ARCADIA CITY COUNCIL REGULAR MEETING MINUTES
TUESDAY, JULY 18, 2017
CALL TO ORDER – Mayor Pro Tem Tay called the regular meeting to order at 7:00 p.m.
INVOCATION – Reverend Thomas Shriver, Emmanuel Assembly of God

ROLL CALL OF CITY COUNCIL MEMBERS
PRESENT: Beck, Chandler, Verlato, and Tay

A motion was made by Council Member Beck, seconded by Council Member Chandler, to
excuse Mayor Amundson from this meeting.
REPORT FROM CITY ATTORNEY REGARDING CLOSED/STUDY SESSION ITEMS City Attorney Deitsch reported that the City Council conducted a Special Meeting at 1:30 p.m. to
consider the one item listed on the posted agenda under Closed Session; he reported that it was anticipated litigation, one matter, which in his opinion was deemed to have been a threat of litigation received by letter challenging Arcadia’s at-large election of council members as
opposed to election of council members by district, no reportable action was taken.
City Attorney Deitsch further reported that the City Council conducted another Special Meeting
at 5:00 p.m. in order to have Study Session discussion to receive a report from staff regarding the 2017 Recreation and Parks Master Plan, no action was taken by the City Council after its discussion.
City Attorney Deitsch further announced that at the same Special Meeting, the City Council
considered the one item listed on the posted agenda, as a litigation matter, under Closed
Session, no reportable action was taken.
SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS
City Manager Lazzaretto reminded the City Council that in June they approved a contract with
Studio Spectrum to upgrade the video capabilities in the Council Chambers, which he reported is complete, except for a couple of minor items that are being worked on.

a. Ordinance No. 2348 amending various sections of Article IX, Chapter 1 of the
Arcadia Municipal Code (“The Development Code”) with an exemption from the California Environmental Quality Act (“CEQA”) to prohibit short-term rentals,
home sharing, and the advertisement of these uses.
Recommended Action: Introduce
Associate Planner Jordan Chamberlain presented the staff report.
Chief Guthrie appeared and explained the Police Department’s procedures when complaints are
received. Mayor Pro Tem Tay opened the public hearing.
Charlton Lee, an Arcadia resident, appeared and expressed the nuisances short-term rentals have created in his neighborhood, and would like to see the Ordinance adopted.
Jerry Selmer, an Arcadia resident, appeared and shared his concerns regarding the home next to him which is being used as a short-term rental (Airbnb), and urged the City Council to adopt
the Ordinance prohibiting short term rental uses.
Hans Gustafsson, an Arcadia resident, appeared and thanked the City Council for addressing
this matter; he shared his frustration that the quality of life and safety of his neighborhood has become a nuisance in the last eight months caused by short-term rental activity.
A motion to close the public hearing was made by Council Member Chandler, seconded by Council Member Beck and, seeing no objection, Mayor Pro Tem Tay declared the public
hearing closed. It was moved by Council Member Chandler, seconded by Council Member Verlato, and carried
on roll call vote to introduce Ordinance No. 2348 amending various sections of Article IX, Chapter 1 of the Arcadia Municipal Code (“The Development Code”) with an exemption from the California Environmental Quality Act (“CEQA”) to prohibit short-term rentals, home sharing, and
the advertisement of these uses.

City Manager Lazzaretto presented the staff report.
Mayor Pro Tem Tay opened the public hearing. No one appeared. A motion to close the public hearing was made by Council Member Chandler, seconded by
Council Member Beck and seeing no objection, Mayor Pro Tem Tay declared the public hearing closed.

ABSENT: Amundson PUBLIC COMMENTS Gail Marshall, an Arcadia resident, appeared and shared some statistics on how coyotes populate; and indicated that wolf urine keeps the coyotes away.
Vivian Chan, an Arcadia resident, appeared and addressed the issue of burglaries in Arcadia;
she indicated that her home has been burglarized 3 times in less than 2 years, and also her
parents’ home was burglarized; and shared her frustration and wanted to know what is being done about burglaries in general.
City Manager Lazzaretto shared Ms. Chan’s frustration; he explained that the City Council has approved additional enforcement and resources in the streets; and provided some tips on what
residents could do to prevent burglaries of their homes.
REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the
City Council related to meetings attended at City expense [AB 1234])
Council Member Beck congratulated all incoming and outgoing board and commission members
and thanked them for their service; he announced that he participated in the Sierra Madre Fourth of July Parade with Council Member Verlato and her family, and Mayor Amundson; that he and the other City Council Members attended the annual Highlands Homeowners
Association picnic at Wilderness Park; that he and City Manager Lazzaretto and Assistant to the City Manager Bruckner will be going to Del Mar Race Track to lobby an amendment to the
Tucker Bill in an attempt to get more revenue from the Race Track; he further announced that on
August 1, there will be dedication in the renaming of the Museum Education Center in honor of Floretta Lauber; and indicated that he was approached by a representative of the County

Arboretum Board and they would like to have a member of the City Council sit on their board in a non-dues paying capacity.
City Attorney Deitsch recommended that the item be placed on a future agenda for discussion, since the matter is not on the agenda. Council Members Chandler and Verlato concurred.
Council Member Chandler thanked Mr. Del Rey for giving the pledge of allegiance, and thanked him for his service; he spoke about the problem with burglaries in Arcadia and indicated that
Arcadia is putting more officers on the streets, and noted that burglars are using Zillow to target homes to burglarize.
Council Member Verlato sympathized with Ms. Chan regarding her family home burglaries; she commented on the Highlands Homeowner Association’s annual picnic, and thanked those City
Council Members and staff who attended, including Lt. Tom Cullen; she announced concerts in
the park on Thursdays, and movies in the park on Friday nights, and invited everyone to attend; and she announced that Vendome is now open for wine and beer retail sales and tasting.
City Clerk Glasco congratulated all incoming and outgoing board and commission members; he noted that Eagle Scout Daniel Black and his Troop came out and landscaped the entire Arcadia
Vietnam Memorial Monument with box hedges; he announced that he also participated in the
Sierra Madre Fourth of July Parade; and that he also attended the Highlands Homeowner Association picnic at Wilderness Park, and noted that it was a great event.
Mayor Pro Tem Tay announced that he also attended the Highlands Homeowner Association picnic at Wilderness Park and that it was a great event; he noted that at last Thursday’s concert
in the park, he met some residents who have lived in Arcadia for more than 30 years and did not know about the concerts; he thanked the Recreation and Community Services Department and Police Department’s Volunteers in Patrol Service (VIPS) for the good job they are doing with the
concerts and movies in the park events, and noted that at the movies in the park last Friday, there was over 1,000 kids; he announced that August 3 is National Night Out; he commented on
the short-term rentals and the parking problem one of the speakers mentioned; he spoke about
increasing the parking permit fees to encourage people to park in their drive-ways, and asked that this matter be placed on a future agenda to discuss increasing the parking permit fees.
Council Members Chandler and Beck concurred.
Council Member Beck also noted that he would like to see a future agenda item to discuss
limiting the number of vehicles, not RV’s, that can be parked in a drive-way. Council Member Chandler and Mayor Pro Tem Tay concurred.
1. CONSENT CALENDAR a. Special and Regular Meeting Minutes of June 20, 2017.

b. Resolution No. 7174 authorizing the Arcadia Police Department to use funds
allocated from the Citizens’ Option for Public Safety-Supplemental Law Enforcement Services Fund (“COPS-SLESF”) for the purpose of front line police services.

c. Purchase Order with Waterline Technologies, Inc. for the purchase and delivery of Sodium Hypochlorite for the disinfection of the City's municipal water supply
in the amount of $39,065.60.
Recommended Action: Approve
d. Purchase Order with 24 Hour LLC, dba National Auto Fleet Group for the purchase of four Ford Explorer black and white police patrol vehicles in the amount of $142,675.84.
Recommended Action: Approve e. Accept all work performed by General Pump Company for Inspection
and Rehabilitation of the Peck Well Project as complete. Recommended Action: Approve
f. Accept all work performed by Vasilj, Inc. for the Miscellaneous Sewer Main Repair Project as complete.

g. Professional Services Agreement with Best Best & Krieger, LLP for Professional
Lobbying and Consulting Services to secure grant funding for water and
stormwater related projects in the amount of $36,000. Recommended Action: Approve
h. Professional Services Agreement with KOA Corporation for On-Call Construction Inspection Services in an amount not to exceed $65,000.
Recommended Action: Approve
i. Agreement for Legal Publication Services with Beacon Media, Inc., in an amount
not to exceed $24,000. Recommended Action: Approve
j. Contract with Hot Line Construction, Inc. for the Morlan Place Underground Utility District in the amount of $475,875.50; authorize the associated utility company
costs to be paid; accept $166,162.50 from Santa Anita LLC (Rusnak Mercedes-
Benz Dealership) for their share of the project; and find that the Project is categorically exempt pursuant to Section 15301 Class 1(b) from the requirements
of the California Environmental Quality Act (“CEQA”).

Council Members Beck and Chandler requested that Consent Calendar Item 2.j be pulled for
comment.

Regarding Consent Calendar Item 2.j, Council Member Beck shared his same concerns that he did back in 2015, regarding spending City money to bury the power poles in front of the Rusnak
property; he indicated that he still feels the same way, and that he will again be voting no on this
item.
Council Member Chandler thanked the Rusnak Family for sticking to their commitment on this project.
Council Member Verlato indicated that since she was not on the City Council in 2015, when this item was approved, she does not feel it is appropriate to comment, and that she would be abstaining.
It was moved by Council Member Chandler, seconded by Mayor Pro Tem Tay, and carried on
roll call vote to approve Consent Calendar Item 2.j.

City Attorney Deitsch explained that a 2-2 tie vote means that the matter should be continued to
a regular meeting where all five Council Members are present.
City Manager Lazzaretto provided additional information regarding this item when it was approved in 2015.
Council Member Chandler indicated that this item is very important and needs to be approved. A motion was made by Council Member Verlato, seconded Council Member Chandler, and
carried on roll call vote to reconsider her earlier vote on Consent Calendar Item 2.j.

CALL TO ORDER – Mayor Amundson called the regular meeting to order at 7:10 p.m.

Pursuant to Government Code Section 54953(b), Mayor Pro Tem Tay participated via
teleconference from 3855 E. Speedway Blvd., Tucson, AZ 85716, and notice was properly
posted as required by law.
SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS
City Manager Lazzaretto stated there was no supplemental agenda information.
PUBLIC HEARING
a. Public hearing to receive public comments on transition to district based elections. Recommendation: Conduct a public hearing to receive public input regarding the composition of the districts and provide direction on the number of draft maps and parameters to be considered
City Manager Lazzaretto gave the staff report. In response to questions raised by Council Member Verlato, Dr. Justin Levitt, Vice President,
National Demographics Corp., explained that the Federal Voting Rights Act does not
necessarily require that a district be drawn by majority or minority, etc., but makes sure to respect the needs of protected class groups in two ways (1) to make sure that if there are
groups of protected class individuals that there is no intent to either pack them all into one
district so that they cannot exert influence elsewhere; and (2) they cannot be diluted in such a way that prevents them from influencing a number of seats, if possible; and explained that as
part of their analysis they will be presenting 3 or 4 options that will be legally defensible maps.
Mayor Amundson opened the public hearing.
Mike Vercillo, an Arcadia resident, appeared and applauded the City Council for moving toward district based elections instead of spending millions of dollars in litigation; he indicated that he
was a little concerned with some of the comments made by the City Council about drawing up districts, and in particular, gerrymandering; he provided the City Council with his own map and a
summary of those neighborhoods; he had several “what if” questions that he shared with the
City Council; and thanked them for the public hearings and allowing the residents to share their comments and concerns.
Richard A. McDonald, Esq., representing the Chinese American Equalization Association, appeared and reiterated some of the same suggestions he provided at the August 1, 2017, City
Council meeting regarding the creation of at least 3 Asian majority districts, and more simple
districts such as north, northeast, northwest, south, southeast, southwest, and central; he presented 2 maps that he spoke about regarding his first and second suggestion (Submission A
and Submission B); he suggested creating an independent task force; he indicated that in 2021 the district lines would have to be redone, because of new census data; he further indicated that there was discussion about the dates regarding going to a June or November, and suggested
keeping an eye on Senate Bill 568 (Lara) which the legislature is going to change the June primary to March, but was recently amended to allow the governor the discretion to go even earlier in the year.
Caroline Blake, an Arcadia resident, appeared and indicated that her comments may change in
the future because it is so early in the process, but that her neighborhood is made up of all
ethnic groups that seem to get along, which she is pleased about; she is opposed to combining all the HOAs into one district; she proposed that the Village be combined with other R-1 single-
story homes; she is in favor of making the population in each of the districts equal; she favors a
City Council residency for those running for City Council at 5 years, one year seems short to her; and regarding the under representation of any one ethnic group, she feels that voter
records could show the percentages of ethics groups, if there is a problem; she is not in favor of any one specific ethnic group living in any one district, and that she would not want to be represented by 98% of any one specific ethic group; that all neighborhoods in Arcadia have a
variety of ethnic groups; and thanked the City Council for allowing her to provide comments. Council Member Chandler made a motion to close the public hearing, and, seeing no objection,
Mayor Amundson declared the public hearing closed. City Manager Lazzaretto indicated that the next public hearing was scheduled for September 5;
however, the demographer is not available and recommended the City Council set the next public hearing date for September 7, 6:00 p.m. in the Council Chamber to receive input
regarding the draft maps, and stated that the maps will be available on or about August 28.
It was moved by Council Member Beck, seconded by Council Member Chandler and carried on
roll call vote to set a Public Hearing on Thursday, September 7, 2017, at 6:00 p.m., in the
Council Chamber to receive public input regarding the content of the draft map or maps and the proposed sequence of elections.

ABSENT: None In response to City Manager Lazzaretto’s recommendation, all Council Members provided their
remarks and comments regarding the make-up of the maps to the demographer. City Manager Lazzaretto indicated that all staff reports and proposed maps will be placed on the
City’s website.
In response to Council Member Verlato’s inquiry, City Manager Lazzaretto indicated that
discussion on the consolidation of the City’s election with the County election will be conducted at the September 7 City Council meeting; he further indicated that only an ordinance is required,
not a vote of the people since the State is compelling cities to do this, which supersedes the City Charter.

Mayor Amundson reported that yesterday the Foothill Unity Center had a great back to school
event, that they had about 1,100 students, and served about 500 families; he announced that Thursday is the last concert of the summer series; and commented on an article in today’s
Pasadena Star News entitled “Meddling Sacramento - Stepping on us as a City”. ADJOURNMENT

a. Pursuant to Government Code Section 54956.9(d)(1) to confer with legal counsel regarding the matter of Los Angeles SMSA Limited Partnership, a California
limited partnership d/b/a Verizon Wireless v. City of Arcadia (United States District Court, Central District, Case No.: 2:17-cv-03778 DSF JEMx).
No reportable action was taken on the Closed Session item.
STUDY SESSION a. Report, discussion and direction regarding potential revenue enhancement
through a voter-approved sales tax measure.

The City Council received a report from City Manager Lazzaretto regarding potential revenue
enhancement through a voter-approved sales tax measure; the City Council (5-0) directed staff to bring back options concerning retention of a consultant and a survey company in order to
further the possible placement of a ballot measure before the voters concerning a potential
sales tax measure.
b. Report, discussion and direction regarding Crime Reduction Strategies. Regarding the “Ring doorbell program” presented by Police Chief Guthrie, on motion by Council
Member Beck, seconded by Council Member Chandler, the City Council (5-0) allocated up to $25,000 to support a $50 rebate program toward the purchase by a homeowner of the $200
item, and the Ring doorbell company will also provide a $50 rebate thereby causing the item to
cost $100, instead of the $200 charge for the item; the City Council also authorized the expenditure of up to $40,000 to waive the $40 annual alarm permit from the City; the motion
was approved 5-0.
c. Report, discussion and direction regarding One Arcadia Competition Results.
The City Council received a report from City Manager Lazzaretto regarding the One Arcadia Competition results; this item pertained to a competition among City staff, led by City Manager
Lazzaretto, to propose programs that might bring Arcadians together. The City Council
provided their input to City Manager Lazzaretto.

City Attorney Deitsch announced that the City Council met in a Closed Session to consider the
one item listed on the posted agenda under Closed Session (a litigation matter), no reportable action was taken.
City Attorney Deitsch further announced that the City Council met in a Study Session to report, discuss and provide direction regarding the 3 items listed on the posted agenda (1) regarding a

PRESENTATIONS
a. Presentation of Mayor's Certificate of Commendation to Janet Chew for her many
years of service to the Arcadia Unified School District.
b. Presentation of Mayor's Certificate of Recognition to WaterSMART Heroes for their efforts in water conservation. PUBLIC COMMENTS
Ringo Suen, an Arcadia resident, appeared and shared his concerns regarding the traffic issues
at Highland Oaks Elementary School; he presented a site model and requested additional signage at the school due to safety issues regarding the drop-off area; he explained the
situation which he views as dangerous; and requested an additional “no right turn” sign,
additional 25 mile limit signs on Virginia Road because parents tend to drive faster than the required speed limit, and a “no-pedestrian crossing” sign near the kindergarten gate.
City Manager Lazzaretto indicated that this matter will be forwarded to the Traffic Safety Committee for review; he indicated that he and Superintendent Vannasdall have been talking
about getting parents involved to talk about the school sites and problems that need to be
addressed.
In response to Council Member Beck’s inquiry, City Manager Lazzaretto indicated that there is a City Council and School Board joint meeting on October 30, 2017, and stated that these types of matters will be on the agenda.
Council Member Beck indicated that he would like to see the School District take on a little more responsibility for the parents that are breaking the law in front of their schools.
REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the
City Council related to meetings attended at City expense [AB 1234]) Council Member Beck congratulated Janet Chew on receiving the Mayor’s Certificate of
Commendation for her continued volunteer work, and the WaterSMART Heroes for their water
conservation efforts, and thanked the Arcadia Beautiful Commission for honoring them; he announced that all 5 Council Members attended a block party in southwest Arcadia last Sunday
and indicated that it was an enjoyable event, and hopes that more parts of town decide to have
block parties.
Council Member Chandler thanked Roger and Marilyn Willander for hosting the block party last Sunday.
Council Member Verlato thanked Ringo Suen for attending and speaking about the safety issues at Highland Oaks Elementary School; she announced that she also attended the block party on
Sunday, and indicated that if anyone is interested in having a block party they should contact
the City; she noted that last Thursday was the last summer concert in the park; she noted some of the events being held around town for the victims of the apartment fire on Fairview Avenue,
and thanked the Arcadia Fire Fighters Association and the Arcadia Fire Department for all they
have done and are doing to help the victims.

Mayor Pro Tem Tay spoke about getting to know your neighbors, which helps prevent crime in the neighborhood, and that if anyone is interested in having a block parties, they should contact
Mike Vercillo at the Arcadia Police Department.
City Clerk Glasco announced that on August 19, the Arcadia Elks Lodge will be hosting a dinner
event for WWII Veterans; he noted that Mayor Amundson will be speaking, and he will be the Master of Ceremonies; and that 54 veterans will be attending.
Mayor Amundson mirrored what Mayor Pro Tem Tay said about block parties; he announced that school begins on Thursday in Arcadia; and that the Foothill Unity Center purchased a new building and is having a ribbon-cutting ceremony is on Thursday; he indicated that the School
District and the City are separate entities, but will be meeting to discuss issues for the good of Arcadia; he also commented on the apartment fire on Fairview Avenue, and thanked all the first
responders, and announced that a GoFundMe account has been set up if anyone is interested
in donating.

2. CITY MANAGER
a. Professional Services Agreement with First Transit, Inc. for the daily operation of
the Arcadia Transit Dial-A-Ride and Fixed Route system in an amount not to exceed $8,248,078.
Recommended Action: Approve Assistant City Manager/Development Services Director Kruckeberg, Deputy Development
Services Director Wray, and Transportation Services Manager Hui provided the staff report. The following individuals appeared to speak.
Jolly Wu, an Arcadia resident, appeared and thanked the Mayor and City Council, and offered a
special thanks to Deputy Development Services Director Phil Wray for listening to their needs,
and she is very happy about the new vendor; she encouraged City staff to keep an eye on the new contract and make sure they follow all ADA laws; she expressed her concerns regarding
their 12 requests and knows that the City is currently working on them; and also spoke about
the waiting period for the bus.
Gail Marshall, an Arcadia resident, appeared and also thanked the City Council and City staff for
choosing First Transit; she would still like to see transit services go outside the City limits at least one or two times a week to take residents to doctor appointments; she indicated that
surrounding cities offer this service; she also spoke about the possibility of using Measure M money to be used for transit services to go outside the City limits; and indicated that she recently attended a Measure M planning meeting in April, and encouraged the City to look into
why Arcadia has not received its allocation of Measure M money. Jason Snow, CEO of Southland Transit, appeared and thanked the City of Arcadia for the 30
year relationship with the City in providing transit service to the residents of Arcadia.

on roll call vote to approve, and authorize and direct the City Manager to execute, a Professional Services Agreement with First Transit, Inc. for the daily operation of the Arcadia
Transit Dial-A-Ride and Fixed Route system in an amount not to exceed $8,248,078.

In response to Mayor Pro Tem Tay’s inquiry, Transportation Services Manager Hui responded that residents do not have to wait outside for the bus, that with the new service, the resident will get advance notice that the bus is on its way which will allow the user enough time to go
outside. City Manager Lazzaretto thanked Mr. Snow and his organization for their service to Arcadia.
b. Designate Mayor Pro Tem Tay as the voting delegate, and City Manager Lazzaretto as the alternate voting delegate for the 2017, League of California
Cities Annual Conference. Recommended Action: Approve

Police Chief Guthrie explained the purpose and difference between the County’s Blue Ribbon
Commission and the League of California Cities efforts regarding strategies that will reduce the unintended negative impacts of AB 109, Proposition 47, and Proposition 57.
It was moved by Council Member Beck, seconded by Council Member Chandler, and carried on roll call vote to approve Mayor Pro Tem Tay as the voting delegate, and City Manager
Lazzaretto as the alternate voting delegate for the 2017, League of California Cities Annual Conference, and to support Resolution No. 1, and Resolution No. 2.
