Location: City Council Chamber Conference Room, 240 W. Huntington Drive, Arcadia
Pursuant to the Americans with Disabilities Act, persons with a disability who require a disability related modification or accommodation in

PUBLIC HEARING
All interested persons are invited to appear at a public hearing and to provide evidence or testimony
concerning any of the proposed items set forth below for consideration. Separate and apart from the
applicant (who may speak longer in the discretion of the Committee) speakers shall be limited to five (5)
minutes per person. The applicant may additionally submit rebuttal comments, at the discretion of the
Committee.
Any writings or documents provided to a majority of the Modification Committee regarding any item on this agenda will be
made available for public inspection in the City’s Planning Services Office located at 240 W. Huntington Drive, Arcadia,
California, during normal business hours.
You are hereby advised that should you desire to legally challenge in court any action taken by the Modification
Committee regarding any Public Hearing item, you may be limited to raising only those issues and objections
you or someone else raised at the public hearing or in written correspondence delivered to the Modification
Committee at, or prior to, the public hearing.
1. Modification No. MC 16-03 and Sign Design Review No. SADR 16-07 with a Class 3 Categorical
Exemption under the California Environmental Quality Act (CEQA) to replace the existing monument sign
with a new double-sided monument sign with LED message boards on a multi-family (R-3) zoned property.

Recommendation: Conditional Approval
Action: A 3-0 vote to conditionally approve, Modification No. MC 16-03 and Sign Design Review
No. SADR 16-07, subject to the following conditions:
1. One, double-sided monument signs with LED message boards shall be permitted perpendicular to W.
Duarte Road. The sign shall not exceed 6’-0” in height by 7’-8” in width.
2. The digital displays on the LED message boards cannot change more frequently than every thirty (30)
minutes and may only be displayed between the hours of 7:00 AM to 10:00 PM, daily.
3. No videos, flashing blinking, or moving images, shall be permitted within a given message. Simple
transitions between messages are acceptable. Examples of acceptable transitions would include, but
not be limited to, fading out/in or sliding in from a single direction. Examples of prohibited animations
would include, but not be limited to, spinning, bouncing, dissolving, or zooming animations.
4. A Certified Arborist shall be on site to monitor the demolition of the existing sign and the excavation for
the foundation of the sign new sign. A follow-up report from the Certified Arborist shall be submitted to
Planning Services prior to a foundation inspection by Building Services.
5. The signs shall be operated and maintained in a manner that is consistent with the proposal and plans
submitted and approved for MC 16-03 and SADR 16-07 by the Modification Committee, and shall be
subject to periodic inspections, after which the provisions of this approval may be adjusted after due
notice to address any adverse impacts to the adjacent streets, rights-of-way, and/or the neighboring
uses and properties.
6. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officials, officers,
employees, and agents from and against any claim, action, or proceeding against the City of Arcadia,
its officials, officers, employees or agents to attack, set aside, void, or annul any approval or conditional
approval of the City of Arcadia concerning this project and/or land use decision, including but not
limited to any approval or conditional approval of the City Council, Planning Commission, Modification
Committee, or City Staff, which action is brought within the time period provided for in Government
Code Section 66499.37 or other provision of law applicable to this project or decision. The City shall
promptly notify the applicant of any claim, action, or proceeding concerning the project and/or land use
decision and the City shall cooperate fully in the defense of the matter. The City reserves the right, at
its own option, to choose its own attorney to represent the City, its officials, officers, employees, and
agents in the defense of the matter.

7. Approval of MC 16-03 and SADR 16-07 shall not be of effect unless on or before 30 calendar days
after approval of this project, the property owner/applicant has executed and filed with the Community
Development Administrator or designee an Acceptance Form available from the Development Services
Department to indicate awareness and acceptance of these conditions of approval.
There is a five working day appeal period after the approval/denial of the request. Appeals are to be filed
by 5:30 p.m. on Tuesday, August 30, 2016.
2. Modification No. MC 16-04 and Sign Design Review No. SADR 16-19 with a Class 3 Categorical
Exemption under the California Environmental Quality Act (CEQA) to replace the existing monument sign
with a new double-sided monument sign with LED message boards and two illuminated directional signs on
an institutional property zoned single-family (R-1) residential.

Recommendation: Conditional Approval
Action: A 3-0 vote to conditionally approve, Modification No. MC 16-04 and Sign Design Review
No. SADR 16-19 subject to the following conditions, including an amendment to condition
No. 2:
1. One, double-sided monument signs with LED message boards shall be permitted perpendicular to W.
Duarte Road. The maximum size of the signs shall not exceed 6’-7” in height by 11’-0” in width.
2. The digital displays on the LED message boards cannot change more frequently than every three (3)
minutes and may operate 24 hours a day, seven days a week. Any changes to the timing of the digital
displays shall be subject to review and approval by the Development Services Director, or designee.
3. No videos, flashing or blinking, or moving images shall be permitted within a given message. Simple
transitions between messages are acceptable. Examples of acceptable transitions would include, but
not be limited to, fading out/in or sliding in from a single direction. Examples of prohibited animations
would include, but not be limited to, spinning, bouncing, dissolving, or zooming animations.
4. The location of the two (2) directional signs shall be determined by the City Engineer prior to the
issuance of a Building Permit.
5. The signs shall be operated and maintained in a manner that is consistent with the proposal and plans
submitted and approved for MC 16-04 and SADR 16-19 by the Modification Committee, and shall be
subject to periodic inspections, after which the provisions of this approval may be adjusted after due
notice to address any adverse impacts to the adjacent streets, rights-of-way, and/or the neighboring
uses and properties.

3. Modification No. MC 16-13 and Single Family Architectural Design Review No. SFADR 16-13 with a Class
5 Categorical Exemption under the California Environmental Quality Act (CEQA) to maintain a street-side
yard setback of 19’-3” where 25’-0” is required for the conversion of a 320 square foot front covered porch
into livable space. The proposed project also includes design review for a 157 square foot second-story
addition and a 61 square foot first floor addition to the existing house.

Action: A 3-0 vote to conditionally approve, Modification No. MC 16-13 and Single Family
Architectural Design Review No. SFADR 16-13, subject to the following conditions amended to
include an added condition as outlined in condition No. 1:
1. The large Olive tree that is located in the street-side yard area and in front of the main entrance to the
house shall be trimmed and maintained to the satisfaction of the Planning Services Manager prior to
issuance of a final building permit for the proposed project.
2. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officials, officers,
employees, and agents from and against any claim, action, or proceeding against the City of Arcadia,
its officials, officers, employees or agents to attack, set aside, void, or annul any approval or conditional
approval of the City of Arcadia concerning this project and/or land use decision, including but not
limited to any approval or conditional approval of the City Council, Planning Commission, or City Staff,
which action is brought within the time period provided for in Government Code Section 66499.37 or
other provision of law applicable to this project or decision. The City shall promptly notify the applicant
of any claim, action, or proceeding concerning the project and/or land use decision and the City shall
cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose its
own attorney to represent the City, its officials, officers, employees, and agents in the defense of the
