STUDY SESSION a. Report, discussion, and direction concerning the Citywide Historic Resources Survey Report. It was moved by Mayor Beck, seconded by Council Member Tay that staff (1) proceed with public outreach to provide information to the residents and allow time for feedback; (2) prepare detailed costs analysis of recommended options including staffing implications; (3) prepare potential timeline for implementation; and (4) return to the City Council in a future Study session for further consideration, after the Nos. 1-3 are completed. Pursuant to Government Code Section 54956.9(d)(1.) to confer with legal counsel regarding the matter of Judith Cook; Pamela McGinnis v. The meeting adjourned at 6:59 p.m. REGULAR CITY COUNCIL MEETING 7:00 p.m. CALL TO ORDER— Mayor Beck called the meeting to order at 7:00 p.m. INVOCATION - Reverend Thomas Shriver, Emmanuel Assembly of God and Arcadia Police Department Chaplain PLEDGE OF ALLEGIANCE -Amy Macklin, Co-President of the Friends of the Arcadia Library 1 07-19-2016 ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Chandler, Tay, Verlato, Amundson, and Beck ABSENT: None REPORT FROM CITY ATTORNEY REGARDING STUDY/CLOSED SESSION ITEM City Attorney Deitsch reported that the City Council met in a Study Session to hear a report, discuss, and provide direction concerning the proposed Citywide Historic Resources Survey report, and it was moved by Mayor Beck, seconded by Council Member Tay that staff (1) proceed with public outreach to provide information to the residents and allow time for feedback; (2) prepare detailed costs analysis of recommended options including staffing implications; (3) prepare potential timeline for implementation; and (4) return to the City Council in a future Study session for further consideration, after the Nos. 1-3 are completed. City Attorney Deitsch also reported that the City Council met in a Closed Session to consider the one item listed on the posted agenda under Closed Session; no reportable action was taken. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto stated that three (3) items relating to Public Hearing 2.a were received, (1) a white binder submitted by the Applicant with information relating to the project; (2) 3 letters in support of the project; and (3) 11 letters in opposition of the project were all distributed to the City Council prior to the meeting. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Tay, seconded by Council Member Chandler, to read all ordinances and resolutions by title only and waive the reading in full. PRESENTATIONS a. Presentation of a $40,000 check from the Friends of the Arcadia Public Library to the Arcadia Public Library. 1. APPOINTMENTS a. Appointment to the Senior Citizens' Commission. Recommended Action: Make Appointment Mayor Beck called for nominations. The City Council nominated as follows: Council Member Verlato—Anthony Leung Council Member Tay— Ivy Song Mayor Beck—Yolanda Barrera Council Member Chandler—Yolanda Barrera Mayor Pro Tern Amundson -Anthony Leung Due to the tie vote, Council Member Chandler withdrew his nomination of Yolanda Barrera and nominated Anthony Leung. 2 07-19-2016 It was moved by Council Member Verlato, seconded by Mayor Pro Tern Amundson, to appoint Anthony Leung to the Senior Citizens' Commission for a two year term ending June 30, 2018. AYES: Verlato, Amundson, Chandler, Tay, and Beck NOES: None ABSENT: None 2. PUBLIC HEARING a. Call up of the Planning Commission approval of single-family architectural design review No. SFADR 16-08 for a proposed 3,588 square-foot, two-story, single- family residence with an attached 418 square-foot, two-car garage at 1101 S. Fifth Avenue. Recommended Action: Uphold Planning Commission Decision Community Development Administrative Kasama and Associate Planner Baldwin presented the staff report. Mayor Beck opened the public hearing. Sherry Xi, resident on Fifth Avenue, appeared and expressed her opposition of the project, and urged the City Council to deny the project. Phillip Chan, designer of the project, appeared and walked the City Council through the binder he submitted regarding the project, and provided a chronology of events; he explained that he tried to address comments and concerns from the neighbors and reminded the City Council that there was no Floor Area Ratio (FAR) requirement when the project was originally submitted; he explained his concerns with the project and City regulations and restrictions regarding FAR; and urged the City Council to approve the project. In response to a question raised by Council Member Verlato, Mr. Chan confirmed that he has never met with Council Member Verlato. Mr. Chan also reminded the City Council of the three letters received by neighbors in support of the project that were distributed to them prior to the meeting. Ivan (inaudible), an Arcadia resident, appeared and expressed his support of the project, but suggested that maybe the size of the home can be reduced so that the neighbors do not feel so intruded upon. Carol Otaviano, an Arcadia resident, appeared and indicated that all aspects of a project should be considered when looking at plans for a new home, not just the floor to area ratio. (name inaudible), resident on Fifth Avenue, appeared and expressed her opposition of the project; she appealed to the City Council to respect their neighborhood by keeping the homes ranch style and one story. Karen (inaudible), resident on Fifth Avenue, appeared and expressed her opposition of the project, and indicated that it is a beautiful home and beautiful design, but indicated that it is too big and does not fit in the neighborhood. 3 07-19-2016 (did not provide her name), resident on Fifth Avenue, also appeared and expressed her opposition of the project; she indicated that the house is too big and does not fit in the neighborhood. A motion to close the public hearing was made by Mayor Pro Tern Amundson, seconded by Council Member Tay, and seeing no further objection, Mayor Beck declared the public hearing closed. Council Member Verlato explained the reason for her calling this item up for City Council review regarding design review. It was moved by Council Member Chandler, seconded by Council Member Tay to uphold the Planning Commission's decision for approval of Single-Family Architectural Design Review No. SFADR 16-08, for a proposed 3,588 square-foot, two-story, single-family residence with an attached 419 square-foot, two-car garage at 1101 S. Fifth Avenue; and that the Conditions of Approval be amended to include removal of windows on the north and south sides of the second floor; that skylights be added to provide for lighting and ventilation; and that trees be added on the north and side sides of the property for privacy purposes. AYES: Chandler, Tay, and Beck NOES: Verlato and Amundson ABSENT: None b. Ordinance No. 2338 amending Chapter 7 of Article IX of the Arcadia Municipal Code with an exemption under the California Environmental Quality Act ("CEQA") to add additional protected trees and unprotected trees to the City's tree preservation regulations. Recommended Action: Introduce Community Development Administrator Kasama and Assistant Planner Chamberlin presented the staff report. Mayor Beck provided photographs of palm trees in his neighborhood and around town, and asked Mr. Thompson, the City's Street Superintendent and Certified Arborist, why shouldn't birch trees and 60 foot palm trees be protected. In response to Mayor Beck's question, Mr. Thompson responded that the birch trees are not drought tolerant trees, they have a shorter life span and do better in colder climates and generally do not do well in desert type areas such as California; and that palms are very invasive trees because of the seed pods and are generally are not maintained very well, that in winds, the fronds tend to blow in the street, and surrounding properties. City Manager Lazzaretto noted that a third party arborist report was requested and it also indicated that birch trees are being attacked by a beetle due to the tree not being drought tolerant; and concurred that palm trees are a very invasive tree. Mayor Beck opened the public hearing. Caroline Blake, an Arcadia resident, appeared and requested a copy of the protected and unprotected tree list; she feels that the tree list should be expanded and provided her reasons; she feels that trees promote property values. 4 07-19-2016 Greg Vanni, an Arcadia resident, appeared and commented on his support of protecting trees in Arcadia, and urged the City Council to vote yes. A motion to close the public hearing made by Council Member Chandler, seconded by Council Member Tay, and seeing no further objection, Mayor Beck declared the public hearing closed. It was moved by Mayor Beck, seconded by Council Member Chandler, to introduce Ordinance No. 2338 amending Chapter 7 of Article IX of the Arcadia Municipal Code with an exemption under the California Environmental Quality Act ("CEQA") to add additional protected trees and unprotected trees to the City's tree preservation regulations; and add liquid ambars to the unprotected tree list. AYES: Beck, Chandler, Tay, Verlato, and Amundson NOES': None ABSENT: None c. Resolution No. 7137 denying Conditional Use Permit No. CUP 15-05 with a categorical exemption under the California Environmental Quality Act ("CEQA") for a new tutoring center within an existing commercial building at 1012 S. Baldwin Avenue. Recommended Action: Adopt Community Development Administrator Kasama and Associate Planner Baldwin presented the staff report. Mayor Beck opened the public hearing. Jinda Korprapun, property owner at 1012 S. Baldwin Avenue, appeared and addressed the City's concerns regarding parking; she also indicated that the school will also provide van transportation services which will minimize traffic concerns; Rufino Segovia, the applicant, appeared and answered questions raised by the City Council; and responded that there will be a total of four rooms -- computer room, library and two classrooms. Jinda Korprapun, the property owner, further explained the purpose of the tutoring center, the use of each room, and added that the tutoring center will provide transportation minimizing student pick-ups and drop-offs. Brianna Serrano, daughter of the applicant, appeared and expressed her support for the tutoring center and urged the City Council to approve the application. A motion to close the public hearing was made by Council Member Chandler, seconded by Council Member Tay, and seeing no further objection, Mayor Beck declared the public hearing closed. After discussion by the City Council, City Manager Lazzaretto suggested that the item be continued to bring back a resolution to allow 12 students and transportation to a minimum of 6 students. 5 07-19-2016 It was moved by Council Member Chandler, seconded by Council Member Verlato to continue the public hearing and bring back a resolution limiting the number of students to 12, and provide transportation to a minimum of at least 6 students. AYES: Chandler, Verlato, Tay, Amundson, and Beck NOES: None ABSENT: None d. Confirm the County of Los Angeles Department of Agricultural Commissioner/Weights and Measures Weed Abatement charges. Recommended Action: Approve City Manager Lazzaretto presented the staff report. Mayor Beck opened the public hearing. No one appeared. A motion to close the public hearing was made by Council Member Chandler, seconded by Council Member Tay, and seeing no further objection, Mayor Beck declared the public hearing closed. It was moved by Council Member Chandler, seconded by Council Member Tay, to approve and confirm the County of Los Angeles Department of Agricultural Commission/Weights and Measures weed abatement charges and order the County Auditor to enter the amounts of the assessment against the parcels of land as they appear on the current assessment roll. AYES: Beck, Chandler, Tay, Verlato, Amundson NOES: None ABSENT: None PUBLIC COMMENTS John MacDonald, an Arcadia resident, appeared and requested staff evaluate the traffic flow situation at Huntington Drive and Second Avenue regarding the north and south traffic flow, that it does not appear that there is enough time for traffic to move through the intersection and suggested maybe adding a turn signal; he explained the Santa Anita Avenue and Foothill Boulevard intersection turning west traffic and requested staff look into it. He asked that Council Member Verlato not speak on behalf of all residents on the hill. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including'reports from the City Council related to meetings attended at City expense[AB 12341) Mayor Pro Tem Amundson spoke about the coyote awareness and coyote whistles being given away at City Hall; and commented on the safety of walking and looking at the cellphone. Council Member Chandler commented on the City Council's pre-meeting held earlier regarding the Citywide Historic Resources Survey Report. Council Member Tay commented on the City's protected tree ordinance, and suggested that staff do some public outreach; he announced that on Saturday two Arcadia residents will be receiving awards, City Clerk Gene Glasco will be receiving the "Community Activist of the Year Award" and Kin Hui will be receiving the "Business Person of the Year Award" from 6 07-19-2016 Congresswoman Judy Chu; he announced the Water 101 forum at the Library and provided reservation information; that on July 31 Aaron Ross will be installed as the new President of the Arcadia Chinese Association; and the Concert in the Park on July 21, and Movie in the Park on July 22, and invited everyone to attend. Council Member Verlato asked residents that when they see an Arcadia Police Officer to stop and say thank you for all they do; she also thanked Police Chief Guthrie and the Arcadia Police Department for all they do and for keeping the community safe. City Clerk Glasco indicated that he was recently at a local restaurant and was stopped by a group of residents who shared with him that they were very pleased with City staff and complimented the City Council on how they are running the City. Mayor Beck commented on the Citywide Historic Resources Survey Report; he asked for City Council Member support to expand the notification area for new construction to include the nearest 30 homes, giving priority to primary streets where the proposed new construction will take place, where all homes on the primary street within 500 feet, whichever is greater, the notification area to include the nearest 5 homes on the street to the rear of the property, and the envelope of the notification letter to be stamped in red "Notice of Proposed New Construction in Your Area"; the appeal period expanded to 10 days, and the notice should include the lot size and square feet, the floor area ratio percentage, and the back of the notification letter to be in Chinese; he feels the notification area small and wants to make sure everyone concerned is notified. Assistant City Manager/Development Services Director Kruckeberg responded that the request is doable, but expressed that his concerns are with the translation because of timing issues. Mayor Beck made a motion to bring back a report regarding this matter in 30 days. The City Council unanimously concurred. In response to a question raised by Mayor Pro Tern Amundson, Assistant City Manager/Development Services Director Kruckeberg responded that tomorrow night's meeting is a public informational meeting regarding the Zoning Code update. Mayor Beck congratulated City Clerk Gene Glasco and Kin Hui on the awards they will be receiving from Congresswoman Judy Chu on Saturday; he noted the dedication at Wilderness Park in honor of Jerry Collins, and reminded everyone to visit Wilderness Park; and also commended and thanked the Police Department for keeping Arcadia safe. 3. CONSENT CALENDAR a. Donation of $1,705 from Santa Anita Park for programs and services at the Gilb Museum of Arcadia Heritage. Recommended Action: Accept b. Gift of $40,000 from the Friends of the Arcadia Public Library for programs, services and materials for the Library. Recommended Action: Accept c. Extension to the Contract with ABM Services, Inc. for janitorial and porter services at various City facilities in an amount not to exceed $310,841.21. - Recommended Action: Approve 7 07-19-2016 d. Professional Services Agreements with Scott Fazekas and Associates, Inc. in the amount of $250,000: and VCA Code Group in the amount of $450,000 for professional building plan review and related services for the Development Services Department. Recommended Action: Approve e. Professional Services Agreement with Armstrong & Walker and Hirsch & Associates Inc. for landscape and irrigation plan checking services in the amount of$200,000. Recommended Action: Approve f. Purchase Order with HD Supply Waterworks for the purchase of data loci radio read water meters for the City's water distribution system in the amount of $500,000. Recommended Action: Approve g. Purchase Order with National Auto Fleet Group for the purchase of five Ford Explorer black and white police patrol vehicles in the amount of$172,070.55. Recommended Action: Approve h. Resolution No. 7139 supporting the Los Angeles County Coordinated Paratransit Plan.
