CLOSED SESSION a. Pursuant to Government Code Section 54956.9(d)(1) to confer with legal counsel regarding the matter of Saving Arcadia Coalition v. City of Arcadia; Real Parties in Interest: Philip Chan; Jian Guo Wang; WC Investment, LLC; Los Angeles Superior Court Central District Case No.: BS164481 (Council Member Verlato has voluntarily recused herself from all matters pertaining to this litigation, and thus did not participate in this Closed Session). No reportable action was taken on the Closed Session item. ElThe meeting adjourned at 6:55 p.m. REGULAR CITY COUNCIL MEETING 7:00 p.m. CALL TO ORDER — Mayor Beck called the regular meeting to order at 7:00 p.m. INVOCATION — Reverend Terry Keenan, The Santa Anita Church PLEDGE OF ALLEGIANCE — Jason Kruckeberg, Assistant City Manager/Development Services Director ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Amundson, Chandler, Tay, Verlato, and Beck ABSENT: None REPORT FROM CITY ATTORNEY REGARDING CLOSED SESSION ITEM City Attorney Deitsch announced that the City Council met in a Closed Session to consider the one item listed on the posted agenda under Closed Session, and that no reportable action was taken. 1 10-18-2016 SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto stated that supplemental items received and distributed to the City Council after the agenda was posted was (1) an email from the property owners of 110 E. Camino Real relating to Public Hearing item 1.a; (2) an email regarding Public Hearing item 1.b from Arcadia resident Karen Schade requesting the City Council reconsider its position regarding artificial turf; (3) a letter from Arcadia resident Kirk Olsen regarding Public Hearing item 1.b requesting the City Council consider his proposal to the Development Code Update regarding the size of homes in South Arcadia to be more in line with other areas of the City; (4) an email from John and Elaine Murphy regarding Public Hearing item 1.b requesting the City Council consider allowing artificial turf in parkway areas; and (5) a revised Resolution No. 7143 and Ordinance No. 2341 from the City Attorney office regarding the Development Code Update. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Tay, seconded by Council Member Chandler to read all ordinances and resolutions by title only and waive the reading in full. PRESENTATIONS a. Presentation by Pauletta Tonilas, Chief Communications Officer of the Los Angeles County Metropolitan Transportation Authority regarding Los Angeles County Traffic Improvement Plan (Measure M). 1. PUBLIC HEARING a. Appeal of the Planning Commission denial of Modification No. MP 16-06 and Architectural Design Review No. SFADR 16-28 for a new, 5,680 square foot, two story, modern style residence at 110 E. Camino Real Avenue. Recommended Action: Conditional Approval Community Development Administrator Kasama presented the staff report. The City Council addressed board and commissioner absences. Mayor Beck opened the public hearing. Robert Tong, Project Designer of the proposed home, appeared and thanked City staff for the very detailed staff report, which he feels addresses all the issues, and indicated that he agrees with staff's recommendation to approve the project; and explained the reasons why he disagrees with the Planning Commission's decision to deny the project. Jane Pan, owner of the proposed home, appeared and thanked City staff for all the assistance provided to them; she explained the reasons why the City Council should approve their project, and urged the City Council to overturn the Planning Commission's decision and approve the project. Jack Zhang, owner of the proposed home, also appeared and urged the City Council to overturn the Planning Commission's decision and approve the project so they can build their family home. 2 10-18-2016 A motion to close the public hearing was made by Council Member Chandler, seconded by Council Member Tay, and seeing no further objection, Mayor Beck declared the public hearing closed. It was moved by Council Member Verlato, seconded by Mayor Beck, and carried on roll call vote to approve the appeal and overturn the Planning Commission's decision, and approve Modification No. 16-06 and Single Family Architectural Design Review No. 16-28, subject to the conditions. YES: Verlato, Beck, Chandler, Tay, and Amundson NOES: None ABSENT: None b. General Plan Amendment No. GPA 16-03, Zone Change No. ZC 16-03, and Text Amendment No. TA 16-03, with a mitigated negative declaration in compliance with the California Environmental Quality Act for the City of Arcadia Zoning and Subdivision Code Update ("Development Code Update"). Resolution No. 7143 adopting a Mitigated Negative Declaration pursuant to the California Environmental Quality Act and approving General Plan Amendment No. GPA 16-03 for the City of Arcadia Zoning Code Update ("Development Code Update"). Recommended Action: Adopt Ordinance No. 2341 adopting amendments to Chapter 1 (Subdivision), Chapter 2 (Zoning Regulations), Chapter 3 (Setbacks), and Chapter 6 (Review of Planning Commission Decisions) of the Arcadia Municipal Code with a new Chapter 1 entitled "Development Code" and amending certain zoning designations and General Plan land use designations with respect to the Development Code Update, including minor amendments to the Tree Preservation Ordinance Recommended Action: Introduce Resolution No. 7149 rescinding City Council Resolution Nos. 4185 and 6199 and incorporating the remaining regulations that were not codified in the City of Arcadia Development Code Update for the property located at Westfield Santa Anita Mall (400 S. Baldwin Avenue) Recommended Action: Adopt Assistant City Manager/Development Services Director Kruckeberg, Planning Services Manager Flores, and Laura Stetson of MIG presented the staff report. Mayor Beck opened the public hearing. John Murphy, an Arcadia resident, appeared and requested the City Council approve artificial turf in parkway areas, or to grandfather in those properties that currently have turf in the parkway areas. 3 10-18-2016 Vince Law, 307 E. Foothill Boulevard, Unit A, Tony Ou, 307 E. Foothill Boulevard, Unit B, Pastor Lee 307 E. Foothill Boulevard, Unit C, and Dr. Ye, 307 E. Foothill Boulevard, Unit D appeared and indicated that when they purchased their home, they thought it was zoned residential, but recently learned that was zoned commercial, and requested the City Council change the zoning from commercial to residential. Alan Feldman, representing Westfield, appeared and provided their support of the Development Code Update. A motion to close the public hearing was made by Council Member Chandler, seconded by Mayor Pro Tem Amundson, and seeing no further objection, Mayor Beck declared the public hearing closed. Mayor Beck asked for comments from the City Council regarding the letters received concerning artificial turf. It was the consensus of the City Council to grandfather in those properties that currently have artificial turf in their parkway areas, but would like to see those property owners be responsible for repairs, if any, and indemnify the City. It was moved by Council Member Chandler, seconded by Mayor Beck, and carried on roll call vote to adopt Resolution No. 7143 adopting a Mitigated Negative Declaration pursuant to the California Environmental Quality Act and approving General Plan Amendment No. GPA 16-03 for the City of Arcadia Zoning Code Update ("Development Code Update"). Recommended Action: Adopt Deputy Director of Development Services/City Engineer Wray presented the staff report. Mayor Beck opened the public hearing. No one appeared. A motion to close the public hearing was made by Council Member Chandler, seconded by Council Member Tay, and seeing no further objection, Mayor Beck declared the public hearing closed. It was moved by Council Member Chandler, seconded by Council Member Tay, and carried on roll call vote to adopt Resolution No. 7151 adopting an amended Transportation Impact Fee for new development in the City of Arcadia. AYES: Chandler, Tay, Verlato, Amundson, and Beck NOES: None ABSENT: None PUBLIC COMMENTS — No one appeared REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense(AB 1234)) Council Member Tay announced that he attended the League of California Cities Conference and that he completed his required AB1234 Ethics Training; he commented on some of the resolutions that passed at the League of California Cities Conference; he noted that City Manager Lazzaretto was a speaker at the Conference; he announced that he attended the Methodist Hospital's Crystal Ball fundraiser on October 8; that he and Mayor Pro Tern Amundson attended Waterfest at the County Park on October 15; that on October 16, the Museum Education Foundation is having a fundraiser; and noted that Thursday, the Museum is having an Open House where the Lucky Baldwin statute will be displayed. Council Member Verlato presented photographs of different homes illustrating plate heights; she commented on the letter received from an Arcadia resident regarding the FAR in South Arcadia; she noted that last week the Youth Council had their first meeting and that they were very excited and energetic about being involved; and announced that she also attended the Crystal Ball. Council Member Chandler had no comments. Mayor Pro Tern Amundson thanked Council Member Verlato for the explanation about plate heights; he noted that Arcadia has secured a AAA bond rating which is the highest rating; he noted that he attended the Historical Resources meeting at the Library; that Arcadia staff will be discussing a vacancy ordinance for homes in Arcadia, and indicated that San Marino has already taken action; he noted coyotes on Live Oak near homes that are under construction; and commented on some of the propositions on the ballot and urged everyone to vote and to vote wisely. 5 10-18-2016 City Clerk Glasco announced that the Arcadia City Clerk's office is a ballot drop off location for the election; he noted that he also attended the Waterfest event at the County Park; that he also attended Museum Foundation fundraiser; that on November 10, the Arcadia Senior's is holding their annual Veterans Luncheon at the Senior Center; and announced his 50th Arcadia High School reunion on Saturday. Mayor Beck indicated that he also attended the Museum Foundation fundraiser; he wished City Manager Lazzaretto a happy birthday; and noted that he attended the Baldwin Stocker Elementary School 50th anniversary with Mayor Pro Tem Amundson. 2. CONSENT CALENDAR a. Regular Meeting Minutes of September 20, 2016. Recommended Action: Approve b. Purchase and upgrade of the Police Department's Camera System by Celplan Technologies, Inc. in an amount not to exceed $70,005. Recommended Action: Approve c. Professional Services Agreement with Celplan Technologies, Inc. for Camera System Maintenance Services at the Police Department. Recommended Action: Approve d. Agreement with the County of Los Angeles for the Administration and Funding of the Bridge Preventative Maintenance Program for various bridges in the City of Arcadia. Recommended Action: Approve e. Accept all work performed by Ferreira Construction Co. Inc. (DBA Ferreira Coastal Construction Co.) for the Valve Replacement Project on Santa Anita as complete. Recommended Action: Approve f. Street closures for Festival of Bands Parade. CITY MANAGER Mayor Beck announced that he has spoken with the City Attorney and because he owns a home within the area, he must recuse himself from participation and discussion. Professional Services Agreement with Willdan Financial Services to form a special district to fund the conversion of the 6.6kV series streetlights in the amount of$28,650. Recommended Action: Approve Public Works Services Director Tait presented the staff report. It was moved by Council Member Chandler, seconded by Council Member Verlato, and carried on roll call vote to approve, and authorize and direct the City Manager to execute a Professional Services Agreement with Willdan Financial Services to form a special district to fund the conversion of the 6.6kV series streetlights in the amount of 28,650.
