CLOSED SESSION Pursuant to Government Code Section 54956.9(d)(1) to confer with legal counsel regarding the matter of Saving Arcadia Coalition v. City of Arcadia; Real Parties in Interest: Philip Chan; Jian Guo Wang; WC Investment, LLC; Los Angeles Superior Court Central District Case No.: BS 164481 (Council Member Verlato has voluntarily recused herself from all matters pertaining to this litigation and did not participate in this Closed Session). No reportable action was taken on this closed session item. The meeting adjourned at 6:50 p.m. REGULAR CITY COUNCIL MEETING 7:00 p.m. CALL TO ORDER— Mayor Beck called the regular meeting to order at 7:00 p.m. INVOCATION — Reverend Thomas Shriver, Emmanuel Assembly of God PLEDGE OF ALLEGIANCE — Jason Kruckeberg, Assistant City Manager/Development Services Director ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Amundson, Chandler, Tay, Verlato, and Beck ABSENT: None REPORT FROM CITY ATTORNEY REGARDING CLOSED SESSION ITEM City Attorney Deitsch announced that the City Council (except for Council Member who has voluntarily recused herself from participation) met in a Closed Session to consider the one item listed on the posted agenda under Closed Session; and that no reportable action was taken. 1 10-04-2016 SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto stated that two minor technical corrections were made to the September 6, 2016, City Council minutes after the agenda was posted, and were distributed to the City Council prior to the meeting. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Tay, seconded by Council Member Chandler to read all ordinances and resolutions by title only and waive the reading in full. PRESENTATIONS a. Proclaiming October 9, 2016, through October 15, 2016, as "Fire Prevention Week". 1. PUBLIC HEARING a. Appeal of the Planning Commission decision to deny Single-Family Architectural Desiqn Review No. SFADR 15-88 for a proposed 6,090-square-foot, two-story, traditional-style residence, with an attached 726-square-foot, three-car garage at 920 S. Fifth Avenue. (continued from the September 6, 2016, City Council Meeting). Recommended Action: Deny Appeal and Uphold Planning Commission Decision Associate Planner Baldwin presented the staff report. Mayor Beck opened the public hearing. Steven Garcia, Attorney for the applicant/owner, appeared on behalf of his client, the owner of the property, Mr. Pan, spoke in support of the project and provided the reasons why the two- story proposed home is compatible with the neighborhood and should be approved. Roger Nemrava, a resident of the Highland Oaks area, appeared and spoke in opposition of the proposed home; and explained why the proposed home does not fit in the neighborhood. Edith Wong, resident of Arcadia, appeared and also spoke in opposition of the project; and indicated that the house is too big and is not compatible with the neighborhood. Attorney Garcia, responded to comments made by Council Member Verlato and Mr. Nemrava; and addressed the photographs in the staff report, and noted that there are no privacy issues with the proposed two-story home and the neighbors. A motion to close the public hearing was made by Mayor Beck, seconded by Council Member Chandler, and seeing no further objection, Mayor Beck declared the public hearing closed. 2 10-04-2016 It was moved by Council Member Chandler, seconded by Mayor Pro Tern Amundson, and carried on roll call vote to deny appeal and uphold Planning Commission decision. AYES: Chandler, Amundson, Tay, Verlato, and Beck NOES: None ABSENT: None a. Resolution No. 7147 ordering the vacation of portions of Hugo Reid Drive and Golden West Avenue. Recommended Action: Adopt Deputy Director of Development Services/City Engineer Wray presented the staff report. Mayor Beck opened the public hearing. No one appeared. A motion to close the public hearing was made by Council Member Chandler, seconded by Council Member Tay, and seeing no further objection, Mayor Beck declared the public hearing closed. It was moved by Council Member Chandler, seconded by Council Member Tay, and carried on roll call vote to adopt Resolution No. 7147 ordering the vacation of portions of Hugo Reid Drive and Golden West Avenue. AYES: Chandler, Tay, Verlato, Amundson, and Beck NOES: None ABSENT: None PUBLIC COMMENTS Roger Nemrava, an Arcadia resident, appeared and spoke about overnight parking in Arcadia; he commented on the large number of vehicles that park on the streets; that vehicles can park overnight on the street all year round for just $84 a year, and that the City should be more restrictive on the process of issuing permits; he suggested the City take a closer look at who is receiving overnight parking permits; and indicated the City should consider raising the fees for the annual overnight parking permits. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense[AB 12341) Council Member Tay stated that he has received several emails blaming him for erecting ugly and eyesore mansions, and that he supports the destruction of Arcadia, which he indicated is nonsense; he noted that mansions were allowed before he was elected to the City Council; that the emails he has received have fictitious names and fictitious email address; that the City Council cannot make everyone happy, that someone will always get upset; and he commented and focused on community unity and safety and promoted Neighborhood Watch. Council Member Verlato reported on actions taken by the Planning Commission at their last meeting regarding a proposed cell tower at a church site; she mentioned an article in the Arcadia Weekly regarding her involvement with Saving Arcadia, and wanted to make it clear the public understands that she is not a member of Saving Arcadia and does not have an official affiliation with them, but that she does support the spirit of the organization and what they are 3 10-04-2016 trying to accomplish; she indicated that she does not support litigation against the City and does not support the idea of the City fighting with its residents; she hopes the City Council can facilitate some kind of resolution without having to go to trial; she hopes that everyone can appreciate her position and her opinion; and that she is ready to review the City's Floor Area Ratio whenever the City is ready. Council Member Chandler asked for City Council support to place the possibility of creating a fire alarm dispensary at the City on a future agenda for discussion (Mayor Beck and Mayor Pro Tem Amundson concurred); and noted for the record that the City is not in conflict with the General Plan, that the General Plan is subjective especially when it comes to the term compatibility. Mayor Pro Tern Amundson spoke about the dangers of coyotes and commented on the City's educational video on the safety of coyotes on the City's website and urged residents to view it; he announced the Arcadia Historic Resources survey community meeting at the Arcadia Library on October 13; and on October 14, Baldwin Stocker Elementary School will be celebrating its 50th year anniversary; he announced that he also attended the Taste of Arcadia; and commented on the various propositions on the ballot and encouraged everyone to get out and vote on November 8, and to vote wisely. City Clerk Glasco announced the Arcadia Museum Foundation's Annual Fundraiser dinner on October 16; and that the Upper San Gabriel Valley Municipal Water District is sponsoring a "Water Fest" on October 15, at the County Park. Council Member Tay reminded everyone that on October 7 is "Coffee with a Cop" at the Arcadia Police Station, Community Room. Mayor Beck announced the Breeders' Cup on November 4 and 5 at Santa Anita Park, and that the Breeders' Cup is looking for volunteers and invited residents to apply; that he also attended the Taste of Arcadia; and noted that he has been asked if Mayor Pro Tern Amundson is running for the Assembly, but learned that it is his son Peter Amundson that is running for the Assembly. 2. CONSENT CALENDAR a. Regular Meeting Minutes of September 6, 2016. Recommended Action: Approve b. Ordinance No. 2340 amending Sections 9220.45.1.3 and 9213 of the Arcadia Municipal Code to regulate the personal, medical, and commercial use of marijuana. Recommended Action: Adopt c. Accept all work performed by American Asphalt South, Inc. for the Fiscal Year 2015-16 Annual Slurry Seal Project as complete. Recommended Action: Approve d. Accept all work performed by Vargas Olson Enterprises, Inc. for the Community Center Restroom Renovation Project as complete. Recommended Action: Approve 4 10-04-2016 e. Accept all work performed by Vasilj, Inc. for the Huntington Drive Sewer Capacity Improvement Project as complete_. Recommended Action: Approve f. Accept all work performed by Vincor Construction, Inc. for the Chamber of Commerce ADA Restroom Improvement Project as complete. Recommended Action: Approve g. Accept all work performed by Pacific Coast Elevator Company (dba Amtech Elevator Services)for the library elevator upgrade project as complete. Recommended Action: Approve h. Letter Agreement with Trovao and Associates, Inc. (dba The Christmas Light Guy Company) to provide holiday decorations for the 2016 Holiday Season in the amount of$34,985. Recommended Action: Approve It was moved by Council Member Tay, seconded by Mayor Pro Tern Amundson, and carried on roll call vote to approve Consent Calendar Item 2.a through 2.h.
