HomeMy WebLinkAbout08/16/2016 ARCADIA CITY COUNCIL REGULAR MEETING MINUTES TUESDAY, AUGUST 16, 2016 CALL TO ORDER— Mayor Beck called the meeting to order at 6:05 p.m. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Chandler, Tay, Verlato, Amundson, and Beck ABSENT: None PUBLIC COMMENTS - No one appeared. CLOSED SESSION a. Pursuant to Government Code Section 54956.8 conference with real property negotiators: Property: 100 W. Huntington Drive Agency Negotiators: City Manager Dominic Lazzaretto, Assistant City Manager/Development Services Director Jason Kruckeberg, and City Attorney Stephen P. Deitsch Negotiating Parties: City of Arcadia and Andy Chang (Seabiscuit Pacifica LLC) Under Negotiations: Price and Terms of Payment No reportable action was taken. STUDY SESSION a. Report, discussion and direction regarding the replacement of the Civic Center Soccer Field. • Recommended Action: Replace with Revolution 360 Field using Cool Play infill Public Works Services Director Tait and Director of Recreation and Community Services Somogyi presented the report. It was moved by Council Member Chandler, seconded by Mayor Beck, to approve Option 2, to replace the Civic Center Soccer Field with the Revolution 360 Field in the amount of$165,000, with the addition of CoolPlay infill, and no logo. The motion carried on the following roll call vote: AYES: Chandler, Beck, Tay, and Verlato NOES: Amundson It was moved by Council Member Chandler, seconded by Mayor Beck, to approve goal anchors in the amount of $8,000 for the Civic Center Soccer Field. The motion carried on the following roll call vote: AYES: Chandler, Beck, Tay, Verlato, and Amundson NOES: None The meeting adjourned at 6:44 p.m. 1 08-16-2016 REGULAR CITY COUNCIL MEETING 7:00 p.m. CALL TO ORDER— Mayor Beck called the meeting to order at 7:00 p.m. INVOCATION - Reverend Jolene Cadenbach, Arcadia Congressional Church PLEDGE OF ALLEGIANCE— Girl Scout Troop 361 ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Council Member Chandler, Tay, Verlato, Amundson, and Beck ABSENT: None REPORT FROM CITY ATTORNEY REGARDING STUDY/ CLOSED SESSION ITEM City Attorney Deitsch reported that the City Council met in a Closed Session to consider the one item listed on the posted agenda under Closed Session; no reportable action was taken. City Attorney Deitsch also reported that the City Council met in a Study Session to receive a report from staff regarding the replacement of the Civic Center Soccer Field; and on motion by Council Member Chandler, seconded by Mayor Beck (with Mayor Pro Tern Amundson voting no) to approve Option 2, to replace the Civic Center Soccer Field with the Revolution 360 Field in the amount of $165,000, with the addition of CoolPlay infill, and no logo; and on motion by Council Member Chandler, seconded by Mayor Beck, the Council voted unanimously to approve goal anchors in the amount of$8,000 for the Civic Center Soccer Field. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto indicated that two Council Members had clarifications to the July 5, 2016, City Council minutes which were corrected, and additional responses to comments on the initial study and proposed mitigated negative declaration on the Arroyo Pacific Academy, Public Hearing item 2.a., were also distributed to the City Council in advance of the meeting. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Tay, seconded by Council Member Chandler, to read all ordinances and resolutions by title only and waive the reading in full. 1. APPOINTMENTS a. Appointments to the Youth Advisory Council. Recommended Action: Make Appointments It was moved to Council Member Chandler, seconded by Council Member Tay, to temporarily suspend the maximum number of members on the Youth Advisory Council from seven to eight until the number of members returns to 7; and appoint Natalie Chen, Sean Lee, Ben Lui, Jillian Moore, and Daisy Lau as the high school representatives to the Youth Advisory Council to serve until June 30, 2018. The motion carried on the following roll call vote: 2 08-16-2016 AYES: Council Member Chandler, Tay, Verlato, Amundson, Beck NOES: None ABSENT: None 2. PUBLIC HEARING Mayor Beck announced that he will recuse himself from discussion and participation in the public hearing; that he has spoken to the City Attorney and has been advised that he does not have a conflict; however, the owner is a personal friend of his and wants to avoid the appearance of a conflict of interest, he will recuse himself. Mayor Beck left the room, and Mayor Pro Tern Amundson took over the public hearing. a. Specific Plan No. SP 15-01, Zone Change No. ZC 16-01, and a Mitigated Negative Declaration pursuant to the California Environmental Quality Act, for the Arroyo Pacific Academy Specific Plan at 325 North Santa Anita Avenue and 400 Rolyn Place. Resolution No. 7144 approving Specific Plan No. SP 15-01, Zone Change No. ZC 16-01, and a Mitigated Negative Declaration under the California Environmental Quality Act ("CEQA"), for the Arroyo Pacific Academy Specific Plan at 325 North Santa Anita Avenue and 400 Rolyn Place. Recommended Action: Adopt Ordinance No. 2339 making certain amendments to the text of the Arcadia Zoning Code; and amending the Zoning designation of certain property within the City from "C-2 with Downtown Overlay" to "SP-AP," Arroyo Pacific Specific Plan, with respect to the Arroyo Pacific Academy School Campus at 325 North Santa Anita Avenue and 400 Rolyn Place. Recommended Action: Introduce Assistant City Manager Kruckeberg and Assistant Planner Chamberlain presented the staff report. Mayor Pro Tern Amundson opened the public hearing. Phillip Clarke, the applicant/owner and President/CEO of the Arroyo Pacific Academy, appeared and thanked the City and City staff for all their help in getting to this point in the process, and feels that this project will be a great asset to the City. Mr. Clarke responded to questions raised by the City Council. A motion to close the public hearing was made by Council Member Chandler, seconded by Council Member Tay, and seeing no further objection, Mayor Pro Tern Amundson declared the public hearing closed. It was moved by Council Member Verlato, seconded by Council Member Tay, to adopt Resolution No. 7144 approving Specific Plan No. SP 15-01,.Zone Change No. ZC 16-01 and a Mitigated Negative Declaration under the California Environmental Quality Act ("CEQA"), for the Arroyo Pacific Academy Specific Plan at 325 North Santa Anita Avenue and 400 Rolyn Place; and 3 08-16-2016 Introduce Ordinance No. 2339 making certain amendments to the text to the text of the Arcadia Zoning Code; and amending the zoning designation of certain property within the City from "C-2 with Downtown Overlay" to "SP-AP," Arroyo Pacific Specific Plan, with respect to the Arroyo Pacific Academy School Campus at 325 North Santa Anita Avenue and 400 Rolyn Place, subject to the Conditions of Approval list in the staff report#1 through #32. The motion carried on the following roll call vote: AYES: Verlato, Tay, Chandler, and Amundson NOES: None ABSENT: None ABSTIAN: Beck Mayor Beck returned to the room at the conclusion of the item and resumed his role as presiding officer. PUBLIC COMMENTS—No one appeared. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense[AB 1234)) Council Member Tay announced that he was on vacation last week in Hawaii, and noted how friendly the people were; and noted that it is not a good idea to post pictures on social media when on vacation because burglars will know you are out of town. Council Member Verlato provided a brief report on actions taken by the Planning Commission at their last meeting, and spoke about the Planning Commission item that she has called up for review by the City Council. Mayor Pro Tern Amundson commented on former Mayor Floretta Lauber's services and felt that former Mayor Kovacic captured the true essence of Floretta in his eulogy, that Floretta would have been very happy with the sendoff she received, and he thanked City staff for all they did; he also spoke about SB 1146 and noted that, due to public outcry, the author withdrew the most offensive provisions relating to religious liberties protected under the First Amendment; he commented on the approval of license plate readers on the agenda; and congratulated Bob and Shirley Wilson of Arcadia who recently celebrated their 65th wedding anniversary. Council Member Chandler also commented on the services of former Mayor Floretta Lauber and also complimented former Mayor Kovacic on his eulogy, and thanked City Clerk Glasco for is help as well. City Clerk Glasco also commented on the services of former Mayor Floretta Lauber and thanked the Police Department for the police escort; and announced that the Gilb Museum of Arcadia Heritage will be presenting a memorial exhibit of former Mayor Floretta Lauber, which includes photographs and highlights of her decades of contributions to the community. Mayor Beck reminded the City Council that on July 19, 2016, a public hearing was conducted regarding a house at 1101 S. Fifth Avenue, the project was approved by a 3-2 vote, but that no windows were to be installed on the north and side of the second floor due to neighbor privacy issues; he noted that he thought about it in days after, and felt that there should be windows on the second floor. 4 08-16-2016 In response to a question raised by Mayor Beck, City Attorney Deitsch explained the process needed to bring the item back to a future City Council meeting for the sole purpose of discussing the windows on the second floor. Mayor Beck asked for City Council support to bring back this item back to a future meeting for the possible reconsideration and discussion of allowing windows on the second floor or not. Council Member Tay, Council Member Chandler, and Mayor Pro Tern Amundson concurred. Mayor Beck announced that Thursday is the last Concert in the Park and invited everyone to attend; he also commented on former Mayor Floretta Lauber's services and the escort service provided by the Police Department, and thought it was a great salute for someone who did a lot for the community, he also complimented former Mayor Kovacic's eulogy, and also thanked City Clerk Glasco for his comments at the Women's Club that were equally good and moving; he indicated that he was recently contacted by the President of the Upper Rancho Home Owners Association because they are concerned about residential burglaries in their area and are considering hiring a private security company 24-7, and asked Police Chief Guthrie to comment on the latest statistics on residential burglaries. Chief Guthrie provided an update on overall residential burglaries. 3. CONSENT CALENDAR a. Special and Regular Meetings Minutes of July 5, 2016, Regular Meeting Minutes of July 19, 2016. Recommended Action: Approve b. Professional Services Agreement with Phoenix Group Information Systems for citation and parking permit processing in an amount not to exceed $31,600. Recommended Action: Approve c. Agreement with Liebert Cassidy Whitmore for personnel related legal services in an amount not to exceed $75,000. Recommended Action: Approve d. Purchase and installation of Automated License Plate Recognition ("ALPR") camera systems from 3M - PIPSTM Technology, Inc. in the amount of$141,880. Recommended Action: Approve e. Purchase of portable handheld radios from Day Wireless Systems for the Police Department in the amount of$100,513.07. Recommended Action: Approve f. Median Island Master Plan Update. Recommended Action: Approve g. Accept all work performed by Vincor Construction, Inc. for the repair of the Colorado.Boulevard right-of-way slope. Recommended Action: Approve Mayor Beck requested Consent Calendar item 3.f be pulled for further discussion, and announced that he will abstain from voting on Consent Calendar item 3.g. The motion carried on the following roll call vote: 5 08-16-2016 It was moved by Council Member Chandler, seconded by Council Member Tay, and carried on roll call vote to approve Consent Calendar Items 3.a through 3.e and 3.g., with amendments to the July 5, 2016, City Council minutes. The motion carried on the following roll call vote: AYES: Beck, Chandler, Tay, Verlato, and Amundson NOES: None ABSENT: None ABSTAIN: Beck (Consent Calendar Item 3.g only) Mayor Beck explained the purpose of pulling this item for discussion; he noted that the staff report for the median project indicates the project is to be completed over the next 4 fiscal years, but recalls at a previous meeting it was discussed to be a three fiscal year project. In response to Mayor Beck's comments, City Manager Lazzaretto apologized for the confusion and indicated that if the City Council desires the project be done over a three fiscal year period that should be the City Council's motion. It was moved by Mayor Beck, seconded by Council Member Chandler, and carried on roll call vote to approve Consent Calendar Item 3.f. and move forward with the median project on a three fiscal year timetable. The motion carried on the following roll call vote: AYES: Beck, Chandler, Tay, Verlato, and Amundson NOES: None ABSENT: None CITY MANAGER a. Neighborhood Notification Policies and Procedures for Design Review proiects. Recommended Action: Approve City Manager Lazzaretto, Mayor Beck, and Assistant City Manager/Development Services Director Kruckeberg presented the staff report. It was moved by Mayor Beck, seconded by Council Member Verlato, and carried on roll call vote to support the notification enhancements outlined in the ongoing Zoning Code Update process including the expansion of the notification area for design review projects to a 300' radius, and an extended appeal period of ten (10) days; and add language to upcoming notices that includes the lot size, floor area ratio, notation that construction is coming soon, and a line in Traditional Chinese that reflects the importance of the document.
