HomeMy WebLinkAbout11/01/2016 ARCADIA CITY COUNCIL REGULAR MEETING MINUTES TUESDAY, NOVEMBER 1, 2016 CALL TO ORDER— Mayor Beck called the meeting to order at 6:05 p.m. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Amundson, Chandler, Tay, Verlato, and Beck ABSENT: None PUBLIC COMMENTS April Verlato, appeared as a resident, and asked if the developer in the Fifth Avenue project entered into a reimbursement agreement with the City, and if a deposit was made to the City for reimbursement of the City's legal fees in this matter; she stated that she feels the City should be moving forward toward settlement; she expressed her disappointment and feels that the City should be meeting with the residents of Fifth Avenue to resolve this matter. CLOSED SESSION a. Pursuant to Government Code Section 54956.9(d)(2) to confer with legal counsel regarding anticipated litigation —one (1) case. No reportable action was taken on the Closed Session item. The meeting recessed at 7:01 p.m., and will reconvene after the open meeting to discuss Closed Session Item (b). REGULAR CITY COUNCIL MEETING 7:00 p.m. CALL TO ORDER— Mayor Beck called the regular meeting to order at 7:05 p.m. INVOCATION — Pastor George Hooper, Church of the Good Shepherd PLEDGE OF ALLEGIANCE — Jason Kruckeberg, Assistant City Manager/Development Services Director ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Amundson, Chandler, Tay, Verlato, and Beck ABSENT: None REPORT FROM CITY ATTORNEY REGARDING CLOSED SESSION ITEMS City Attorney Deitsch announced that the City Council met in a Closed Session to consider the two items listed on the posted agenda under Closed Session; he stated that the City Council will recess after the open session to Closed Session in order to consider item (b) on the posted 1 11-01-2016 agenda; he reported that Closed Session Item (a) was anticipated litigation regarding potential district elections in Arcadia; and that no reportable action was taken. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto stated that there was no supplemental agenda information. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Tay, seconded by Council Member Chandler to read all ordinances and resolutions by title only and waive the reading in full. PRESENTATIONS a. Presentation of a Proclamation to Arcadia High School Band Director Kevin Sherrill for the Arcadia Festival of Bands. b. Presentation of the Los Angeles County Economic Development Commission ("LAEDC") Most Business Friendly City Award Finalist plaque by Bob Machuca, District Manager for the Los Angeles County Economic Development Commission. c. Presentation of a Mayor's Certificate of Commendation to recognize Arcadia resident Edward J. Lopez for the publication of his book "Flight of a Hell Hawk". PUBLIC COMMENTS — No one appeared REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense(AB 12341) Council Member Verlato reported that last week's Planning Commission meeting was only 30 minutes long,-and that there were no major projects to report; she stated that last Friday was another successful Pokemon Lure Fest in Downtown Arcadia; she mentioned that in last Sunday's Los Angeles Times there was an article that talked about how developers try to control city elections, and noted that in Arcadia's last election a developer donated $26,000 to a candidate's campaign; she noted that last night was Halloween and her children dressed up as video game characters; and she thanked the Arcadia Fire Department who came out to her parent's home and assisted her father. Council Member Tay reported that beginning November 1, the City will be on the winter watering schedule; and that Arcadia will be very busy with Breeders' Cup in town and asked residents to be patient with the traffic. Mayor Pro Tem Amundson noted that last Saturday he attended a "Make a Difference" fundraiser at the Arcadia Women's Club for battered women which was a success; he announced that tomorrow in Downtown Arcadia a kick-off party to the Breeders' Cup is planned from 5:00 p.m. to 9:00 p.m. with a salute to Zenyatta, and invited everyone to attend; and he encouraged everyone to get out and vote next Tuesday. • 2 11-01-2016 Council Member Chandler announced that he and Mayor Pro Tem Amundson attended the annual Elks Lodge Appreciation Luncheon honoring all fire and law enforcement personnel. City Clerk Glasco announced that Monday is the last day to drop off your ballot at the City Clerk's office; that November 10 is the Arcadia Veteran's Day Luncheon at the Community Center; that November 11 is Veteran's Day, and that he will be attending a ribbon cutting ceremony at the Arcadia Gardens Retirement Hotel where they will be dedicating a hall in honor of Veterans; he announced a list of restaurants that will be giving free meals to Veterans; and noted that Mr. Edward J. Lopez will be honored at the Arcadia Vietnam War Memorial on Friday, November 11, where his name will be added to the memorial. Mayor Beck recognized and congratulated Mr. Lopez for his autobiography; he thanked City staff on the City being a finalist for the most business friendly City; and announced that he voted by mail. 1. CONSENT CALENDAR a. Regular Meeting Minutes of October 4, 2016. Recommended Action: Approve b. Lease Agreement with the Arcadia Chamber of Commerce for a five-year term for the City-owned property at 388 West Huntington Drive. Recommended Action: Approve c. Professional Services Agreement with Urban Graffiti Enterprises, Inc., for graffiti removal services at a monthly amount of $2,000, and nuisance abatement services on a case-by-case basis. Recommended Action: Approve d. Extension to the Contract with Siemens Industry, Inc. for extraordinary repairs of traffic signals in the amount of$45,588.60. Recommended Action: Approve e. Professional Services Agreement amendment with California Watershed Engineering ("CWE") Inc. for the Enhanced Watershed Management Program Plan for the Rio Hondo/San Gabriel River Water Quality Group in an amount not • to exceed $521,682.50. Recommended Action: Approve f. Purchase Order with Terminix for the treatment of termites for the City's Library building in an amount not to exceed $32,362; and authorize an additional appropriation of$32,362 from the General Fund Reserve. Recommended Action: Approve g. Revisions to the _ classification specification for Utilities Superintendent, Accounting Technician I/I I, and Senior Accounting Technician. Recommended Action: Approve 3 11-01-2016 h. Accept all work performed by EC Construction for concrete pavement rehabilitation of Foothill Boulevard from Michillinda Avenue to Santa Anita Avenue. Recommended Action: Approve Accept all work performed by J. Colon Coatings, Inc., for the Torrey Pines Reservoir Exterior Recoatinq Project as complete. Recommended Action: Approve j. Donation from the Friends of the Arcadia Public Library in the amount of $3,400 for additional programs and services at the Library. CITY MANAGER a. Professional Services Agreement with NAI Capital Commercial, Inc., for Economic Development Consulting Services in the amount of$64,800. Recommended Action: Approve Assistant City Manager/Development Services Director Kruckeberg, and Economic Development Analyst Schwehr presented the staff report. It was moved by Council Member Chandler, seconded by Council Member Tay, and carried on roll call vote to approve the Professional Services Agreement with NAI Capital Commercial, Inc., for Economic Development Consulting Services in the amount of$64,800. AYES: Chandler, Tay, Verlato, Amundson, and Beck NOES: None ABSENT: None b. Resolution No. 7148 approving the City of Arcadia 2016 Water Master Plan Update. Recommended Action: Adopt Public Works Services Director Tait and Principal Civil Engineer Ken Herman presented the staff report. It was moved by Council Member Verlato, seconded by Council Member Tay, and carried on roll call vote to adopt Resolution No. 7148 approving the City of Arcadia 2016 Water Master Plan Update. AYES: Verlato, Tay, Chandler, Amundson, and Beck NOES: None ABSENT: None 4 11-01-2016 Mayor Beck adjourned the meeting in memory of long-time Arcadia resident, and U.S. Olympian, Simone Schaller. The City Council recessed to Closed Session. b. Pursuant to Government Code Section 54956.9(d)(1) to confer with legal counsel regarding the matter of Saving Arcadia Coalition v. City of Arcadia; Real Parties in Interest: Philip Chan; Jian Guo Wang; WC Investment, LLC; Los Angeles Superior Court Central District Case No.: BS164481. (Council Member Verlato has voluntarily recused herself from all matters pertaining to this litigation, and thus did not participate.) No reportable action was taken on the Closed Session item. ADJOURNMENT The City Council meeting adjourned at 8:46 p.m. to Tuesday, November 15, 2016, at 6:00 p.m. in the City Council Chamber Conference Room.
