HomeMy WebLinkAbout11/15/2016 • ARCADIA CITY COUNCIL REGULAR MEETING MINUTES TUESDAY, NOVEMBER 15, 2016 CALL TO ORDER— Mayor Beck called the meeting to order at 6:20 p.m. ROLL CALL OF.CITY COUNCIL MEMBERS PRESENT: Amundson, Chandler, Tay, Verlato, and Beck ABSENT: None PUBLIC COMMENTS April Verlato, appeared as a resident, and again asked if the developer in the Fifth Avenue project has entered into a reimbursement agreement with the City, and feels the City should be moving forward to resolve this matter. CLOSED SESSION a. Pursuant to Government Code Section 54956.9(d)(2) to confer with legal counsel regarding anticipated litigation —one (1) case. b. Pursuant to Government Code Section 54956.9(d)(1) to confer with legal counsel regarding the matter of Saving Arcadia Coalition v. City of Arcadia; Real Parties in Interest: Philip Chan; Jian Guo Wang; WC Investment, LLC; Los Angeles Superior Court Central District Case No.: BS164481. (Council Member Verlato has voluntarily recused herself from all matters pertaining to this litigation and did not participate in Closed Session item b). No reportable action was taken on the Closed Session items. The meeting adjourned at 6:53 p.m. REGULAR CITY COUNCIL MEETING • 7:00 p.m. CALL TO ORDER— Mayor Beck called the regular meeting to order at 7:05 p.m. INVOCATION — Reverend Jolene Cadenbach, Arcadia Congregational Church PLEDGE OF ALLEGIANCE— Mary Hansen, an Arcadia resident ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Amundson, Chandler, Tay, Verlato, and Beck ABSENT: None REPORT FROM CITY ATTORNEY REGARDING CLOSED SESSION ITEMS 1 11-15-2016 City Attorney Deitsch announced that the City Council met in a Closed Session to consider the two items listed on the posted agenda under Closed Session; and that item (a) was anticipated litigation regarding district based elections; no reportable action was taken. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto stated that presentations to the Leadership Academy participants will be made under Presentations. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Tay, seconded by Council Member Chandler to read all ordinances and resolutions by title only and waive the reading in full. PRESENTATIONS a. Presentation by Ricky Whitman from the Pasadena Humane Society & SPCA regarding the Adopt-a-Pet program. b. Presentation of Mayor's Certificates of Commendation to Arcadia residents who volunteered as Captain, coordinating 250 volunteers for the Breeders' Cup event. c. Presentation of Mayor's Certificates to the participants of the Leadership Academy. 1. PUBLIC HEARING a. Appeal of the Planning Commission denial of Conditional Use Permit No. CUP 15-03, Architectural Design Review No. ADR 15-06, and Wireless Regulation Waiver Request No. W 15-01 for the revised proposal for a new wireless communication facility housed in a 53'-0" tall, faux bell tower structure in the southeasterly portion of the parking lot at the Church of the Transfiguration property at 1881 South First Avenue. Recommended Action: Continue to January 17, 2017, City Council meeting City Manager Lazzaretto indicated that the applicant Verizon Wireless has requested an extension to the January 17, 2017, City Council meeting, and recommended approval. It was moved by Council Member Chandler, seconded by Council Member Tay, and carried on roll call vote to continue the public hearing to the January 17, 2017, City Council meeting. AYES: Chandler, Tay, Verlato, Amundson, and Beck NOES: None ABSENT: None PUBLIC COMMENTS Ringo Suen, an Arcadia resident, appeared and spoke about traffic congestion problems, including illegal parking by the parents when children are dropped off before school hours, at Highland Oaks Elementary School. 2 11-15-2016 At the request of Mayor Beck, City Manager Lazzaretto responded that he is aware of the situation, and that he has spoken to the School Superintendent, and the City and the School District will work together to prepare an informational pamphlet to distribute to the parents at all the schools. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense[AB 1234J) Council Member Tay announced that on December 1, there will be another meeting regarding the Historic Resources Survey in the Council Chambers at 6:00 p.m.; and December 3 is the Annual Breakfast with Santa and Holiday Snow Festival, and invited everyone to attend. Council Member Verlato thanked her neighbor Mr. Suen for attending the City Council meeting and encouraged all residents to come to a City Council meeting if they feel they have an issue that needs to be addressed; she announced that last Thursday she attended with Mayor Beck and Mayor Pro Tem Amundson an event put on by the Los Angeles County Economic Development Commission where Arcadia was recognized as a finalist for the Most Business Friendly City Award; Saturday she attended the Arcadia Chinese Association fundraiser dinner, and thanked them for all they do for the community; on December 2, the City is having their Christmas Tree Lighting ceremony at the Transit Plaza, and on December 3 the Downtown Arcadia Improvement Association will be hosting a Holiday Market in the Downtown Area; she announced that at the last Planning Commission meeting the Santa Anita Inn submitted new plans for their building project; and wished everyone a Happy Thanksgiving. Mayor Pro Tern Amundson announced that he met with residents regarding the Verizon cell tower matter which was continued to the January 17, 2017, City Council meeting; he noted that the Library will be closed next week for fumigation; he noted that he attended the Breeders' Cup; he attended the Arcadia Chinese Association fundraiser dinner, and also thanked them for all they do for the community; he also attended the Veteran's Day luncheon at the Senior Center; and wished everyone a Happy Thanksgiving and encouraged everyone to be thankful for what they have. Council Member Chandler announced that he also attended Breeders' Cup; and congratulated the Marine Corps on their 241st Birthday, and noted that the Marine Corps was founded in a little tavern in Philadelphia in 1775. City Clerk Glasco announced all the events he attended on Veteran's Day, including the Arcadia Gardens Retirement Hotel grand opening ribbon cutting ceremony. Mayor Beck also commented on the Veteran's Day Luncheon on November 10 at the Senior Center, and the Arcadia Gardens Retirement Hotel ribbon cutting ceremony; he congratulated City Manager Lazzaretto, Assistant City Manager/Development Services Director Kruckeberg, and Economic Development Analyst Schwehr on the City being a finalist for the Most Business Friendly City award; and announced.Coffee with the Mayor on December 6, and at 3:00 p.m. that same day, the ad-hoc transportation committee will meet. Mayor Pro Tern Amundson mentioned the Arcadia Business Guide for someone who would like to do business or start a business in Arcadia. 3 11-15-2016 2. CONSENT CALENDAR a. Regular Meeting Minutes of October 18, 2016. Recommended Action: Approve b. Ordinance No. 2341 adopting amendments to Chapter 1 (Subdivisions), Chapter 2 (Zoning Regulations), Chapter 3 (Setbacks), and Chapter 6 (Review of Planning Commission Decisions) of the Arcadia Municipal Code with a new Chapter 1 entitled "Development Code" and amending certain zoning designations and General Plan land use designations with respect to the Development Code Update, including minor amendments to the Tree Preservation Ordinance. Recommended Action: Adopt c. Ordinance No. 2342 amending Article VIII of the Arcadia Municipal Code relating to Building Regulations and adopting by reference the 2016 Edition of the California Building Code, Volumes 1 and 2, and Appendix J based on the 2015 of the International Building Code, including State of California amendments applicable to local jurisdictions, and further adopting by reference including amendments, the 2016 California Residential Code, the 2016 California Green Building Standards Code, the 2016 California Plumbing Code, the 2016 California Electrical Code, the 2016 California Mechanical Code, the 2016 California existing Buildings Code, the Uniform Code for the Abatement of Dangerous Buildings, 1997 Edition, as published by the International Code Council, and the 2016 Los Angeles County Grading Code. Recommended Action: Introduce Ordinance No. 2342 and set the public hearing for December 6, 2016 d. Ordinance No. 2343 amending Article III of the Arcadia Municipal Code relating to Fire Regulations and adopting by reference the 2016 Edition of the California Fire Code in its entirety, including Appendix Chapter 4, and Appendices B, C, D, K, and N based on the 2015 Edition of the International Fire Code published by the International Code Council. Recommended Action: Introduce Ordinance No. 2343 and set the public hearing for December 6, 2016 e. Extension to the contract with Sheldon Mechanical Corporation for HVAC Preventative Maintenance Services at various City facilities in the amount of $138,984. Recommended Action: Approve f. Purchase and upgrade of the Police Department's Computer Network Infrastructure by ConvergeOne in the amount of$43,512.50. Recommended Action: Approve g. New Record Keeper for the City of Arcadia's 457 Deferred Compensation Plan. Recommended Action: Receive and File Council Member Chandler pulled Consent Item b for further discussion 4 11-15-2016 • • It was moved by Council Member Tay, seconded by Council Member Chandler, and carried on roll call vote to approve Consent Calendar Item 2.a and 2.c through 2.g. AYES: Tay, Chandler, Amundson, Verlato, and Beck NOES: None ABSENT: None Council Member Chandler provided his thoughts on the amendments to the Development Code, and indicated that for the most part, the Development Code has remained the same since 1964 regarding single family development; he spoke about the square footage of home that can be built on a lot, and that a Floor Area Ratio does depreciate the value of the property; he stated that he voted no and felt that the City has done well without any amendments; he spoke about the land value in Arcadia rising; that he personally does not like the addition of the Floor Area Ratio; and hopes that the City Council and Planning Commission play by the rules. Council Member Tay indicated that he does not mind the Floor Area Ratio in the Development Code, and reminded everyone that once the Development Code is in place that everyone should abide by the rules. It was moved by Council Member Chandler, seconded by Mayor Pro Tern Amundson, and carried on roll call vote to approve Consent Calendar Item 2.b.
