CITY OF ARCADIA Arcadia Modification Committee Annotated Agenda Tuesday, June 28, 2016, 7:45 a.m. Location: City Council Chamber Conference Room, 240 W. Huntington Drive, Arcadia Pursuant to the Americans with Disabilities Act, persons with a disability who require a disability related modification or accommodation in order to participate in a meeting, including auxiliary aids or services, may request such modification or accommodation from Planning Services at 626-574-5423. Notification 48 hours prior to the meeting will enable the City to make reasonable arrangements to assure accessibility to the meeting. CALL TO ORDER ROLL CALL COMMITTEE MEMBERS: Brad Thompson, Chairman Dominic Lazzaretto, Committee Member and City Manager Jason Kruckeberg, Committee Member and Assistant City Manager/Development Services Director STAFF MEMBERS: Lisa Flores, Planning Services Manager Nick Baldwin, Associate Planner SUPPLEMENTAL INFORMATION FROM STAFF REGARDING AGENDA ITEMS None PUBLIC COMMENTS (5 minute time limit per person) None PUBLIC HEARING All interested persons are invited to appear at a public hearing and to provide evidence or testimony concerning any of the proposed items set forth below for consideration. Separate and apart from the applicant (who may speak longer in the discretion of the Committee) speakers shall be limited to five (5) minutes per person. The applicant may additionally submit rebuttal comments, at the discretion of the Committee. You are hereby advised that should you desire to legally challenge in court any action taken by the Modification Committee regarding any Public Hearing item, you may be limited to raising only those issues and objections you or someone else raised at the public hearing or in written correspondence delivered to the Modification Committee at, or prior to, the public hearing. 1. Healthy Sycamore tree Permit No. TRH 16-01 with a Categorical Exemption from the California Environmental Quality Act (CEQA) to legalize the unpermitted removal of an 18-inch Sycamore tree that was located in the rear yard area at 170 W. Norman Avenue. Planner: Nick Baldwin, Associate Planner Staff Report Applicant: Grace Huang Project Location: 170 W. Norman Avenue Recommendation: Conditional Approval Action: A 3-0 vote to deny TRH 16-01 to legalize the unpermitted removal of a protected tree at 170 W. Norman Avenue. The Committee determined that a denial is the appropriate decision since the unpermitted removal was found to be not acceptable. The following compensatory measures were imposed per the City Tree Preservation Regulations (AMC Section 9707.c.2): 1. Within 90 days of this decision, a 72-inch box Sycamore tree shall be planted in the front yard at a location that is subject to the approval of the Planning Services Manager or designee. 2. A Certified Arborist shall supervise the planting of the 72-inch box Sycamore tree on the property and shall submit a follow-up report to Planning Services to verify the fulfillment of this condition. This report shall also be submitted within 90 days of this approval. 3. Within 90 days of this decision, a fine in the amount of $2,600 shall be paid to the City of Arcadia. 4. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officials, officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officials, officers, employees or agents to attack, set aside, void, or annul any approval or conditional approval of the City of Arcadia concerning this project and/or land use decision, including but not limited to any approval or conditional approval of the City Council, Planning Commission, Modification Committee, or City Staff, which action is brought within the time period provided for in Government Code Section 66499.37 or other provision of law applicable to this project or decision. The City shall promptly notify the applicant of any claim, action, or proceeding concerning the project and/or land use decision and the City shall cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose its own attorney to represent the City, its officials, officers, employees, and agents in the defense of the matter. 5. Within 30 calendar days after the decision for this project, the property owner/applicant shall execute and file with the Community Development Administrator or designee an Acceptance Form available from the Development Services Department to indicate awareness and acceptance of these conditions of approval. There is a five working day appeal period after the approval/denial of the request. Appeals are to be filed by 5:30 p.m. on Wednesday, July 6, 2016.
