AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, AMENDING THE ZONING DESIGNATION OF CERTAIN
PROPERTIES WITHIN THE CITY FROM "C-G GENERAL
COMMERCIAL" TO "R-1(7,500) LOW DENSITY RESIDENTIAL" WITH A
ZONING MAP AMENDMENT AT 303, 305, 307, AND 309 E. FOOTHILL
BOULEVARD
WHEREAS, the City of Arcadia, as a function of its regulatory authority, under
the Arcadia Development Code Section 9108.03, to amend the zoning designation of
certain properties within the City, by adoption of an ordinance; and
WHEREAS, on April 13, 2017, General Plan Amendment Application No. GPA
17-01 and Zone Change Application No. 17-01 were filed by the property owners of the
affected properties, Vince Law, Yen-Kuang Lee, Tiny Ou, and Jing R. Zhong,
("Applicants"), to rezone their properties from General Commercial (C-G) to Low Density
Residential (R-1-7,500) for their properties located at 303, 305, 307, and 309 East
Foothill Boulevard ("the Project"); and
WHEREAS, on June 6, 2017, the Planning Services completed an environmental
assessment for the Project in accordance with the California Environmental Quality Act
("CEQA"). The Project qualifies as a Categorical Exemption under CEQA pursuant to
Section 15301 (as existing facilities) and Section 15303 (as minor alteration in land
use). The Project does not involve the expansion of use beyond the existing single-
family residences. The preliminary assessment indicating that the Project is
Categorically Exempt from CEQA was made for public review on July 13, 2017; and
WHEREAS, on July 25, 2017, a duly noticed public hearing was held before the
Planning Commission on the Project, including the Categorical Exemptions at which

time all interested persons were given full opportunity to be heard and to present
evidence; and
WHEREAS, following the public hearing, the Planning Commission adopted
Resolution No. 1996 by a 4-0 vote with one Commissioner absent, to recommend
approval of General Plan Amendment No. GPA 17-01 and Zone Change No. ZC 17-01
with a Zoning Map Amendment as recommended by the Development Services
Department to the City Council; and
WHEREAS, on September 5, 2017, a duly noticed public hearing before the City
Council on said applications, including the CEQA determination that the Project is
categorically exempt, at which time all interested persons were given full opportunity to
be heard and to present evidence; and
WHEREAS, all other legal prerequisites to the adoption of this Ordinance have
occurred.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, DOES ORDAIN AS FOLLOWS:
SECTION 1 . The factual data set forth in the Recitals of this Ordinance,
Resolution No. 7176, and by the staff report dated September 5, 2017, are true and
correct.
SECTION 2. That the City Council, based upon the entire record, including all
written and oral evidence presented, finds as follows with respect to the proposed zone
change as shown in Exhibit A - "Changes to the City's Official Zoning Map":
The proposed update to the Zoning Map will ensure that the Zoning Map is
consistent with the approval to the General Plan land use designation and zone change

from Commercial to Low Density Residential (R-1-7,500). The proposed Zone Change
will not have any detrimental effect upon the health, safety and general welfare of the
City, nor will it have an effect on the conditions of the built environment since the
amendments consists of making the designations and zoning consistent with the
existing uses — single-family residential.
SECTION 3. The subject properties shall abide by the all required provisions and
development standards under the Arcadia Development Code for Low Density
Residential Zone (R-1-7,500).
SECTION 4. For the foregoing reasons the City Council determines that the
Project is exempt from review under the California Environmental Quality Act (CEQA)
pursuant to Section 15301 (as existing facilities) and Section 15305 (as minor alteration
in land use) of the CEQA Guidelines. The proposed Project consists of changing the
land use designations and zoning of four properties to make the designation consistent
with the existing single-family residential uses. There are no proposed changes to the
physical environment. The Project does not involve the expansion of the use beyond the
existing single-family residences.
SECTION 5. The City Council hereby approves of and adopts amendment of
the zoning designation of certain properties within the City from "G-C General
Commericlal" to "R-1(7,500) Low Density Residential" with a Zoning Map Amendment,
as set forth in Exhibit "A" attached hereto.
SECTION 6. The City Clerk shall certify to the adoption of this Ordinance and
shall cause a copy of same to be published in the official newspaper of said City within

fifteen (15) days after its adoption. This Ordinance shall take effect on the thirty-first
(31st) day after its adoption.
