REPORT FROM CITY ATTORNEY REGARDING CLOSED SESSION ITEM City Attorney Deitsch reported that the City Council met in a Closed Session to consider the one item listed on the posted agenda under Closed Session; no reportable action was taken. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Tay, seconded by Mayor Pro Tern Chandler to read all ordinances and resolutions by title only and waive the reading in full. PRESENTATIONS a. Presentation by Chief Guthrie of Life Savings Awards for Sergeant Jeremy Lachenmyer and Officer Wally Ashby. b. Presentation of a tile plaque to Scott Hettrick, CEO of the Arcadia Chamber of Commerce, and presentation of Proclamation to Scott and Betty Hettrick for their contributions to the community. Bruce McCallum appeared and thanked Scott Hettrick for all he has done for the community. 1. APPOINTMENTS a. Appoint Reina Burgess to the Senior Citizen Commission Golden Age Club to fill an unexpired term. Recommended Action: Approve City Manager Lazzaretto presented the staff report. It was moved by Council Member Beck, seconded by Council Member Tay, and carried on roll call vote to appoint Reina Burgess to the Senior Citizen Commission Golden Age Club to fill an unexpired term. AYES: Council Member Beck, Tay, Chandler, and Kovacic NOES: None ABSENT: Council Member Segal 2. PUBLIC HEARING a. Direct the Los Angeles County Agricultural Commissioner to abate nuisances upon those properties located in the City of Arcadia, and approve the Annual Weed Abatement Property list. Recommended Action: Approve City Manager Lazzaretto presented the staff report. Mayor Kovacic opened the public hearing. No one appeared. A motion to close the public hearing was made by Mayor Pro Tern Chandler, seconded by Council Member Tay, and seeing no further objection, Mayor Kovacic declared the public hearing closed. 2 02/16/2016 It was moved by Mayor Pro Tem Chandler, seconded by Council Member Tay, and carried on roll call vote to direct the Los Angeles County Agricultural Commissioner to abate nuisances upon those properties located in the City of Arcadia, and approve the Annual Weed Abatement Property list. Text Amendment No. TA 15-04, Conditional Use Permit No. 15-10, Architectural Design Review No. ADR 15-22, and Modification No. 15-10, along with an exemption from the California Environmental Quality Act ("CEQA"), to allow a Starbucks Cafe with drive-through service at 5 West Live Oak Avenue, and to amend drive-through regulations Citywide. Assistant City Manager/Development Services Director Kruckeberg and Economic Development Analyst Schwehr presented the staff report. Mayor Kovacic opened the public hearing. Kayman Wong, Architect for Evergreen Development, appeared and answered questions raised by the City Council regarding trash, parking, construction and the number of employees. Charlie Arbing, Starbucks representative, appeared and spoke about employee programs and alternate forms of transportation to and from work. A motion to close the public hearing was made by Mayor Pro Tern Chandler, seconded by Council Member Tay, and seeing no further objection, Mayor Kovacic declared the public hearing closed. Ordinance No. 2333 amending portions of Article IX, Chapter 2, Part 6 and 7 of the Arcadia Municipal Code in order to allow drive-through fast food restaurants as a permissible use within the MU - Mixed Use Zone subject to approval of a Conditional Use Permit, and to amend the parking regulations for drive-through businesses Citywide. Recommended Action: Introduce It was moved by Mayor Pro Tern Chandler, seconded by Council Member Tay, and carried on roll call vote to introduce Ordinance No. 2333 amending portions of Article IX, Chapter 2, Part 6 and 7 of the Arcadia Municipal Code in order to allow drive-through fast food restaurants as a permissible use within the MU - Mixed Use Zone subject to approval of a Conditional Use Permit, and to amend the parking regulations for drive-through businesses Citywide. General Plan Amendment No. GPA 15-02, Specific Plan No. 14-01, Tentative Parcel Map No. TPM 14-06 (73407), and a Final Environmental Impact Report ("FEIR") (SCH #2015041002) and Mitigation and Monitoring Program per the California Environmental Quality Act ("CEQA"), for the development of the Arcadia Logistics Center, a logistics center/industrial park with a maximum of 1,688,000 square feet of building space on an 81.27-acre property that was formerly a sand and gravel quarry and an Inert Debris Engineered Fill Operation ("IDEFO") at 12321 Lower Azusa Road. Assistant City Manager/Development Services Director Kruckeberg and Community Development Administrator Kasama presented the staff report. Mayor Kovacic opened the public hearing. John Edwards, Jr., owner and applicant of the Arcadia Reclamation Facility, appeared and provided background information relating to the project including the concerns of El Monte residents; he indicated that he would like to see the project approved, and urged the City Council to put a cap on the traffic study to the 1-605 Corridor initiated by Caltrans. El Monte Council Member Norma Macias, appeared and indicated that the City of El Monte and the applicant are in negotiations, and requested the item be continued for two weeks in order for the applicant and the City of El Monte to continue their negotiations regarding traffic, and public safety concerns. Dave Gondek, Deputy City Attorney for the City of El Monte, appeared and indicated that he has a letter signed by their City Manager requesting a continuance until Tuesday, March 2, 2016, stating that the applicant has meet some of El Monte's concerns, but needed additional time to complete their negotiations. Howard Owens, resident of the City of El Monte, appeared and discussed concerns raised by his neighbors regarding the project. The applicant, John Edwards, Jr., responded to comments made by City of El Monte officials, he discussed the security system and cameras on the property, and trucks turning out of the property, and the pending agreement with the City of El Monte; he urged the City Council to 4 02/16/2016 approve the project, and feels that Arcadia's approval of the project would not affect his negotiations with El Monte. A motion to close the public hearing was made by Council Member Tay, seconded by Mayor Pro Tern Chandler, and seeing no further objection, Mayor Kovacic declared the public hearing closed. Resolution No. 7113 adopting environmental findings pursuant to the California Environmental Quality Act, certifying the Final Environmental Impact Report (SCH#2015041002) for the Arcadia Logistics Center Project; adopting a Statement of Overriding Considerations, and a Mitigation Monitoring and Reporting Program; and approving the Proiect. Recommended Action: Adopt Resolution No. 7115 approving General Plan Amendment No. GPA 15-02 pertaining to Economic Development Policy No. ED-1.4 for the development of a master-planned warehousing and logistics center in the Lower Azusa Road Reclamation Area at 12321 Lower Azusa Road. Recommended Action: Adopt Resolution No. 7116 approving Tentative Parcel Map No. TPM 14-06 (73407) for the development of a master-planned warehousing and logistics center in the Lower Azusa Road Reclamation Area at 12321 Lower Azusa Road. Recommended Action: Adopt equa Ordinance No. 2334 adopting Specific Plan —Arcadia Logistics Center (SP-ALC), adding Section 9231.21.3 (Arcadia Logistics Center Specific Plan) to the Arcadia Municipal Code, and amending the zoning designation and map of the City to change the zoning from Commercial-Manufacturing (C-M) to Specific Plan — Arcadia Logistics Center (SP-ALC) concerning certain property at 12321 Lower Azusa Road. Recommended Action: Introduce It was moved by Mayor Kovacic, seconded by Council Member Beck, and carried on roll call to continue this item to the next regular City Council meeting of March 1, 2016. AYES: Council Member Kovacic, Beck, and Tay NOES: Council Member Chandler ABSENT: Council Member Segal PUBLIC COMMENTS Brian Ortiz, Arcadia Police Officers Association President, appeared and spoke about the effects of Measure A being a threat to the City and residents; he provided statistics of City jobs that will be lost if it is passed, he referenced the City of Sierra Madre as an example of what could happen if Measure A passes; and urged residents to vote No on Measure A, and hopes to see more No on Measure A signs throughout the City. maw Domenico Tallerico, Proponent of Measure A and resident of Arcadia, appeared and stated that Measure A is a vote for people keeping more of their money; he commented on scare tactics 5 02/16/2016 paid with taxpayer money to create a presentation of a Utility Users Tax Impact Analysis; and .M„ spoke above the role of government and asked for a repeal of the City's Utility Users tax. April Verlato, President of the Downtown Arcadia Improvement Association, appeared and announced that the Association will be participating in the Gold Line celebration on March 5; she noted the scheduled activities and raffle prizes donated by the Downtown Arcadia businesses; and encouraged families to come out. Lawrence C. Papp, Proponent of Measure A and an Arcadia resident, appeared and indicated that many of his "Yes on Measure A" signs have gone missing; and spoke about government waste and inefficiencies, and employee salaries. Jeremy Conrad, Arcadia Fire Fighters Association, appeared and indicated that they are walking the streets and sharing the impact and safety concerns with residents if Measure A is passed; he thanked the residents who have opened their doors to discuss Measure A; he provided contact information if residents want a No on Measure A yard sign; and urged residents to vote No on Measure A. John MacDonnell, an Arcadia resident, appeared and thanked the City Council for their service; he noted that chunks of broken concrete needs to be cleaned up at Santa Anita and Foothill Boulevard; he spoke on voting and democracy and finds it to be a problem when campaign signs are placed on private property without permission of the property owner; and encouraged residents to go out and educate themselves and vote. Burton Brink, an Arcadia resident, appeared and commented on the Residential Zoning Review Committee recommendations; he spoke about North Arcadia being lumped into other non- Homeowner Association areas; and asked for a larger sliding scale to be used in the recommendations just like the Highlands Homeowner Association. Peter Amundson, an Arcadia resident, complimented on the new Starbucks on Live Oak Avenue; he commended the City Council for being a good neighbor to the City of El Monte, and feels that the City Council made the right decision not to contract with the City of Sierra Madre for police services; he spoke about the increase in crime; and noted the upcoming Community Meeting and decade old issues hoping for a resolution in putting Arcadia back together harmoniously. Marcie Schultz, an Arcadia resident, appeared and indicated that she is April Verlato's campaign manager spoke, and that she only puts campaign signs on properties who request them. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense CAB 1234]) Mayor Pro Tem Chandler announced that he and Council Member Tay attended the 16th Annual Arcadia Chinese Association Senior Luncheon event. Council Member Tay spoke about impacts to the City if Measure A is passed, and encouraged everyone to vote No on Measure A; he announced that he attended the Arcadia Chinese Association Lunar New Year's Senior Luncheon event and appreciates what that they do; he ,..., announced candidate forums on February 21 at the Arcadia Women's Club, and on February 24 at the Arcadia Library, sponsored by the Chamber of Commerce, and encouraged everyone to attend. 6 02/16/2016 „ Council Member Beck thanked Estelle Sykes for her work on the Senior Commission; he thanked Mayor Kovacic and his wife, and Council Member Tay and his wife for attending the Methodist Hospital Mardi Gras event; he sent his condolences to Segal family, on the loss of Council Member Segal's father; he commented on employee salary negotiations in response to Mr. Papp's comments; he complimented City Manager Lazzaretto and spoke on the depletion of City reserve funds during the past recession and the need to build them back up for future need in an emergency situation like another recession; he noted that candidates should not take missing political signs personally. Mayor Kovacic stated that he is encouraged regarding the zoning code update process; he commented on the missing election signs; he requested Public Works Services look into the area at Santa Anita Avenue and Foothill Boulevard regarding the chunks of concrete, as noted by Mr. MacDonald; he spoke about the placement of election signs; he announced the Gold Line grand opening on March 5, and the Arcadia High School Constitution Team winning at the State Finals in Bakersfield, and National Finals in April, and invited everyone to come watch future practices. City Manager Lazzaretto announced that at the community meeting tomorrow night, the zoning code update process, the history of the zoning code, proposals to make changes and additional recommendations to the code will be discussed; and noted that it will go before the Planning Commission on February 23, and encouraged as much public input as possible. ADJOURNMENT Mayor Kovacic adjourned this meeting in memory of Barry Segal, father of City Council Member Mickey Segal at 10:02 p.m. to Tuesday, March 1, 2016, at 6:00 p.m. in the City Council Conference Room.
