CITY OF ARCADIA Arcadia Modification Committee Annotated Agenda Tuesday, July 26, 2016, 7:45 a.m. Location: City Council Chamber Conference Room, 240 W. Huntington Drive, Arcadia Pursuant to the Americans with Disabilities Act, persons with a disability who require a disability related modification or accommodation in order to participate in a meeting, including auxiliary aids or services, may request such modification or accommodation from Planning Services at 626-574-5423. Notification 48 hours prior to the meeting will enable the City to make reasonable arrangements to assure accessibility to the meeting. Huntington Drive, Arcadia, California, during normal business hours. PUBLIC HEARING All interested persons are invited to appear at a public hearing and to provide evidence or testimony concerning any of the proposed items set forth below for consideration. Separate and apart from the applicant (who may speak longer in the discretion of the Committee) speakers shall be limited to five (5) minutes per person. The applicant may additionally submit rebuttal comments, at the discretion of the Committee. You are hereby advised that should you desire to legally challenge in court any action taken by the Modification Committee regarding any Public Hearing item, you may be limited to raising only those issues and objections you or someone else raised at the public hearing or in written correspondence delivered to the Modification Committee at, or prior to, the public hearing. 1. Modification No. MC 16-10 and Administrative Architectural Design Review No. Admin SFADR 16-45 with a Categorical Exemption from the California Environmental Quality Act (CEQA) to convert the existing legal non-conforming third car garage to livable space that is attached to the main house and maintain the existing setbacks. Planner: Nick Baldwin, Associate Planner Staff Report Applicant: George White, Property Owner Project Location: 2236 Hollis Lane Recommendation: Conditional Approval Action: A 3-0 vote to conditionally approve Modification No. MC 16-10 and Administrative Architectural Design Review No. Admin SFADR 16-45 at 2236 Hollis Lane, subject to the following conditions: 1. The concrete driveway leading to the attached garage that will be converted to livable space shall be removed and landscaped. The plans submitted to Building Services for plan check shall be revised to reflect the proposed changes and comply with the City’s Water Efficient Landscaping Ordinance. 2. The detached garage shall be improved to match the same roof, paint color, and windows as approved on the main house. 3. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officials, officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officials, officers, employees or agents to attack, set aside, void, or annul any approval or conditional approval of the City of Arcadia concerning this project and/or land use decision, including but not limited to any approval or conditional approval of the City Council, Planning Commission, Modification Committee, or City Staff, which action is brought within the time period provided for in Government Code Section 66499.37 or other provision of law applicable to this project or decision. The City shall promptly notify the applicant of any claim, action, or proceeding concerning the project and/or land use decision and the City shall cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose its own attorney to represent the City, its officials, officers, employees, and agents in the defense of the matter. 4. Approval of MC 16-10 and Admin. SFADR 16-45 shall not be of effect unless on or before 30 calendar days after approval of this project, the property owner/applicant has executed and filed with the Community Development Administrator or designee an Acceptance Form available from the Development Services Department to indicate awareness and acceptance of these conditions of approval. Modification No. MC 16-12 and Administrative Architectural Design Review No. Admin ADR 16-52 with a Categorical Exemption from the California Environmental Quality Act (CEQA) to allow the expansion of a legal non-conforming duplex by allowing a new 400 square foot, detached, two car garage on a property that is zoned single-family (R-1). Duarte Road Recommendation: Conditional Approval Action: A 3-0 vote to conditionally approve Modification No. MC 16-12 and Administrative Architectural Design Review No. Admin ADR 16-52 at 274 & 276 W. Duarte Road, subject to the following conditions: 1.
