Wray, Deputy Director of Development Services/City Engineer By: Tim Kelleher, Assistant Engineer SUBJECT: CONTRACT WITH SEQUEL CONSTRUCTION FOR THE PAVEMENT REHABILITATION OF SECOND AVENUE FROM HUNTINGTON DRIVE TO FOOTHILL BOULEVARD IN THE AMOUNT OF $669,490. Recommendation: Approve SUMMARY As part of the ongoing Pavement Management Program, the City annually appropriates Proposition C funding for arterial repaving projects. For the Fiscal Year 2016-17 Capital Improvement Program (“CIP”), the City Council appropriated funding for the rehabilitation of Second Avenue between Huntington Drive and Foothill Boulevard, as well as traffic signal improvements at Second Avenue and Santa Clara Street. The Second Avenue Rehabilitation will be a complete resurfacing. The project will also include the resurfacing of Morlan Place as a follow up to the Morlan Place Underground Utility District. The project was advertised in November of 2017, and bids were opened November 30, 2017. Six (6) bids were received, and Sequel Construction submitted the successful low bid in the amount of $669,490. It is recommended that the City Council approve, and authorize and direct the City Manager to execute a contract with Sequel Construction for the Pavement Rehabilitation of Second Avenue from Huntington Drive to Foothill Boulevard. BACKGROUND The City annually appropriates Proposition C funding for arterial street pavement projects. For the Fiscal Year 2016-17 Capital Improvement Program (“CIP”), the City Council appropriated funding for the Arterial Pavement Rehabilitation of Second Avenue from Huntington Drive to Foothill Boulevard. Arterial Rehabilitation – Second Avenue from Huntington Drive to Foothill Boulevard December 19, 2017 Page 2 of 3 The City’s Pavement Management Program, which analyzes the existing condition of the street pavement, has identified Second Avenue between Huntington Drive and Foothill Boulevard, as the highest priority street for repair. This segment of Second Avenue has an average Pavement Condition Index (“PCI”) rating of 45, with 100 being best, and zero being worst. The Second Avenue Rehabilitation will include removing and replacing isolated sections of pavement, and grinding and resurfacing the entire street with 1-1/2-inches of new asphalt. As part of this project, the traffic signal at the intersection of Second Avenue and Santa Clara Street will be upgraded. The upgrade will include rewiring the intersection, and installing a battery back-up system, a new cabinet, and controller. Also, a conduit and fiber optic line will be installed from Huntington Drive to Santa Clara Street to connect the Santa Clara Street traffic signal to the City’s Traffic Signal Control System. Also included in this project is the resurfacing of Morlan Place. The Morlan Place Underground Utility District project removed and replaced the paving over several trench lines in the street. Now that the work for the Underground Utility District is complete, and the trench lines repaved, this project will include paving the balance of the street. DISCUSSION The project was advertised for bids in November 2017, and bids were opened on November 30, 2017. The engineer’s estimate was $800,000. Bids were received from six (6) prospective contractors with the following results: Company Amount Sequel Contractors, Inc. $669,490 Gentry Brothers Inc. $676,720 All American Asphalt $697,770 Hardy & Harper Inc. $742,000 Palp Inc/Excel $787,193 E C Construction $812,437 After reviewing the bid documents, Sequel Construction was determined to be the lowest responsible bidder. Sequel has been in existence for many years, and is an extremely competent contractor. They have performed work for the City in the past with favorable results. Based on these results, it is determined that Sequel Construction can satisfactorily perform the required work. Arterial Rehabilitation – Second Avenue from Huntington Drive to Foothill Boulevard December 19, 2017 Page 3 of 3 ENVIRONMENTAL IMPACT The project is categorically exempt per Section 15301 class 1(c) from the requirements of the California Environmental Quality Act (“CEQA”). FISCAL IMPACT This project was budgeted out of two projects in the Fiscal Year 2016-17 Capital Improvement Program. The first is the Arterial Pavement Rehabilitation of Second Avenue Project at a total of $700,000, with $600,000 from Proposition “C” funds for the paving, and $100,000 in Transportation Impact Fees for the traffic signal improvements. The second project is the Miscellaneous Traffic Signal Improvements Project for additional traffic signal improvements, like the conduit and fiber optics line and the battery backup system, at $100,000 in Transportation Impact Fees. The combined budget from the two projects is $800,000. The low bid for the work is $699,490, and with a 10% contingency, the maximum total cost of the project would be $736,439. There are sufficient funds from the two project budgets to cover all elements of the project. RECOMMENDATION It is recommended that the City Council authorize the City Manager to execute a contract with Sequel Construction for the Pavement Rehabilitation of Second Avenue from Huntington Drive to Foothill Boulevard in the amount of $699,490, with a 10% contingency; and determine the project is categorically exempt pursuant to Section 15301 Class 1(c) from the requirements of California Environmental Quality Act (“CEQA”). PROJECT NO. 41854517 NOVEMBER 2017 1. PARTIES AND DATE. This Contract is made and entered into this ______ day of _________, 2017, by and between the CITY OF ARCADIA (hereinafter called the "Owner") and SEQUEL CONSTRUCTION (hereinafter called the "Contractor"). 2. RECITALS. 2.1 The Owner is a charter City organized under the laws of the State of California, with power to contract for services necessary to achieve its purpose; 2.2 Contractor, in response to a Notice Inviting Bids issued by Owner on November 2017, has submitted a bid proposal for construction the Arterial Rehabilitation – Second Avenue from Huntington Drive to Foothill Blvd. project described in the Contract. 2.3 Owner has duly opened and considered the Contractor's bid proposal, and duly awarded the bid to Contractor in accordance with the Notice Inviting Bids and the other Bid Documents, and has given written notice to Contractor on December 2017. 2.4 Contractor has obtained, and delivers concurrently herewith, Performance and Payment Bonds and evidences of insurance coverage as required by the Contract. 3. This Contract includes and hereby incorporates in full by reference the following documents, including all exhibits, drawings, specifications and documents therein, and attachments and addenda thereto: a. Such amount shall be subject to adjustment in accordance with the applicable terms of this Contract. All Work shall be subject to, and performed in accordance with the above referenced documents. 3.3 Standard of Performance. Contractor shall perform all Work under this Contract in a skillful and workmanlike manner, and consistent with the standards generally recognized as being employed by professionals in the same discipline in the State of California. Contractor represents and maintains that it is skilled in the professional calling necessary to perform the Work. Contractor warrants that all employees and subcontractors shall have sufficient skill and experience to perform the Work assigned to them. Finally, Contractor further represents that it, its employees and subcontractors have all licenses, permits, qualifications and approvals of whatever nature that are legally required to perform the Work, and that such licenses and approvals shall be maintained throughout the term of this Contract. Contractor shall perform and complete all Work under this Contract within 25 working days, beginning ten (10) calendar days after the date on which the Notice to Proceed is sent by the Owner to the Contractor. Moreover, Contractor shall perform its Work in strict accordance with any completion schedule, construction schedule or project milestones developed pursuant to provisions of the Contract, including but not limited to the Project Schedule located in the Specifications. Contractor agrees that if such Work is not completed within the aforementioned period and/or pursuant to any such completion schedule, construction schedule or project milestones developed pursuant to provisions of the Contract, including but not limited to the Project Schedule located in the Specifications, it is understood, acknowledged and agreed that the Owner will suffer damage. Pursuant to Government Code Section 53069.85, Contractor shall pay to the Owner as fixed and liquidated damages the sum of One Thousand Dollars ($1,000) PER DAY as provided by the applicable provisions of the General Conditions, found in Part "B" of the Contract Appendix. 3.5 Owner's Basic Obligation. Owner agrees to engage and does hereby engage Contractor as an independent contractor to furnish all materials and to perform all Work according to the terms and conditions herein contained for the sum set forth above. Except as otherwise provided in the Contract, the Owner shall pay to Contractor, as full consideration for the satisfactory performance by the Contractor of the services and obligations required by this Contract, the above referenced compensation in accordance with compensation provisions set forth in the Contract. 3.6 Contractor's Labor Certification. Contractor maintains that he is aware of the provisions of Section 3700 of the California Labor Code which require every employer to be insured against liability for Worker's Compensation or to undertake self-insurance in accordance with the provisions of that Code, and agrees to comply with such provisions before commencing the performance of the Work. A certification form for this purpose is attached hereto as Exhibit “A” and incorporated herein by reference, and shall be executed simultaneously with this Contract. 3.7 Attorneys' Fees. If either party commences an action against the other party, either legal, administrative or otherwise, arising out of or in connection with this Contract, the prevailing party in such action shall be entitled to have and recover from the losing party reasonable attorneys' fees and all other costs of such action. 3.8 Successors. The parties do for themselves, their heirs, executors, administrators, successors, and assigns agree to the full performance of all of the provisions contained in this Contract. Contractor may not either voluntarily or by action of law, assign any obligation assumed by Contractor hereunder without the prior written consent of the Owner.
