SUBJECT: ACCEPT ALL WORK PERFORMED BY GENTRY BROTHERS, INC.
FOR THE ROAD REHABILITATION OF SANTA ANITA AVENUE FROM
GRAND VIEW AVENUE TO FOOTHILL BOULEVARD PROJECT AS
COMPLETE AND AUTHORIZE THE FINAL PAYMENT TO BE MADE IN
ACCORDANCE WITH THE CONTRACT DOCUMENTS
Recommendation: Approve
On November 17, 2009, the City Council awarded a contract to Gentry Brothers, Inc. in
the amount of $646,115, plus a 10% contingency, for the construction of the Road
Rehabilitation of Santa Anita Avenue from Grand View Avenue to Foothill Boulevard.
The terms and conditions of this project have been complied with and the work has
been performed to staff's satisfaction for a total project cost of $740,696.58. This
amount reflects the original contract amount of $646,115 plus changes totaling
$94,581.58 or 14.6% above the original contract amount.
Staff recommends that the City Council accept all work performed by Gentry Brothers,
Inc. as complete and authorize the final payment to be made in accordance with the
contract documents.
On February 17, 2009, the President signed into law the American Recovery and
Reinvestment Act of 2009 (ARRA). ARRA provides $27.5 billion supplemental funding
to Federal Highway Administration (FHWA) projects to be apportioned to the states and
cities. City staff has submitted applications for various road improvement projects to the
California Department of Transportation (CALTRANS) and have received approvals.

On November 17, 2009, the City Council awarded a contract to Gentry Brothers, Inc. in
the amount of $646,115, plus a 10% contingency, for the construction of the Road
Rehabilitation of Santa Anita Avenue from Grand View Avenue to Foothill Boulevard.
The terms and conditions of this contract have been complied with and the work has
been performed to staff's satisfaction. Therefore, staff recommends that the City
Council accept all work performed by Gentry Brothers, Inc. as complete and authorize
the final payment to be made in accordance with the contract documents, subject to
retention of $74,069.
In addition to the work originally covered by the contract, there were four (4) contract
change orders (CCO). The following reflects the change orders associated with the

The street striping, CCO #1, was left out of the original bid due to alternatives still being
considered at the time of the bid opening. The total striping scope was presented to the
contractor during construction and the final price of $5,924 was negotiated. CCO #2
was for a safety barrier to be installed at the terminus of Orange Grove Avenue at Santa
Anita Avenue.
CCO #3 and #4 were for additional road paving and sub -grade repairs. Unstable sub -
grade materials were encountered along Santa Anita Avenue between Ontare Road
and Sierra Madre Boulevard. These unstable soils were removed and stabilization
fabric and rock base were placed to bridge these areas. At other locations additional
pavement repairs were added to correct pavement failures exposed by the removals.
The cost of sub -grade stabilization (CCO #3) and additional pavement repairs (CCO #4)
amounted to $30,695.33 and $54,162.25 respectively.
The final contract amount has been determined to be $740,696.58. This amount
reflects the original contract amount of $646,115 plus changes totaling $94,581.58.
Prior to approval of the final invoice, representatives from the Federal Highway
Administration performed an audit of the construction documents. Upon their audit, it
was discovered that the contractor did not properly assign and report certain elements
of work covered under his Disadvantaged Business Enterprise goals. Funds will be
withheld from the retention payment until the contractor can resolve this issue.

FISCAL IMPACT
The total budget for this project is $857,000 with $757,000 in Federal ARRA funds and
$100,000 in Proposition C funds. The total construction cost is $740,696.58. There is
sufficient funding to cover all project costs and the City will be reimbursed the $757,000
Federal ARRA funds.
RECOMMENDATION
That the City Council accept all work performed by Gentry Brothers, Inc. for the Road
Rehabilitation of Santa Anita Avenue from Grand View Avenue to Foothill Boulevard as
complete and authorize the final payment to be made in accordance with the contract
documents, subject to retention of $74,696.58.
