HomeMy WebLinkAbout06/21/2016 ARCADIA CITY COUNCIL REGULAR MEETING MINUTES TUESDAY, JUNE 21, 2016 CALL TO ORDER— Mayor Beck called the meeting to order at 7:00 p.m. INVOCATION - Reverend Darwin Ng, Police Department Chaplain PLEDGE OF ALLEGIANCE— Caleb Sales ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Council Member Amundson, Chandler, Tay, and Beck ABSENT: Council Member Verlato A motion was made by Mayor Pro Tem Amundson, seconded by Council Member Tay, to excuse Council Member Verlato from this meeting. REPORT FROM CITY ATTORNEY REGARDING'CLOSED/STUDY SESSION ITEMS . City Attorney Deitsch reported that the City Council conducted a Study Session at a Special Meeting to consider the one item listed on the posted agenda regarding a request for commemorative naming of a City Facility in honor of Floretta Lauber; and at the direction of the City Council, the item will be brought back to the July 19, 2019, Study Session. II City Attorney Deitsch also reported that the City Council met in a Closed Session to consider the one item listed on the posted agenda under Closed Session regarding pending litigation; no reportable action was taken. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto reported that regarding Consent Calendar item 3.o, for animal control services, there was a typographical error in the letter from the Pasadena Humane Society which reflected a 2% increase, which should actually be 3%; and regarding Consent Calendar item 3.q for jail services, the letter from G4 Secure Solutions also has a typographical error that reflects a 3% increase, and it should be 2.5%; and stated that the staff reports and agreements for both items reflect the correct increases, only the letters were incorrect and distributed to the City Council in advance of the meeting. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Tay, seconded by Council Member Chandler to read all ordinances and resolutions by title only and waive the reading in full. PRESENTATIONS a. Presentation of Employment and Training Services Offered by the Foothill Workforce Development Board, Phillip L. Dunn, Executive Director 1 06-21-16 Council Member Chandler requested that Consent Calendar item 3.u. be pulled for separate discussion and action at this time. u. Amendment to the Joint Powers Agreement ("JPA") with the Cities of Arcadia, Duarte, Monrovia, Sierra Madre, South Pasadena, and Pasadena to form the Foothill Workforce Development Board. Recommended Action: Approve It was moved by Council Member Chandler, seconded by Council Member Tay, and carried on roll call vote to approve an amendment to the Joint Powers Agreement ("JPA") with the Cities of Arcadia, Duarte, Monrovia, Sierra Madre, South Pasadena, and Pasadena to form the Foothill Workforce Development Board. APPOINTMENTS a. Appointments to City Boards and Commissions. Recommended Action: Make Appointments Mayor Beck announced that the Youth Advisory Council appointments will be made at a future time. Mayor Beck called for nominations and appointments. Arcadia Beautiful Commission (4 positions) Mayor Beck nominated Ethel Laczko for reappointment the Arcadia Beautiful Commission. Seeing no other nominations, it was moved by Mayor Beck, seconded by Council Member Chandler, that Ethel Laczko be appointed to the Arcadia Beautiful Commission for a (4) four year term ending June 30, 2020. AYES: Council Member Beck, Chandler, Amundson, and Tay NOES: None ABSENT: Council Member Verlato Mayor Beck nominated Barbara Lyle for appointment the Arcadia Beautiful Commission. Seeing no other nominations, it was moved by Mayor Beck, seconded by Council Member Chandler, that Barbara Lyle be appointed to the Arcadia Beautiful Commission for a four (4) year term ending June 30, 2020. • AYES: Council Member Beck, Chandler, Amundson, and Tay NOES: None ABSENT: Council Member Verlato 2 06-21-16 Mayor Beck nominated Robert Miller to fill the unexpired term of Richard Cordano on the Arcadia Beautiful Commission ending June 30, 2017. Seeing no other nominations, it was moved by Mayor Beck, seconded by Council Member Chandler, that Robert Miller be appointed to the Arcadia Beautiful Commission to fill an unexpired term ending June 30, 2017. AYES: Council Member Beck, Chandler, Amundson, and Tay NOES: None ABSENT: Council Member Verlato Arcadia Museum Commission (1 position) Mayor Beck nominated Carlos Reza, Jr. for appointment to the Arcadia Museum Commission. Council Member Tay nominated Jerry Selmer for appointment to the Arcadia Museum Commission. Seeing no other nominations, City Council Members voted as follows: Mayor Beck: Carlos Reza, Jr. Council Member Chandler: Jerry Selmer Council Member Tay: Jerry Selmer Mayor Pro Tern Amundson: Carlos Reza, Jr. It was the consensus of the City Council that the appointment to the Arcadia Museum Commission be continued to the July 5, 2016, City Council meeting when the full City Council is present. Human Resources Commission (2 positions open) Mayor Beck nominated James Dolan for appointment to the Human Resources Commission. Seeing no other nominations, it was moved by Council Member Chandler, seconded by Mayor Beck that James Dolan be appointed to the Human Resources Commission for a four (4) year term ending June 30, 2020. AYES: Council Member Chandler, Beck, Tay, and Amundson NOES: None ABSENT: Council Member Verlato Council Member Chandler nominated Michael Rock to the Human Resources Commission. Seeing no other nominations, it was moved by Council Member Chandler, seconded by Council Member Tay, that Michael Rock be appointed to the Human Resources Commission for a four (4) year term ending June 30, 2020. Council Member Chandler nominated Elizabeth Renfrew for appointment to the Library Board of Trustees. Seeing no other nominations, it was moved by Council Member Chandler, seconded by Council Member Tay that Elizabeth Renfrew be appointed to the Library Board of Trustees for a four (4) year term ending June 30, 2020. AYES: Council Member Chandler, Tay, Amundson, and Beck NOES: None ABSENT: Council Member Verlato Planning Commission (1 position) Mayor Beck announced that a Study Session was conducted on June 7, 2017, and potential candidates were interviewed, and it was the consensus that Deborah Lewis be re-appointed to the Planning Commission. Seeing no other nominations, it was moved by Council Member Chandler, seconded by Mayor Beck, that Deborah Lewis be re-appointed to the Planning Commission for a four (4) year term ending June 30, 2020. AYES: Council Member Beck, Chandler, Amundson, and Tay NOES: None ABSENT: Council Member Verlato Recreation and Parks Commission (2 positions) Mayor Beck nominated Steve Swinney and Lyn Tom for appointments to the Recreation and Parks Commission. Seeing no other nominations, it was moved by Council Member Chandler, seconded by Council Member Tay, that Steve Swinney and Lyn Tom be appointed to the Recreation and Parks Commission for four (4)year terms ending June 30, 2020. AYES: Council Member Beck, Tay, Chandler, and Amundson NOES: None ABSENT: Council Member Verlato Senior Citizens' Commission (2 At-Large position and 2 Service Club Appointments) Mayor Beck nominated Patsy Harbicht for appointment to the Senior Citizen's Commission Assistance League position. Seeing no other nominations, it was moved by Council Member Chandler, seconded by Council Member Tay, that Patsy Harbicht be appointed to the Senior Citizen's Commission Assistance League position for a two (2) year term ending June 30, 2018. 4 06-21-16 AYES: Council Member Chandler, Tay, Amundson, and Beck NOES: None ABSENT: Council Member Verlato Mayor Beck nominated Angie Slemaker for appointment to the Senior Citizen's Commission Golden Age Club position. AYES: Council Member Beck, Tay, Chandler, and Amundson NOES: None ABSENT: Council Member Verlato Council Member Chandler nominated Ivy Song for appointment to the Senior Citizen's Commission At-Large Position. Mayor Beck announced that Ivy Song is not a senior citizen and would like to have a senior appointed to the Commission. Mayor Beck nominated John Dickey for appointment to the Senior Citizen's Commission At- Large Position. Seeing no other nominations, it was moved by Mayor Beck, seconded by Council Member Chandler, that John Dickey be appointed to the Senior Citizen's Commission At-Large position for a two (2) year term ending June 30, 2018. AYES: Council Member Beck, Chandler, Tay, and Amundson NOES: None ABSENT: Council Member Verlato Youth Advisory Council (4 High School and 3 Middle School appointments) Due to the number of applications, Mayor Beck requested that the appointments to the Youth Advisory Commission be continued, since Council Member Verlato is absent and is the liaison. It was the consensus of the City Council that this item be continued to a future meeting. 5 06-21-16 b. Mayor's appointment of Council Member Verlato to serve as liaison to the Youth Advisory Council. Recommended Action: Receive and File Mayor Beck announced his appointment of Council Member Verlato to serve as liaison to the Youth Advisory Council, which she has accepted. It was the consensus of the City Council to receive and file the Mayor's appointment of Council Member Verlato to serve as liaison to the Youth Advisory Council 2. PUBLIC HEARING a. Adoption of the Fiscal Year 2016-17 Budgets. Resolution No. 7131 adopting a budget for Fiscal Year 2016-17 and appropriating the amounts specified therein as expenditures from the funds. Resolution No. 7134 adopting a Capital Improvement and Equipment Plan for Fiscal Years 2016-17 through 2020-21. Recommended Action: Adopt City Manager Lazzaretto presented an overview of the Fiscal Year 2016-17 General Fund Budget, General Fund Revenue and Expense Budget, establishment of the Other Post Employment Benefit ("OPEB")trust fund, an overview of PERS rates, proposed new programs, Capital Improvement Fund; Equipment Replacement Fund; and provided a budget summary. Mayor Beck opened the public hearing. Lawrence C. Papp, an Arcadia resident, appeared and spoke about employee pay and benefits packages; he asked the City Council to start standing up for the taxpayers, not the employees and their unions; he commented about proposed department increases and all the new programs, and asked if they are really necessary. A motion to close the public hearing was made by Council Member Chandler, seconded by Council Member Tay, and seeing no further objections, Mayor Beck declared the public hearing closed. It was moved by Council Member Chandler, seconded by Council Member Tay, and carried on roll call vote to adopt Resolution No. 7131 adopting a budget for Fiscal Year 2016-17 and appropriating the amounts specified therein as expenditures from the funds. Resolution No. 7132 adopting an updated City of Arcadia 2015 Urban Water Management Plan. Recommended Action: Adopt Environmental Services Officer Hevener presented the staff report. Mayor Beck opened the public hearing. No one appeared. A motion to close the public hearing was made by Council Member Chandler, seconded by Council Member Tay, and seeing no further objections, Mayor Beck declared the public hearing closed. It was moved by Mayor Pro Tern Amundson, seconded by Council Member Tay, and carried on roll call vote to adopt Resolution No. 7132 adopting an updated City of Arcadia 2015 Urban Water Management Plan. AYES: Council Member Amundson, Tay, Chandler, and Beck NOES: None ABSENT: Council Member Verlato c. Resolution No. 7133 confirming the Engineer's Report for the levy and collection of the Arcadia Citywide Lighting District No. 1 and the associated assessment diagram; and ordering the levy and collection of assessments for Fiscal Year 2016-17. Recommended Action: Find the Resolution is exempt under the California Environmental Quality Act and Adopt Management Analyst Carmen Masud presented the staff report. Mayor Beck opened the public hearing. No one appeared. A motion to close the public hearing was made by Council Member Chandler, seconded by Council Member Tay, and seeing no further objections, Mayor Beck declared the public hearing closed. It was moved by Council Member Tay, seconded by Council Member Chandler, and carried on roll call vote to adopt Resolution No. 7133 confirming the Engineer's Report for the levy and collection of the Arcadia Citywide Lighting District No. 1 and the associated assessment diagram; and ordering the levy and collection of assessments for Fiscal Year 2016-17. AYES: Council Member Tay, Chandler, Amundson, and Beck NOES: None ABSENT: Council Member Verlato d. Appeal of Business Permit and License Review Board revocation of a business license for noncompliance with the City of Arcadia Massage Therapist and Business License Regulations by Qiu Xia Liu at 149 East Huntington Drive. Recommended Action: Uphold Revocation and Deny Appeal City Attorney Deitsch explained to the City Council the administrative proceeding process. Business License Officer Vergel presented the staff report. 7 06-21-16 Mayor Beck opened the public hearing. City Attorney Deitsch stated that the Appellant was advised prior to the hearing that she was allowed to bring an interpreter. Qiu Xia Liu, the appellant appeared, and asked that her business license not be revoked and read a prepared statement regarding the incident. A motion to close the public hearing was made by Council Member Chandler, seconded by Council Member Tay, and seeing no further objections, Mayor Beck declared the public hearing closed. It was moved by Council Member Chandler, seconded by Council Member Tay, and carried on roll call vote to uphold the revocation and deny the appeal of Business Permit and License Review Board revocation of a business license for noncompliance with the City of Arcadia Massage Therapist and Business License Regulations by Qiu Xia Liu at 149 East Huntington Drive; and not be allowed to own or operate a massage business or work as message therapist in the City of Arcadia for one year. AYES: Council Member Chandler, Tay, Amundson, and Beck NOES: None ABSENT: Council Member Verlato PUBLIC COMMENTS — No one appeared f REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense(AB 12341) Council Member Tay reminded everyone to eat and shop in Arcadia; and announced the June 26 Golden Streets event and invited everyone to attend. Mayor Pro Tern Amundson announced that the windmill at Denny's will be turned on again on Wednesday, June 29; and Saturday, July 2 is the Arcadia Downtown Patriotic Festival, and invited everyone to attend. Council Member Chandler congratulated Fire Chief Norwood on his upcoming retirement. City Clerk Glasco announced the beginning of the summer concerts on Thursday, July 7 on the front lawn at City Hall, and movies in the park beginning on Friday, July 8; and wished every a Happy and Safe Fourth of July. Mayor Beck wished everyone a Happy Safe Fourth of July; and commented on the number of highly qualified applicants for City's Board and Commission appointments; and also congratulated Fire Chief Norwood for all his years of service. Fire Chief Norwood thanked City staff and current and former City Councils for all their support to him and the Fire Department. 8 06-21-16 3. CONSENT CALENDAR a. Resolution No. 7124 ordering the vacation of a public utility easement at 681 North First Avenue. Recommended Action: Adopt b. Resolution No. 7128 approving an agreement with California Employers' Retiree Benefit Trust ("CERBT") for establishing Section 115 Irrevocable OPEB Trust; and delegating authority to the City Manager and/or designee to authorize distributions from the OPEB Trust Fund. Recommended Action: Adopt c. Resolution No. 7135 establishing an appropriations limit for Fiscal Year 2016-17 pursuant to Article XIII-B of the California Constitution. Recommended Action: Adopt d. Resolution No. 7136 confirming the amount of a special assessment, confirming and ordering the recovery of penalties and costs assessed and imposed by the Arcadia City Council for violations of City Codes occurring on the property at 226 E. Forest Avenue, Arcadia, California, A.P.N. 5772022019, and ordering the assessment be collected on the tax roll by the Los Angeles County Tax Collector as a special assessment in the amount of $41,709.89 to recoup costs and fees incurred in the prosecution of the People v. Corregidor nuisance abatement action. Recommended Action: Adopt e. Ordinance No. 2337 repealing Chapter 9.4 of Article IV of the Arcadia Municipal Code regarding Sex Offender Registration. Recommended Action: Adopt f. Contract with Vincor Construction Inc. for the installation of electrical lighting equipment at the Arcadia Par 3 Golf Course in the amount of$139,197.36. Recommended Action: Approve g. Contract with E&R Construction, Inc. for the Water Main Replacement Project in the amount of$224,772.50 Recommended Action: Approve h. Contract with J. Colon Coatings, Inc. for the Torrey Pines Reservoir Exterior Recoating Project in the amount of$48,000. Professional Services Agreement with Studio Spectrum, Inc. for video production and broadcast services for City Council meetings in the amount of$32,500. Recommended Action: Approve n. Professional Services Agreement with All City Management Services for crossing guard services in an amount not to exceed $565,819. Recommended Action: Approve o.
