A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, APPROVING GENERAL PLAN AMENDMENT NO. GPA
17-01 AND ZONE CHANGE NO. ZC 17-01 WITH A ZONING MAP
AMENDMENT TO CHANGE THE ARCADIA GENERAL PLAN LAND USE
DESIGNATION AND REZONE THE PROPERTIES LOCATED AT 303,
305, 307, AND 309 E. FOOTHILL BOULEVARD FROM COMMERCIAL
TO LOW DENSITY RESIDENTIAL, WITH A CATEGORICAL
EXEMPTION UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY
ACT ("CEQA")
WHEREAS, local governments are authorized by Government Code Section
65350, et. seq. to prepare, adopt and amend General Plans; and
WHEREAS, the Arcadia Municipal Code provides that the adoption or
amendment of any General Plan within the City shall be accomplished by resolution;
and
WHEREAS, on April 13, 2017, the General Plan Amendment Application No.
GPA 17-01 and Zone Change Application No. 17-01 (the "Project") were filed by the
property owners of the affected properties, Vince Law, Yen-Kuang Lee, Tony Ou, and
Jing R. Zhong, ("Applicants"), to change the City of Arcadia General Plan land use
designation of their properties from Commercial to Low Density Residential, and to
reclassify their zoning designation from General Commercial (C-G) to Low Density
Residential (R-1-7,500) for their properties located at 303, 305, 307, and 309 East
Foothill Boulevard; and
WHEREAS, on June 6, 2017, the Planning Services completed an environmental
assessment for the Project in accordance with the California Environmental Quality Act
("CEQA") and determined that the Project qualifies as a Categorical Exemption under
CEQA pursuant to Section 15301 as existing facilities and Section 15303 as minor
alteration in land use; and
WHEREAS, on July 25, 2017, a duly notice public hearing was held before the
Planning Commission on the Project, at which time all interested persons were given full
opportunity to be heard and to present evidence; and
WHEREAS, after the public hearing the Planning Commission adopted
Resolution No. 1996 by a 4-0 vote with one Commissioner absent to recommend
approval of the Project with a Categorical Exemption from CEQA to the City Council;
and
WHEREAS, on September 5, 2017, a duly noticed public hearing was held
before the City Council on the Project, at which time all interested persons were given
full opportunity to be heard and to present evidence; and
WHEREAS, all other legal prerequisites to the adoption of this Resolution have
been fulfilled.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1. The City Council hereby finds that the factual data submitted by the
Development Services Department in the Recitals of this Resolution, Ordinance No.
2349, and by the staff report dated September 5, 2017, are true and correct.
SECTION 2. The City Council finds as follows with respect to the proposed
general plan amendment and zone change as shown in Exhibit A — "Changes to the
Official Arcadia General Plan Land Use Map":
1. The amendment is internally consistent with all other provisions of the General
Plan.

FACT: The proposed General Plan Amendment is internally consistent with the
goals, objectives, and policies of the Arcadia General Plan. Approval of the proposed
General Plan Amendment from Commercial to Low Density Residential, and rezoning of
the properties from General Commercial (C-G) to Low Density Residential (R-1-7,500),
is consistent with the Housing and Land Use and Community Development Elements by
conserving existing housing stock and by establishing consistency between the Land
Use Plan and the Zoning Code. A designation of Low Density Residential is a more
appropriate designation than Commercial, and this will allow the existing residential
structures to align with the former land use designation and residential use of the
subject properties. The reclassification of the four properties will allow for the property
owners to maintain and improve the existing residential structures. The proposed
General Plan Amendment and Zone Change is consistent with the following General
Plan goals and policies:
Housing Element
Goal H-1: Conserve and improve the condition of the existing housing stock.
Land Use and Community Development Element
Policy LU-1.6: Establish consistency between the Land Use Plan and the Zoning
Code.
2. The proposed amendment will not be detrimental to the public interest, health,
safety, convenience, or general welfare of the City.
FACT: The proposed General Plan Amendment and Zone Change will not have
any detrimental effect upon the health, safety and general welfare of the City, nor will it
have an effect on the conditions of the built environment since the amendments

consists of making the land use designation and zoning consistent with the existing
uses — single-family residential. There will be no physical changes to the built
environment.
3. The proposed Zoning Map Amendment is consistent with the General Plan
and any applicable specific plan(s).
FACT: The proposed Zoning Map Amendment to rezone the properties from
General Commercial (C-G) to Low Density Residential (R-1-7,500) will ensure that the
Zoning Map is consistent with the General Plan land use designation, and the existing
use of the property is allowed by the Development Code.
SECTION 3. For the foregoing reasons the City Council determines that the
Project is exempt from review under the California Environmental Quality Act (CEQA)
under Section 15301 (as existing facilities) and Section 15305 (as minor alteration in
land use) of the CEQA Guidelines. The proposed Project consists of changing the land
use designations and zoning of four properties to make the designation consistent with
the existing single-family residential uses. There are no proposed changes to the
physical environment. The Project does not involve the expansion of the use beyond the
existing single-family residences.
SECTION 4. The City Council hereby approves General Plan Amendment No.
GPA 17-01 and Zone Change No. ZC 17-01 with a Zoning Map Amendment, pursuant
to Arcadia Development Code Section 9108.03.060 of the Development Code.
SECTION 5. The City Clerk shall certify to the adoption of this Resolution.
