Huntington Drive, Arcadia, California. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Beck, Chandler, Verlato, Tay, and Amundson ABSENT: None PUBLIC COMMENTS - No one appeared. CLOSED SESSION a. Pursuant to Government Code Section 54956.9(d)(1) to confer with legal counsel regarding the matter of Los Angeles SMSA Limited Partnership, a California limited partnership d/b/a Verizon Wireless v. City of Arcadia (United States District Court, Central District, Case No.: 2:17-cv-03778 DSF JEMx). b. Pursuant to Government Code Section 54956.9(d)(1) to confer with legal counsel regarding the matter of People for Ethical Treatment of Animals, Inc., and Sarah Rosenberg v. City of Arcadia, et al., – Los Angeles County Superior Court (Central District) Case No.: BS168280. c. Pursuant to Government Code Section 54956.9(d)(1) to confer with legal counsel regarding the matter of Richard Salmon, an individual v. The City Council reconvened to Closed Session at 10:00 p.m. No reportable action was taken on the Closed Session items. The Special Meeting adjourned at 10:19 p.m. ARCADIA CITY COUNCIL REGULAR MEETING MINUTES TUESDAY, JUNE 20, 2017 CALL TO ORDER – Mayor Amundson called the regular meeting to order at 7:02 p.m. INVOCATION – Reverend Terry Keenan, The Santa Anita Church PLEDGE OF ALLEGIANCE – Lee Shimmin, Arcadia Resident and US Army Veteran ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Beck, Chandler, Verlato, Tay, and Amundson ABSENT: None REPORT FROM CITY ATTORNEY REGARDING CLOSED/STUDY SESSION ITEMS City Attorney Deitsch announced that the City Council met in a Special Meeting to consider four of the six litigation matters listed on the posted agenda under Closed Session; he indicated that one matter pertained to anticipated litigation regarding a claim for conducting council elections by districts rather than at-large, no reportable action was taken; he further announced that at the conclusion of the Regular Meeting, the City Council will adjourn back into Closed Session to consider the last two items, and that it is anticipated there will not be any action taken which is required to be reported under the Brown Act. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto stated that relating to City Manager item 3.a regarding the Coyote Management Plan, the staff report has been revised to include an environmental analysis in the recommendation, also six emails were submitted and received by residents after the agenda was posted; and additional emails from residents were presented by Debbie Priester that were previously received by the City Council. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Mayor Pro Tem Tay and seconded by Council Member Chandler to read all ordinances and resolutions by title only and waive the reading in full. PRESENTATIONS a. Presentation of Mayor’s Certificate of Commendation to CHOICESS in appreciation for support of the City of Arcadia Summer Movie Series. b. Presentation by Jason Farned, San Gabriel Valley Mosquito and Vector Control Public information Officer. c. Presentation by BikeSGV presenting framed 626 Golden Streets Event photo and final report to the City Council and staff. 1 06-20-2017 d. Presentation by the Friends of the Library of a monetary gift to the City of Arcadia for the Arcadia Public Library. e. Presentation by the Friends of the Arcadia Historical Society of a $1,000 scholarship to Arcadia Police Explorer Joseph Arredondo. APPOINTMENTS a. Appointments to City Boards and Commissions. Recommended Action: Make Appointments Mayor Amundson called for nominations and appointments. Arcadia Beautiful Commission (3 positions) Council Member Beck nominated Burton Brink and Robert Miller for appointment to the Arcadia Beautiful Commission. Council Member Chandler nominated Sheryl Hunter for appointment to the Arcadia Beautiful Commission. Seeing no other nominations, it was moved by Council Member Beck, seconded by Council Member Chandler, and carried on roll call vote that Burton Brink, Robert Miller, and Sheryl Hunter be appointed to the Arcadia Beautiful Commission for four (4) year terms ending June 30, 2021. AYES: Beck, Chandler, Verlato, Tay, and Amundson NOES: None ABSENT: None Human Resources Commission (1 position) Council Member Beck nominated John McMahon for reappointment to the Human Resources Commission. Seeing no other nominations, it was moved by Council Member Beck, seconded by Council Member Chandler, and carried on roll call vote that John McMahon be reappointed to the Human Resources Commission for a (4) four year term ending June 30, 2021. Resolution No. 7172 confirming the Engineer’s Report for the levy and collection of the Arcadia Citywide Lighting District No. 1 and the Associated Assessment Diagram; and ordering the levy and collection of assessments for Fiscal Year 2017-18, including an exemption under the California Environmental Quality Act (“CEQA”). Recommended Action: Adopt Carmen Masud, Management Analyst in the Public Works Services Department, presented the staff report. Mayor Amundson opened the public hearing. No one appeared. A motion to close the public hearing was made by Council Member Chandler, seconded by Mayor Pro Tem Tay, and seeing no further objection, Mayor Amundson declared the public hearing closed. It was moved by Council Member Chandler, seconded by Mayor Pro Tem Tay, and carried on roll call vote to adopt Resolution No. 7172 confirming the Engineer’s Report for the levy and collection of the Arcadia Citywide Lighting District No. 1 and the Associated Assessment Diagram; and ordering the levy and collection of assessments for Fiscal Year 2017-18, including an exemption under the California Environmental Quality Act (“CEQA”). AYES: Chandler, Tay, Verlato, Beck, and Amundson NOES: None ABSENT: None PUBLIC COMMENTS Keanny Jimenez, Sierra Vista High School Junior and Waste Management Student Intern, appeared and spoke about the Paint Care Program, and presented the City with a check for $298.99 for paint picked up in Arcadia through the At-Your-Door Service for the first quarter of 2017. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense \[AB 1234\]) Council Member Beck spoke about residential burglaries in Arcadia, and complimented the Police Department in their efforts to fight crime; he also spoke about surrounding cities banding together to change the law for those who burglarize homes; he indicated that he initiated meetings with City Managers and Police Chiefs from the Cities of Duarte and Monrovia along with City Manager Lazzaretto, which he feels is a first step in fighting this regional problem; he announced that he attended the Lucky Baldwin Poker Tournament on June 10, with his wife, Council Member Verlato and her husband, and City Manager Lazzaretto and his wife, and hopes it becomes an annual event, and noted that monies raised will help to restore historical buildings at the Arboretum; he noted the tragic passing of a 27 year Public Works Department employee on June 18, and sent his condolences to the family; he thanked the Friends of the Library for their $40,000 donation to the Library, which is on the Consent Calendar; he further noted that the Library is constantly making improvements to make it more attractive and functional, and invited residents to visit the Library; he also complimented Director of Library and Museum 4 06-20-2017 Services Darlene Bradley on the job she does as the Director, and noted that she recently initiated the new passport service which will bring additional revenue to the City. Council Member Chandler mirrored what Council Member Beck said regarding toughening the penalties for criminals. Council Member Verlato announced the festivities for the July 1 Patriotic Festival and encouraged everyone to attend. Mayor Pro Tem Tay announced that he recently attended the Independent Cities Association Summer Conference, and indicated that the topics of discussion were immigration, sanctuary cities, and cyber security in small cities, and noted that continuing education is important; he indicated that on May 22, he attended, as a delegate, the San Gabriel Valley Council of Governments (the “COG”) meeting, and spoke about Assembly Bill 1408, which was introduced by Assembly Member Calderon as a result of the recent murder of a Whittier Police Officer by a parolee who violated the terms of his post community supervision 5 times in the 7 months he was released; he indicated that the COG unanimously (31 cities) voted to support Assembly Bill 1408; he indicated that on June 17, he and Mayor Amundson attended the Chinese Relay for Life indoors at the Community Center; and he announced Concerts in the Park on June 29, Movies in the Park on June 30, and the Patriotic Festival on July 1. City Clerk Glasco congratulated Arcadia Police Explorer Joseph Arredondo on receiving the Lieutenant Ed Ostashay Historical Society Scholarship, and noted how helpful he was at the one year anniversary of the Arcadia Vietnam Memorial; and announced that he will be at the Patriotic Festival with the Arcadia Police Department 1959 Ford Galaxy 500. Mayor Amundson announced that he was in attendance with Mayor Pro Tem Tay at the Chinese Relay for Life on June 17; he wished all the Dads a belated Happy Father’s Day; he read an excerpt from an article in the Investor’s Business Daily regarding crime, and provided some statistics regarding property and violent crimes in California; he stated that the League of California Cities will be taking up the issue on crime; he commented on the meeting with the officials from Monrovia and Duarte regarding crime, and reminded everyone that their vote matters; he noted that due to the heat, everyone should conserve their use of utilities to avoid rolling blackouts; he announced the Patriotic Festival on July 1, the activities taking place, and invited everyone to attend, and he thanked all the sponsors who contributed to make this a great event. 1. CONSENT CALENDAR a. Special and Regular Meeting Minutes of June 6, 2017. Recommended Action: Approve b. Reject the low bid from Cedro Construction, Inc., and award a Contract to J. De Sigio Construction, Inc. for the Water Main Replacement Project in the amount of $302,000. Recommended Action: Approve c. Reject all bids received for Janitorial and Porter Services at Various City Facilities, and direct staff to re-bid, and approve a two month contract extension with ABM Services, Inc. in the amount of $52,437.06. Recommended Action: Approve 5 06-20-2017 d. Agreement for Services with the Arcadia Chamber of Commerce in the amount of $75,837. Recommended Action: Approve e. Agreement for Special Services with Liebert Cassidy Whitmore for Personnel Related Legal Services in an amount not to exceed $85,000. Recommended Action: Approve f. Professional Services Agreement with Studio Spectrum, Inc. for Video Production and Broadcast Services for City Council meetings in the amount of $30,600. Recommended Action: Approve g. Agreement for Claims Administration Services with AdminSure, Inc. for Workers’ Compensation Third Party Claims Administration Services in the amount of $321,792. Recommended Action: Approve h. Professional Services Agreement with G4S Secure Solutions, Inc. for Jail Services in the amount of $859,048.32. Recommended Action: Approve i. Professional Services Agreement with Range Maintenance Services, LLC. for Gun Range Maintenance Services in an amount not to exceed $52,140. Recommended Action: Approve j. AYES: Tay, Verlato, Beck, Chandler, and Amundson NOES: None ABSENT: None 3. CITY MANAGER a. The City of Arcadia Coyote Management Plan. Recommended Action: Adopt Assistant to the City Manager Bruckner presented the staff report. Council Member Verlato indicated that she would like to see the Coyote Management Plan include references and citations used in the Coyote Management Plan. Matt Bruce, Campaign Specialist representing PETA, appeared and noted that the June 20, staff report states that no comments were received, but clarified that comments were made on the City’s coyote website; and spoke about a Coyote Ecology and Behavior Report, which he provided a copy to the City Council. Mayor Amundson asked Mr. Bruce if PETA was willing to work with Arcadia to get legislators to relocate coyotes by using their resources. 7 06-20-2017 Mr. Bruce responded that PETA’s issue remains the same, that they do not want to see Arcadia working with trappers; and indicated that he would need to learn more about the relocation process. Stefanie Thomason, an Arcadia resident, appeared and encouraged the City Council to do something about the coyotes and reject the misguided approach by the Pasadena Humane Society and PETA; and read several articles on coyote attacks. Debbie Priester, an Arcadia resident, appeared and also encouraged the City Council to do something about the coyotes; and asked the City Council to protect their residents. May (last name not given), an Arcadia resident, appeared and indicated that her dog was attacked by a coyote today. Lee Shimmin, an Arcadia resident, appeared and commented on the coyote population, and expressed his support of the Coyote Management Plan. David Phong, an Arcadia resident, appeared and provided his concerns regarding the coyote problem in Arcadia; he noted that a neighbor’s cat has been missing for a while and was probably been eaten by a coyote; he also noted the problems of coyotes living in vacant homes; and encouraged the City Council to do the right thing and continue the plan to trap coyotes. Rachel Lin, an Arcadia resident, appeared and provided her concerns regarding the increase of the coyote population and the harm they are causing; and urged the City Council to continue its plan to trap coyotes. It was moved by Council Member Chandler, seconded by Mayor Pro Tem Tay, and carried on roll call vote to determine that the Coyote Management Plan is exempt from environmental review pursuant to the California Environmental Quality Act; and adopt the City of Arcadia Coyote Management Plan.
