HomeMy WebLinkAbout03/20/2018 ARCADIA CITY COUNCIL REGULAR MEETING MINUTES TUESDAY, MARCH 20, 2018 CALL TO ORDER— Mayor Amundson called the meeting to order at 6:06 p.m. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Beck, Chandler, Verlato, Tay, and Amundson ABSENT: None PUBLIC COMMENTS— No one appeared. STUDY SESSION a. Report, discussion, and direction regarding the Language Access Services Policy. City Manager Lazzaretto and Assistant to the City Manager Bruckner provided the City Council with a report. Council Member Beck requested additional surveys from the Cities of Monterey Park, Diamond Bar and Irvine. Council Member Verlato suggested using volunteers for translations when appropriate; and professional translation services when applicable. It was the consensus of the City Council that staff bring back to a future City Council meeting for adoption, a policy regarding Language Access Services. b. Discussion and direction concerning Arcadia's position in choosing between two options in LACCE's ("Los Angeles Community Choice Energy") dba Clean Power Alliance of Southern California in their negotiations with Southern California Edison for energy purchase and rates. It was the consensus of the City Council to follow staff's recommendation to work with SCE on a reasonable solution to SCE's Power Cost Indifference Charges and related pass through fees. The City Council recessed to Closed Session at 6:42 p.m. to consider the one item listed on the posted agenda under Closed Session. CLOSED SESSION a. Pursuant to Government Code Section 54956.96 conference involving a Joint Powers Agency — Los Angeles Community Choice Energy Authority (dba) Clean Power Alliance of Southern California. 1 03-20-2018 Discussion will concern: Conference with legal counsel — anticipated litigation (Government Code Section 54957) Significant exposure to litigation pursuant to paragraph (2) or(3) of subdivision (d) of Section 54956.9: (1) Name of local agency representative on Joint Powers Agency Board: Mayor Pro Tern Sho Tay No reportable action was taken on the Closed Session item. The meeting ended at 7:00 p.m. REGULAR CITY COUNCIL MEETING 7:00 p.m. CALL TO ORDER— Mayor Amundson called the regular meeting to order at 7:05 p.m. INVOCATION — Reverend Terry Keenan, The Santa Anita Church PLEDGE OF ALLEGIANCE —Sergeant First Class Steven Swinney, United States Army Mayor Amundson presented Mr. Swinney with a 50th Anniversary Commemorative Vietnam Veterans lapel pin and proclamation. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Beck, Chandler, Verlato, Tay, and Amundson ABSENT: None REPORT FROM CITY ATTORNEY REGARDING CLOSED/STUDY SESSION ITEMS City Attorney Deitsch reported that the City Council met prior to the regular meeting in a special meeting in order to conduct a study session to receive reports from staff and discuss the two items listed on the posted agenda regarding (1) the Language Access Services Policy; and (2) concerning Arcadia's position in choosing between two options in LACCE's ("Los Angeles Community Choice Energy") dba Clean Power Alliance Southern California in their negotiations with Southern California Edison for energy purchase and rates. He stated that on motion by Council Member Chandler, seconded by Council Member Verlato, the City Council unanimously directed staff to bring forward at a future open session meeting of the City Council a proposed language access services policy, and noted that the City Council provided guidance to Mayor Pro Tem Tay on the CPA. City Attorney Deitsch further reported that the City Council met in a closed session to consider the one item listed on the posted agenda; no reportable action was taken. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto noted that there are two requests to speak on the City Manager items, and the Mayor would like to hear those speakers at that time. 2 03-20-2018 MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Mayor Pro Tern Tay, and seconded by Council Member Chandler to read all ordinances and resolutions by title only and waive the reading in full. There being no objection, the motion was considered approved. PRESENTATIONS a. Mayor's Certificates of Commendation to Arcadia Girl Scout Troop 4221 for earning the Girl Scout Gold Award. b. Presentation of American Red Cross Month Proclamation to Ambassador Sylvia Ramos. c. National Fix-a-Leak Week Council Presentation. PUBLIC COMMENTS Caroline Papp, an Arcadia resident, appeared and discussed the importance of historic buildings, and indicated that the question was whether we cared more about preserving historic properties or money. Lawrence Papp, an Arcadia resident, appeared and stated he was disturbed and saddened by the extensive spending by City government; he discussed increased costs of each department with the cost of living only increasing by 8.8%, high salaries, with median pay over$100,000 per year; he listed jobs that were more dangerous than fireman and policeman; he stated that the City Council needed to pay better attention to fiscal matters and stop employees from loading their last twelve months of employment in order to balloon pensions; he urged residents to vote for Tom Beck and Joyce Platt; and quoted the prophet Micah. Rodney Williamson, an Arcadia resident, expressed concern about his house being up for historic designation and urged caution to avoid taking away property rights. John Chen appeared and asked if Council Member Beck had an 8,000-square foot mansion; he indicated his opposition to the historic preservation ordinance ("HPO"); and encouraged voters to vote for Bob Harbicht and Roger Chandler. Miley Fawn, representing Congresswomen Judy Chu, introduced herself and invited the City Council to the Opioid Workshop on March 28, 7-8:30 p.m., at Pasadena City College. Linna, District 2 resident, appeared and asked Council Member Beck why the Police Association endorsed Mr. Harbicht; she commented on the need to solve the City's crime problems; she discussed her contributions to the community, and questioned why the City could infringe on her property rights with the HPO. Brett Mitulski, an Arcadia resident, appeared and stated the 2016 City Council election proved the power of the people unifying the City, but the districting process threatens the progress; he stated that District 3 was robbed of an election; and urged voters to vote for Tom Beck and Joyce Platt. 3 03-20-2018 Sidney Chan, an Arcadia resident, appeared and urged the City Council to listen to the residents of Arcadia regarding the HPO; he discussed excessive litigation in Arcadia; he suggested the use of license place readers to prevent crime; and encouraged the voters to vote for Mr. Harbicht and Mr. Chandler. Shirley Ying Fing, an Arcadia resident, appeared and expressed her concerns regarding rising crime rates, and asked what the City Council was doing to protect the residents; she shared the same concerns as Mr. Williamson regarding the HPO; and urged the Council Members to serve the people. Edward Mui, Arcadians Against Residential Towers, appeared and reminded the City Council to oppose the 53-foot cell tower. Susan Guo, an Arcadia resident, appeared and commented on the City's postcard regarding the HPO, and asked questions regarding the number of potential historic homes; and asked how the voting procedures to establish a district would be conducted. Judy Xu, an Arcadia resident, appeared and discussed the postcard received from Tom Beck; she stated that Bob Harbicht and Roger Chandler seemed to have a heart for Arcadia and shared her values for community safety; and expressed concern regarding the HPO. _ Liangyi Gu, an Arcadia resident, appeared and discussed the HOA's and ARB's and questioned the need for the HPO; she stated that Mr. Beck was endorsed by the biggest developers; and suggested residents determine the real cause of mansionization. Edmund, an Arcadia resident, appeared and responded to comments made by Gail Marshall at the prior City Council meeting, and stated that Roger Chandler had not sent out the "hit piece" Ms. Marshall mentioned; he expressed disappointment in Joyce Pratt's campaign practices; he commented on posts on the Sierra Madre Tattler, and stated Tom Beck and Joyce Platt were not running clean campaigns. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense(AB 1234]). Council Member Verlato announced that she attended the presentation by Carol Libby on the History of Arcadia through a collection of watercolor paintings, and the San Gabriel Valley Economic Partnership's Economic Forecast Summit on March 15; she commented on the recent homelessness initiative meeting; she further announced that she and Mayor Amundson went to the reveal of the first bike rack in Downtown Arcadia on March 19; she announced Peacock Day at the Arboretum on March 24; and announced that Maki Hsieh will be performing at the New Moon Concert at the Arcadia Performing Arts Center on March 24; she thanked City staff for the HPO postcards; she expressed concerns with misinformation provided by City Council candidates; she encouraged community feedback on the HPO, and noted the proposed ordinance was not adopted, and was just a process for designation; and wished everyone a Happy Easter. Mayor Pro Tern Tay stated that he understood concerns regarding the HPO, and suggested someone with knowledge on City staff assist in determining historic properties; he announced Dim Sum with a Detective for the Arcadia Police Foundation on March 9; and summarized the police activity report included in the City Manager's Weekly Report and thanked the Police Department. 4 03-20-2018 Council Member Beck responded to comments made by speakers, and indicated that the Arcadia Weekly and Arcadia's Best were privately owned and controlled; he noted that the Arcadia Fire Fighters Association concluded that all the candidates were strong on safety; he stated that the election was not about safety, but rather land use; he reiterated his 100% voting record in favor of the Police and Fire Departments; he stated Debbie Priester was not affiliated with Joyce Platt's campaign; he confirmed that he was running a clean campaign and discussed individuals removing his signs; he also indicated that he would maintain his dignity, reputation and ethics; he encouraged residents to vote and hoped for increased turnout. He stated he would attend Maki Hsieh's performance on March 24, and the Chamber Installation Dinner on March 28; and wished those that celebrated Easter a meaningful holiday. City Clerk Glasco indicated that the City's website is a great source of information for residents; he indicated that new lights would be installed soon at the Arcadia Vietnam War Monument and Memorial; and that Vietnam Veterans could contact him for a commemorative lapel pin. Mayor Amundson stated that he hoped the election craziness was not the new norm; he discussed the impact of district elections and his hope to go back to at-large elections; he stated there was no set timeline for the HPO; he referenced the book Lies, Damn Lies, and Statistics, The Manipulation of Public Opinion in America; he stated the City Council supported the Police Department and Officers and misinformation during election campaigns was misleading and damaging toward the integrity of the City Council; he commented on the reduction in crimes and commended the Police Department for all their efforts; he suggested residents maintain fences or add coyote rollers to reduce coyotes; he quoted Jim Rohn and his theme of"Leave a Legacy" at the Mayor's Breakfast on Friday, April 6, 7:30 am, at the Arcadia Community Center; and wished a Good Passover and Happy Easter. 1. CONSENT CALENDAR a. Supplemental budget appropriation in the amount of $114,646 from the General Fund Reserve, increasing the compensation to an amount not to exceed $193,896; and amending the Professional Services Agreement with the Lew Edwards Group for Professional Consulting Services and related public outreach. Recommended Action: Approve b. Professional Services Agreement with LAE Associates, Inc. for inspection of Southern California Edison's Street Light Replacement Proiect in the amount of $54,982. Recommended Action: Approve c. Contract with California Surfacing for the Tennis Court Resurfacing Project at Camino Grove Park and Bicentennial Park in the amount of $44,400. Recommended Action: Approve d. Contract with Cedro Construction, Inc. for the Valve Replacement Proiect on Santa Anita Avenue in the amount of$149,040. Recommended Action: Approve e. Purchase Order with Tyler Technologies for annual technical support and maintenance of the Energov Software System in the amount of $45,687.62. Recommended Action: Approve 5 03-20-2018 f. Purchase and upgrade of the Police Station's Camera System and Video Storage (Phase II) by CelPlan Technologies, Inc., in an amount not to exceed $80,000. Resolutions approving Memoranda of Understanding establishing compensation and related benefits for the represented employee groups. Resolution No. 7203 approving a Memorandum of Understanding establishing compensation and related benefits from employees represented by the Arcadia Fire Fighters Association ("AFFA")for April 1, 2018, through June 30, 2020. Recommended Action: Adopt Resolution No. 7204 approving a Memorandum of Understanding establishing compensation and related benefits from employees represented by the Arcadia City Employees Association ("ACEA")for April 1, 2018, through June 30, 2020. Recommended Action: Adopt Resolution No. 7205 approving a Memorandum of Understanding establishing compensation and related benefits from employees represented by the Arcadia Public Works Employees Association ("APWEA")for April 1, 2018, through June 30, 2020. Recommended Action: Adopt Resolution No. 7206 approving a Memorandum of Understanding establishing compensation and related benefits from employees represented by the Arcadia Police Officers Association ("APOA")for April 1, 2018, through June 30, 2020. Charles Goldwasser, attorney for Arcadia Police Officers Association, appeared and on behalf of the Arcadia Police Officers Association expressed gratitude to the City Council for their hard work during the negotiation process.
