HomeMy WebLinkAbout7143 RESOLUTION NO. 7143 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ADOPTING A MITIGATED NEGATIVE DECLARATION PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT AND APPROVING GENERAL PLAN AMENDMENT NO. GPA 16-03 FOR THE CITY OF ARCADIA ZONING CODE UPDATE ("DEVELOPMENT CODE UPDATE") WHEREAS, in August 2014, the City of Arcadia Development Services Department initiated the Zoning Code Update ("Development Code Update"), which would ensure there is consistency with the General Plan that was adopted in 2010; and WHEREAS, pursuant to the proposed Development Code Update, Article IX of the Municipal Code would be reorganized by consolidating the following four chapters: Chapter 1 — Subdivision Code, Chapter 2 — Zoning Regulations, Chapter 3 — Setbacks, and Chapter 6 — Review of Planning Commission Decisions, with a new Chapter 1 entitled "Development Code;" and WHEREAS, the proposed Development Code Update also includes a General Plan Amendment to extend the Downtown Mixed Use ("DMU") General Plan designation (and the implementation of the DMU zone) to all properties on the south side of St. Joseph Street (between First and Second Avenue), properties on the east and west sides of First Avenue (between St. Joseph Street and La Porte Street), and select properties with frontage on Santa Anita Avenue between St. Joseph Street and Huntington Drive as attached in Exhibit "A"; and WHEREAS, the Development Code Update also includes changes to the Zoning Map to address inconsistencies between the Zoning Map and the General Plan land use map, eliminate duplicative zones and incorporate them into other similar zones, and eliminate archaic zones that no longer apply on the Zoning Map as set forth in Ordinance No. 2341; and WHEREAS, on July 21, 2016, the Draft Initial Study/Mitigated Negative Declaration for the Zoning Code Update was circulated for public review and comment for 20 days from July 21, 2016 to August 10, 2016; and WHEREAS, the Initial Study/Mitigated Negative Declaration ("MND") tiers off of the 2030 General Plan Final Environmental Impact Report ("FEIR") that was certified by the City Council in 2010; and together, the MND and the General Plan FEIR constitute the environmental record for the Development Code Update; and WHEREAS, the MND concluded that the implementation of the Development Code Update will have less-than-significant impacts with mitigation measures for the following areas: Aesthetics, Air Quality, Biological Resources, Geology and Soils, Hazards and Hazardous Materials, Hydrology and Water Quality, Noise, Transportation/Traffic, and Utilities and Service Systems; and WHEREAS, on September 13, 2016, a duly noticed public hearing was held before the Planning Commission on said applications, including the Initial Study/Mitigated Negative Declaration ("IS/MND"), at which time all interested persons were given full opportunity to be heard and to present evidence; and WHEREAS, after the public hearing the Planning Commission adopted Resolution No. 1973 with a 5-0 vote to recommend approval of the Development Code Update to the City Council; and WHEREAS, on October 18, 2016, a duly noticed public hearing was held before the City Council on said applications, including the IS/MND, at which time all interested persons were given full opportunity to be heard and to present evidence; and 2 WHEREAS, all other legal prerequisites to the adoption of this Resolution have been fulfilled. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. The factual data submitted by the Development Services Department in the attached report and Mitigated Negative Declaration are true and correct. SECTION 2. This City Council finds, based upon the entire record: 1. That the proposed action is consistent with the goals, policies, and actions of the General Plan. FACT: The comprehensive update to the Development Code clarifies the review authority and permit procedures, refines allowed uses and development standards for each of the City's zoning districts, and establishes specific use provisions consistent with the action and policy directives set forth in the General Plan. The proposed update to the Zoning Map will ensure that the Zoning Map is consistent with the newly adopted Development Code. The proposed amendments to the General Plan to expand the DMU designation will improve the livability of the City by expanding the permitted uses within the downtown and commercial areas by implementing the vision and goals of the community as expressed in the General Plan. 2. The proposed action would not be detrimental to the public interest, health, safety, convenience, or welfare of the City. FACT: The proposed amendments are in the public interest and reflect the input from the residents, decision makers, and other stakeholders in the community. No 3 changes are proposed under the proposed amendments that would reduce or compromise existing standards that protect the health, safety or general welfare of the City. 3. Pursuant to the provisions of the CEQA, an Initial Study, Mitigated Negative Declaration has been prepared for the Development Code Update, and the Code will have less-than-significant impacts with mitigation measures. SECTION 3. That for the foregoing reasons the City Council adopts the Mitigated Negative Declaration for the Development Code Update, which.consists of General Plan Amendment No. GPA 16-01, Zone Change No. ZC 16-03 and Text Amendment No. TA 16-03. The City Council further adopts General Plan Amendment No. GPA 16-03. SECTION 4. The Secretary shall certify to the adoption of this Resolution.
