycling
program for their communities. In 2009, Senate Bill (SB) 546 made changes to its used
oil grant programs. It replaced the Used Oil Block Grant Program (UBG) which the City
has received funding for the past several years into the new Used Oil Payment Program
(OPP).

The intent of the UBG program is similar to the OPP; however, some changes were
made most notably the following: Streamlining the application and administration
procedures; changing the funding from a reimbursable grant program (formerly Used Oil
Block Grant Program) to a one -time payment program (referred as the Used Oil
Payment Program); encouraging local governments to use at least 10% of their
individual funding on collection and recycling of used oil filters; expend received grant
funds within a 24 -month term.
For fiscal year 2010 -11, the City received notice from CalRecycle informing the City that
we needed to apply for the new Used Oil Payment Program (OPP). The on -line
application must be completed and a resolution must be adopted by the City Council in
order for the City to continue receiving grant funds from the new program. Additionally,
the application and resolution authorize the City Manager or his /her designee to execute
an agreement, contracts, and requests for payment regarding this matter on behalf of
the City.
The City of Arcadia has provided excellent services and educational information to
residents under the former Used Oil Block Grant Program. Currently, the City's Used
Oil Program provides Do- it- Yourself oil changing kits (that include a used oil container,
filter, changing mat, and used oil filter container), public education via the City's
newsletter and local publications such as the San Gabriel Valley News Group, and free
used oil residential curbside pick -up. The City's Used Oil Program aims to provide
residents with proper disposal methods of used oil rather than disposing used oil in
trash cans or in storm drains where it can contaminate our waterways and cause harm
to wildlife.
Therefore, staff recommends that the City Council adopt Resolution No. 6732
authorizing the submittal of the Used Oil Payment Program (OPP) application to
CalRecycle.
FISCAL IMPACT
The California Department of Resources Recycling and Recovery allocates funds based
on population via SB 546. For fiscal year 2010 -11, the City of Arcadia is expected to
receive approximately $14,000 which can only be used for used oil recycling related
activities.
RECOMMENDATION
Adopt Resolution No. 6732 authorizing the submittal of the Used Oil Payment Program
(OPP) application to CalRecycle.

RESOLUTION NO. 6732
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARCADIA, AUTHORIZING THE SUBMITTAL OF A USED OIL
PAYMENT PROGRAM (OPP) APPLICATION TO CALRECYCLE
WHEREAS, pursuant to Public Resources Code § 48690 the Department of
Resources Recycling and Recovery (CalRecycle), formerly known as the California
Integrated Waste Management Board, has established the Used Oil Payment Program
(OPP) to make payments to qualifying jurisdictions for implementation of their used oil
programs; and
WHEREAS, in furtherance of this authority CalRecycle is required to establish
procedures governing the administration of the Used Oil Payment Program; and
WHEREAS, CalRecycle's procedures for administrating the Used Oil Payment
Program require, among other things, an applicant's governing body to declare by
resolution certain authorizations related to the administration of the Used Oil Payment
Program.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1. The City Council authorizes the City Manager or his /her
designee, to execute in the name of the City of Arcadia all documents, including but not
limited to, applications, agreements, annual reports including expenditure reports and
amendments necessary to secure said payments to support our Used Oil Collection
Program.
SECTION 2. This authorization is effective until rescinded by City of
Arcadia.
