HomeMy WebLinkAbout03/15/2016 ARCADIA CITY COUNCIL mmik REGULAR MEETING MINUTES TUESDAY, MARCH 15, 2016 CALL TO ORDER— Mayor Kovacic called the meeting to order at 7:00 p.m. INVOCATION — Reverend Thomas Shriver, Emmanuel Assembly of God Church PLEDGE OF ALLEGIANCE — Matt Hattfield, Arcadia High School Constitution Team ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Council Member Beck, Tay, Chandler, Segal, and Kovacic ABSENT: None REPORT FROM CITY ATTORNEY REGARDING CLOSED/STUDY SESSION ITEMS City Attorney Deitsch reported that the City Council met in a Closed Session at a Special Meeting to consider the two items listed on the posted agenda under Closed Session; that the second item pertained to anticipated litigation regarding the City's sign ordinance, and according to the Ralph M. Brown Act is required to be reported in open session, no reportable action was taken. City Attorney Deitsch also reported that the City Council met in a Study Session to hear a report from staff to discuss and provide direction regarding an analysis of the Duarte Road and Santa Anita Avenue mid-block crosswalks and in-ground warning light systems; he announced that the City Council gave direction to staff regarding the intersection of Duarte Road and Lovell Avenue, the Duarte Road crosswalk east of Baldwin Avenue, the Duarte Road crosswalk west of Baldwin Avenue, the intersection of Santa Anita Avenue and Leroy Avenue, and the Santa Anita Avenue crosswalk at Alta Street, and in the future if any crosswalks are eliminated or adjusted in any way, they will be brought forward at a meeting so that the public is informed in advance. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS Assistant City Manager/Development Services Director Kruckeberg stated there was no supplemental agenda information. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Tay, seconded by Mayor Pro Tem Chandler to read all ordinances and resolutions by title only and waive the reading in full. PRESENTATIONS a. Presentation of Mayor's Certificate of Commendation to the Arcadia High School Constitution Team for Winning the State Finals. MIRO b. Presentation of Mimi's Cafe gift certificates to City of Arcadia employees by the Arcadia Chinese Association. 1 03/15/16 PUBLIC COMMENTS ••,� Mayor Kovacic announced the process for public comments and decorum due to the number of speakers, and explained the purpose of City Manager agenda item 2.a. Sidney Chan, an Arcadia resident, appeared and spoke in support of having an economic impact study prepared for the residential zoning code regulations; and noted his concerns regarding the amount of property tax money given to the Arcadia School District. Mark Shyang Liu, an Arcadia resident, appeared and spoke regarding Dr. Robert Wilson and requested erecting a statue in his honor. Doug Meyer, an Arcadia resident, appeared and spoke regarding the FAR; and read a letter he previously sent the City Council noting his strong objection to a new zoning code in fear of how it could possibly hurt property values in the City. Kelsea Jeon, Arcadia Unified High School Constitution Team member, appeared and thanked Mayor Kovacic for his many years of help with the constitution team; she spoke about their participation in Washington, D.0 in April, and requested donations to help with the cost and provided information on how people could donate, if interested. Polly Wong, an Arcadia resident, appeared and spoke against making changes to the residential zoning regulations. Dean Radle, an Arcadia resident, appeared and requested that the City Council provide "* educational outreach regarding the proposed plastic bag ban ordinance. Joanne Wong, an Arcadia resident, appeared and expressed her concerns regarding the proposed residential zoning code regulations. Burton Brink, an Arcadia resident, appeared and spoke in favor of the zoning code regulations and feels that false information has been given to the residents of Arcadia regarding this issue. Pasquale Chiechi, an Arcadia resident, appeared and stated that personal beliefs should not influence decisions. Kristi Ortiz, Arcadia Police Civilian Association, appeared and spoke about her job as a police dispatcher; and urged residents to vote No on Measure A. Winston Shu, an Arcadia resident, appeared and spoke against changes to the proposed residential zoning code; and urged residents to vote No on Measure A. Brian Ursettie, Arcadia Fire Fighters Association President, appeared and spoke about deception and misdirection being used by supporters of Measure A regarding employee salaries made during the public comment period at the last City Council meeting; and urged voters to vote No on Measure A. Rickey Lau, an Arcadia resident, appeared and indicated that residents were not properly ...A noticed regarding the February 23 Special Meeting of the Planning Commission on the zoning code amendments, and urged the City Council to conduct an economic impact study. 2 03/15/16 OfRO ,,, Frank Lin, an Arcadia resident, appeared and urged the City Council to leave the current zoning code as it currently is and requested no changes. April Verlato, an Arcadia resident, appeared and shared her hopes that the City Council conduct an environmental impact study related to the recommended changes to the residential zoning regulations that will yield the most accurate results. Mark Walker, an Arcadia resident, appeared and spoke about the proposed zoning code changes and how passionate residents are on both sides of the issue; he urged the City Council to place the item on the November ballot and let the people decide, and to conduct an economic impact study. Brett Mitulski, an Arcadia resident, appeared and spoke about the upcoming City Council Municipal Election, and referenced city council candidate qualifications. Brian Ortiz, Arcadia Police Officers Association, appeared and encouraged residents to vote No on Measure A. Sylvia Straka, an Arcadia resident, appeared and expressed her confusion and the impact the FAR would have on the community; she expressed her support of the Planning Commission's recommendation to authorize an economic impact study; and asked that the facts be accurately shared with the residents following the study. Tony Zheng, an Arcadia resident, appeared and spoke about his neighbors' confusion regarding omo the proposed zoning code changes; and encouraged the City Council to listen to the people when making decisions. Beverly Zhou, an Arcadia resident, appeared and spoke in opposition to any zoning code changes. Chen Suen, Arcadia resident and member of the Arcadia Fire Fighters Association, appeared and encouraged residents to vote No on Measure A; and commended City staff and the City Council on the fair and efficient way they run the City. Lee Marshall, an Arcadia resident, appeared and spoke about the misperception of the residential zoning code regulations; he thanked the City Council for establishing the Zoning Code Review Committee; he commended City staff for preparing some of the recommendations; and noted his opposition of the economic impact study. Dom Tallerico, an Arcadia resident, appeared and read a letter he previously sent to City Council requesting a debate on Measure A. Jing Zhang, an Arcadia resident, appeared with an interpreter and expressed her opposition of the proposed zoning code initiative; and a negative interaction she had with the Planning Division when she tried to get a permit to build a larger home. Peter Amundson, an Arcadia resident, appeared and commented on a flyer left on his door ,, regarding the residential zoning regulations and its misinformation; and asked the City Council to ifni do something reasonable to help the City move forward. 3 03/15/16 Eric Rosa, an Arcadia resident, appeared and spoke in opposition of the proposed changes to the City's single-family residential zoning code regulations; and encouraged the City Council to _.,, look at the possible economic impact the proposed changes would have on the community. Timothy Burch, an Arcadia resident, appeared and encouraged the City Council to make decisions based on policy not on public opinion polls. Julia Liu, an Arcadia resident, appeared and voiced her opposition to the Highlands HOA making a statement that all its members were in favor to the proposed zoning code changes. Robert Stover, an Arcadia resident, appeared and spoke about the Zoning Code Review Committee; he indicated that one of the members also sits on the Planning Commission, and the conflict it creates; and asked that that member recuse herself from any discussion on the Planning Commission regarding the Zoning Code Review Committee's recommendations. Shan Shan Hu, an Arcadia resident, appeared and spoke in favor of a larger home for her family. Roger Nemrava, an Arcadia resident, appeared and spoke in support of Measure A. Edmund Lui, an Arcadia resident, appeared and urged the City Council to authorize an economic impact study and presented the City Council with a petition with signatures opposed to the recommendation. Sheng Chang, an Arcadia resident, appeared and spoke in support of the economic impact study. """ Charlie Shen (did not appear) John Mac Donnell, an Arcadia resident appeared and spoke in support of Bob Harbicht, and urged everyone to vote and vote No on Measure A. Lawrence C. Papp, an Arcadia resident, appeared and spoke regarding the funding behind each side of Measure A. Dee Chow, an Arcadia resident, appeared and urged the City Council to listen to the residents before making any zoning code changes. The City Council took a recess at 9:20 p.m., and reconvened at 9:30 p.m. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense CAB 12341) Council Member Segal suggested holding an all-day workshop study session in order to give everyone the opportunity to attend and make progress on the issue of the proposed changes to the City's single-family residential zoning code; and recommended that Thursday, March 24, 2016, would be a good date. After discussion, it was decided that the session would be held at 9:00 a.m., in the City Council Chambers. MIMS Mayor Pro Tem Chandler announced the Gold Line grand opening event, and the new Arcadia Transit schedule. 4 03/15/16 WO Council Member Tay indicated that he felt personally attacked by comments directed at him in previous public comments; and commented on his providing Chinese translation at an event where information was provided on the zoning code regulations recommendation. Council Member Beck addressed earlier comments made by residents regarding the lack of notice on the zoning code update; he stated that the City has made numerous attempts to reach out to residents regarding this issue and wonders how anyone can make such a claim; he encouraged residents to vote; and wished everyone a Happy Easter: and provided information on the upcoming Citizen of the Year Dinner and the Mayors Community Breakfast. City Clerk Glasco announced that he spoke earlier at the Sierra Madre Rotary Club regarding the Arcadia Vietnam War Monument; and provided election and voting information. Assistant City Manager/Development Services Director Kruckeberg had no comments. Mayor Kovacic thanked all public speakers for coming out; he encouraged everyone to attend the upcoming Mayor's Community Breakfast; he thanked the Arcadia Chinese Association for the gift cards to the City employees; he thanked them for co-sponsoring Law Day on April 30; and encouraged residents to ride the Gold Line. 1. CONSENT CALENDAR All matters listed under the Consent Calendar are considered to be routine and can be acted on by one roll call vote. There will be no separate discussion of these items unless a member of the wa City Council, staff, or the public requests that a specific item be removed from the Consent Calendar for separate discussion and action. a. Regular Meetinq Minutes of February 16, 2016. Recommended Action: Approve b. Contract with Ferreira Construction Co. Inc. dba Ferreira Coastal Construction Co., for the Valve Replacement Project on Santa Anita Avenue in the amount of $285,780. Recommended Action: Approve c. Contract with Vargas Olson Enterprises, Inc. for the Community Center Restroom Renovation Project in the amount of$138,610. Recommended Action: Approve d. Purchase Order with Black and White Emergency Vehicles, Inc. for the purchase and installation of emergency equipment and lighting for City vehicles in an amount not to exceed $180,186.44. Recommended Action: Approve e. Contract with Nobest, Inc. for the Baldwin Avenue and Duarte Road Intersection Improvements Project in the amount of$276,000. Recommended Action: Approve VIM f. Purchase Order with Altec Industries, Inc. for the purchase of a used aerial lift truck for the Public Works Services Department in the amount of$65,000. 5 03/15/16 Recommended Action: Approve g. Resolution No. 7117 authorizing submittal of the Fiscal Year 2015-16 Transportation Development Act — Article 4 claim forms to receive capital and operating funds for Arcadia Transit. Recommended Action: Adopt h. Ordinance No. 2334 adopting Specific Plan —Arcadia Logistics Center(SP-ALC), adding Section 9231.21.3 (Arcadia Logistics Center Specific Plan) to the Arcadia Municipal Code, and amending the zoning designation and map of the City to change the zoning from Commercial-Manufacturing (C-M) to Specific Plan — Arcadia Logistics Center (SP-ALC) concerning certain property at 12321 Lower Azusa Road. Recommended Action: Adopt It was moved by Mayor Pro Tern Chandler, seconded by Council Member Tay, and carried on roll call vote to approve Consent Calendar Items 1.a through 1.h. AYES: Council Member Chandler, Tay, Beck, Segal, and Kovacic NOES: None ABSENT: None 2. CITY MANAGER a. Consideration of the Planning Commission recommendation to authorize an economic impact study related to recommended changes to the City's single- family residential zoning regulations, and discussion of the process to consider those changes. Recommended Action: Do not pursue Economic Study and provide direction on process for reviewing zoning changes Assistant City Manager/Development Services Director Kruckeberg provided the staff report. It was moved by Mayor Pro Tern Chandler, seconded by Council Member Tay, and carried on roll call vote to authorize an economic impact study to be completed related to the residential zoning regulations.
