Flores, Senior Planner SUBJECT: AUTHORIZING SUBMISSION OF AN APPLICATION TO THE STATE OF CALIFORNIA STRATEGIC GROWTH COUNCIL (SGC) SUSTAINABLE COMMUNITIES PLANNING GRANT AND INCENTIVE PROGRAM TO UPDATE THE CITY'S ZONING ORDINANCE. Recommendation: Adopt Resolution No. 6739 The Development Services Department is recommending that the City Council approve and adopt a Resolution to complete an application for the California Strategic Growth Council's (SGC) Sustainable Communities Planning Grant and Incentive Programs for $236,870 to fund a Zoning Ordinance Update. A grant application was filed on the deadline, August 31, 2010, but in order for the application to be deemed complete and eligible for consideration, a resolution from the City Council is required to be adopted and submitted by September 30, 2010. The grant awards are expected to be announced by November 2010. In November 2006, California voters passed Proposition 84, the $5.4 billion "Safe Drinking Water, Water Quality and Supply, Flood Control, River and Coastal Protection Bond of 2006." Funding for local sustainable planning programs was made available through the Sustainable Communities Planning Grant and Incentive Program portion of Prop 84. The grant program implements the vision of the Governor and Legislature to foster the development of sustainable communities throughout California. The primary goal is develop and implement plans that reduce greenhouse gas emissions through environmentally - friendly objectives, such as improving air and water quality, reducing automobile usage usage and fuel consumption, promoting energy efficiency and conservation, strengthening the economy, and improving housing affordability. The State of California's Strategic Growth Council will manage three funding cycles for fiscal year 2010 -2011. We are currently in the second cycle and approximately $20 million has been made available by the Bond Act for planning projects. A minimum of 25% (at least $5 million and up to $13 million) has been set aside to fund city projects such as specific plans, infill plans, zoning ordinance updates, climate action plans, and general plan updates. Grant funding is set at a minimum of $100,000 and a maximum of $1,000,000 per project. The City is seeking funding through Focus Area #1: Local Sustainable Planning to update the City's Zoning Ordinance. Throughout the years the City has only made periodic updates to sections of the Zoning Ordinance, but has not conducted a comprehensive update since adoption of the current Zoning Ordinance nearly 35 years ago. A comprehensive update to the Zoning Ordinance is much needed to achieve the highest level of internal consistency and to ensure that the new Zoning Ordinance carries out the goals and objectives of the new General Plan. FISCAL IMPACT There are no financial implications to the City to apply for the grant, and there are no matching funds required. If the City is successful at securing the grant, Development Services Department will provide in -kind staff support anytime as a local match, and return to the City Council for approval of a Zoning Ordinance update program. RECOMMENDATION That the City Council adopt the attached Resolution No. 6739 for application of the Zoning Ordinance Update project under the Proposition 84 Grant Funding. Approved By: ∎o -- _ Q�..�. Donald Penman, City Manager Attachment: Resolution No. 6739 Resolution No. 6739 Zoning Ordinance Update Grant September 21, 2010 Page 2 RESOLUTION NO. 6739 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE SUSTAINABLE COMMUNITIES PLANNING GRANT AND INCENTIVES PROGRAM UNDER THE SAFE DRINKING WATER, WATER QUALITY AND SUPPLY, FLOOD CONTROL, RIVER AND COASTAL PROTECTION BOND ACT OF 2006 (PROPOSITION 84) FOR ZONING ORDINANCE UPDATE. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY FIND, ORDER AND RESOLVE AS FOLLOWS: WHEREAS, the Legislature and Governor of the State of California have provided funds for the program shown above; and, WHEREAS, the Strategic Growth Council has been delegated the responsibility for the administration of this grant program, establishing necessary procedures; and, WHEREAS, said procedures established by the Strategic Growth Council require a resolution certifying the approval of application(s) by the Applicant's governing board before submission of said application(s) to the State; and WHEREAS, the applicant, if selected, will enter into an agreement with the State of California to carry out the development of the proposal. NOW, THEREFORE, BE IT RESOLOVED THAT THE CITY COUNCIL OF THE CITY OF ARCADIA HEREBY: 1. Approves the filing of an application for the Zoning Ordinance Update in order to become a sustainable community; and, 1 2. Certifies that the applicant understands the assurances and certification in the application; and, 3. Certifies that the applicant or title holder will have sufficient funds to develop the Proposal or will secure the resources to do so; and, 4. Certifies that the Proposal will comply with any applicable laws and regulations; and, 5. Appoints the Development Services Director, or designee, as agent to conduct all negotiations, execute and submit all documents including, but not limited to applications, agreements, payment requests and so on, which may be necessary for the completion of the aforementioned project(s).
