HomeMy WebLinkAboutItem 2a - Regular Meeting Minutes of May 16, 2017 ARCADIA CITY COUNCIL REGULAR MEETING MINUTES TUESDAY, MAY 2, 2017 CALL TO ORDER – Mayor Amundson called the meeting to order at 5:03 p.m. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Beck, Chandler, Verlato, Tay, and Amundson ABSENT: None PUBLIC COMMENTS – No one appeared prior to the Study session item being presented. Mayor Amundson welcomed comments as part of the Study Session. STUDY SESSION a. Report, discussion, and direction concerning regulations for short term rentals such as Airbnb and VRBO. Ken Ng, an Arcadia resident, appeared and expressed safety concerns over short term rentals; he indicated that the home next door is rented out through Airbnb; and stated that as a resident he no longer feels safe with different people coming in and out of the home. Hans Gustaffson, an Arcadia resident, appeared and expressed his concerns over the property located at 2511 Florence Avenue; he spoke about the weekly events occurring at the property; he indicated that the home has become a nuisance to the neighborhood; and urged the City Council to treat this as an emergency and move quickly in finding a solution. Matt, an Arcadia resident, appeared and suggested regulating a minimum stay with Airbnb rentals. Charlton Lee, an Arcadia resident, appeared and stated that his neighbor’s home is listed as an Airbnb rental; he indicated that this has caused problems with his neighbor; and shared an incident that occurred in which he had to contact the police. Council Member Chandler announced that Jerry Selmer, an Arcadia resident, was unable to attend the meeting, but submitted an email to the City Council regarding his concerns with Airbnb’s. Assistant City Manager/Development Services Director Kruckeberg presented a PowerPoint presentation regarding short term rentals such as Airbnb and VRBO. It was moved by Council Member Chandler, seconded by Council Member Beck, and carried on roll call vote to direct staff to prepare an Ordinance to be considered at a Public Hearing before the Planning Commission and City Council prohibiting short term rentals in residential zones within the City. AYES: Verlato, Chandler, Beck, Tay and Amundson NOES: None 1 05-02-2017 b. Report, discussion and direction regarding Pension Costs and Unfunded Liabilities. City Manager Lazzaretto provided the City Council with a comprehensive report and presented a PowerPoint presentation concerning pension costs and unfunded liabilities facing the City in the future. No action was requested or taken by the City Council on this item. c. Report, discussion, and direction concerning use and disposition of City parking lots along Wheeler Avenue and Indiana Street, east of First Avenue. City Manager/Development Services Director Kruckeberg presented a PowerPoint presentation. The City Council indicated it would prefer a lease of City owned parking lots for a proposed project of an aggregation of certain parcels on that block, replacement parking of at least 1.5 to 1, up to two to one parking spaces for existing spaces, and directed staff to work with potential developers and property owners to have the City participate in such a project. This meeting recessed at 6:45 p.m.; and will reconvene to Closed Session as listed on the posted agenda after the regular meeting. The City Council reconvened to Closed Session at 8:26 p.m. CLOSED SESSION a. Pursuant to Government Code Section 54956.9(d)(1) to confer with legal counsel regarding the matter of Dana Nava v. Dominic Lazzaretto; Real Party in Interest: City of Arcadia (California Court of Appeal Second Appellate District Case No.: B266783). b. Pursuant to Government Code Section 54956.9(d)(1) to confer with legal counsel regarding the matter of Southern California Gas Company, a California corporation v. Southern California Edison Company, a California corporation; City of Arcadia, a municipal corporation; and Does 1-10, inclusive (Los Angeles Superior Court Case No.: BS161634). No reportable action was taken on the Closed Session items. The Closed Session adjourned at 9:04 p.m. REGULAR CITY COUNCIL MEETING 7:00 p.m. CALL TO ORDER – Mayor Amundson called the regular meeting to order at 7:02 p.m. INVOCATION – Reverend Jolene Cadenbach, Arcadia Congregational Church PLEDGE OF ALLEGIANCE – Jim Helms 2 05-02-2017 ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Beck, Chandler, Tay, Verlato, and Amundson ABSENT: None REPORT FROM CITY ATTORNEY REGARDING CLOSED/STUDY SESSION ITEMS City Attorney Deitsch reported that the City Council met in a Study Session to consider the following items listed on the posted agenda, as follows. (a) City Council received a PowerPoint presentation from Assistant City Manager/Development Services Director Kruckeberg regarding regulations for short term rentals such as Airbnb’s and VRBO’s; the City Council directed staff to bring back an Ordinance to be considered at a future Public Hearing before both the Planning Commission and the City Council prohibiting short term rentals in residential zones within the City. (b) City Council received a comprehensive report and PowerPoint presentation from City Manager Lazzaretto concerning pension costs and unfunded liabilities facing the City in the future. (c) City Council received a PowerPoint presentation from Assistant City Manager/Development Services Director Kruckeberg. The City Council discussed and provided direction concerning the use and disposition of City parking lots along Wheeler Avenue and Indiana Street east of First Avenue; the City Council indicated it would prefer a lease of City owned parking lots for a proposed project of an aggregation of certain parcels on that block, replacement parking of at least 1.5 to 1 and up to two to one parking spaces for existing spaces; and directed staff to work with potential developers and property owners to have the City participate in such a project. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto requested that the Public Comment period be moved prior to the Public Hearing due to the Arcadia Transit Schedule used by speakers in attendance; and stated that staff has requested Consent Calendar item 2.c, regarding the Professional Services Agreement with Best, Best & Krieger, LLP for Professional Lobbying and Consulting Services, be tabled to address questions from staff before presenting this item to City Council. The City Council unanimously concurred. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Mayor Pro Tem Tay and seconded by Council Member Chandler to read all ordinances and resolutions by title only and waive the reading in full. PUBLIC COMMENTS Jolly Wu, an Arcadia resident, appeared and thanked City Manager Lazzaretto for responding to her concerns regarding upgrades to the restrooms in the City Council Chambers; she clarified comments made at the April 4, City Council meeting; she expressed her concerns and frustrations with the terms of the Dial-A-Ride contract not being enforced; and urged the City Council to enforce the recent changes made to the Dial-A-Ride program. 3 05-02-2017 Gail Marshall, an Arcadia resident, appeared and addressed her concerns with the Dial-A-Ride Program; she also agreed with Ms. Wu’s comment about the contract not being enforced; and urged the City Council to provide proper services. 1. PUBLIC HEARING a. Ordinance No. 2347 amending various sections of Article IX, Chapter 1 of the Arcadia Municipal Code (The Development Code), with an exemption under the California Environmental Quality Act ("CEQA"), to update the City’s regulations for accessory dwelling units, and to address minor text cleanups. Recommended Action: Continue to the May 16, 2017, City Council meeting Assistant City Manager/Development Services Director Kruckeberg, Planning Services Manager Flores, and Senior Planner Landry presented the staff report. Mayor Amundson opened the public hearing. No one appeared. A motion to close the public hearing was made by Council Member Chandler, seconded by Mayor Pro Tem Tay, and seeing no further objection, Mayor Amundson declared the public hearing closed. It was moved by Council Member Chandler, seconded by Mayor Pro Tem Tay, and carried on roll call vote to continue to the Public Hearing to May 16, 2017, to allow the staff a chance to develop a sliding scale for Accessory Dwelling Units based on lot sizes. AYES: Chandler, Tay, Beck, Verlato, and Amundson NOES: None ABSENT: None REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense \[AB 1234\]) Council Member Beck announced that his youngest son will be graduating from LMU on Saturday; and he congratulated Joyce Platt who will receive the Arcadia Senior of the Year award next Tuesday. Council Member Chandler announced that on June 20, the San Gabriel Mosquito and Vector Control Board will be providing a presentation during the City Council meeting, and provided a brief description of what services the Mosquito and Vector Control Board offers residents. Council Member Verlato announced the Planning Commission met last week and provided a report on items they discussed and considered; she referred to an article in the Pasadena Star News regarding deforestation of our urban areas due to mansionization, and stated why the City Council passed an ordinance protecting the trees; and she further announced that this weekend is the Community Bike Ride, and the Arcadia Firefighters’ Annual Pancake Breakfast, and urged everyone to attend. Mayor Pro Tem Tay announced that Law Day was a success, and thanked all the attorneys who participated, and thanked everyone who volunteered; he also announced that on Monday he attended a ceremony honoring Methodist Hospital with the 5-Star Award with Mayor Amundson; and that Saturday is the Arcadia Firefighters’ Annual Pancake Breakfast; and May 6 and May 20, the City will be giving away free mulch. 4 05-02-2017 City Clerk Glasco announced that Summer Watering Days began on Monday, May 1, and that watering is limited to Tuesday, Thursday, and Saturday from May 1 through October 31; that tickets for the Arcadia Firefighters’ Annual Pancake Breakfast are available at City Hall; and also announced that Saturday is “Wild West Days” at the Los Angeles County Arboretum from 10:00 a.m. to 4:00 p.m. Mayor Amundson stated that good things are happening in Downtown Arcadia, and referred to a newsletter with an upcoming calendar of events; he announced the Patriotic Festival on July 1, in the Downtown Area, and on Sunday the Asia Choral Festival will be performing at the Arcadia Performing Arts Center; he noted an incident involving three dogs attacked by coyotes reported in the Police blog; and announced City Council liaison appointments for 2017-18 to City Boards and Commissions and local outside agencies which was already distributed to the City Council. . In response to City Manager Lazzaretto’s request, Assistant City Manager/Development Services Director Kruckeberg explained the City’s tree replacement regulations. 2. CONSENT CALENDAR a. Special and Regular Meeting Minutes of April 18, 2017. Recommended Action: Approve b. Contract with MNR Construction, Inc. for Phase 2 of the Huntington Drive Sewer Capacity Improvement Project in the amount of $274,051. Recommended Action: Approve c. Professional Services Agreement with Best, Best & Krieger, LLP for Professional Lobbying and Consulting Services to secure grant funding through the 2007 Water Resources Development Act (“WRDA”) Authorization in the amount of $72,000. Recommended Action: Tabled to a future meeting d. Resolution No. 7164 declaring its intention to vacate an easement for street and highway purposes over land bounded on the Southwest by the Arcadia Par-3 Golf Course, and on the Northwest by Daines Drive, in the unincorporated County of Los Angeles, setting a public hearing relative thereto for June 6, 2017, and approving a categorical exemption pursuant to the California Environmental Quality Act (“CEQA”). Recommended Action: Adopt e. Contract with California Professional Engineering, Inc. for traffic signal improvements on Duarte Road at First and Second Avenues in the amount of $159,050. Recommended Action: Approve It was moved by Council Member Chandler, seconded by Mayor Pro Tem Tay, and carried on roll call vote to approve Consent Calendar Items 2.a, 2.b, 2.d, and 2.e. (Consent Calendar Item 2.c was continued to a future City Council meeting).
