SUBJECT: ACCEPT ALL WORK PERFORMED BY JRN INC. FOR WILDERNESS
PARK SLOPE STABILIZATION AS COMPLETE AND AUTHORIZE THE
FINAL PAYMENT TO BE MADE IN ACCORDANCE WITH THE
CONTRACT DOCUMENTS
Recommendation: Accept
On June 16, 2009, the City Council awarded a contract to JRN, Inc. in the amount of
$368,590 plus a 10% contingency for the construction of the Wilderness Park Slope
Stabilization Project. The terms and conditions of this project have been complied with
and the work has been performed to staff's satisfaction for a total project cost of
$402,458.49. This amount reflects the original contract amount of $368,590 plus
changes totaling $33,868.49 or 9.2% above the original contract amount.
Staff recommends that the City Council accept all work performed by JRN, Inc. as
complete and authorize the final payment to be made in accordance with the contract
documents.
During heavy rainfall in January 2005, a portion of the backyard slope at 2248 Highland
Oaks Drive slid down onto the adjacent Wilderness Park Access Road. As a result of
the slide, the property owner filed a lawsuit for damages caused by the slide.
Subsequently, the City and the property owner entered into a settlement agreement
whereby the City agreed to construct a retaining wall and rebuild a more stable slope to
protect from further erosion.
The project was included in the City's fiscal year 2008/09 Capital Improvement Program
with a budget of $450,000. Plans and specifications were prepared in early 2009 and

the project was bid in May. Bids were opened on May 26, 2009 with the lowest bid of
$368,590 submitted by JRN Inc.
On June 16, 2009, the City Council awarded a contract for the Wilderness Park Slope
Stabilization to JRN Inc., in the amount of $368,590, and approved an additional
appropriation of $50,000 from the Capital Outlay Fund.
DISCUSSION
Work began on September 8, 2009 and was completed by January 15, 2010. The
project included construction of a retaining wall that consists of drilled concrete piles
embedded with steel columns and wood lagging installed between the steel columns to
a maximum height of 23 feet. In addition the slope was restored from behind the new
wall to the existing rear yard and patio of 2248 Highland Oaks Drive. The sloped area
above the retaining wall includes a perimeter chain link fence and concrete drainage
ditches that connect to a new catch basin and subsurface storm drain system. The
subsurface drain pipe collects runoff from the backyard drainage system of 2248
Highland Oaks Drive as well as the slope drainage ditches and outlets the flow onto the
access road below. Overall, staff was very pleased with the contractor's performance
relative to delivery and quality of work.
There was one change order in the amount of $33,868.49, which increased the contract
amount to $402,458.49. During construction, adverse slope conditions became
apparent that were previously unforeseen. The design team determined that the wall
alignment should be modified to better protect the eroded slope and to provide a better
transition from manufactured to natural slopes. The original design was for the retaining
wall to be located at the edge of the park access roadway with the very north and south
ends turned inward and tapering up the slope to act as wing walls to hold the new fill
material behind the wall. The modification was to the north and south ends to eliminate
the inward segments and to continue the wall along the roadway edge. Although the
change did not impact the cost of the wall, additional costs were required for fill material,
special slope treatment, storm drain pipe and welded angle iron to retain the wood
lagging.
The one change order of $33,868.49 reflects an increase of 9.2% over the contract
amount.
FISCAL IMPACT
This project was included in fiscal year 2008/09 Capital Improvement Program with a
budget of $450,000. The City Council approved an additional appropriation of $50,000
from the Capital Outlay Fund on June 16, 2009 for a total budget of $500,000. The total
construction cost was $402,458.49 and the total project cost including construction,
design, inspection, survey, and construction administration is within the total budget.

RECOMMENDATION
That the City Council accept all work performed by JRN Inc. for the Wilderness Park
Slope Stabilization Project as complete and authorize the final payment to be made in
accordance with the contract documents.
