ARCADIA PLANNING COMMISSION
REGULAR MEETING MINUTES
Tuesday, July 26, 2016
CALL TO ORDER
Chairman Lin called the meeting to order at 7:00 p.m. in the Arcadia City Council Chamber
PLEDGE OF ALLEGIANCE

ABSENT: None
SUPPLEMENTAL INFORMATION FROM STAFF REGARDING AGENDA ITEMS
The following information was distributed: For Item 1, a map and printed images of the proposed
project at 920 S. Fifth Avenue; for Item 3, a letter from the property owner; for Item 5, the
Consultant was in attendance to address any traffic concerns along with City Attorney Stephen
Deitsch to ensure technical issues are properly addressed.
PUBLIC COMMENTS (5 minute time limit per person)

PUBLIC HEARINGS
1. Appeal of the Development Services Department decision to deny Single-Family Architectural
Design Review No. SFADR 15-88 for a proposed 6,400 square-foot, two-story, Traditional-style
residence, with an attached, 718 square-foot, three-car garage at 920 S. Fifth Avenue – (This
item was continued from the June 14, 2016 meeting.)
Appellant and Applicant: Philip Chan, Designer
Recommended Action: Deny Appeal and Uphold Denial
Community Development Administrator Jim Kasama introduced the item and turned it
over to Associate Planner Nick Baldwin who presented the staff report.
Chairman Lin opened the Public Hearing.
Chairman Lin asked if the appellant would like to speak on this item.
Appellant/applicant and designer Mr. Philip Chan responded.
Chairman Lin asked if anyone else would like to speak in favor of the appeal.
No one responded.
Chairman Lin asked if there was anyone who would like to speak in opposition to the
appeal.

MOTION
It was moved by Commissioner Chiao, seconded by Commissioner Thompson to close
the public hearing. Without objection, the motion was approved.

the appeal and uphold the Development Services Department decision of the denial of
Single-Family Architectural Design Review No. SFADR 15-88 for a proposed 6,400
square-foot, two-story, Traditional-style residence, with an attached, 718 square-foot,
three-car garage at 920 S. Fifth Avenue.

2. Resolution No. 1968 – Approving Conditional Use Permit No. CUP 16-05 with a Categorical
Exemption under the California Environmental Quality Act (CEQA) for a new 2,800 square-foot
indoor playground at 52 E. Live Oak Avenue
Applicant: Sandra Wu, Business Owner
Recommended Action: Approve and Adopt Resolution No. 1968
Community Development Administrator Jim Kasama introduced the item and turned it
over to Associate Planner Nick Baldwin who presented the staff report.

Applicant and business owner Mrs. Sandra Wu along with Mr. Frank Wu responded.
Chairman Lin asked if anyone else would like to speak in favor of this item.

item.

It was moved by Vice Chairman Chan, seconded by Commissioner Chiao to close the
public hearing. Without objection, the motion was approved.

MOTION
It was moved by Commissioner Chiao, seconded by Commissioner Thompson to adopt
Resolution No. 1968 – Approving Conditional Use Permit No. CUP 16-05 with a
Categorical Exemption under the California Environmental Quality Act (CEQA) for a new
2,800 square-foot indoor playground at 52 E. Live Oak Avenue subject to the conditions
in the staff report and amended to add a condition requiring that the owner/applicant
shall execute and record in the Office of the Los Angeles County Registrar Recorder a
Covenant providing reciprocal access and parking for the two properties currently owned
by the owner/applicant at and proximate to the subject property. Such Covenant shall be
prepared by the owner/applicant, shall be in a form and substance approved by the City
Attorney (e.g., it shall not be amended or terminated without written approval of the City),
shall be submitted to the City’s Community Development Administrator or designee for
approval by the City Attorney prior to recordation with the County Recorder and shall be
recorded with the County Recorder prior to issuance by the City of a business license
pursuant to this Conditional Use Permit. The owner/applicant shall deposit with the City
the sum of $1,500 for purposes of the City Attorney’s review of the Covenant. Such
deposit shall be increased on demand by the City as needed and any excess funds shall
be properly refunded to the owner/applicant.

Lane

Recommended Action: Deny Appeal and Uphold Approval

5. Resolution No. 1967- Recommending to the City Council, approval of Specific Plan No. SP
15-01, Zone Change No. ZC 16-01, and a Mitigated Negative Declaration under the
California Environmental Quality Act (CEQA), for the Arroyo Pacific Academy Specific Plan at
325 North Santa Anita Avenue and 400 Rolyn Place
Applicant: Mr. Phillip Clarke
Recommended Action: Adopt Resolution No. 1967 and forward a recommendation to the City
Council.
Commissioner Thompson stated that he conducted an appraisal of a portion of the
subject properties. It has been more than three years since he conducted the appraisal.
In addition, he is an acquaintance of one of the owners of the subject properties. He said
he discussed this with City Attorney Stephen Deitsch and was advised by Mr. Deitsch
that there is no conflict of interest based on the information Commissioner Thompson
provided.
City Attorney Stephen Deitsch confirmed that Commissioner Thompson has no conflict
of interest relating to this project.
Community Development Administrator Jim Kasama introduced the item and turned it
over to Planning Services Manager Lisa Flores and Assistant Planner Jordan
Chamberlin who presented the staff report.

Chairman Lin asked if the applicant would like to speak on this item.
Applicant and President of Arroyo Pacific Academy Mr. Phillip Clarke responded along
with the Traffic Engineer Pat Gibson.
Chairman Lin asked if anyone else would like to speak in favor of this item.

Chairman Lin asked if there was anyone who would like to speak in opposition to this
item.

It was moved by Commissioner Chiao, seconded by Vice Chairman Chan to close the
public hearing. Without objection, the motion was approved.
MOTION
It was moved by Commissioner Chiao, seconded by Vice Chairman Chan to adopt
Resolution No. 1967 to recommend to the City Council, approval of Specific Plan No.
SP 15-01, Zone Change No. ZC 16-01, the Mitigated Negative Declaration and
Mitigation Monitoring & Reporting Program under the California Environmental Quality
Act (CEQA), for the Arroyo Pacific Academy Specific Plan at 325 North Santa Anita
Avenue and 400 Rolyn Place, subject to the conditions in the staff report, with the City
Attorney’s revisions to condition no. 1 and the change in the number of students from
250 to 258.

MATTERS FROM CITY COUNCIL LIAISON
City Council Liaison April Verlato was not able to attend this meeting.
MATTERS FROM PLANNING COMMISSIONERS
Commissioner Chiao reiterated his sentiment that the fee for design review appeals should be
increased.
MATTERS FROM MODIFICATION COMMITTEE
Commissioner Lewis substituted as Chairperson for Chairman Brad Thompson and announced
that the two items on the agenda were both conditionally approved.
MATTERS FROM STAFF INCLUDING UPCOMING AGENDA ITEMS
Mr. Kasama referred to binders of the draft Zoning Code Update that were distributed to the
Commissioners and advised the Commissioners to review the draft for the August 9 Study

Session, and to send any questions to Planning Services Manager Lisa Flores; and that there
are two items in addition to the study session for the next meeting.
ADJOURNMENT
The Planning Commission adjourned this meeting at 9:45 p.m. to Tuesday, August 9, 2016, at
5:00 p.m., in the City Council Chamber Conference Room at 240 W. Huntington Dr., Arcadia.
