SUBJECT: RESOLUTION NO. 1962 – APPROVING CONDITIONAL USE PERMIT
NO. CUP 15-13 WITH A CATEGORICAL EXEMPTION UNDER THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) FOR A
TUTORING BUSINESS FOR UP TO 84 CHILDREN IN A 2,654 SQUARE-
FOOT TENANT SPACE AT 9 LAS TUNAS DRIVE
Recommendation: Adopt Resolution No. 1962
SUMMARY
The applicant is requesting approval of Conditional Use Permit Application No. CUP 15-
13 to expand a tutoring business into a 2,654 square-foot tenant space at 9 Las Tunas
Drive (dba: Little Stanford Academy & Stanford Institute). The proposed tutoring
business expansion will accommodate up to 84 children and 10 staff. The project has
been found to be exempt from review under the California Environmental Quality Act
(CEQA) as a Class 3 Categorical Exemption for the conversion of an existing small
structure. It is recommended that the Planning Commission approve Conditional Use
Permit No. CUP 15-13, subject to the conditions listed in this staff report, and adopt the
attached Resolution No. 1962 (Attachment No. 1).
BACKGROUND
The property is zoned Mixed Use (MU). A tutoring business is a conditionally-permitted
land use in the MU zone per Arcadia Municipal Code Sections 9268.10 and 9275.1.56.
The General Plan

restaurant, which
closed in July 1997,
and the building is
vacant. The proposed

square-foot, former restaurant building that was constructed in 1969.
Conditional Use Permit No. CUP 01-018 was granted in 2001 for a tutoring business at
2617 S. Santa Anita Avenue (see Attachment No. 6: Resolution No. 1648), the tenant
space next to the subject proposed location - see the above photo. The applicant has
operated the Little Stanford Academy tutoring business at 2617 S. Santa Anita Avenue
since 2013. The applicant plans to continue to operate in that space, as well as at 23 W.
Las Tunas Drive in the same shopping center (dba:
Stanford Institute - see photo to the right), which was
approved by Conditional Use Permit No. CUP 14-17
(see Attachment No. 7: Resolution No. 1932).
PROPOSAL
The application materials indicate that the applicant
hopes to have as many as 150 students in the new
space, in addition to the children in the existing spaces
in the shopping center. However, according to an
evaluation by the City’s Building Official of the
proposed floor plan, the proposed tenant space can
only accommodate up to 94 people. The applicant is
proposing to staff the facility with 10 employees, so a
maximum of 84 students would be allowed under the
Building Code. The tutoring business will provide
classes and homework assistance for children from kindergarten through grade 12. The
applicant anticipates that they will serve roughly 70 percent elementary students, 15
percent middle school, and 15 percent high school students.
Initially the hours of
operation will be from
12:30 p.m. to 6:30 p.m.,
Monday through Friday,
and 9:30 a.m. to 5:00
p.m. on Saturdays. The
application materials
indicate that they hope
to expand to seven days
a week by 2017.
The interior of the
building will be
remodeled to create seven classrooms and two restrooms (refer to Attachment No. 4 for
the Site Plan and Floor Plan). Except for signage, no exterior alterations to the building
or structures are proposed, including to the doors or windows.

There are currently 277 parking spaces in the shopping center, and an additional six (6)
handicapped-accessible spaces (refer to Attachment No. 3 for an Aerial Photo with
Zoning Information and Photos of the Subject Property). The proposed 2,654 square-
foot tutoring business requires one (1) parking space for every five (5) students and one
(1) for every employee. With
84 students and 10 staff
proposed, the parking
requirement for the proposed
use is 27 spaces. The
applicant has provided a
parking study (Attachment
No. 5) that shows that there
are many available parking
spaces in the shopping
center, and more than 27
were available during the
likely busy times from 3 p.m.
until 7 p.m.
Access to the shopping center is from both Santa Anita Avenue and Las Tunas Drive.
There are two driveways from Santa Anita near the proposed tutoring business that
would likely provide primary access to the business.
The tutoring center currently appears to
use a trash bin on the north side of the
building. The condition does not meet
City standards since it’s not in a roofed
enclosure. As a condition of approval,
staff recommends that the applicant
provide a trash enclosure on the property
that meets City standards.
ANALYSIS
The proposed tutoring business will
occupy the 2,654 square-foot tenant
space that was last used as a restaurant.
The Arcadia Municipal Code requires a total of 27 parking spaces for the proposed
tutoring business. By comparison, if a new 2,654 square-foot restaurant was proposed
to be operated at this site, it would be required to provide 26 parking spaces, and a
retail use would require 13 parking spaces. The proposed tutoring business is therefore
within the range of land-use intensity allowed for the site.
A new Starbucks coffee shop has been approved to be located adjacent to the shopping
center at the intersection of Las Tunas Drive and Santa Anita Avenue. It is a separate
parcel with its own parking lot. Given the substantial number of parking spaces available
in the shopping center, and the separation from the parking lot for Starbucks, it is not

anticipated that there will be any impact on the availability of parking near the expanded
Little Stanford Academy.
FINDINGS
Section 9275.1.2 of the Arcadia Municipal Code requires that for a Conditional Use
Permit to be granted, it must be found that all of the following prerequisite conditions
can be satisfied:
1. That the granting of such Conditional Use Permit will not be detrimental to the
public health or welfare or injurious to the property or improvements in such
zone of vicinity.
The proposed use will not be detrimental to the public health or welfare, or the
surrounding properties because the size of the proposed tutoring business, and the
amount of traffic generated are consistent with other uses permitted by-right on the
property. A parking study was conducted for the Project and sufficient parking will
be available for the use. Based on this information, the Project will not be
detrimental to the public health or welfare or injurious to the other properties in the
area. The proposed tutoring business will not conflict with the operation of the other
businesses in the shopping center.
2. That the use applied for at the location indicated is properly one for which a
Conditional Use Permit is authorized.
The zoning of the site is MU, Mixed Use. Arcadia Municipal Code Sections 9268.10
and 9275.1.56 allow tutoring businesses in the MU zone with an approved
Conditional Use Permit.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces, walls, fences, parking, loading,
landscaping, and other features required to adjust said use with the land and
uses in the neighborhood.
The building for the proposed tutoring business was most recently used as a
restaurant. The tutoring business will occupy the northerly 2,654 square-feet of the
building. No exterior changes are proposed for the use except for signage. The
hours of the tutoring business do not conflict with the adjacent land uses. The
parking study prepared for the Project showed an abundance of available parking
for the use. The property features, lighting, landscaping, and other improvements
are adequate for this use.
4. That the site abuts streets and highways adequate in width and pavement
type to carry the kind of traffic generated by the proposed use.
The Project site is located in the large shopping center at the intersection of Las
Tunas Drive and Santa Anita Avenue. The streets are adequate in width and
pavement type to carry the traffic that will be generated by the proposed tutoring

business. No significant impacts are anticipated, nor are mitigation measures
proposed for the neighboring streets.
5. That the granting of such Conditional Use Permit will not adversely affect the
comprehensive General Plan.
Approval of the tutoring business at the site is consistent with the Commercial Land
Use Designation of the site. The Project will not adversely affect the comprehensive
General Plan.
The proposed project, with the recommended conditions of approval will satisfy each
prerequisite condition, and all City requirements regarding disabled access and
facilities, occupancy limits, building safety, health code compliance, emergency
equipment, environmental regulation compliance, and parking and site design shall be
complied with by the property owner/applicant to the satisfaction of the Building Official,
City Engineer, Community Development Administrator, Fire Marshal, and Public Works
Services Director, or their respective designees. The changes to the existing facility are
subject to building permits after having fully detailed plans submitted for plan check
review and approval by the aforementioned City officials.
ENVIRONMENTAL IMPACT
If it is determined that no significant physical alterations to the site are necessary, then
this project, as a conversion of an existing structure of up to 10,000 square feet in an
urbanized area from one use to another, qualifies as a Class 3 Categorical Exemption
per the provisions of the California Environmental Quality Act (CEQA) pursuant to
Section 15303(c) of the CEQA Guidelines. Refer to Attachment No. 2 for the Preliminary
Exemption Assessment.
PUBLIC COMMENTS/NOTICE
Public hearing notices for this item were
mailed on or before April 28, 2016, to the
property owners and tenants of those
properties that are located within 300 feet of
the subject property. As of May 4, 2016, no
comments have been received in response
to the public hearing notices.
RECOMMENDATION
It is recommended that the Planning
Commission approve Conditional Use Permit
No. CUP 15-13 for a tutoring business, and
find that the project is exempt per Section
15303(c) of the CEQA Guidelines, by
adopting Resolution No. 1962 that includes the following conditions of approval:

1. The use approved by CUP 15-13 is limited to a tutoring business, which shall be
operated and maintained in a manner that is consistent with the proposal and plans
submitted and approved for CUP 15-13, and shall be subject to periodic
inspections, after which the provisions of this Conditional Use Permit may be
adjusted after due notice to address any adverse impacts to the adjacent streets,
rights-of-way, and/or the neighboring businesses and properties.
2. A maximum of 10 staff and 84 children are permitted, with class hours limited to
9:30 a.m. to 6:30 p.m. seven days a week.
3. The applicant shall construct a trash enclosure, sized to comply with City
requirements, on the property prior to the final inspection of any building permits
issued for the expansion of the tutoring center. Said trash enclosure shall be
designed to the satisfaction of the Community Development Administrator or
designee.
4. All City requirements regarding disabled access and facilities, occupancy limits,
building safety, health code compliance, emergency equipment, environmental
regulation compliance, and parking and site design shall be complied with by the
property owner/applicant to the satisfaction of the Building Official, City Engineer,
Community Development Administrator, Fire Marshal, and Public Works Services
Director, or their respective designees. The changes to the existing facility may be
subject to building permits after having fully detailed plans submitted for plan check
review and approval by the aforementioned City officials.
5. Noncompliance with the plans, provisions and conditions of approval for CUP 15-13
shall be grounds for immediate suspension or revocation of any approvals, which
could result in the closing of the tutoring business.
6. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its
officials, officers, employees, and agents from and against any claim, action, or
proceeding against the City of Arcadia, its officials, officers, employees or agents to
attack, set aside, void, or annul any approval or conditional approval of the City of
Arcadia concerning this project and/or land use decision, including but not limited to
any approval or conditional approval of the City Council, Planning Commission, or
City Staff, which action is brought within the time period provided for in Government
Code Section 66499.37 or other provision of law applicable to this project or
decision. The City shall promptly notify the applicant of any claim, action, or
proceeding concerning the project and/or land use decision and the City shall
cooperate fully in the defense of the matter. The City reserves the right, at its own
option, to choose its own attorney to represent the City, its officials, officers,
employees, and agents in the defense of the matter.
7. Approval of CUP 15-13 shall not be of effect unless on or before 30 calendar days
after Planning Commission adoption of the Resolution, the property owner and
applicant have executed and filed with the Community Development Administrator

or designee an Acceptance Form available from the Development Services
Department to indicate awareness and acceptance of these conditions of approval.
PLANNING COMMISSION ACTION
Approval
If the Planning Commission intends to approve this proposal, the Commission should
approve a motion to approve Conditional Use Permit No. 15-13, stating that the
proposal satisfies the requisite findings, and adopting the attached Resolution No. 1962
that incorporates the requisite environmental and Conditional Use Permit findings and
the conditions of approval as presented in this staff report, or as modified by the
Commission.
Denial
If the Planning Commission intends to deny this proposal, the Commission should
approve a motion to deny Conditional Use Permit No. 15-13, stating the finding(s) that
the proposal does not satisfy with reasons based on the record, and direct staff to
prepare a resolution for adoption at the next meeting that incorporates the
Commission’s decision and specific findings.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ARCADIA, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT
NO. CUP 15-13 WITH A CATEGORICAL EXEMPTION UNDER THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) FOR A NEW
TUTORING BUSINESS WITHIN AN EXISTING COMMERCIAL
BUILDING AT 9 W. LAS TUNAS DRIVE
WHEREAS, in December 2015, Ms. Eileen Li, the owner of Little Stanford
Academy and the Stanford Institute, submitted an application for Conditional Use Permit
No. CUP 15-13 to permit a new tutoring business in an existing commercial building that
will serve 84 children at 9 W. Las Tunas Drive (the “Project”); and
WHEREAS, on March 29, 2016, Planning Services completed an
environmental assessment for the Project in accordance with the California
Environmental Quality Act (CEQA), and recommended that the Planning Commission
determine that the Project is exempt under CEQA per Section 15303 of the CEQA
Guidelines because the Project is converting the use of an existing building, does not
involve the use of a significant amount of any hazardous materials, and does not
exceed 10,000 square feet of floor area within an urbanized setting; and
WHEREAS, on May 10, 2016, a duly noticed public hearing was held before the
Planning Commission on the Project, at which time all interested persons were given full
opportunity to be heard and to present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Community Development
Division in the attached report dated May 10, 2016, are true and correct.
SECTION 2. This Commission finds, based upon the entire record:
1. That the granting of such Conditional Use Permit will not be detrimental to
the public health or welfare or injurious to the property or improvements in such zone or
vicinity.
FACT: The proposed use will not be detrimental to the public health or welfare,
or the surrounding properties because the size of the proposed tutoring business, and
the amount of traffic generated are consistent with other uses permitted by-right on the

SECTION3. Thatforthe foregoing reasonsthisCommission grants. a
ConditionalUse Permit to operate aneducational center, upon the following conditions:

I. Thereshallbe no
parking or
stoppingalong the driveway aislefor picking-
up/or
dropping offofstudents.
2. Two "LoadingOnly" spaces shallbe provided inaddition to anyrequired van-
accessible handicappedparking spacesubject tostaff'sreviewand approval.
3. Themaximumhumberofstudents atany onetime shall notexceedfifty (50).
4. AllCity coderequirements regardingaccessibility, fire protection, occupancy,
andsafety shallbecomplied with tothe satisfactionof Building ServicesandtheFire
Department.
5. Approval ofCUP01-018shall nottake effectuntilthe property owner and
applicant haveexecutedandfiledthe Acceptance FormavailablefromtheDevelopment
Services Department toindicate acceptance of the
conditions of approval.
6. Allconditions of approval shallbe complied with prior tothe opening ofthe
learning center.
Noncompliance withtheplans, provisions andconditionsofCUP01-
018shallbegrounds forimmediate suspension or
revocation of anyapprovals forthe
education center.
SECTION 4. The Secretary shall certify to the adoption of thisResolution and
shall cause a copy tobeforwarded tothe City Councilofthe City ofArcadia.
