Wray, Deputy Director of Development Services /City Engineer Prepared by: Tim Kelleher, Assistant Engineer SUBJECT: AUTHORIZE THE CITY MANAGER TO ENTER INTO A CONTRACT WITH HARDY & HARPER IN THE AMOUNT OF $292,000 FOR THE STREET REHABILITATION OF DUARTE ROAD BETWEEN EL MONTE AVENUE AND SANTA ANITA AVENUE AND A 300 -FOOT SEGMENT AT THE WEST CITY LIMIT AND AUTHORIZE A 10% CONTINGENCY Recommendation: Approve On February 17, 2009, the President signed into law the American Recovery and Reinvestment Act of 2009 (ARRA), of which a portion of the act will fund infrastructure improvement projects throughout the nation. The City of Arcadia's share of funding from ARRA for road improvements is approximately $1.7 million. Two projects utilizing this funding have already been completed. The Street Rehabilitation of Duarte Road between El Monte Avenue and Santa Anita Avenue and a 300 -foot segment at the west City limit is the third and final ARRA project. The project has been federally approved and bid. Staff recommends that the City Council award a contract in the amount of $292,000 to Hardy & Harper for the Street Rehabilitation of Duarte Road between El Monte Avenue and Santa Anita Avenue and a 300 -foot segment at the west City limit. On February 17, 2009, the President signed into law the American Recovery and Reinvestment Act of 2009 (ARRA). The ARRA provides $27.5 billion in supplemental funding to Federal Highway Administration (FHWA) projects to be apportioned to the states after certain takedowns. California's share is estimated to be $2.57 billion. The City of Arcadia's share is approximately $1.7 million. Staff Report September 7, 2010 Page 2 City personnel have submitted applications for various road improvement projects to the California Department of Transportation (Caltrans). Caltrans together with the Federal Highway Administration (FHWA) and the Metropolitan Transit Authority (MTA) have reviewed and approved the project. This project is proposed to repair two segments of Duarte Road, between Santa Anita Avenue and El Monte Avenue and a short segment at the very west City limits approximately 300 feet long. This short segment was left out of the City's previous Duarte Road Rehabilitation project to allow the County of Los Angeles to complete its underground utility district work at its terminus in Arcadia. The project involves the replacement of uplifted curb, gutter, and sidewalk, the grinding of the top two inches of old asphalt pavement, asphalt overlay and striping. A Notice Inviting Bids was published and bid packages were distributed to area contractors. Seven companies submitted bids which were opened on August 31, 2010: Because this project is funded by Federal ARRA funds, it must follow the Federal funding guidelines and requirements. Staff established an under - utilized Disadvantaged Business Enterprise (UDBE) participation goal for this project of 3 %. Although contractors must make a good faith effort to meet the City's UDBE goal, it is not an absolute requirement. The low bidder presented 0% UDBE participation for the project, but filed the required good faith effort documents. Upon review, staff has determined that a reasonable good faith effort was made to consider UDBE contractors. Staff has reviewed the bid documents for content and has investigated the contractor's background and their recent projects for competency. It is staff's opinion that Hardy & Harper can satisfactorily perform the work required and recommends that the City Council award a contract in the amount of $292,000 to Hardy & Harper for the Street Rehabilitation of Duarte Road between El Monte Avenue and Santa Anita Avenue and a 300 -foot segment at the west City limit. The funding for the project comes from $300,000 in Federal ARRA funds and $100,000 in Proposition C funds. The State has approved the ARRA funding with Program Supplemental Agreement No. 010 -N. The Proposition C funding will only be used for those expenses above $300,000. The total cost of his contract with contingency is $321,200 which is within the total budget. Staff Report September 7, 2010 Page 3 RECOMMENDATION It is recommended that the City Council authorize the City Manager to enter into a contract with Hardy & Harper in the amount of $292,000, authorize a 10% contingency and waive any abnormality in the bid or bidding process for the Street Rehabilitation of Duarte Road between El Monte Avenue and Santa Anita Avenue and a 300 -foot segment at the west City limit.
