HomeMy WebLinkAboutItem 1a - Regular Meeting Minutes of December 5, 2017 1 12-05-2017 ARCADIA CITY COUNCIL REGULAR MEETING MINUTES TUESDAY, DECEMBER 5, 2017 CALL TO ORDER – Mayor Amundson called the meeting to order at 6:05 p.m. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Beck, Chandler, Verlato, Tay, and Amundson ABSENT: None PUBLIC COMMENTS – No one appeared. STUDY SESSION a. County of Los Angeles Community Choice Energy JPA. Recommended Action: Direct Staff to Prepare Necessary Documents to Join the Los Angeles County Community Choice Energy JPA It was moved by Council Member Beck, seconded by Council Member Verlato, and carried on roll call vote to bring back to the next regular meeting for further discussion and consideration, and possible introduction of an ordinance. AYES: Beck, Verlato, Chandler, Tay and Amundson NOES: None ABSENT: None CLOSED SESSION a. Pursuant to Government Code Section 54957.6 to confer with labor negotiators. City Negotiators: City Manager Dominic Lazzaretto, Administrative Services Director Hue Quach, and Assistant City Manager/Development Services Director Jason Kruckeberg. Employee Organizations: Arcadia Public Works Employees Association, Arcadia Employees Association, Arcadia Police Civilian Employees Association, Arcadia Police Officers’ Association, Arcadia Firefighters’ Association, and unrepresented employees: Department Heads, Division Managers, Supervisors, and part-time employees. No reportable action was taken on the Closed Session item. The meeting recessed at 6:59 p.m., and will reconvene after the regular meeting to a continued closed session. 2 12-05-2017 REGULAR CITY COUNCIL MEETING 7:00 p.m. CALL TO ORDER – Mayor Amundson called the regular meeting to order at 7:05 p.m. INVOCATION – Reverend Darwin Ng, Arcadia Police Department Chaplain PLEDGE OF ALLEGIANCE - Ray Tagney, U. S. Army National Guard ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Beck, Chandler, Verlato, Tay, and Amundson ABSENT: None REPORT FROM CITY ATTORNEY REGARDING CLOSED/STUDY SESSION ITEMS City Attorney Deitsch reported that the City Council met in a Study Session prior to the regular meeting to consider the possibility of joining the Los Angeles Community Choice Energy Joint Powers Authority, and upon motion by Council Member Beck, seconded by Council Member Verlato, the City Council unanimously (5-0) directed staff to prepare the necessary documents for City Council consideration at the December 19 meeting to join the L.A. County Community Choice Energy Joint Powers Authority; he explained that this is an entity which would purchase electricity from power producers and sell to residents and businesses in Arcadia, and elsewhere in the County at a lower cost than electric utilities, such as Edison; that if the City were to join the Authority, which could be as early as the next City Council meeting, the implementation of the program could occur on or before January 2019 or possibly the 3rd or 4th quarter of 2018, and would include residents or businesses within Arcadia who would have the option of choosing to purchase their electricity from the Joint Powers Authority instead of from Edison. City Attorney Deitsch further reported that the City Council met in a Closed Session to consider the one item listed on the posted agenda under Closed Session, that no action was taken yet since discussion was not completed; he recommended that at the conclusion of the open session that the Mayor recess to a continued Closed Session to complete discussion of that item. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto stated there was no supplemental agenda information. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Mayor Pro Tem Tay and seconded by Council Member Chandler to read all ordinances and resolutions by title only and waive the reading in full. 1. PUBLIC HEARING a. Resolution No. 7189 approving the Grant of an Easement to Southern California Edison Company for public utilities on City-owned property at 33 West Huntington Drive for the Morlan Place Underground Utility District. Recommended Action: Adopt 3 12-05-2017 Deputy Director of Development Services/City Engineer Wray presented the staff report. Mayor Amundson opened the public hearing. No one appeared. A motion to close the public hearing was made by Council Member Chandler, seconded by Mayor Pro Tem Tay and seeing no objection, Mayor Amundson declared the public hearing closed. It was moved by Council Member Chandler, seconded by Mayor Pro Tem Tay, and carried on roll call vote to adopt Resolution No. 7189 approving the Grant of an Easement to Southern California Edison Company for public utilities on City-owned property at 33 West Huntington Drive for the Morlan Place Underground Utility District. AYES: Chandler, Tay, Verlato, and Amundson NOES: None ABSENT: None ABSTAIN: Beck At the request of Mayor Amundson, Fire Chief Lang announced that the Arcadia Fire Department received the 2017 American Heart Association Mission: Life Gold Star Award; and provided an update where Arcadia personnel are currently assisting with area wildfires. In response to a question raised by Council Member Beck, Fire Chief Lang responded that fire personnel receive their normal pay from the City, then is reimbursed by the State. PUBLIC COMMENTS – No one appeared. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense [AB 1234]). Council Member Beck congratulated Fire Chief Lang and the Fire Department for receiving the award; he announced December 12, is the Menorah Lighting ceremony at the Transit Place; and the Police Chief’s holiday breakfast on December 14. Council Member Chandler announced that he attended the Foothill Gold Line Extension from Glendora to Montclair Groundbreaking Ceremony, and noted that the contractor doing the underground work is W. A. Rasic Construction, who were Arcadia residents and lived down the street from him, and the boys who now run the company all attended Arcadia schools. Mayor Pro Tem Tay announced that he attending the Christmas Lighting ceremony at the Gold Line Station on December 1, and thanked staff for putting the event together; and noted that all the children enjoyed Snow Fest on December 2. Council Member Verlato also announced that she also attended the Christmas Lighting Ceremony at the Transit Plaza on December 1; she attended Breakfast with Santa, and Snow Fest on December 2; and reminded everyone that December 8 is Kids Night Out and encouraged parents to take advantage of it and drop the kids off at the Community Center; she further announced the Holiday Market on December 9, and that there will be a 110th birthday anniversary bash for First Avenue Middle School; she noted that she recently attended the Southern California Association of Governments Economic Summit, and commented on affordable housing and converting commercial space for residential multi-family use; and 4 12-05-2017 extended her thoughts and prayers to those families who have lost their homes in the recent fires. Council Member Chandler announced that he, Mayor Pro Tem Tay and staff attended the grand opening of the Rusnak/Mercedes-Benz dealership in Arcadia. City Clerk Glasco announced that on December 2, he attended the annual Christmas Tree Lane event at the Arcadia Elks Lodge to support veteran’s and disadvantaged children, and indicated that over $8,000 was raised for charity; that on December 3, the Arcadia Elks hosted their annual Rose Parade Banner; and further announced that he attended Congresswoman Judy Chu’s annual holiday party and toy drive; and that on December 10, he will assist in the interview process for recommendation of student candidates of California’s 27th District for appointment to the Annapolis West Point Air Force and Coast Guard Academy. Mayor Amundson stated that he was recently approached by a neighbor who apologized to him for comments he made during his election; he commented on the community meeting held last evening, and some of the topics of discussion; he announced that it is Taco Lita’s 50th Anniversary, and after the Council meeting he will go and present the certificate to them; he spoke about how not to be a victim during the holiday season and encouraged everyone to be extra vigilant; and commented on the resolutions on the Consent Calendar relating to the district election, and asked City Attorney Deitsch to comment on the City of Poway matter. In response to Mayor Amundson’s request, City Attorney Deitsch indicated that the City Council, under a threat of litigation, adopted an ordinance for district elections; he noted that Arcadia is in the company of many other cities and other public entities; he explained that as a result of what has been going on throughout California, the City of Poway who adopted an ordinance, filed a lawsuit in federal court challenging the California Voting Rights Act, and any requirement to transition to district elections; he indicated that the City of Arcadia directed the City Attorney to investigate if there was any way the City could lend its name in support of the Plaintiff; he further indicated that a brief is being presented by the San Gabriel Valley Council of Governments, which Arcadia is a member, which would temporarily prevent the implementation of the CVRA to require cities to adopt district ordinances and conduct elections under that. City Attorney Deitsch reported that this week it is expected the COG will finalize the Amicus Brief, which he will review; and that the hearing will take place on January 12, at 1:30 p.m. in the U.S. District Court, DTLA, and invited any Council Member or member of public to attend and hear arguments. In response to Council Member Beck’s question, City Attorney Deitsch indicated that if the Judge grants the preliminary injunction, he does not feel it would not affect Arcadia’s election in April, since the City has already adopted it election resolutions and it would definitely be too short of a notice; and indicated that a preliminary injunction is not a final determination. 2. CONSENT CALENDAR a. Special and Regular Meeting Minutes of November 21, 2017. Recommended Action: Approve b. Resolutions relating to the General Municipal Election to be held on Tuesday, April 10, 2018. 5 12-05-2017 Resolution No. 7190 calling for the holding of an All-Mail Ballot General Municipal Election on Tuesday, April 10, 2018, for the election of Members of the City Council in Electoral Districts 2, 3, and 5 as required by the City Charter. Recommended Action: Adopt Resolution No. 7191 requesting the Board of Supervisors of the County of Los Angeles to render specified services to the City relating to the conduct of an All-Mail Ballot General Municipal Election to be held on Tuesday, April 10, 2018. Recommended Action: Adopt Resolution No. 7192 adopting regulations for candidates for elective office pertaining to candidates’ statements submitted to the voters at an All-Mail Ballot General Municipal Election to be held on Tuesday, April 10, 2018. Recommended Action: Adopt c. Ordinance No. 2351 (uncodified) amending uncodified Ordinance No. 2276 and reauthorizing that ordinance as amended, including the fee paid to the City by State video franchise holders for public, educational, and government access purposes. Recommended Action: Adopt d. Purchase Order with Penske Chevrolet of Cerritos for the purchase of one 2018 Chevrolet Silverado 4WD pickup truck in the amount of $32,079.11. Recommended Action: Approve e. Purchase Order with Yamada Enterprises for Phase II of new furniture and charging systems for the Arcadia Public Library in the amount of $93,343.87. Recommended Action: Approve f. Reject all bids received for the Tennis Court Resurfacing Project and direct staff to rebid the project. AYES: Chandler, Tay, Beck, Verlato, and Amundson NOES: None ABSENT: None 3. CITY MANAGER a. Ordinance No. 2352 amending Section 1700 of Chapter 7 of Article 1 of the Arcadia Municipal Code, changing the General Municipal Election date from April of even-numbered years to the Statewide General Election in November of even- numbered years, commencing with the November 2022 election, in order to comply with California Senate Bill 415. Recommended Action: Introduce City Manager Lazzaretto presented the staff report. 6 12-05-2017 It was moved by Council Member Chandler, seconded by Mayor Pro Tem Tay, and carried on roll call vote to introduce Ordinance No. 2350 adding Section 1704 to Chapter 7 of Article I of the Arcadia Municipal Code establishing by-district elections, defining district boundaries, and scheduling elections within the districts. Resolution No. 7193 approving amendments to the San Gabriel Valley Council of Governments Joint Powers Agreement as adopted by the Council’s Governing Board. Recommended Action: Adopt City Manager Lazzaretto presented the staff report. It was moved by Mayor Pro Tem Tay, seconded by Council Member Chandler, and carried on roll call vote to adopt Resolution No. 7193 approving amendments to the San Gabriel Valley Council of Governments Joint Powers Agreement as adopted by the Council’s Governing Board. AYES: Tay, Chandler, Beck, Verlato, and Amundson NOES: None ABSENT: None c. Proposed ballot measure for revenue enhancement to support vital City services. Recommended Action: Continue public outreach and plan for the ballot initiative to be placed on the April 2020 General Municipal Election. City Manager Lazzaretto presented the staff report. Council Member Verlato requested City Council support to bring back for consideration to create a Citizens Committee. Mayor Amundson and Council Member Beck concurred. It was moved by Council Member Verlato, seconded by Council Member Chandler, and carried on roll call vote to direct staff to continue a broad public education campaign.
