As you may recall the Arcadia Redevelopment Agency as part of its Design
Depuy Guy Manager! Review action of Feb. 2, 1999, required the execution and recordation of an
'Prue"` "Acknowledgement and Declaration of Agency Rights" regarding
Director condemnation. Jim Kasama referred to it in his letter to you of February 4,
1999.
Enclosed is the "Declaration" for execution by the current legal owner(s) of
the property. Please have it executed and notarized by the owner(s) and
returned to me. Please include a copy of the Grant Deed transferring the
property to the current owners or alternatively a copy of the final owners title
policy showing title vested in the current owners. We will need the
Declaration returned and recorded prior to issuance of the certificate of
occupancy of 119 E. La Porte Street.

ACKNOWLEDGMENT AND DECLARATION OF
AGENCY RIGHTS RE CONDEMNATION
(119 E. St. Joseph)
The undersigned represents that he/she/they is/are the sole fee simple Owner of the
property ("Property") described in the legal description attached as Exhibit A. The Owner
acknowledges that the Property is located within the City of Arcadia ("City"), and within the
boundaries of the Arcadia Redevelopment Agency's ("Agency") Central Redevelopment Project
Area ("Project Area").
The Owner has submitted an application to the City and the Agency for the development
of the Property ("Development"). As required by the Redevelopment Plan applicable to the
Project Area, the Agency has approved the Development's Design Review. Furthermore, on
February 2, 1999, the City Council approved M99-001 and ADR 98-038 relating to the
Development.
The Owner acknowledges that the Agency's approval of the Design Review was
expressly conditioned upon and subject to the Owner's acknowledgment and declaration set
forth in this document.
The Owner acknowledges that the square footage of the Property is significantly less
than the minimum square footage required under the Redevelopment Plan for development of
the Property. Upon application by the Owner, the Agency agreed to waive such deficiency and
approve the Design Review, subject to the Owner's acknowledgment and agreement as set
forth herein. The Owner acknowledges and agrees that, Health and Safety Code Section 33394
notwithstanding, the Agency shall have the right, after payment of just compensation and
following all legally required notices and findings, to acquire the Property for any proper
redevelopment purpose under the California Community Redevelopment Law (Health and
Safety Code Sections 33000 et. seq.) and the Redevelopment Plan. The Owner acknowledges
that the foregoing does not imply a predetermination or commitment by the Agency to acquire
the Property through eminent domain or otherwise.
The Owner Acknowledges that he/she/they have/has been provided a copy of Health and
Safety Code Section 33394, has/have had the opportunity to consult with legal counsel of the
Owner's own choosing and that the Owner& fully understands the meaning and implications of
this document and agrees to be bound by all of the terms and conditions set forth herein. The
Owner acknowledges that the Owner's execution and agreement to be bound by this document
is an express condition precedent and consideration to the Agency for the Agency's approval of
the Design Review for the Development, which approval the Agency would not have given in the
absence or unenforceability of this document.
This document and the Owner's acknowledgments, and agreements hereunder shall be
binding upon the Owner and all voluntary and involuntary successors of the Owner or to the
Property , e Development. This document may be recorded against the Property at any time
following its e ecution.
