MP 16-01 AND OAK TREE ENCROACHMENT PERMIT NO. TRE 16-03 WITH A CLASS 5 CATEGORICAL EXEMPTION FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) FOR A NEW 12,490 SQUARE-FOOT, TWO-STORY RESIDENCE WITH FIRST-STORY SIDE YARD SETBACKS OF 16’-0” AND 15’-0” IN LIEU OF 36’-7” REQUIRED; AND SECOND-STORY SIDE YARD SETBACKS OF 30’-0” AND 46’-0” IN LIEU OF 73’-3” REQUIRED AT 901 FALLEN LEAF ROAD Recommended Action: Conditional Approval SUMMARY The applicant, Mr. Tim Barber, Architect, is requesting approval of first and second story side yard setback modifications for a new 12,490 square-foot, Spanish-style, two-story residence with an attached 880 square-foot, three-car garage, a 6,296 square-foot basement, and a 480 square-foot detached accessory structure on an irregular-shaped, 38,325 square-foot lot. The proposed development will encroach into the protected area of one oak tree. The architectural design of the proposed residence has been reviewed and approved by the Architectural Review Board of the Rancho Santa Anita Property Owner’s Association (ARB) and this project qualifies as a Class 5 Categorical Exemption from the California Environmental Quality Act (CEQA) as a minor alteration in land use limitations. It is recommended that the Planning Commission approve Modification No. MP 16-01 and Oak Tree Encroachment Permit No. TRE 16-03, subject to the conditions listed in this staff report. BACKGROUND The subject property is an irregularly shaped 38,325 square-foot, interior lot, zoned R-0 & D - refer to Attachment No. 1 for an Aerial photo with Zoning Information and Photos of the Subject Property and Vicinity. The property is currently improved with a 7,114 square foot, one-story, Ranch-style, single-family residence built in 1954. A Certificate of Demolition was approved on April 22, 2016, for the existing residence. The evaluation by an Architectural Historian found that the existing residence has no historical significance because it is common in type and style. The Historian’s report is included as Attachment No. 2. The architectural design of the proposed new residence was reviewed and approved by the Rancho Santa Anita Property Owners’ Association’s (Upper Rancho) Architectural Review Board (ARB) on September 24, 2015 and they found the proposed setbacks to be adequate MP 16-01 & TRE 16-03 901 Fallen Leaf Road May 10, 2016 Page 2 of 7 because they are the same or greater than the existing home and the applicant was able to adjust the design to mitigate the concerns of the neighboring property owners – see Attachment No. 3 ARB Findings and Action Form. PROPOSAL The applicant is proposing to demolish the existing structures on the site to build a new 12,490 square-foot, Spanish-style, two-story residence with an attached 880 square-foot, three-car garage, a 6,296 square-foot basement, and a 480 square-foot detached accessory structure. The front elevations are shown below, and the architectural plans are included as Attachment No. 4. The proposed new residence includes eight bedrooms, six full bathrooms, five half bathrooms, a media room with a bar and wine cellar, a gun room, a gym and yoga room, three mudrooms, two offices, two laundry rooms, a music room, and a playroom. The proposed architectural style is described as Spanish, with architectural features that include red barrel clay tile roofing, exposed rafters, gabled roofs, dark blue wood frame doors and windows, and smooth white colored stucco. The overall building height is 29’-10” as measured from the average existing grade, where a maximum of 30-0” is permitted by Code. The proposed new residence will have a lot coverage of approximately 25%. The maximum allowed by Code is 35%. The development will encroach into the protected area of one oak tree located in the City’s parkway area, and a dead Sycamore tree located in the northwest corner of the subject property has been approved for removal. Due to the irregular shape of the lot, the applicant is requesting approval of Zoning Modifications to allow a westerly first-story side yard setback of 16’-0’ and a northerly first-story side yard setback of 15’-0”, both in lieu of 36’-7” required, and a 30’-0” westerly second-story side yard setback and a 46’-0” northerly second-story side yard setback, both in lieu of 73’-3” required. Figure 1. - A rendering of the east elevation of the proposed new residence Figure 2. - A rendering of the south elevation of the proposed new residence MP 16-01 & TRE 16-03 901 Fallen Leaf Road May 10, 2016 Page 3 of 7 ANALYSIS Zoning Modifications Per Resolution 6770, the required side yard setbacks for the Upper Rancho are a minimum of 15’-0”. The R-0 zoning regulations requires a first story side yard setback to be 10% of the lot width measured along the front lot line, and the second story side yard setback to be 20% of the lot width. The intent of the side yard setback requirements is to provide adequate buffers between properties proportionate to the widths of the lots. The subject property is irregularly shaped with a front property line that measures 366’-5”, which is nearly twice the width of the two nearest lots (i.e., 911 Fallen Leaf Road and 900 Fallen Leaf Road). Based on the front lot width, the first-story side yard setback requirement is 36’-7” and the required second-story setback is 73’-3”. The applicant is requesting Modifications to allow a westerly first-story side yard setback of 16’-0’ and a northerly first-story side yard setback of 15’- 0”, and a 30’-0” westerly second-story side yard setback and a 46’-0” northerly second-story side yard setback. Applying the 10 and 20 percent requirements for side yard setbacks results in unreasonable requirements for this property and significantly reduces the buildable area of the subject lot. Allowing the reduced side yard setbacks for this property will avoid an unreasonable hardship for developing this lot. Also, the proposed setbacks are the same or greater than the existing house and they comply with the Upper Rancho’s setback requirement per Resolution 6770. The Rancho Santa Anita Property Owners’ Association’s Architectural Review Board has reviewed and approved the plans and is in support of the Modification requests. During the ARB review process concerns were raised regarding the compatibility of the proposed home. Due to the grade difference between the subject property and the neighboring property to the west the ARB felt that the southern portion of the home would be out of scale with the neighborhood. Other issues that were discussed were privacy for the neighboring property owners and front yard fencing. To address these concerns, the applicant made changes to the proposed design. The main changes include the following: 1. Lowered the overall building height by 2’-0 by revising the roof pitch from 4:12 to 3:12 and lowering the grade and a portion of the southern wing of the home (the garage and mudroom). By lowering the grade, the elevation difference between the subject property and neighboring property to the west was reduced from 5’-0” to 4’-0”. 2. Added 18’-0” tall hedge along westerly side property line for privacy. 3. Removed fencing along a portion of the street frontage to be more harmonious with the neighborhood and maximize sightlines. Oak Tree Encroachment Permit There is one healthy Engelmann Oak tree located in the City’s parkway on the west side of the subject property. Perimeter garden walls, walkways, and landscaping will encroach into the protected area of the oak tree. Certified Arborist, Mr. Scott McAllaster prepared a Protected Tree Report dated January 15, 2016, – refer to Attachment No. 5 for the Arborist Report. The Arborist found that with protective measures, the development will not have an adverse impact MP 16-01 & TRE 16-03 901 Fallen Leaf Road May 10, 2016 Page 4 of 7 on the health of the oak tree. The Public Work Services Department maintains trees in the public right-of-way. Dave Thompson, Street Superintendent, reviewed the plans and Arborist Report and requested that the walkway and wall be moved 10’-0” away from the trunk of the tree, outside the critical root zone. This request has been added as a condition of approval. There is also a Sycamore tree located in the northwest corner of the subject property. During the Arborist’s initial visit on January 15, 2016, it was found that this tree has a fungus that causes defoliation and dieback. The severity of the infection could not be determined at the time and a follow-up assessment was recommended to be done in the spring to see if the tree could recover. The Arborist re-examined the tree on April 22, 2016, and determined that this Sycamore had died – refer to Attachment No. 6 for the Arborist’s Report for the Dead Sycamore. The Arborist recommends removal of the tree. The applicant submitted a Diseased and/or Hazardous Tree Removal Permit application on April 26, 2016. Staff approved the application with the condition that two, 24”-box Engelmann Oak trees be planted at locations to be determined by the Certified Arborist. Architectural Style The Rancho Santa Anita Property Owners’ Association’s Architectural Review Board (ARB) is charged with the responsibility to ensure that the designs for new homes are consistent with the City’s Single-Family Residential Design Guidelines, and the design guidelines and regulations in City Council Resolution No. 6770, both of which are intended to ensure that new homes are harmonious and compatible with the neighborhood. The ARB approval states that the home is significantly visible from the public right-of-way and adjoining properties due to the grade difference between the neighboring properties, the overall height of the proposed home, and the size of the home being larger than the existing house. But, the ARB also finds that the proposal is acceptable because of the numerous changes that were made to satisfy the neighboring property owner and because the proposed home provides greater setbacks than the existing residence – refer to Attachment No. 3 for the ARB Findings and Action Form. Staff also finds the proposed design to be consistent with the City’s Single-Family Residential Design Guidelines, and the design standards in Resolution No. 6770. However, due to the irregular shape of the lot, the grade that slopes up from the street, and the very long street frontage, minor revisions to the proposed design would further the harmony and compatibility of the design with the adjacent structures and neighborhood. Staff recommends contouring the grade in front of the home to at least the level of the garden walls shown around the patios so that fewer structural features will be visible from the street. In order to help break up the massing of the home along the street frontage, staff recommends increasing the size of the two required replacement trees from 24”-box to 48”-box Engelmann Oaks that are minimum 15’-0” in height. The trees shall be located in the front yard area in the south and southeast portions of the site. The locations shall be reviewed and approved by the Development Services Director, or designee. FINDINGS Modifications Section 9292.1.4 of the Arcadia Municipal Code states that the purpose of the Modification procedures is for the following: 1. Secure an appropriate improvement of a lot, MP 16-01 & TRE 16-03 901 Fallen Leaf Road May 10, 2016 Page 5 of 7 2. Prevent an unreasonable hardship, or 3. Promote uniformity of development. The requested Modifications will allow side yard setbacks that are proportionate to the lot, and compatible with the setbacks of other houses in the neighborhood. The requested Modifications will secure an appropriate improvement of the subject lot and promote uniformity of development. Oak Tree Encroachment The Certified Arborist found that the proposed encroachments, with protective measures, will not harm the one Oak Tree. However the Public Works Services Department requested that the wall and walkway be moved 10’-0” from the trunk of the tree, outside the critical root zone area. With the condition that the wall and walkway be relocated, the encroachment will be consistent with the City’s Tree Preservation Regulations. ENVIRONMENTAL ANALYSIS The proposed project qualifies as a Class 5 Categorical Exemption for minor alterations in land use limitations under the requirements of the California Environmental Quality Act (CEQA) per Section 15305 of the CEQA Guidelines. Refer to Attachment No. 7 for the Preliminary Exemption Assessment. PUBLIC NOTICE/COMMENTS Public hearing notices for MP 16-01 and TRE 16-03 were mailed to the property owners of those properties that are located within 100 feet of the subject property on April 28, 2016. As of May 5, 2016, staff has not received any public comments on this project. RECOMMENDATION It is recommended that the Planning Commission approve Modification No. MP 16-01 and TRE 14-03, subject to the following conditions: 1. The proposed design shall be revised as follows: a. Contour the grading in front of the home to at least the level of the garden walls shown around the patios so that fewer structural features will be visible from the street; and b. Two 48”-box Engelmann Oaks that are minimum 15’-0” in height shall be planted in the front yard area in the south and southeast portions of the site. The locations shall be reviewed and approved by the Development Services Director, or designee. 2. The project shall be developed and maintained by the applicant/property owner in a manner that is consistent with the plans submitted and conditionally approved for Modification No. MP 16-01 and Oak Tree Encroachment No. TRE 16-03, subject to the approval of the Community Development Administrator or designee. The project shall be developed and maintained by the applicant/property owner in compliance with all of the recommended tree protection measures listed in the Tree Report(s) prepared for this project. The wall and walkway around the oak tree shall be revised to be at least 10’-0” away from the trunk, outside the critical root zone area. 4. The applicant/property owner shall comply with all City requirements regarding building safety, fire prevention, detection, suppression, emergency access, public right-of-way improvements, parking, water supply and water facilities, sewer facilities, trash reduction and recycling requirements, and National Pollutant Discharge Elimination System (NPDES) measures to the satisfaction of the Building Official, Fire Marshal, Public Works Services Director and Development Services Director, or their respective designees. Compliance with these requirements is to be determined by having fully detailed construction plans submitted for plan check review and approval by the foregoing City officials and employees. 5. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officials, officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officials, officers, employees or agents to attack, set aside, void, or annul any approval or conditional approval of the City of Arcadia concerning this project and/or land use decision, including but not limited to any approval or conditional approval of the City Council, Planning Commission, or City Staff, which action is brought within the time period provided for in Government Code Section 66499.37 or other provision of law applicable to this project or decision. The City shall promptly notify the applicant of any claim, action, or proceeding concerning the project and/or land use decision and the City shall cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose its own attorney to represent the City, its officials, officers, employees, and agents in the defense of the matter. 6. Approval of MP 16-01, and TRE 16-03 shall not take effect unless on or before 30 calendar days after Planning Commission approval of these applications, the property owner and applicant have executed and filed with the Community Development Administrator or designee an Acceptance Form available from the Development Services Department to indicate awareness and acceptance of these conditions of approval. PLANNING COMMISSION ACTION Approval If the Planning Commission intends to approve this project, the Commission should approve a motion to approve Modification No. MP 16-01 and Oak Tree Encroachment Permit No. TRE 16- 03, based on the aforementioned findings, including that the project is Categorically Exempt from the California Environmental Quality Act (CEQA), and subject to the aforementioned conditions, or as may be modified by the Commission. Denial If the Planning Commission intends to deny this project, the Commission should approve a motion to deny Modification Application No. MP 16-01 and/or Oak Tree Encroachment Application No. TRE 16-03, and state the specific findings that the proposal does not satisfy based on the evidence presented with specific reasons for denial. (ldanconia@timbarberltd.com) Re: 901 Fallen Leaf Road, Arcadia, California – Assessment of Tree #40 Dear Mr. and Mrs. Holliday, This letter is submitted in response to the City of Arcadia’s request for the re-evaluation of a mature California sycamore (Tree #40) located at the northwest corner of the property located at 901 Fallen Leaf Road in Arcadia. Tree #40 is a mature sycamore tree that, at the time of our original site visit on January 12, 2016, exhibited extensive dieback and wilting leaves. It was our conclusion at that time that the presence of sycamore anthracnose was the cause of the defoliation. We recommended reassessing the tree in the spring to evaluate the severity of infection to see how, or if, the tree had put on a new set of leaves. During my evaluation of this tree on April 22, 2016, the tree appears to have further declined and now appears dead. The tree exhibits no live foliage and no evidence of new growth. In addition, a large Ganoderma conk is present on the north side of the trunk. Ganoderma is a pathogenic fungi that causes white rot decay in trees. Infected wood becomes soft and the tree is prone to ductile fracture and windthrow1. We determined that decay is very likely present and recommend removal of this tree. Although Tree #40 is proposed for removal as part of the proposed development of the property, the tree is recommended for removal as a direct result of its present poor overall health and structure. This tree is significantly and irreparably compromised, has an elevated probability of failure, and should be removed as soon as possible.
