STUDY SESSION (OPEN TO THE PUBLIC) a. Public Hearing to receive public comments on the transition to district based elections. Recommended Action: Conduct a public hearing to receive public input and provide direction b. Consideration of changing City General Municipal Election dates in order to comply with California Senate Bill 415. Deitsch, City Attorney SUBJECT: PUBLIC HEARING TO RECEIVE PUBLIC COMMENTS ON THE TRANSITION TO DISTRICT BASED ELECTIONS Recommendation: Conduct a public hearing to receive public input and provide direction SUMMARY On August 1, 2017, the City Council held its first public hearing regarding the process of transitioning to district based elections. On August 9, 2017, the City Council held its second public hearing regarding potential voting districts and number of draft maps for the City’s demographer to prepare. This action was in response to threatened litigation regarding alleged non-compliance with the California Voting Rights Act (“CVRA”), and in furtherance of the City Council’s adopted resolution of intention to transition from at- large to district-based elections. Under Assembly Bill (“AB”) 350, the City now has 90 days to complete the transition process, during which time the public will have at least five opportunities to comment on the proposal and the draft maps that are created for the potential voting districts. This is the third such opportunity. Six maps have been created by the demographer and 12 maps have been proposed by members of the public. All were made available on the City’s website for public review prior to August 30, 2017. It is recommended that the City Council conduct a public hearing to receive input regarding the proposed district maps submitted by the public and the City’s demographer, and provide further direction to the demographer as appropriate. BACKGROUND In 2003, the CVRA became law. The CVRA, in an attempt to prevent the disenfranchisement of protected classes of persons, establishes a low bar for attorneys seeking to force cities to convert from at-large to by-district elections. Public Hearing – Transition to By-District Elections September 7, 2017 Page 2 of 7 2 Numerous public agencies in California have been sued under the CVRA. Plaintiffs challenging at-large elections of legislative bodies such as city councils have typically prevailed in litigation (the City Attorney is unaware of any public entity prevailing). Several cities, school districts, and hospital districts have settled with challengers, either prior to or in the midst of litigation brought pursuant to the CVRA. Cities and other public entities have had a statutory obligation to reimburse successful challengers for their attorneys’ fees pursuant to the CVRA. For example, the City of Palmdale incurred $4.7 million in legal fees in unsuccessfully defending in court its at- large city council election system, and the Cities of Santa Barbara, Whittier, Anaheim, and Modesto incurred legal fees of between $600,000 and $3 million in settling such challenges after adopting by-district elections. At least 55 California cities have transitioned, or are in the process of transitioning, from at-large to by-district elections as a result of the CVRA. In addition, there are at least 146 school districts, 27 community college districts, and eight water or other special districts which have done or are doing so under the CVRA. Last year, the California legislature adopted AB 350 amending Elections Code Section 10010 to cap the attorneys’ fees a prospective plaintiff may recover if a public agency adopts a resolution of intention to change to a by-district system of elections within 45 days after the receipt of a letter from that prospective plaintiff alleging a CVRA violation. On June 6, 2017, the City received a letter from Kevin Shenkman, Esq., alleging that the City’s at-large City Council election system diluted the ability of certain protected classes of persons within the City to elect candidates of their choice and demanding the City notify him of its intent to change to a by-district election system by July 21, 2017, in accordance with AB 350. While the City Council did not in any way concede to Mr. Shenkman’s allegations, in an effort to avoid costly litigation, on July 21, 2017, the City Council adopted Resolution No. 7179, a resolution declaring the City’s intention to transition from at-large to district- based elections pursuant to Elections Code Section 10010. On August 1, 2017, the City held its first public hearing to obtain input on any proposed district boundaries. A summary of public comments provided is listed below. Richard McDonald – Chinese American Equalization Association: Mr. McDonald recommended that the City obtain a minimum of three maps from the City’s demographer. Mr. McDonald recommended that the City Attorney be involved in the drawing of the maps to ensure acceptable legal criteria are considered in the drafting of district boundaries. Mr. McDonald recommended two options of which three Asian majority districts would be created. The first includes one south of Duarte Road, a Public Hearing – Transition to By-District Elections September 7, 2017 Page 3 of 7 3 second south of the 210 freeway, and another east of Santa Anita Racetrack using El Monte Boulevard as a dividing line in the south, Baldwin Avenue as the dividing line in the north, and Huntington Boulevard as the primary southern boundary for the two northern districts. The second option for consideration is to have five districts, one in the northeast, one in the northwest, one in the southeast, one in the southwest, and a horizontal central district connecting north and south. Paul Van Fleet: Mr. Van Fleet agreed with Council’s decision to avoid costly litigation by transitioning to district based elections. Mr. Van Fleet questioned how the district elections would be staggered under the upcoming election cycle. Mr Van Fleet recommended that in addition to ethnicity, resident’s socioeconomic status be taken into consideration when drafting districts. Finally, Mr. Van Fleet questioned how the rotation of the Mayor position would be determined under the new district model and suggested that each Mayor be appointed for 9 months instead of a year. Roger Nemrava: Mr. Nemrava was opposed to districting. Should the City move to district-based elections, Mr. Nemrava suggested that Santa Anita Boulevard be the dividing line between east and west Arcadia. Mr. Nemrava recommended that the Highlands Homeowners Association be one district as it represents a cohesive community of interest. Mr. Nemrava suggested that the Oaks and Upper and Lower Rancho Home Owners Associations be a separate district as they too represent separate communities of interest. Mr. Nemrava suggested that Camino Real be the dividing line between north and south Arcadia. Using Camino Real as the dividing line, the Village area should be combined with the area north of Camino Real and west of Santa Anita Boulevard. The fourth district would include east Arcadia with areas east of Santa Anita Boulevard and then south to Camino Real. All areas south of Camino Real would be the final district. Sheng Chang: Dr. Chang congratulated the City Council for changing the City’s voting system from at-large to district-based voting. Dr. Chang expressed his desire for straightforward, simple, and fair districts with emphasis placed on population and demographic considerations. Dr. Chang also requested that the City Council consider term limits as part of their deliberations. Burton Brink: Mr. Brink was opposed to districting and is supportive of the City’s current voting system. Nevertheless, Mr. Brink recommended that the homeowners associations in the City be considered during the drafting of district maps as a cohesive community of interest. Gary Kovacic: Mr. Kovacic stated reasons for opposing going to district elections. Mr. Kovacic recommended that City Council carefully draft the district boundaries and should take into consideration communities of common interest within each district, including homeowners associations and other traditional neighborhoods that exist Public Hearing – Transition to By-District Elections September 7, 2017 Page 4 of 7 4 throughout the City. Mr. Kovacic cautioned the City Council to avoid gerrymandering in order to preserve a current Council Member’s seat. Mr. Kovacic posed several questions to the City Council which include how will the district-based system be implemented in the upcoming election? How will incumbency be factored in to the process? Mr. Kovacic recommended that an independent committee be created to study and recommend proposed district boundaries. Laurie Thompson: Ms. Thompson was not present but submitted an email to be included in the official record for the August 1, 2017, meeting. Ms. Thompson stated the Highlands is in a category by itself for many reasons. Also, the Village has had a different flavor and set of circumstances ever since its inception in 1937. The Village would be better represented in district with R-1 zoned homes. The Upper Rancho, Lower Rancho, and Oaks are zoned R-0. Overall, she stated her position of keeping the HOA’s intact and not clumping them into only one or two districts. On August 9, 2017, the City held its second public hearing to obtain input on any proposed district boundaries. A summary of public comments provided is listed below. Mike Vercillo: Mr. Vercillo applauded the City Council for moving toward district based elections instead of spending millions of dollars in litigation; he indicated that he was a little concerned with some of the comments made by the City Council about drawing up districts, and in particular, gerrymandering; he provided the City Council with his own map and a summary of those neighborhoods; he had several “what if” questions that he shared with the City Council; and thanked them for the public hearings and allowing the residents to share their comments and concerns. Richard McDonald – Chinese American Equalization Association: Mr. McDonald reiterated some of the same suggestions he provided at the August 1, 2017, City Council meeting regarding the creation of at least 3 Asian majority districts, and more simple districts such as north, northeast, northwest, south, southeast, southwest, and central; he presented 2 maps that he spoke about regarding his first and second suggestion (Submission A and Submission B); he suggested creating an independent task force; he indicated that in 2021 the district lines would have to be redone, because of new census data; he further indicated that there was discussion about the dates regarding going to a June or November, and suggested keeping an eye on Senate Bill 568 (Lara) which the legislature is going to change the June primary to March, but was recently amended to allow the governor the discretion to go even earlier in the year. Caroline Blake: Ms. Blake indicated that her comments may change in the future because it is so early in the process, but that her neighborhood is made up of all ethnic groups that seem to get along, which she is pleased about; she is opposed to combining all the HOAs into one district; she proposed that the Village be combined with other R-1 single-story homes; she is in favor of making the population in each of Public Hearing – Transition to By-District Elections September 7, 2017 Page 5 of 7 5 the districts equal; she favors a City Council residency for those running for City Council at 5 years, one year seems short to her; and regarding the under representation of any one ethnic group, she feels that voter records could show the percentages of ethics groups, if there is a problem; she is not in favor of any one specific ethnic group living in any one district, and that she would not want to be represented by 98% of any one specific ethic group; that all neighborhoods in Arcadia have a variety of ethnic groups; and thanked the City Council for allowing her to provide comments. DISCUSSION Procedure Under AB 350 Elections Code Section 10010 provides a specific process for the adoption of an ordinance to transition to district-based elections. The process includes a series of public hearings at which the public is invited to provide input regarding the composition of the districts. The maps for Council districts will be drawn by a professional demographer with extensive experience in the CVRA and drafting Council districts. Before drawing a draft map or maps, the City must hold at least two public hearings over a period of no more than 30 days, at which the public is invited to provide input regarding the composition of the districts. The first hearing was on August 1, 2017, and the second hearing was held on August 9, 2017. After the draft maps are drawn, the City shall publish at least one draft map. The City shall also publish the potential sequence of elections, if the City Council Members will be elected at different times to provide for staggered terms of office. Then, the City shall hold at least two additional public hearings over a period of no more than 45 days, at which the public is invited to provide input regarding the content of the draft maps and the proposed sequence of elections. The anticipated schedule for the transition is as follows: Aug. 1, 2017 Public Hearing No. 1 - Completed Aug. 9, 2017 Public Hearing No. 2 – this Agenda Item Aug. 30, 2017 Publication of Draft Map(s) Sep. 7, 2017 Public Hearing No. 3 Sep. 19, 2017 Public Hearing No. 4 Oct. 3, 2017 Introduction of Ordinance Public Hearing – Transition to By-District Elections September 7, 2017 Page 6 of 7 6 Oct. 17, 2017 Second Reading and Adoption of Ordinance Public comments on the transition and the proposed district maps are very important and all residents within the City are encouraged to participate in these hearings. Criteria for Establishing Districts The drawing of City Council districts is regulated by both state and federal law, including the CVRA and the Federal Voting Rights Act. For example, under federal law, council districts may not be drawn with race as the predominate factor. (Shaw v. Reno (1993) 509 U.S. 630.) The professional demographer retained by the City to draw Council districts will ensure the districts are compliant with these standards. Under Elections Code Section 21620, districts must be drawn as nearly equal in population as may be according to the latest federal decennial census. In establishing the boundaries, the City Council may give consideration to the following factors: (1) Topography; (2) Geography; (3) Cohesiveness, Contiguity, Integrity, and Compactness of Territory; and (4) Community of Interest of the Districts. Based on public input and City Council guidance received at the public hearings on August 1 and 9, 2017, the City’s demographer has generated six maps (Attachment 1). The public has also submitted 12 maps (Attachment 2). These maps are all available on the City’s website at www.ArcadiaCA.gov/districts for public review. The City Council can discuss any of the proposed maps submitted by the public or the demographer, and consider each as a possible final district boundary map or recommend further changes. It should be noted that, of the public maps submitted, only Maps A, B, and L would be legally defensible with regard to population and demographic distributions within the proposed district boundaries. All of the maps submitted by the demographer would meet those legal standards. CEQA ANALYSIS The transition from at-large to district-based elections is exempt from environmental review under the California Environmental Quality Act (“CEQA”) (Pub. Resources Code, § 21000 et seq.) pursuant to State CEQA Guidelines (Cal. Code Regs., tit. 14, § 15000 et seq.) Sections 15061(b)(3), 15320, and 15378(b)(3). The transition process is an organizational and administrative activity of the City, does not have the potential to Public Hearing – Transition to By-District Elections September 7, 2017 Page 7 of 7 7 result in either a direct or reasonably foreseeable indirect physical change in the environment, and is therefore not a project for purposes of CEQA. (State CEQA Guidelines, §§ 15061(b)(3); 15378(b)(5).) In the event the transition process does constitute a project, it is categorically exempt under the Class 20 (Changes in the Organization of Local Governments) categorical exemption. (State CEQA Guidelines, § 15320.) None of the exceptions to the exemptions found in State CEQA Guidelines section 15300.2 apply. FISCAL IMPACT There is no fiscal impact associated with the public hearing. RECOMMENDATION It is recommended that the City Council conduct a public hearing to receive input regarding the proposed district maps submitted by the public and the City’s demographer, and provide further direction to the demographer as appropriate. Deitsch, City Attorney Prepared By: Lisa Mussenden, Chief Deputy City Clerk/Records Manager SUBJECT: CONSIDERATION OF CHANGING CITY GENERAL ELECTION DATES IN ORDER TO COMPLY WITH CALIFORNIA SENATE BILL 415 Recommended Action: Provide direction as to which date to move the City’s regularly-scheduled general municipal election SUMMARY Arcadia currently holds its general municipal election for City Council members and other City elected officials on the second Tuesday of April in each even-numbered year. Under State law, April is a “non-concurrent” election date. Senate Bill 415 requires a local public agency with a non-concurrent election date to change it to either the June statewide primary or November statewide general election, if the agency’s voter turnout for a local non-concurrent election was at least 25% lower than its average voter turnout for the last four statewide general elections. SB 415 was enacted to improve voter turnout at local elections. All of Arcadia’s past four April municipal elections showed at least a 25% voter turnout decline when compared to the four statewide general election average. Therefore, Arcadia must move its municipal election date as required by SB 415. SB 415 does not require the City to immediately change its municipal election date in 2018, although that is an option. As long as the City has adopted a plan by January 1, 2018, to move its future municipal elections, it is not required to actually change its municipal election date until 2022. Pending legislation (SB 568) may change the June statewide primary election to a potentially “floating” date, making scheduling of the municipal election less predictable. For that reason as well as others outlined below, it is recommended that the City Changing General Municipal Election Date (Senate Bill 415) September 7, 2017 Page 2 of 6 Council select a November election date because it is unlikely that this date will change in the future. This would mean November 2018, 2020, or 2022. Although the November election is preferable, the choice for the year in which the change is implemented is not as clear cut. For example, changing in 2018 would allow all modifications to the City’s elections process to take place at one time as the City will be transitioning to District based elections in 2018. On the other hand, waiting until 2022 would provide the most amount of time to prepare for the transition and possibly allow for the City to react to any changes in the law that may happen over the next six years. Based upon City Council direction, staff will return with an ordinance to enact the change. DISCUSSION Arcadia’s Municipal Elections Are Currently Held in April of Even-Numbered Years: Pursuant to City Charter Section 1100 and Section 1700 of the Municipal Code, Arcadia currently holds its general municipal election for City Council members and other elected officials on the second Tuesday of April in each even-numbered year. Arcadia has held April elections since 1952, the most recent one occurring on April 10, 2016. Its next regularly scheduled municipal election would take place on April 10, 2018, with three City Council seats open. Background of Senate Bill 415: The California Voter Participation Rights Act (Senate Bill 415 - Elections Code Sections 14050 – 14057) was signed by Governor Brown on September 1, 2015, and becomes effective on January 1, 2018. The intent of SB 415 is to improve voter turnout at local elections. According to state legislative reports, local agencies which hold elections on non-concurrent dates often see lower voter turnout than at elections held on the two statewide election dates. A non-concurrent date is any date other than the June statewide primary or November statewide general election. Arcadia’s April municipal election is a non-concurrent date. SB 415 requires a local public agency with a non-concurrent election date to change it to either the statewide primary or general election if the agency’s voter turnout for a local non-concurrent election was at least 25% lower than its average voter turnout for the last four statewide general elections (November 2016, 2014, 2012, and 2010). A more detailed discussion of how this “25% rule” applies to Arcadia is provided below. Attorney General Says SB 415 Applies to Charter Cities: Before getting into numbers, an important legal issue was recently resolved. For nearly two years, it was unclear whether SB 415 applied to charter cities. As noted above, Changing General Municipal Election Date (Senate Bill 415) September 7, 2017 Page 3 of 6 Arcadia’s Charter directly conflicts with SB 415, setting a clearly different election date. While the bill’s author claimed that SB 415 was intended to apply to charter cities, the text of the law is ambiguous at best. Further, elections are typically considered a “municipal affair” where a city’s charter supersedes state law. On July 11, 2017, the California Attorney General issued an opinion stating that SB 415 applies to charter cities because improving voter turnout at elections is a “matter of statewide concern” rather than a “municipal affair”. In such a case, state law prevails over any conflicting charter provision. While Attorney General opinions are not legally binding like court decisions, they are viewed by the courts as highly persuasive and local agencies generally follow them as they would a court decision. Does SB 415 Require Arcadia to Change Its Municipal Election Date? Is There a 25% Voter Turnout Decline?: SB 415 requires a City to change its municipal election date, “if holding an election on a non-concurrent date has previously resulted in a significant decrease in voter turnout.” As noted above, Arcadia holds its municipal elections on a non-concurrent date – April. The remaining question under SB 415 becomes whether there has been a “significant decrease in voter turnout.” This requires an analysis of whether the “voter turnout for a regularly scheduled election in [Arcadia] is at least 25 percent less than the average voter turnout within [Arcadia] for the previous four statewide general elections.” The Los Angeles County Registrar of Voters has provided the City Clerk’s Office with the following Arcadia turnout figures for the previous four statewide general elections: Statewide General Election Cycle Arcadia Registered Voter Turnout Votes Percentage 2010 15,043 51.93% 2012 19,430 67.25% 2014 9,631 33.09% 2016 19,082 66.18% Average 15,796 54.61% To avoid a “significant decrease in voter turnout,” a City municipal election should have achieved at least a turnout of 11,847 voters, or 40.96% of Arcadia registered voters. This number is calculated by taking 75% of the four statewide general election average (75% x 54.61% = 40.96%). Any turnout below 75% of the statewide average will be “at least 25% less than the average voter turnout” and trigger SB 415’s requirement to move the municipal election. The figures for the City’s municipal elections in the past four cycles are as follows: Changing General Municipal Election Date (Senate Bill 415) September 7, 2017 Page 4 of 6 Municipal Election Cycle Arcadia Registered Voter Turnout Votes Percentage 2010 3,178 11.02% 2012 6,923 24.61% 2014 6,516 22.18% 2016 8,993 32.42% Therefore, the percentage difference between the City’s municipal election turnout and the four statewide general election average is as follows: Municipal Election Cycle Turnout % Comparison to Statewide Average % Decline 2010 11.02% 11.02% / 54.61% = .20 80% 2012 24.61% 24.61% / 54.61% = .45 55% 2014 22.18% 22.18% / 54.61% = .40 60% 2016 32.42% 32.42% / 54.61% = .60 40% Ultimately, none of the City’s past four municipal elections drew a 40.96% voter turnout rate and all showed at least a 25% decline in voter turnout compared to the four statewide general election average. Therefore, the City has held a non-concurrent election – indeed, four such elections – with a significant decrease in voter turnout. As such, the City is required to change its municipal election date to either the June statewide primary election or the November statewide general election in even- numbered years. How to Implement SB 415?: SB 415 provides the following procedure to implement its requirements: A political subdivision may hold an election other than on a statewide election date if, by January 1, 2018, the political subdivision has adopted a plan to consolidate a future election with a statewide election not later than the November 8, 2022, statewide general election. The City is not required to immediately change its municipal election date in 2018, although that is an option. As long as the City has adopted a plan by January 1, 2018, to move its future municipal elections, it isn’t required to actually change its municipal election date until 2022. This leaves Arcadia with six available options to move its municipal election: 1.) June statewide primary, starting with the June 2018 Election; 2.) June statewide primary, starting with the June 2020 Election; 3.) June statewide primary, starting with the June 2022 Election; Changing General Municipal Election Date (Senate Bill 415) September 7, 2017 Page 5 of 6 4.) November statewide general, starting with the November 2018 Election; 5.) November statewide general, starting with the November 2020 Election; 6.) November statewide general, starting with the November 2022 Election. If the City Council chooses Options 1 or 4, the change will go into effect immediately with the next municipal election in 2018. With Options 2 or 5, the City would conduct an April 2018 election and would transition to the new date in 2020. With Options 3 or 6, the City would conduct an April 2018 and April 2020 election, and would transition to the new date in 2022. State law allows a City to extend or decrease the terms of current elected officials by up to 12 months, in order to match their terms with a changed municipal election date [Elections Code Section 10403.5(b)]. If the City moves the municipal election to June, City Council terms in that year would be extended by two months (April to June) to match them with the new election cycle. If the City moves the municipal election to November, City Council terms would be extended by seven months in that year (April to November) to match them with the new election cycle. Concerns with SB 568: SB 415 requires Arcadia to move its municipal election to either the statewide primary or the statewide general election date. Currently, that is the first Tuesday after the first Monday in June and November of even-numbered years. With SB 568 pending in the Assembly, if enacted, beginning in 2019 it would change the date of the statewide primary to the third Tuesday in March. In presidential election years, the Governor could move this date even earlier by executive proclamation under specified circumstances. Therefore, the California statewide primary may move to mid-March, and could be moved to different dates by gubernatorial proclamation. This would cause municipal elections in 2020, 2024, and future presidential election years to potentially “float” to coincide with whenever the statewide primary is conducted. It is uncertain at this time if SB 568 will ultimately pass. SB 568 does not affect the statewide general election in November. It is unlikely that this date will change since that coincides with presidential general elections. Because the November date is the more predictable option for scheduling purposes, it is recommended that the City Council move the City’s municipal election to the November general election date rather than the statewide primary election date, which could turn out to be June, March, or some other “floating” date. For reasons discussed above, it is recommended that the City Council select a November election date (Options 4, 5, or 6) because that date will not change and can be relied upon for scheduling purposes. With pending legislation (SB 568) that may change the statewide primary election date from June to March of even-numbered years, and may even cause the primary date to “float” for certain elections, the surety of a November election is a better alternative. Changing General Municipal Election Date (Senate Bill 415) September 7, 2017 Page 6 of 6 Is a Voter-Approved Charter Amendment Required?: SB 415 does not spell out the nature of a plan to achieve compliance. Normally, amendments to the City Charter must be approved by the voters; however, a Charter amendment is not required to adopt a plan in this case. The Attorney General’s Office has opined that SB 415 prevails over any contrary city charter provision. Because Arcadia is now prohibited by state law from enforcing this provision of its charter, it is, in effect, void. Therefore, the City Council may adopt an Ordinance to move the municipal election in order to comply with SB 415 and disregard the contrary provision in the City’s Charter. Policy Considerations Regarding New Date of Election: The choice for the year in which to make the change is not as clear cut. For example, changing in 2018 would allow all modifications to the City’s elections process to take place at one time as the City will be transitioning to District based elections in 2018. This will cause less disruption for the electorate. On the other hand, waiting until 2022 would provide the most amount of time to prepare for the transition and possibly allow for the City to react to any changes in the law that may happen over the next six years. For instance, there may be more legal clarity on whether SB 415 even applies to charter cities and whether SB 568 was adopted. In other words, there are advantages to either approach; therefore, staff will be seeking policy direction from the City Council on this matter. Based upon City Council direction, staff will return with an ordinance to enact a plan to change its election date that can be in effect January 1, 2018, in order to comply with SB 415. ENVIRONMENTAL ANALYSIS The proposed action does not constitute a project under the California Environmental Quality Act (“CEQA”), and it can be seen with certainty that it will have no impact on the environment. Thus, this matter is exempt under CEQA. FISCAL IMPACT There are potential savings as a result of consolidating the City’s municipal election with the statewide election; however, it is not expected to be significant. RECOMMENDATION It is recommended that the City Council provide direction as to which date to move the City’s regularly scheduled general municipal election.
