HomeMy WebLinkAboutItem 1a - Special and Regular Meeting Minutes of February 20, 2018 ARCADIA CITY COUNCIL SPECIAL MEETING MINUTES TUESDAY, FEBRUARY 20, 2018 CALL TO ORDER - Mayor Amundson called the Special Meeting to order at 5:02 p.m. in the City Council Conference Room, 240 W. Huntington Drive, Arcadia, California. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Beck, Chandler, Tay, and Amundson ABSENT: Verlato A motion was made by Council Member Chandler, seconded by Mayor Amundson to excuse Council Member Verlato. Council Member Verlato arrived at 5:05 p.m. PUBLIC COMMENTS Gail Marshall, an Arcadia resident, appeared and requested that City provide out-of-town medical trips by Arcadia Transit; she also provided information to the City Council that showed other Cities provide such service. STUDY SESSION (OPEN TO THE PUBLIC) a. Report, discussion, and direction regarding provision of out-of-town medical trips by Arcadia Transit. Recommended Action: Continue current policy and do not provide out-of-town medical trips The City Council received a report from staff and, after some discussion it was the consensus to table additional discussion of this item to a future meeting. b. Report, discussion and direction regarding a potential mixed-use development proposal at 121 E. Foothill Blvd. (Highlander Center). The City Council received a report from staff and the proposed developer and their representatives. Due to time, the City Attorney recommended that this Study Session item be continued to after the Regular Meeting. CLOSED SESSION a. Pursuant to Government Code Section 54956.9(d)(1) to confer with legal counsel regarding the matter of Los Angeles SMSA Limited Partnership, a California limited partnership d/b/a Verizon Wireless v. City of Arcadia; (United States District Court, Central District, Case No.: 2:17-cv-03778 DSF JEMx). b. Pursuant to Government Code Section 54956.9(d)(1) to confer with legal counsel regarding the matter of Tom Crosby, an individual; Ellen Fu Crosby, an individual v. City of Arcadia, a California municipality; Santa Anita Oaks Homeowners Association, Inc., a California non-profit corporation; and Vincent I. Vargas, an individual (Los Angeles Superior Court Case No. BS172105). c. Pursuant to Government Code Section 54957.6 to confer with labor negotiators. City Negotiators: City Manager Dominic Lazzaretto, Administrative Services Director Hue Quach, and Assistant City Manager/Development Services Director Jason Kruckeberg Employee Organizations: Arcadia Public Works Employees Association, Arcadia Employees Association, Arcadia Police Civilian Employees Association, Arcadia Police Officers’ Association, Arcadia Firefighters’ Association, and unrepresented employees: Department Heads, Division Managers, Supervisors, and part-time employees No reportable action was taken on the Closed Session items (a) and (c). Closed Session Item (b), was continued to after the regular meeting. At 7:00 p.m., the City Council recessed the Special Meeting in order to hold the Regular Meeting of the City Council. At 8:12 p.m. the City Council resumed discussion of Study Session Item b, regarding the potential mixed-use development proposal at 121 E. Foothill Boulevard (Highlander Center). It was the consensus of the City Council that the property needs to be improved, that the McDonald’s should be included in the project, and that the developer should talk to the neighbors in the area; the City Council concurred that the project could be a 3 story project, and are open to residential components of the project, At 9:05 p.m., the City Council adjourned to Closed Session. Regarding Closed Session Item b, no reportable action was taken. Mayor Amundson adjourned the meeting at 9:29 p.m. 1 02-20-2018 ARCADIA CITY COUNCIL REGULAR MEETING MINUTES TUESDAY, FEBRUARY 20, 2018 CALL TO ORDER – Mayor Amundson called the regular meeting to order at 7:07 p.m. INVOCATION – Pastor George Hooper, Church of the Good Shephard PLEDGE OF ALLEGIANCE – Sergeant Jennifer Robinson, United States Marine Corps ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Beck, Chandler, Verlato, Tay, and Amundson ABSENT: None REPORT FROM CITY ATTORNEY REGARDING CLOSED/STUDY SESSION ITEMS City Attorney Deitsch reported that the City Council met prior to the regular meeting in a special meeting in order to conduct a study session to receive reports from staff and discuss the two items listed on the posted agenda regarding: (1) the possible provision of out-of-town medical trips by Arcadia Transit and, after some discussion, the City Council determined to table the matter for additional discussion within the next few weeks; and (2) presentation regarding a potential mixed-use development proposal at 121 E. Foothill Boulevard (Highlander Center), the City Council received a report from the proposed developer and their representatives, and have determined that after tonight’s open session, the City Council will resume the discussion. City Attorney Deitsch further reported that the City Council met in a closed session to consider Items (a) and (c) listed on the posted agenda, no reportable action was taken; and that Item (b) has not yet been discussed, and recommended the City Council recess the regular meeting to a closed session to discuss Item (b), including the study session previously mentioned, and reported that it is anticipated that no reportable action will be taken regarding closed session Item (b). SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto announced that there was no supplemental information MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Mayor Pro Tem Tay and seconded by Council Member Chandler to read all ordinances and resolutions by title only and waive the reading in full. PRESENTATIONS a. Arcadia Chinese Association presentation of Mimi's Cafe gift cards to Arcadia City staff in appreciation of providing excellent customer service to the City. 2 02-20-2018 1. PUBLIC HEARING a. Direct the Los Angeles County Agricultural Commissioner to abate nuisances upon those properties located in the City of Arcadia, and approve the Annual Weed Abatement Property List. Recommended Action: Approve City Manager Lazzaretto presented the staff report. Mayor Amundson opened the Public Hearing. No one appeared. A motion to close the public hearing was made by Council Member Chandler, seconded by Mayor Pro Tem Tay, and seeing no objection, Mayor Amundson declared the public hearing closed. It was moved by Council Member Chandler, seconded by Council Member Verlato, and carried on roll call vote to direct the Los Angeles County Agricultural Commissioner to abate nuisances upon those properties located in the City of Arcadia, and approve the Annual Weed Abatement Property List. AYES: Chandler, Verlato, Beck, Tay, and Amundson NOES: None ABSENT: None PUBLIC COMMENTS Teri Muse, Public Sector Solutions Manager with Waste Management, appeared and provided a 2017 Waste Management Year in Review. Gail Marshall, an Arcadia resident, appeared and thanked the City Council for having Waste Management as its waste hauler; she also thanked the City Council for tabling the study session item regarding the out-of-town medical trips; and asked Mayor Pro Tem Tay not have such vicious stuff coming out of this campaign, and asked that he clean it up a bit; and commented on the number of campaign signs being placed in illegal areas. Judy Xu, an Arcadia resident, appeared and indicated that Bob Harbicht election signs are being stolen, and feels the City should step in; she spoke about the increase in crime in Arcadia; she noted that her home is being proposed as a historic home by the City, and feels that it should be up to her, not the City, whether the home is preserved; she indicated the reasons why she supports Bob Harbicht; and addressed rude comments being made in this election. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense [AB 1234]). Council Member Verlato wished good luck to Arcadia resident and former Arcadia Unified School District student, Olympic skater Mirai Nagasu; she announced that she attended the Chinese New Year luncheon at the Community Center on February 9, and the Arcadia Chinese Parents Booster Club fundraiser on February 10 at the Masonic Lodge; she noted that at the last Parks and Recreation Commission meeting, they reviewed the 5 Year Capital Improvement Plan for the parks; she announced the Boy Scouts Troop 104, pancake breakfast fundraiser February 25 at Holy Angels Church; she commented on an article in the Arcadia Weekly 3 02-20-2018 regarding historical preservation and spoke about the inaccuracies in the article; and indicated that she asked to be moved from sitting next to Mayor Pro Tem Tay on the dais because of things he posted on his website, Arcadia’s Best. Mayor Pro Tem Tay announced that on February 10, he attended the Arcadia Chinese Parents Booster Club fundraiser at the Masonic Lodge which raised about $47,000 for the School District; on February 13, he attended the Methodist Hospital Mardi Gras fundraiser event; on February 15, he attended the Ontario International Airport seminar regarding the future of the airport, and that 4,600 homes will be built around the airport; he further announced that he attended the San Gabriel Valley Council of Governments meeting and noted that Interim Director Marisa Creter was named the Executive Director; he announced the new Transit App that can be downloaded on your cell phone; he noted that throughout the years he has learned not to explain himself to anyone, because the person who likes you won’t need it, and the person that doesn’t like you won’t believe you. Council Member Beck responded to comments made by speaker Judy Xu regarding crime in Arcadia, and indicated that crime is a concern to the City Council; he also announced that he attended the Methodist Hospital Mardi Gras fundraiser, and on Saturday, he will be attending Hugo Reid Little League opening day; he further announced that March 28 is the Chamber of Commerce Installation Dinner; on March 1, Police Chief Guthrie will be speaking at the Monrovia Community Center and will address Propostions 47 and 57 and AB 109 regarding the early release of felons; and he thanked the Arcadia Chinese Association for the presentation of Mimi's Cafe gift cards to Arcadia City staff in appreciation of providing excellent customer service to the City. Council Member Chandler commended Police Chief Guthrie and the Police Officers for their presence at the schools in the aftermath of the school shooting in Florida, and noted that the City and School District received letters of appreciation from the parents for making them feel safe; and announced that he also attended the Chinese New Year luncheon at the Community Center, and the Arcadia Chinese Parents Booster Club fundraiser. City Clerk Glasco also announced Assembly Member Chris Holden’s Public Safety meeting at the Monrovia Community Center on March 1, and that Police Chief Guthrie will be a speaker; and also the Santa Anita Chili cook-off on February 24 at Santa Anita Park, and noted the proceeds will go to the Foothill Unity Center. Mayor Amundson announced that he represented Arcadia at County Supervisor Barger’s Chinese New Year celebration; that he also attended the Methodist Mardi Gras and Arcadia Chinese Parents Booster Club fundraisers; he indicated that the City will look for a way to honor Olympic skater Mirai Nagasu; he announced the Mayor’s Breakfast on April 6, and the theme is “Legacy” and the guest speaker will be former L.A. County Supervisor Mike Antonovich, and the State of the City address will take place that morning; he provided tips and recommendations on how to avoid coyotes, and reminded everyone if they see a coyote, to report it; he spoke about Sacramento taking away local government control, including the abuse of the California Voting Rights Act, and Senate Bill 415, which took away the rights of when cities have their elections, and spoke about those cities fighting back; he commented that he would like to go on record opposing Senate Bill 827, which will take away local control of cities around transit centers, and requested the support of two City Council Member to place it on a future City Council for discussion (Mayor Pro Tem Tay and Council Member Chandler concurred); and noted that he will be at Eisenhower Park for Little League opening day ceremonies. 4 02-20-2018 2. CONSENT CALENDAR a. Special Meeting Minutes of January 30, 2018, and Special and Regular Meeting Minutes of February 6, 2018. Recommended Action: Approve b. Resolution No. 7202 establishing a Citizen’s Financial Advisory Committee. Recommended Action: Adopt c. Execute Memorandum of Understanding with the San Gabriel Valley Council of Governments (“SGVCOG”) for the County of Los Angeles Homelessness Plan Development. Recommended Action: Approve d. Accept all work performed by California Professional Engineering, Inc. for Traffic Signal Improvements on Duarte Road at First and Second Avenue as complete. Recommended Action: Approve Council Member Chandler pulled Consent Calendar Item (b) for further discussion. It was moved by Council Member Chandler, seconded by Mayor Pro tem Tay, and carried on roll call vote to approve Consent Calendar Items 2.a., 2.c. and 2.d. AYES: Chandler, Tay, Beck, Verlato, and Amundson NOES: None ABSENT: None In response to Council Member Chandler’s request for further discussion regarding Consent Calendar Item 2.b, City Manager Lazzaretto provided additional background regarding the City Council’s request to establish a Citizen’s Financial Advisory Committee. It was moved by Council Member Chandler, seconded by Council Member Verlato, and carried on roll call vote to approve Consent Calendar Item 2.b. AYES: Chandler, Verlato, Beck, Tay, and Amundson NOES: None ABSENT: None At the conclusion of the regular City Council meeting at 8:04 p.m., Mayor Amundson recessed to the continued Study Session regarding the potential mixed-use development proposal at 121 E.
