HomeMy WebLinkAboutItem 2a - Minutes 1 10-03-2017 ARCADIA CITY COUNCIL REGULAR MEETING MINUTES TUESDAY, OCTOBER 3, 2017 CALL TO ORDER – Mayor Amundson called the regular meeting to order at 7:00 p.m. INVOCATION – Reverend Thomas Shriver, Police Department Chaplain PLEDGE OF ALLEGIANCE – Air Force Airman 1st Classman Juliana Kosharek ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Beck, Chandler, Verlato, Tay, and Amundson ABSENT: None REPORT FROM CITY ATTORNEY REGARDING CLOSED/STUDY SESSION ITEMS City Attorney Deitsch announced that the City Council met earlier in a Study Session to interview four potential Planning Commission candidates to fill one unexpired term ending June 30, 2018; and noted that after deliberations, the City Council unanimously appointed Donald Fandry to fill the unexpired term ending June 18, 2018. City Attorney Deitsch further announced that the City Council met in a Closed Session to consider the one item listed on the posted agenda under Closed Session regarding litigation; no reportable action was taken. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto stated there was no supplemental agenda information. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Mayor Pro Tem Tay and seconded by Council Member Chandler to read all ordinances and resolutions by title only and waive the reading in full. PRESENTATIONS a. Proclaiming October 8, 2017, to October 14, 2017, as "Fire Prevention Week". Mayor Amundson announced that City Manager Item 3.a regarding the conceptual design of the Veterans Memorial Monument at the Arcadia Community Center will be discussed at this time. 3. CITY MANAGER a. Approve the conceptual design of the Veterans Memorial at the Arcadia Community Center. Recommended Action: Approve Assistant to the City Manager Bruckner provided the staff report. 2 10-03-2017 Bob Harbicht, representing the Arcadia Rotary Club, appeared and indicated that for the last 2 years, the Arcadia Rotary Club has raised significant funds for a Veterans Memorial at the Arcadia Community Center; he thanked Mary E. Hansen and the Santa Anita Race Track for their generous donations toward the monument; he provided information regarding the design and materials to be used; and indicated that the unveiling of the monument would be Memorial Day, May 28, 2018. Mr. Harbicht responded to various questions raised by the City Council regarding the conceptual design and location of the Veterans Memorial Monument. It was moved by Council Member Chandler, seconded by Mayor Pro Tem Tay, and carried on roll call vote to approve the conceptual design of the Veterans Memorial at the Arcadia Community Center, without conditions. AYES: Chandler, Tay, Beck, and Amundson NOES: Verlato ABSENT: None 1. PUBLIC HEARING a. Ordinance No. 2350 adding Section 1704 to Chapter 7 of Article I of the Arcadia Municipal Code establishing by-district elections, defining district boundaries, and scheduling elections within the districts. Recommended Action: Introduce City Manager Lazzaretto provided the staff report. City Manager Lazzaretto indicated that 127 emails were received in favor of the Green Map, 24 emails in favor of the Purple Map, and 4 of those emails supported the Green Map and Purple Map, one email in favor of the Orange Map, and four emails were opposed to Public Map M. Council Member Verlato indicated that some of the emails the City received referenced the Wisconsin gerrymandering case currently before the U.S. Supreme Court; and asked City Attorney Deitsch if the Wisconsin case would affect districting in Arcadia. City Attorney Deitsch indicated that the issues in Wisconsin are somewhat different from Arcadia; that in Wisconsin it is a case of pure political gerrymandering, and in his opinion does not see the issue of political gerrymandering in the maps before the City Council; and indicated that the City cannot wait for any decision by the U.S. Supreme if we are to take advantage of the safe harbor provisions in the California law and act by October 17, 2017. City Manager Lazzaretto indicated that the City’s demographer and the City Attorney’s office have indicated that any of the maps he mentioned are defensible from a legal standpoint. Mayor Amundson opened the public hearing, and indicated that due to the number of speaker cards, he announced 2 minutes per person for public comment. Janet Chan appeared and spoke in support of the Green Map, and indicated that she sent an email to the City. 3 10-03-2017 John Chen appeared and spoke in support of the Green Map, and indicated that he did not send an email to the City. Brett Mitulski appeared and spoke in support of Map M. Knut Dale appeared and spoke in support of Map M. Roger Nemrava appeared and spoke in support of Map M. Nelson Ge appeared and spoke in support of the Green Map, and indicated that he sent an email to the City. Fei Hou appeared and spoke in support of the Green Map. Michael Zhu appeared and spoke in support of the Green Map. Liangyi Gu appeared and spoke in support of the Green Map, and indicated that she did not send an email. Richard A. McDonald, representing the Chinese American Equalization Association, appeared and requested that emails sent to the City be made a part of the administrative record; and indicated his clients prefer the Green Map, and also supports the Purple Map and the proposed Ordinance. Jingjing Yan appeared and spoke in support of the Green Map. Jennifer Ji appeared and spoke in support of the Green Map. Kate Guo appeared and spoke about gerrymandering, and wanted clarification, and if this was truly for the benefit of the whole City, and indicated that she did not send an email to the City. Jenny (no last name given) appeared and spoke in support of the Green Map. Jana Gao appeared and indicated that she supports the Green Map, and that she did not send an email to the City. Zhi Jiang appeared and indicated that he supports the Green Map, and that he did not send an email to the City. Lingli Wang appeared and indicated that she strongly supports the Green Map, and that she sent an email to the City. Cathy Tan appeared and indicated that she supports the Green Map. Susan Guo appeared and indicated that she supports the Green Map, and that she sent an email to the City. Judy J. Xu appeared and indicated that she supports the Green Map, and that she sent an email to the City. 4 10-03-2017 Gary Kovacic appeared and commented on the City Council’s decision by refusing to accommodate Council Member Beck’s schedule at the last meeting; he shared his concerns regarding the various maps, and suggested that Map K be resurrected because he feels it is more equitable; and indicated that he did not send an email to the City. Alice Zhu appeared and spoke in support of the Green Map, and indicated that she sent an email to the City. Tina Wu appeared and spoke in support of the Green Map. YongPing Zhang appeared and spoke in support of the Green Map. Edmond Liu appeared and spoke in support of the Green Map, and indicated that he sent an email to the City. (inaudible) appeared and indicated that they never received any notices regarding these hearings; and indicated that he feels embarrassed that the City Council is pronouncing their names wrong; and indicated that he supports Map M. Eileen Wei appeared and spoke in support of the Green Map, and indicated that she sent an email to the City. (did not provide her name) appeared and indicated that a lot of people didn’t know about the meeting tonight, because of the short notice. A motion to close the public hearing was made by Council Member Chandler, seconded by Mayor Pro Tem Tay and seeing no objection, Mayor Amundson declared the public hearing closed. It was moved by Council Member Chandler seconded by Mayor Pro Tem Tay and carried on roll call vote to introduce Ordinance No. 2350 adding Section 1704 to Chapter 7 of Article I of the Arcadia Municipal Code establishing by-district elections, defining district boundaries, and scheduling elections within the districts, with the Purple Map. AYES: Chandler, Tay, and Amundson NOES: Beck and Verlato ABSENT: None Council Member Verlato indicated that she would like to reconsider her vote to go to districts; and requested the support of two Council Members to place that item on a future agenda to reconsider the vote taken regarding the resolution of intention to go to district, adopted on July 21, 2017. City Attorney Deitsch discussed the process with the City Council regarding Council Member Verlato’s request, and indicated that the motion to rescind must take place before the next regular meeting on October 17, 2017. Council Member Beck and Mayor Amundson concurred. 5 10-03-2017 b. Resolution No. 7183 Denying the Appeal of Planning Commission Resolution No. 1991 approving Tentative Tract Map No. TTM 17-02 (74941), Multiple Family Architectural Design Review No. MFADR 16-10, and Protected Tree Encroachment Permit No. TRE 16-54 with a Categorical Exemption under the California Environmental Quality Act (“CEQA”) for a ten unit residential condominium development at 837-841½ W. Huntington Drive. Recommended Action: Adopt Associate Planner Chamberlain provided the staff report. City Manager Lazzaretto noted for the records that three emails opposing the project were received from Caroline Blake, Victoria Lorona, and Mark Chang. Mayor Amundson opened the public hearing. Caroline Blake, an Arcadia resident, appeared and indicated that she represents several Coronado Drive homeowners, and shared their opposition of the project. Al Lorona, an Arcadia resident, appeared and expressed his opposition of the project. Mark Chang, an Arcadia resident, appeared and also expressed his opposition of the project. Kim Tay, an Arcadia resident, appeared and expressed his opposition of the project. Pison Netsawang, representing the Architect of the project, appeared and addressed issues brought up in the appeal letter; and addressed questions raised by the City Council. A motion to close the public hearing was made by Council Member Chandler seconded by Mayor Pro Tem Tay and seeing no objection, Mayor Amundson declared the public hearing closed. It was moved by Council Member Chandler, seconded by Mayor Pro Tem Tay and carried on roll call vote to adopt Resolution No. 7183 Denying the Appeal of Planning Commission Resolution No. 1991 approving Tentative Tract Map No. TTM 17-02 (74941), Multiple Family Architectural Design Review No. MFADR 16-10, and Protected Tree Encroachment Permit No. TRE 16-54 with a Categorical Exemption under the California Environmental Quality Act (“CEQA”) for a ten unit residential condominium development at 837-841½ W. Huntington Drive; and amend the Conditions of Approval to include screening across the rear property line with landscaping to be maintained with at least 20 feet hedges. Professional Services Agreement with Home Bot Automation, Inc. (DBA Ring) for private security camera services in an amount not to exceed $25,000. Recommended Action: Approve Police Chief Guthrie, and Management Analyst Dr. Brutus presented the staff report. It was moved by Council Member Chandler, seconded by Mayor Pro Tem Tay and carried on roll call vote to approve, and authorize and direct the City Manager to execute a Professional Services Agreement with Home Bot Automation, Inc. (DBA: Ring) for private security camera services in an amount not to exceed $25,000. AYES: Chandler, Tay, Beck, Verlato and Amundson NOES: None ABSENT: None PUBLIC COMMENTS – No one appeared. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense [AB 1234]) Council Member Verlato announced that she attended the Taste of Arcadia last Monday, and commented on its success; she attended the Golden Plate Awards by the Foothill Unity Center last Thursday, and indicated that Mayor Amundson received a Golden Plate Award; that last week was the Mayor’s L.A. County Conference hosted by the City of Arcadia; the Moon Festival at the Arboretum was last Saturday night, hosted by the Arcadia Chinese Association; and last night she was a guest judge for the Arcadia High School Constitution Team and complimented their talents, and thanked them for having her as a guest judge. Mayor Pro Tem Tay announced that he also attended the events announced by Council Member Verlato. Council Member Beck commented on the La Vegas shooting tragedy, and other similar tragedies that have occurred; he commended Chief Guthrie for the 3 month plan in an attempt to fight residential burglary crime, and noted some statistics; he commended Public Works Services Director Tait for buying water on sale; and shared pictures of his new granddaughter. Council Member Chandler commended the Police Department for the great job they do. City Clerk Glasco announced that he also attended the Taste of Arcadia last Thursday; and further announced that on October 19, Art Del Rey of Art Del Rey Realty will be honored as Arcadia’s Business Icon by the Arcadia Chamber of Commerce and Arcadia Historical Society; and that on November 4, the Arcadia Women’s Club will be having a fundraiser dinner and Musical Military Tribute to raise money for floodlights at the Arcadia Vietnam Veteran’s Monument. Mayor Amundson commented on the L.A. County Mayor’s Conference hosted by the City of Arcadia, and thanked the Santa Anita Race Track for hosting the event, and thanked Methodist 7 10-03-2017 Hospital, Westfield, Waste Management and the Chamber of Commerce for sponsoring the event, and commented on some of the topics that were discussed; he announced that he attended the Arcadia High School Homecoming game; he commented on the “we” in the US Constitution; and also commented on the tragedy in Las Vegas. 4. CONSENT CALENDAR a. Special Meeting Minutes of September 7, 2017, and Regular Meeting Minutes of September 19, 2017. Recommended Action: Approve b. Resolution No. 7182 accepting a dedication of certain property at 615 South Second Avenue (12-foot width dedication along property frontage as part of Parcel Map 71991) for public use. Recommended Action: Adopt c. Contract with CJ Concrete Construction, Inc. for the Fiscal Year 2017-18 Annual Concrete Repairs Project in the amount of $63,871.25. Recommended Action: Approve d. Contract with National Plant Services, Inc. for the Fiscal Year 2017-18 Annual Sewer CCTV Inspection in the amount of $47,500. Recommended Action: Approve e. Professional Services Agreement with RRM Design Group for design services for the Arcadia Gold Line Station Pedestrian Linkage Project in the amount of $199,950. Recommended Action: Approve f. Accept all work performed by Vargas Olson Enterprises, Inc. for the Library Carpet Tile Installation Project as complete. Recommended Action: Approve g. Purchase of 3,500 acre-feet of Imported Replacement Water from the Main San Gabriel Basin Watermaster for a total cost of $2,691,500. ARCADIA CITY COUNCIL SPECIAL MEETING MINUTES TUESDAY, NOVEMBER 7, 2017 CALL TO ORDER – Mayor Amundson called the Special Meeting to order at 3:40 p.m. in the City Council Conference Room, 240 W. Huntington Drive, Arcadia, California. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Beck, Chandler, Tay, and Amundson ABSENT: Verlato On motion by Council Member Chandler, seconded by Mayor Pro Tem Tay, Council Member Verlato was excused. PUBLIC COMMENTS – No one appeared. Council Member Verlato arrived at 3:45 p.m. CLOSED SESSION a. Pursuant to Government Code Section 54956.9(d)(1) to confer with legal counsel regarding the matter of Richard Salmon, an individual v. City of Arcadia; Elgin Sweeper Company, a Delaware Corporation; Juan Carlos Calderon, an individual; Samuel Andrew Delgado, an individual, and Does 1 through 25 (Los Angeles Superior Court Case No. BC595969). b. Presentation of Mayor’s Certificates of Commendation to the participants of the 2017 Leadership Academy. 2 11-07-2017 PUBLIC COMMENTS Jolly Wu, an Arcadia resident, appeared and spoke on behalf of former Mayor Gail Marshall who is in the hospital; she expressed Ms. Marshall’s concerns regarding the use of the Dial-A-Ride buses to transport participants to Taste the Town luncheons; Ms. Wu also expressed her own concerns over the use of the buses to transport participants to Taste the Town luncheons; and provided her recommendation for upgrading the restrooms in the City Council Chambers. Rona Poli, an Arcadia resident, appeared and mirrored Ms. Wu’s comments on behalf of former Mayor Gail Marshall; she expressed her concerns and her perception of a misuse of the Dial-A-Ride program, and asked the City Council to enforce policies. Beverly Street, an Arcadia resident, appeared and announced that on November 12, the Arcadia Historical Society will be celebrating its 65th anniversary at the Prince Erik Hall Gardens, and shared some accomplishments by the Arcadia Historical Society; and she thanked the City Council for their continued support in preserving the history of the City. Susan Guo, an Arcadia resident, appeared and inquired about the October 3, 2017, Regular Meeting Minutes; and asked when those minutes would be available. In response to Ms. Guo’s inquiry, City Manager Lazzaretto responded that those minutes would be available at the November 21, 2017, City Council Meeting. Nelson Ge, an Arcadia resident, appeared and expressed his concerns about the level of authority of the HOA’s and ARB’s; he asked the City Council to question whether this type of government should be changed; and questioned whether the City Council is over stretching their power with regard to the proposed Historic Preservation Ordinance. Liangyi Gu, an Arcadia resident, appeared and also expressed her concerns about the level of authority of the HOA’s, ARB’s and Resolution No. 6770; she indicated that the HOA’s do not have legal authority with the application process for altering homes; and shared her reasons why she is not comfortable with the proposed Historic Preservation Ordinance. PUBLIC HEARING a. Additions to the Statement of Objectives and Projects for use of Community Development Block Grant (“CDBG”) funds for Fiscal Year 2017-18 and Memorandum of Understanding with the Los Angeles County Community Development Commission. Recommended Action: Approve Assistant City Manager/Development Services Director Kruckeberg, and Deputy Director of Development Services/City Engineer Wray presented the staff report. Mayor Amundson opened the Public Hearing. No one appeared. A motion to close the public hearing was made by Council Member Chandler seconded by Mayor Pro Tem Tay, and seeing no objection, Mayor Amundson declared the public hearing closed. 3 11-07-2017 It was moved by Council Member Chandler, seconded by Council Member Verlato, and carried on roll call vote to approve additions to the Statement of Objectives and Projects for use of Community Development Block Grant (“CDBG”) funds for Fiscal Year 2017-18 and Memorandum of Understanding with the Los Angeles County Community Development Commission. AYES: Chandler, Verlato, Beck, Tay, and Amundson NOES: None ABSENT: None REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense [AB 1234]). Council Member Verlato noted that the joint meeting with the Arcadia Unified School District Board was a success; that Deputy Director of Development Services/City Engineer Wray will be working with the School District in an effort to educate and promote school traffic safety; she announced that she attended the Shine A Light Fundraiser Dinner; she attended the Arcadia PTA meeting as the City’s Liaison; she attended the Halloween Haunt on October 27 in Downtown Arcadia, and thanked everyone who contributed; she further announced that December 9 is the Holiday Market in the Downtown, which will include First Avenue Middle School’s 110-year celebration; and asked for support from the City Council to explore ideas on how to better communicate with the Chinese community, and requested a Study Session to further discuss. The City Council concurred. Mayor Pro Tem Tay commented on the completion of the Leadership Academy; he explained the purpose of the Taste the Town luncheons, and the use of Dial-A-Ride buses to transport the seniors; he thanked everyone on behalf of the Arcadia Masonic Lodge for attending the Award Ceremony in honor of former Mayor Jim Helms; he announced that on October 28, he attended the Methodist Hospital Crystal Ball fundraiser; that November 2, was the Historical Preservation community meeting; he further announced that on November 11 there will be an Ikebana Exhibition at the Floretta Lauber Education Center; and on November 13, there will be a Historical Preservation community meeting, and encouraged everyone to attend. In response to comments made regarding use of City transit buses for the Taste the Town senior luncheons, City Manager Lazzaretto explained that Taste the Town luncheons is a City run program, and the use of the City transit buses for this event was 100% his decision, not Council Member Tay’s; and indicated that staff made sure that all participants qualified for the program and event. He indicated that Ms. Poli’s comments will be looked into by staff. Council Member Beck wished Gail Marshall a speedy recovery; he announced that he attended Ruth Gilb’s funeral earlier; he announced that he also attended the Methodist Hospital Crystal Ball; and that he presented Circus Vargas a Mayor’s Certificate of Commendation on behalf of Mayor Amundson. Council Member Chandler commented on the nice letter received from Mr. Helms thanking the City Council for attending the Award Ceremony; and he thanked the Arcadia Women's Club for the Shine A Light Veterans Fundraising Dinner. 4 11-07-2017 City Clerk Glasco stated that the Shine A Light Veterans Fundraising Dinner was a great event, and thanked the City Council and community for attending; he also thanked the dedicated volunteers that helped put the event together; he noted that the Arcadia Women's Club is still accepting donations for the Vietnam War Monument; and wished everyone a happy Veterans Day. Mayor Amundson announced that he also attended the Methodist Hospital Crystal Ball, and noted that over $600,000 was raised; he thanked the Recreation and Community Services Department for putting together the Veterans Day luncheon; he announced that there was a Coffee with the Mayor event this morning; he spoke about the great things coming to Live Oak Avenue; and he thanked the Police Department for their efforts in making Arcadia safe. 1. Professional Services Agreement with Psomas for Environmental Consulting Services to update the Downtown Mixed Use Zoning Designation in the amount of $65,800, and a budget amendment to appropriate the necessary funds from General Fund Reserves. Recommended Action: Approve c. Contract with Vincor Construction Inc. for the Par 3 Facility Improvements Project in the amount of $48,522.37 Recommended Action: Approve d.
